die knaller news (wer ist denn noch der englischen sprache mächtig
??) ist allerdings von heute.
es hat nämlich einen richterwechsel gegeben. der eigentlich
berufene richter hat wohl irgendeine dumme bemerkung gemacht. jetzt
ist eine dame dran, die dafür bekannt ist, sich absolut gerecht zu
verhalten und sich technisch enorm vorzubereiten.
und diese tante hat vor kurzer zeit gerade microsoft den hintern
versohlt. das besondere daran: sie legt patente gerne weiter aus,
besonders wenn es um begrifflichkeiten geht. das haben wir ja hier
mit der "variable-clock-speed".
aber lest es selbst...
Intel vs. Patriot Scientific, Intel seeking summary judgment -- The
case was originally assigned to the Honorable Joseph C. Spero,
however for reasons unknown to me the case was reassigned to The
Honorable Saundra Brown Armstrong.
IMO a VERY positive move for PTSC. I have done extensive research
on Judge Armstrong`s previous rulings and have come to the
conclusion that she is more than qualified for her position on the
Supreme Court. She is very knowledgeable in technology and has
heard many high profile cases regarding Intellectual property.
It does not matter who the plaintiff or defendant is -- she bases
her decisions on facts presented, former cases and quite simply,
determining between right and wrong.
Her fair and unbiased demeanor clearly is all we could ask for in a
Judge deciding the first and most crucial point of litigation. I do
not believe that Intel is too happy about this turn of events.
Another poster mentioned April 6 and June 4 as court dates.
Although I have not seen the documents in which he is referring to
I think it is safe to assume that those dates were for Judge
Spero.
This poster also said that the scheduled Judge had
expressed favor towards Intel, if this is true it would explain why
the case was reassigned. Intel Vs Patriot Scientific Next scheduled
motion -- April 20th at
1:00pm, 1301 Clay St., 3rd floor, Court room 3 in Oakland
California.
