Dachte erst vielleicht ne gute Kaufgelegenheit. Aber wie es scheint werden die Zahlen wo beschissen ausfallen. Was meint ihr? Fusilev komplett weggebrochen?

Nee davon kann eigentlich jetzt noch gar nicht die rede sein. Die Frage ist ob Sandoz auch off label verkaufen kann, dann wirds ab Q2 15 runtergehen mit den Fusilev zahlen. Wenn nicht bleibt ohnehinn alles beim alten. Die Fusilev verkäufe waren die letzten Q stabil, sehe nicht dass sich da was ändern sollte, ausser dass Sandoz et al off label verkauft, re gegen den Patentschutz für colorectal, der nach meinem verständniss völlig intakt ist. Denke SPPI wird da aber dahinter her sein und falls sandoz off label macht wirds teuer für Sandoz!

Warum dann der brutale Abverkauf? Werden die Zahlen so schlecht erwartet?
Für die Indikation mit dem meisten Fusilev Umsatz hat man bis 2018 "Orphan Drug Status" Schutz.
Inwiefern hier Off-Label verkauft werden kann ist halt die Frage. ODS ist ja eigentlich ein sehr wichtiges Instrument der FDA, um private Forschung für eigentlich nicht so lukrative Krankheiten zu stimulieren. Eigentlich wäre es genauso im Sinne der FDA, wie vom SPPI, dass ODS nicht umgangen werden kann.
Inwiefern hier Off-Label verkauft werden kann ist halt die Frage. The U.S. District Court for the District of Nevada ruled Friday that claims 1 and 2 of Spectrum's '829 patent that covers Fusilev are invalid. Spectrum had previously sued generic drugmaker Sandoz for allegedly infringing on the claims.

(NASDAQ:SPPI) with a $15 price target, after the US District Court in Nevada ruled last Friday that the levoleucovorin formulation used by Sandoz Inc. (private), does not infringe on Spectrum’s Fusilev intellectual property (IP), and effectively invalidated key IP covering Fusilev’s composition of matter.
Benjamin wrote, “While the company is planning to appeal the decision, in our opinion, the ruling is a clear disappointment for investors because it could accelerate the entry of generic competition. However, we remind investors that Fusilev is still protected by orphan drug exclusivity until 2018 as a treatment for patients with colorectal cancer (CRC). Even though the osteosarcoma orphan exclusivity is set to expire next month, we believe that the combination of a citizen’s petition filed to the FDA, the challenges of launching at risk during the appeal process, CRC exclusivity described above, and the strong relationships the company has been able to secure with hospitals and community physicians should keep Fusilev revenues protected into 2018.”
