Summary

This SC17/WG8 meeting was exclusively for 14443-3, to finish resolving the comments from the balloting and discuss the patent issues.

Patent issues were discussed at length. Although the exact clause in the standard which the patent holders are claiming are unknown, Innovatron had provided a commitment letter to ISO(WG8N515) stating that they will abide by the ISO rules. The French delegation presented a letter from France Telecom authorizing Innovatron to handle licensing issues.

It is the responsibility of individual companies to contact the patent holders for licensing issues, based on the licensing fees, each member can then decide whether they want to proceed with the current standard or revise the standard if the licensing terms are not reasonable. The FDIS
will not be balloted until after the Nice meeting in February.

Known patent holders on 14443-3 are as follows (CHECK WG8N476, 477):

Delegates was ask to provide contact information on patent holders in their countries.

AFNOR claims Innovatron did not attend their national meetings for a couple of years, this is the reason why AFNOR was not aware of their patent issues.

The comments from Germany, Israel, Japan, UK and US were all resolved and then the comments from France were discussed last due to the no vote by the due dated. All of the comments were either accepted or resolved by the delegates.

Several additions were made to make ISO14443-3 easier to read:

1. Type B anticollision case example was contributed by Andrew Roberts,
2. The French delegation had submitted a text to replace clause 7.9.3 (Application Data).
3. Japan presented a revised version of Annex C ­ Type A timeslot anticollision.
4. Clause 7.6 - Anticollision Response Rule updated.
5. Clause 6.1.3 Frame Delay Time PCD to PICC. Text submitted by Israel and Germany.
6. Modified the note below TABLE 6.1.

Japan is proposing a modification for Type B anticollision wherein the TIMESLOT can be selected as an alternate anti-collision method. It is technically feasible to implement, but not as efficient as the slot marker method. Japan was asked if there are any outstanding patents and no answer
was given.

Philips presented an unofficial letter showing their licensing terms to be;
1. $10,000. One time up front
2. .5% of net card sales or $.005/card max
3. .5% of net terminal sales or $1.50/terminal max
4. No fees when using Philips IC/modules.

Action items from the meeting;
1. Created a letter to be addressed to patent holders mentioned in N476 and N477 - Convener
2. Decision in the national bodies on how to procedures on 14443-3; to be reviewed in Nice.
A. Ballot ISO14443-3 as FDIS
B. Expand ISO14443-3 with additional options
C. Separate Type A and Type B
The results of these discussions are to be presented at the WG8 meeting in Nice.

Joint meeting of SC17/WG4, SC17/WG8 and SC31

Michael Heggenbarth and Chris Stanford attended the meeting, held on 29 November 1999 at BSI in London, U.K. The meeting goal was to find a way to deal with WG8`s proposal on the UID specification presented in WG8N484.

Since SC17 had already approved taking the category `E` in ISO/IEC 7816-5 for satisfying the UID matter then SC31 agreed that the WG8N484 could be modified, so that the reservation of coding space for UID will only be in the range from `E0` to `E7`, More details of this meeting will be presented at the NCITS

21.1 The Summary Report of the 20th meeting of WG8 in Vienna (Doc. N 444) was approved with minor modifications.

21.2 WG8 Convener informed WG8 of the following SC17 Resolutions:

"RESOLUTION 394 - PLACEMENT OF THE NEW WORK ITEM ON CRYPTOGRAPHIC TOKEN INFORMATION

ISO/IEC JTC1/SC17 resolves that should the new work item on cryptographic token information application (see N 1567) be approved by JTC1 and assigned to SC17, the work be undertaken in WG4 and co-ordinated with WG8 as appropriate. SC17 instructs WG4 to commence work on this item as soon
as possible without waiting for the work item to be approved by JTC1."

"RESOLUTION 395 - VOCABULARY HARMONIZATION

ISO/IEC JTC1/SC17 recognizes the generous offer on the part of SC31 and their vocabulary rapporteur Mr Craig Harmon and requests its Project Editors to notify Mr Harmon harmon@ia.net) of any new terminology defined during the development of their standards."

"RESOLUTION 396 - THANKS TO LIAISON REPRESENTATIVE

ISO/IEC JTC1/SC17 thanks Susanne Björkander (Sweden) for the work she has undertaken on SC17`s behalf as the SC17 Liaison with ISO/IEC JTC1/SC31."

"RESOLUTION 397 - APPOINTMENT OF LIAISON REPRESENTATIVE

ISO/IEC JTC1/SC17 appoints Ove Bardenfleth-Nielsen (Denmark) as its Liaison member to ISO/IEC JTC1/SC31."

"RESOLUTION 409 - THANKS TO PROJECT EDITOR

ISO/IEC JTC1/SC17 thanks David Baddeley (Switzerland) for the work he has undertaken as Project Editor for ISO/IEC 14443 Parts 2 and 3 and ISO/IEC 10373-6."

"RESOLUTION 410 - RE-APPOINTMENT OF CONVENOR OF WG8

ISO/IEC JTC1/SC17 re-appoints Michael Hegenbarth (Germany) as Convenor of WG8 for a further period of 3 years. SC17 thanks Mr Hegenbarth for the work he has undertaken on behalf of SC17 over the past 3 years."

"RESOLUTION 415 - PROPOSED CHANGE TO SC17`S TITLE AND SCOPE

ISO/IEC JTC1 SC17 resolves that its title and scope be modified as follows: Title: Cards and Personal Identification

Scope: Standardization in the area of

a)identification and related documents,

b) cards, and devices associated with their use in interindustry applications and international interchange. SC17 instructs its Secretariat to submit this revised title and scope to the upcoming JTC1 Plenary meeting for their approval."


21.3 WG8 was informed by the Convener about the new SC17 policy on its treatment with patent issues as
laid down in the Docs. N 463 = SC17 N 1585, N 466 = SC17 N 1603 and in SC17 Resolution 398
contained in Doc. 472, effective at once.
WG8 requests all the participants and members of the WG8 meeting to follow this new policy and also
instructs the Conveners of the TFs to apply the same policy with the delegates and members of their TFs.

Doubts were raised, whether the new policy of SC17 does resolve major concerns like:

- The term "reasonable condition" in the ISO/IEC committment statement seems still to be an open door
for patent holders to pretend their willingness to commit to the spirit of ISO/IEC on respecting the patent
situation but in fact nevertheless to do the opposite by requesting too high license fees. The request came
up to let the patent holders give exact values of the licence fees when signing the ISO/IEC committment
statement.

- Further it was questioned whether the ISO/IEC Secretariat can ever judge about the term "reasonable",
i.e. the value of the fee. Which tools and possibilities has got the ISO/IEC Secretariat for such a
judgement?

- Specifically related to the next step to ballot 14443-2 and 14443-3 for FDIS ballot, what is the policy of
SC17? Should a ballot be halted until the statements will be signed by the patent holders. If not all those
will sign, how are those cases be dealt with? Any judgement by WG8 experts, whether the patents of
those holders, having not signed the committment statement, even though allow using alternatives within
a Standard can not totally be guaranteed. Who will be responsible for the possibly wrong decision to
publish a Standard and how will such a decision be corrected? Will a Standard go back to CD level in the
worst case?

The WG8 Convener will consult the SC17 Chairman and the SC17 Secretariat on those concerns and will
seek solutions, so that the further process of the 14443 series will not be affected too much.
21.4 The WG8 Convener asks the Head of Delegation of all those countries, where patents are known and
which have not been clarified yet, to find an appropriate contact person with the patent holding
companies, so that the SC17 Secretariat can start negotiations for achieving from those companies the
ISO/IEC committment statement.

The two documents N 476 and N 477 contain a draft summary of the patent situation for 14443-2 and
14443-3, where the TF2 Convener is asked to update them and send their edited versions back to the
WG8 Convener.

21.5 WG8 was informed by the Convener about the new SC17 policy on its treatment with test methods as
laid down in the Doc. N 456 = SC17 N 1554 and in SC17 Resolution 400 as follows:

"RESOLUTION 400 - PROCEDURE FOR THE DEVELOPMENT OF TEST METHODS

ISO/IEC JTC1 SC17 adopts the Test Methods procedure in N 1554 with the following changes:

Clause 2 - change the words "ensure compatibility and consistency" to "ensure compatibility,
reproducibility and consistency".

Clause 14 - End the paragraph after the second sentence i.e. delete the rest of the paragraph."
21.6 WG8 informes specifically its Project Editors of SC17 Resolution 404 as follows:



"RESOLUTION 404 - DEVELOPMENT OF ISO/IEC JTC1/SC17 STANDARDS

ISO/IEC JTC1/SC17 instructs its Project Editors to use the correct version of the ISO template for the
version of Word that they use. ISO/IEC JTC1/SC17 further instructs its Project Editors to convert
Standard text from Word format to PDF format, if available, before sending them to another Working
Groups or to the SC17 Secretariat for ballot."


21.7 WG8 was informed by the Convener about the new SC17 policy on the principles on coexistent
technologies as laid down in the Doc. N 457 = SC17 N 1555 and in SC17 Resolution 411 as follows:

"RESOLUTION 411 - CHANGE TO THE PRINCIPLES ON COEXISTENT TECHNOLOGIES

ISO/IEC JTC1/SC17 instructs its Secretariat to replace the wording in Clause 5 of N 1555 with the
proposed wording submitted by WG9 in N 1616 and to re-issue the Principles as an SC17 document.".

Clause 14 - End the paragraph after the second sentence i.e. delete the rest of the paragraph."
21.8 WG8 approved the Doc. N 479 "Proposed Amendment/Revision to ISO/IEC 7816-5" with minor
modifications as to be forwarded to SC17/WG4. The WG8 Convener will send the revised version of N
479 to WG4 and will ask it to take N 479 into account for its discussion and changes to ISO/IEC 7816-5
via a revision or an amendment procedure.

21.9 WG8 resolved the comments on ISO/IEC FCD 15693-2 (Doc. N 448) and asks the WG8 Convener to
forward the final version of 15693-2 to the SC17 Secretariat for FDIS Ballot.
The negative vote from Japan was resolved.

21.10 WG8 approved the draft of ISO/IEC CD 15693-3 (Doc. 474) as to be forwarded to the SC17 Secretariat
for CD Registration and Ballot. Purely editorial final comments can be forwarded to the Project Editor of
15693-3 no later than 1999-10-20.

21.11 WG8 approved the adjusted title and terms of reference for 15693-4, proposed by TF3, which are now:

Title: ISO/IEC 15693-4, Identification cards - Contactless integrated circuit(s) cards - Vicinity cards -
Part 4: Extended command set and security features

Terms of Reference:
- To extend the existing commands defined in 15693-3.
- To add new functionalities, e.g. authentication. biometrics, logical addressing of the data elements and
simple internal functions.
- Coordination with WG4 is intended.

21.12 WG8 resolved the comments on ISO/IEC FCD 14443-2 (Doc. N 465) and asks the WG8 Convener to
forward the final version of 14443-2 to the SC17 Secretariat for FDIS Ballot.

21.13 Considering Resolution 19.7 and 14443-2 reaching the FDIS status, WG8 invites the National
Standardization Organizations to submit proposals for possible future optional enhancements to
ISO/IEC 14443-2.

21.14 WG8 resolved the comments on ISO/IEC FCD 14443-3 (Doc. N 471) just partly. More time is needed to
resolve all the submitted comments. A special 14443-3-only meeting was scheduled for 1999-11-30/12-02
at BSI or APACS in London for this purpose.

The WG8 Convener, however, requested WG8 members to not submit additional comments to this
process of the resolution of comments except those which help to precise own existing FCD comments
and those which help to resolve FCD comments from others. Those additional comments shall be



available to the WG8 Convener for distribution within WG8 no later than 15 November 1999.

This additional procedure also gives some time to resolve in the meantime the remaining patent issues and
allows a special expert group of BSI to present their offer to WG8 which will consist of purely editorial
improvements to 14443-3 aiming at a better readibility and thus to a better acceptance by future users of
this part of ISO/IEC 14443.

21.15 WG8 approved the draft of ISO/IEC CD 14443-4 (Doc. 473) as to be forwarded to the SC17 Secretariat
for CD Registration and Ballot. Purely editorial final comments can be forwarded to the Project Editor of
14443-4 no later than 1999-10-20.

21.16 WG8 thanks the Convener of TF2 Mr. Pascal Roux for having successfully brought the development
of the 14443 series to the end. The work had been done under difficult circumstances, where consensus
could only be found after long time and detailed investigations, so that WG8 feels special respect for Mr.
Roux`s past efforts.

21.17 WG8 resolved the comments on ISO/IEC FCD 10536-1 (Doc. N 447) and asks the WG8 Convener to
forward the final version of 10536-1 to the SC17 Secretariat for FDIS Ballot.

21.18 WG8 thanks the Project Editors Mr. Hauke Meyn and Mr. Alain Berthon for having done extreme
efforts for successfully providing WG8 in time with the final WD versions of 14443-4 and 15693-3 for
approval as CD ballot text.

21.19 The next WG8 and TFs meetings are scheduled as follows:

21.20 WG8 expresses its sincere gratitude to all involved with sponsoring and organizing the San Diego
WG8 meeting, i.e. the members of the committee NCITS B10.5 having sponsored the magnificant
arrangements for the WG8 and TF meetings and to the companies Cubic, MAGTEK, Motorola and
Polaroid having sponsored the wonderful dinner and the reception party. Also WG8 thanks in particular
Mr. Francis Christian for having prepared and managed all the organizational details that efficiently and
pleasantly.
