Cable companies Tevel, Matav, and Golden Channels today petitioned the High Court of Justice (HCJ) against Attorney General Elyakim Rubinstein and Minister of Communications Binyamin Ben-Eliezer. They asked the HCJ to order the respondents to grant them a license to operate high-speed Internet services.

The cable companies claim that Ben-Eliezer supports their request, but the section of the Communications Law prevents him from granting them the license. The cable companies, represented by Adv. David and Dafna Libai, are claiming that the license to be granted to Bezeq for operating high-speed Internet creates an economically harmful monopoly.

The petition quotes letters sent by Ben-Eliezer to Rubinstein, in which he stresses the importance of high-speed Internet services for promoting competition in the sector and expresses his desire to grant an immediate license to the cable companies. The petition attacks Rubinstein’s position, according to which the Minister of Communications is not authorized to grant the license to the cable companies before amendment of the Communications Law.

The petition further alleges that the regulation depriving the cable companies of their right a license is exceptionally unreasonable, violates the public welfare, is discriminatory, and deprives the cable companies of an equal and fair opportunity to participate in market competition. The companies claim that the regulation does not meet the test of the Basic Laws.

According to the cable companies, Ministry of Communications legal advisor Yizhar Tal, who is responsible for the Communications Law, believes that an immediate license can be granted to the cable companies. Anti-Trust Authority director-general David Tadmor holds the same position.

The cable companies allege that denying them the possibility of using their infrastructure to supply additional communications services and realize the enormous economic potential contained in the infrastructure constitutes a violation of their property rights. The cable group therefore believes that Rubinstein’s legal opinion is unconstitutional and improper, and should be nullified.

Spannend. Wahrlich ein Wirtschaftskrimi. Für mich klingt die Argumentation der Cables sehr vernünftig - aber was natürlich der High Court of Justice dazu sagt...

Notfalls muß man eben zunächst mit "Low-Speed"-Internet und BOT vorlieb nehmen. Gut, daß BOT Vertragsbestandteil ist.
