InternetStudios Got the Rights, Suit Says, Now August Entertainment Wants Its Money

While the Internet may have changed the economic model in many industries, in the film business it`s still the same: buy the rights to a film, pay for the rights to a film.
In a suit filed Thursday, film distributor August Entertainment accused InternetStudios.com of failing to pay $2 million in licensing fees for feature films represented by the company. InternetStudios owns ReporterTV.com and OnlineFilmSales.com, and was in acquisition negotations last month with London-based film trade journal Screen International. August has acted as the licensing agent on films for a number of producers, including Columbia TriStar Home Video.




The complaint claims that InternetStudios on March 24 licensed rights to a series of films, including True Romance.



The complaint, filed in Los Angeles Superior Court, claims that InternetStudios on March 24 licensed rights to a series of films, including Pioneer LDC`s Necronomicon, Team Players` Skeeter and Davis Film`s True Romance, which starred Christian Slater, Patricia Arquette, Brad Pitt and Val Kilmer.
The deal called for August to receive $1 million immediately, $500,000 three months after the agreement was executed and $500,000 six months after the date of the agreement, according to the complaint.
On June 5 and again on June 16, however, an attorney for InternetStudios sent August letters indicting that it wouldn`t pay the fees.
InternetStudios` OnlineFilmSales subsidiary is an online marketplace for distribution rights to films both domestically and overseas. As of early July, it claimed to represent the rights to over 1,500 pictures. In an April 4 press release, InternetStudios named August as one of the distributors it had signed to list films on the marketplace site.
A representative of InternetStudios said he hadn`t seen the suit and couldn`t comment.
InternetStudios shares are publicly traded on the Over-the-Counter Bulletin Board. The company on Wednesday announced it would join film financier Robert Beattie to launch InternetStudios Entertainment Finance, a production finance firm, at the Toronto International Film Festival.
Reserving the right to name up to 20 co-defendants, August`s complaint says InternetStudios had ``deliberately rendered itself financially unable to respond to a money judgment through gifts, salaries, loans, dividends and other devices and schemes.`` The distributor is represented by David M. Wolf of Wolf & Wolf.
