Rubinstein to Recommend: High Speed Internet for Cable Cos - Only if They Meet Government Demands

Attorney General Elyakim Rubinstein is expected to recommend to Prime Minister Ehud Barak to accept the demand of Minister of Communications Benjamin Ben-Eliezer to offer the cable companies high speed Internet short-term licenses until the end of their franchises only on the condition that they agree to sign commitments, which they until now opposed.

According to Rubinstein, granting licenses without such commitments is liable to raise serious legal problems that will not pass the scrutiny of the High Court of Justice. Senior officials believe that the cable companies will find it difficult to meet these obligations.

The cable companies have not replied to questions posed by the Ministry of Justice regarding the contradiction between receiving temporary licenses and the fact that permanent legislation has yet to be passed by the Knesset. In addition, they have not agreed to accept unbundling obligations - the use of their infrastructures by competitors.

The attorneys for Cellcom, Ofek and Barak are submitting a joint petition to the High Court of Justice to issue a restraining order against granting licenses to the cable companies. Yesterday, the attorneys of the three companies held their first meeting, where it was decided to work together to prepare the appeal.

It was also decided that Cellcom`s legal advisor Michal Bleich will represent the independent communications companies forum, consisting of the three companies, at the meeting of the Knesset Finance Committee on Wednesday to discuss the competition rates in the inland communications market.
