Der britische Online-Spieleanbieter PartyGaming plc (ISIN GI000A0ERMF2 (Nachrichten)/ WKN A0ERMF) verbuchte im vierten Quartal einen kräftigen Umsatzanstieg.

Wie der weltweit größte Anbieter von Online-Pokerspielen am Freitag bekannt gab, verbesserten sich die Umsatzerlöse im Schlussquartal um 65 Prozent auf 320,3 Mio. Dollar, nach 194,0 Mio. Dollar im Vorjahreszeitraum. Insgesamt verzeichnete der Konzern im Schlussquartal 229.277 neue Spieler. Insgesamt verbesserte sich der durchschnittliche Tagesumsatz von 1,9 Mio. Dollar auf 2,5 Mio. Dollar.

Insgesamt entwickelte sich der Verlauf im vierten Quartal im Rahmen der Erwartungen. Dabei hat sich die Nachfrage nach BlackJack angesichts der deutlich gesteigerten Nachfrage einige Wochen nach der Einführung dieses Angebots etwas gelegt. Derzeit hat sich diese Entwicklung jedoch stabilisiert wobei bei diesem Angebot nunmehr ein durchschnittlicher Tagesumsatz von 0,8 Mio. Dollar erreicht wird.

Partygaming leider im Minus, vielleicht hatten Anleger mit noch besseren Zahlen gerechnet.

Letztes Jahr legte Partygaming einen Reebound mit über 100% hin, ich schätzte auf 50-70%.

Ich habe meine ersten Partygaming's nach dem "großen Absturz" vor knapp einem Jahr gekauft und sehe bei Partygaming einen langfristigen Aufwärtstrend. Partygaming is sehr volatil und anfällig gegen "Störmeldungen a la USA", bet on sport oder bet and win (bwin). Aber die Halbahreszahlen waren überzeugend, und die üblicherweise starken Quartale III und IV kommen ja noch!

Übrigens: Die Dividende war auch ganz nett! Plötzlich waren da knapp über 1.500 Euro auf meinem Konto!

Ich verstehe auch nicht, warum Partygaming in Deutschland so "unterbelichtet" ist. Naja - das wird vielleicht auch noch. Mit bwin habe ich mal einen schnellen Zock gemacht - Partygaming möchte ich noch länger halten. Aber habe immmer ein Auge drauf...

LONDON (Reuters) - The United States detained a second Internet gaming executive on Thursday, adding to fears it is cracking down on the lucrative industry and sparking share price falls that wiped over 800 million pounds off the market value of the sector.

Online bookmaker Sportingbet Plc (SBT.L: Quote, Profile, Research) said its chairman, Peter Dicks, had been detained by U.S. authorities, mirroring the detention in July of another online gaming CEO on racketeering charges.

Shares across the 6.4 billion pound-a-year industry fell sharply, with industry leader PartyGaming (PRTY.L: Quote, Profile, Research) plunging as much as 19 percent before closing 9.8 percent lower at 105-3/4 pence. 888 Holdings Plc (888.L: Quote, Profile, Research) dropped 15.8 percent.


Dicks was arrested in New York late on Wednesday at JFK Airport on a warrant from Louisiana, said Pasquale DiFulco, a spokesman for the Port Authority of New York and New Jersey.

"He was picked up at 11:30 p.m. (EDT.L: Quote, Profile, Research) at JFK Airport on an active out-of-state warrant. He's being held by Port Authority police awaiting extradition," said DiFulco, who would not reveal the nature of the charges.

"This arrest highlights the U.S. Department of Justice is going after online gaming companies by arresting their board members," said a London analyst who declined to be named.

Analyst Paul Leyland at Arbuthnot Securities said he was keen to know whether the charge sheet contained anything that might allow the extradition of any other Sportingbet executives.

He said the long-term impact on the sector would also depend on whether the charges related to taking sports bets from U.S. citizens or taking U.S. gamblers' money in general, including online casino and poker wagers.

Sportingbet said earlier on Thursday it had sought an immediate temporary suspension of its shares pending clarification of the situation.

RACKETEERING CHARGES

Analysts said Sportingbet's U.S.-focused sports betting business was similar to that of BETonSPORTS (BSS.L: Quote, Profile, Research), whose CEO David Carruthers was arrested in Texas in July.

Carruthers and seven others pleaded not guilty to racketeering and other charges. The Costa Rica-based company has since said it is closing its U.S. business.


"Clearly the first indictment against BETonSPORTS was not a company-specific issue," said one London analyst.

News of Dicks's detention overshadowed strong results from PartyGaming, which said core profit rose 47 percent in the first six months of the year to $380 million and stressed it was reducing its dependence on the U.S. market.

PartyGaming said it whittled down the percentage of revenues it takes from the United States to 77 percent in the first half, from 86 percent a year earlier.

PartyGaming has been trying to reduce its U.S. exposure for over a year, partly as a response to attempts by some U.S. politicians to get Internet gaming banned.

PartyGaming Chief Executive Mitch Garber told a conference call on Thursday that the anti-gambling bill, backed by Rep. Bob Goodlatte, faced opposition in the Senate, and time was running short ahead of U.S. elections.

"Time is in short supply, and the bill continues to face opposition, but this is politics, and we are not complacent, and the outcome remains uncertain," he said.

LONDON, Sept 8 (Reuters) - Online bookmaker Sportingbet (SBT.L: Quote, Profile, Research) said its chairman faced charges in the United States for providing "gambling by computer", sparking fears no executive in the $12-billion-a-year industry was safe from prosecution.

Sportingbet said Chairman Peter Dicks had been arrested at JFK Airport in New York early on Thursday for alleged violation of Louisiana State laws, mirroring the arrest in July of another CEO on racketeering charges.

Finance Director Andy McIver told Reuters on Friday, "Until this is resolved I won't be travelling to the U.S."


"The Louisiana laws involved are incredibly wide ranging," he added. "It covers practically any form of doing anything involving any sort of gaming and a computer."

The arrest of Dicks added to fears of a U.S. crackdown on the lucrative industry and wiped over $1.5 billion off the stock market value of the UK-listed sector on Thursday.

"What was he doing?" asked one London analyst who declined to be named. "You just don't travel to the U.S. any more if you're in that business."

Investors had been keen for an update on whether the arrest of Dicks was linked to Sportingbet's sports betting operations, or whether it also covered other online gambling activities like poker and casino.

"The fact that Louisiana state law does not make a distinction between the type of gaming activities being provided means that this latest move is likely to have implications for William Hill (WMH.L: Quote, Profile, Research), 888.com (888.L: Quote, Profile, Research) and PartyGaming (PRTY.L: Quote, Profile, Research) in particular," said analyst David Jennings at Davy stockbrokers.

Individual states might now try to go after other Internet gaming companies, he added.

A PartyGaming spokesman said: "It would be inappropriate to comment on Sportingbet's situation, especially since we've yet to find out what this is all about."

888 and William Hill were not immediately available for comment.

The arrest of Dicks follows that in July of David Carruthers, Chief Executive of rival firm BETonSPORTS (BSS.L: Quote, Profile, Research), on racketeering charges.

LONDON, Sept 14 (Reuters) - Sportingbet's (SBT.L: Quote, Profile, Research) Chairman Peter Dicks quit his job with the online bookmaker on Thursday, within minutes of a New York City court ruling that he could leave the United States, sending its shares up 25 percent.

Dicks left the criminal court after a 10-minute hearing. He was given back his passport and made no comment but is expected to return home soon.


"His intention is to return to the UK shortly," a source familiar with the situation said.

The company issued a brief statement in London saying it had accepted Dicks immediate departure with great reluctance and later said New York Governor George Pataki's office had withdrawn a governor's warrant necessary to transfer Dicks to the state of Louisiana.

Sportingbet's shares rose 10 percent early on amid speculation Dicks might not be extradited to Louisiana to face charges of violating the state's laws against online gambling.

News of the court ruling sent them up another 15 percent to close at 192 pence.

Dicks had appeared in court to face charges of "gambling by computer" and was allowed to return to Britain on the condition that he return to New York on Sept. 28 for a hearing on his extradition to Louisiana.

"People feel that this is a more pragmatic approach to gaming firms and is a bit less negative for the company. But the stock is still a long way off from where it was a few months ago. This is still a sector with remarkably little visibility," one dealer said following Dicks's court appearance.

Sportingbet said Dicks had left to concentrate on personal matters and that a new independent non-executive chairman would be appointed in due course.


U.S. AUTHORITIES CLEAR UP


Dicks's arrest last week at JFK airport in New York followed that in July of David Carruthers, who was then chief executive of BETonSPORTS Plc (BSS.L: Quote, Profile, Research), by U.S. federal authorities on racketeering charges.

Costa-Rica based BETonSPORTS has since said it is closing its U.S. business.

The arrest of Dicks added to fears of a U.S. crackdown on the online gambling industry and wiped over $1.5 billion off the stock market value of the UK-listed sector last Thursday.

"No-one is much the wiser as to what will happen until the September 28 hearing," said a spokesman for an online gaming company who declined to be named.

Investors have been looking for insight into whether Dicks's arrest was linked to Sportingbet's sports betting operations, or whether it also covered other online gambling activities like poker and casino.

Sportingbet's Finance Director, Andy McIver, has said that the Louisiana laws involved are wide ranging and cover any sort of gaming and a computer.

Empire Online H1 EBITDA falls, warns 2007 earnings growth may be challenging

LONDON (AFX) - Online gaming company Empire Online Limited said it expects
earnings growth in 2007 to be challenging if there is no pick up in the sign-up
rates of new players.
The company made the warning as it posted a fall in EBITDA for the six
months to June to 15.7 mln usd from 24.9 mln a year earlier.
Empire said it is currently signing up around 250 new real money players a
day and that while it expects full year results to be broadly in line with
market expectations 2007 will be challenging if there is no improvement in sign
up rates.
Net gaming revenue for the half was 38.2 mln usd compared to 49.7 mln a year
ago. But if revenues from Empire Poker, which was sold to PartyGaming in
February, are excluded net gaming revenue was 34.7 mln usd compared to 10.7 mln.
The net gaming revenue for its casino operations, boosted by the purchase of
Playtech licenses last year, rose to 30.2 mln usd from 10.7 mln and offset the
fall in poker revenues, which were down to 8 mln usd from 39 mln after the
Empire Poker sale.
Empire said the sale made a net profit of 237 mln usd after costs.
Referring to recent legal problems of other online gambling companies in the
US the company said: "The regulatory uncertainty that the online gaming industry
has always faced has increased as a consequence of recent events. In light of
this, the board will review carefully all uses for the company's surplus capital
in order to maximize shareholder value."
The company said it will pay an interim dividend of around 1.7 cents a
share.

LONDON, Sept 27 (Reuters) - Louisiana is determined to stop Internet gambling companies from taking bets in the southern U.S. state and has issued four arrest warrants for staff at Sportingbet Plc (SBT.L: Quote, Profile, Research), a police officer told the Financial Times.

Captain Joe Lentini, head of the casino section of Louisiana's Police Gaming Enforcement division, said in an interview published on Wednesday the warrants included one for Peter Dicks, former chairman of the UK-listed company.

Dicks is due to appear in a New York court on Thursday to hear if he will be extradited to Louisiana, the newspaper said.

The other three warrants were for Sportingbet executives or directors, Lentini said, declining to reveal names.


In a worrying sign for the lucrative online gambling business, the officer told the FT he was also investigating other companies and their bosses were at risk of arrest.

"We have agents all over the state working on this daily. There are other sites we're looking into," Lentini said.

Louisiana is one of a number of U.S. states that prohibits Internet gambling, which has become a hot topic in recent weeks amid fears of a crackdown by the United States.

The Dicks court case comes as the U.S. Senate mulls whether to tighten federal laws against the practice. The bill would prohibit most forms of Internet gambling and make it illegal for banks and credit card companies to make payments to online gambling sites.

Investors in British-based gaming companies such as BETonSPORTS Plc (BSS.L: Quote, Profile, Research), Partygaming Plc (PRTY.L: Quote, Profile, Research) and 888 Holdings Plc (888.L: Quote, Profile, Research) are closely watching the U.S. legislation.

Sportingbet executive director Nigel Payne wrote in an article for the Times newspaper on Wednesday that the opposition to online-gambling was spurred more by commercial interests than a desire to protect minors from getting hooked.

"I believe that the real picture that emerges is one of fiscal protectionism that is being masked by political manoeuvering and adroit public relations," Payne wrote.

Dicks was arrested in New York this month on charges of "gambling by computer." His arrest followed that in July of David Carruthers, then chief executive of BETonSPORTS

William Hill said it had taken steps to stop accepting casino and poker business from clients with a U.S. address or U.S.-issued credit card, the same as steps already in place to prevent Internet betting on sports events by U.S. residents.

This year has seen the arrests in the United States of Sportingbet Plc's (SBT.L: Quote, Profile, Research) chairman on charges of "gambling by computer" and BETonSPORTS Plc's (BSS.L: Quote, Profile, Research) then chief executive on racketeering charges.



Costa Rica-based BETonSPORTS subsequently said it is closing its U.S. business, and the arrests added to fears of a U.S. crackdown on the online gambling industry.

LONDON, Sept 27 (Reuters) - Sportingbet's (SBT.L: Quote, Profile, Research) Finance Director Andy McIver is working on the assumption that the U.S. state of Louisiana has a warrant out for his arrest on online gambling charges, he said in an interview on Wednesday.

His comments follow the arrest of Sportingbet Chairman Peter Dicks at JFK airport in New York earlier this month on charges of "gambling by computer".


"I'm personally working on the assumption that it is a stronger possibility rather than a weaker possibility," McIver told Reuters by phone from London when asked whether he expected Louisiana to have a warrant out for his arrest.

Shares across the sector have taken a series of knocks since July as some U.S. politicians seek to ban Internet gambling there and as U.S. and European prosecutors also target executives from BETonSPORTS (BSS.L: Quote, Profile, Research) and Bwin.com (BWIN.VI: Quote, Profile, Research).

In a separate announcement on Wednesday, British bookmaker William Hill (WMH.L: Quote, Profile, Research) said it had stopped its gaming business in the United States, pending clarification on the scope and enforceability of state and federal gaming laws.

UK gaming stocks have lost a combined 2.4 billion pounds ($4.6 billion) in value since the end of June as the industry continues to haemorrhage value and lose executives.

"We have now formally said that no board member is to go to the United States following the arrest of Peter Dicks," said McIver, who is due to take over as Sportingbet's chief executive in October.

Dicks quit his job at Sportingbet earlier this month and is due to return to New York on Sept. 28 for a hearing on his possible extradition to Louisiana.

The Financial Times reported on Wednesday that Louisiana had issued three more arrest warrants for Sportingbet staff.

"They said all along that there are other people," said McIver. "They said all along that it is us as a company. Therefore I assumed that, as one of what is a handful of executive directors, I would be one of them. But I don't know."

Sportingbet shares fell by as much as 3.1 percent on Wednesday, but by 1400 GMT they were down by just 1.4 percent at 176-3/4 pence, valuing the group at around 745 million pounds.


EXTRADITION OUTLOOK

Lawyers say U.S. prosecutors would not be able to extradite Sportingbet's executives from the UK because they have not been charged with anything illegal under British law.

Only by adding a crime such as fraud to the charge sheet would extradition be possible, they say.

McIver's comments follow a week of negative sentiment for the online gaming sector.

On Monday, Sportingbet's merger target World Gaming (WGP.L: Quote, Profile, Research) said its chairman and a director had resigned, and on Tuesday Empire Online (EOL.L: Quote, Profile, Research) told Reuters it was reining back its aggressive acquisition plans and considering safer options for its $250 million war chest.

On Tuesday, London's upmarket Ritz Hotel said it had closed its online gaming site due to legal uncertainty.

McIver said U.S. law on online gaming had not changed either at a federal level or at a state level in Louisiana, which has had anti-online gambling laws since 1997.

"Until something fundamentally changes -- some law goes through the Senate or if the courts take a different view -- then maybe we'll rebalance strategy," he said. "We'd review the situation." NEW YORK, Sept 29 (Reuters) - A New York judge on Friday dismissed the arrest warrant for the former chairman of British online gambling firm Sportingbet Plc (SBT.L: Quote, Profile, Research), allowing him to return to Britain.

The ruling ends three weeks of uncertainty for Peter Dicks, who was arrested in New York on Sept. 7 under a warrant issued by the state of Louisiana charging him with "gambling by computer."

The withdrawal of the warrant in New York signals that the United States' clampdown on Internet gambling -- which is highly popular in the country but still technically illegal -- may not be as harsh as some had feared.



"I'm very grateful," Dicks said as he left a New York criminal court in the borough of Queens, wearing a dark gray business suit.

According to one of Dicks' lawyers, New York State Governor George Pataki refused to sign an order to extradite Dicks to Louisiana to face the charges against him.

Louisiana's warrant to arrest Dicks on the same charges remains active, the lawyer said.

PartyGaming, Sportingbet Plunge on U.S. Gambling Law (Update1)

Oct. 2 (Bloomberg) -- Shares of PartyGaming Plc, Sportingbet Plc and 888 Holdings Plc plunged after Congress passed laws curbing gambling payments, wiping out U.S. revenue for online- gaming companies traded in London.

Congress passed the legislation Sept. 30, making it unlawful for credit-card companies to collect payments for transactions with online-gaming sites. PartyGaming and 888 said today they\'d suspend business with U.S. residents when the law takes effect.

``It looks like the U.S. government has found a way to make life almost impossible,\'\' said Philippe Gijsels, senior equity strategist at Fortis Bank SA\'s private investment unit in Brussels, which manages $62 billion. ``These companies that were trying to get into the U.S. market are just backing out. I would not touch them at these levels.\'\'

U.S. President George W. Bush is expected to sign the legislation into law within the next two weeks, Gibraltar-based 888 said in a Regulatory News Service statement.

``The bill is now only a Presidential signature away from becoming law, and that could pose a serious threat to the business models of several operators,\'\' Mark Brumby, an analyst at Oriel Securities, wrote in an e-mailed note.

Gambling on the Internet has become a $12 billion-a-year business. Internet-based casinos such as PartyGaming and 888, operating in locations such as Gibraltar and Antigua, take in billions from U.S. gamblers. PartyGaming, the world\'s biggest Internet poker company, got more than four-fifths of its sales from the U.S. last year.

`Shutting Down\'

The measure, added to unrelated legislation providing $3.4 billion for U.S. port security, was passed before Congress recesses to campaign for the Nov. 7 elections.

``Basically we are shutting down the payment system for Internet gambling,\'\' Representative James Leach, an Iowa Republican, said Sept. 30.

The Justice Department has been pursuing wire fraud charges against executives and operators of online casinos. David Carruthers, then the chief executive officer of Betonsports Plc, was charged by a federal grand jury in July with illegal interstate gambling.

Former Sportingbet Chairman Peter Dicks, facing extradition to Louisiana on illegal gambling charges, was set free last week by New York authorities after having been arrested as a fugitive.

Shares Plunge

The suspension will have a ``material adverse impact\'\' on 888\'s performance this year and thereafter, the company said in its statement. PartyGaming said its profit would be ``significantly short of consensus forecasts\'\' for 2006 and 2007.

``There is going to be carnage,\'\' said Tejinder Randhawa, an analyst at Evolution Securities in London. ``Everyone is going to be looking at how these companies will react.\'\'

Shares of Gibraltar-based PartyGaming, the world\'s largest publicly traded online gaming company, slid 65 pence, or 61 percent, to 42 pence at 8:27 a.m. in London.

888, the world\'s largest online casino, slid 70.5 pence, or 48 percent, to 76 pence. The company said about half of its revenue is made in the U.S.

Sportingbet tumbled 69 percent to 58 pence. The company today said the U.S. rules prompted it to abandon talks to buy World Gaming Plc, whose shares slid 76 percent today.

Empire Online Ltd., whose online gambling brands include Club Dice, fell 17 pence, or 25 percent, to 50 pence. NETeller Plc, a U.K. provider of money transfers for Internet gaming companies, fell 215 pence, or 61 percent, to 140 pence.

Ich habe meine ersten Partygaming\'s nach dem "großen Absturz" vor knapp einem Jahr gekauft und sehe bei Partygaming einen langfristigen Aufwärtstrend. Partygaming is sehr volatil und anfällig gegen "Störmeldungen a la USA", bet on sport oder bet and win (bwin). Aber die Halbahreszahlen waren überzeugend, und die üblicherweise starken Quartale III und IV kommen ja noch!

Ich werde mal nen Tausender riskieren und mir ein Paar Aktien von Partygaming kaufen. Ich denke das die Jungs sich von so einem Gesetzt nicht abschrecken lassen und andere Mittel und Wege finden werden wie sie mit Onlinecasinos Geld verdienen koennen. Wenn es ein Gesetzt gibt gibt es meist auch eine Gesetztesluecke und die gilt es dann zu finden und auszunutzen. Ich bin da recht zuversichtlich das da was kommen wird. Wie und was weiss ich nicht. Die Branche wird sich nicht so schnell unterbuttern lassen. Dafuer steckt zuviel "kriminelle" Energie dahinter

Sie führten außerdem an, dass das Alkohol-Verbot von 1919 zu einem Anstieg der organisierten Kriminalität und zu illegalen Kneipen geführt habe. Die US-Poker Players Alliance will jetzt vom Kongress eine Ausnahmegenehmigung erreichen, weil Poker aus ihrer Sicht kein Glücksspiel sei, sondern einen klugen Kopf verlange.

Online-Glücksspiele und Pornografie gehörten seit Beginn der weltweiten Verbreitung des Internets zu den profitablen Einnahmequellen. Nach Angaben der American Gaming Association erschien die erste Webseite mit Online-Glücksspielen im Jahr 1995.

Jetzt kommts drauf an:
Wie schnell schafft es Partygaming die Kosten der neuen Situation anzupassen.
Immerhin brechen ca 80% der Umsätze weg, ohne dass die Fixkosten so schnell mitsinken können.
Da die letzten veröffentlichten Zahlen schon etwas zurückliegen, ist es schwer dies einzuschätzen. Ich könnten mir vorstellen, dass es Sinn macht noch etwas mit einem neuen Einstieg zu warten.

Der Vertrag werde für Werbung und dem Vertrieb von Glücksspielen ein striktes Internet-Verbot vorsehen, bekräftigte Niedersachsens Ministerpräsident Christian Wulff heute in Bad Pyrmont Aussagen vom Vorabend. Ausnahmen würden für Lotto und Toto sowie das Internet-Angebot von Spielbanken gelten.

Diese könnten aber auf zwei Jahre beschränkt werden, wenn dies nach der Detail-Abstimmung der Länder so gewünscht werde. Fernsehwerbung werde verboten, wobei aber unter anderem die Ziehung der Lottozahlen ausgenommen sei. Auch die Telefonwerbung für Glücksspiele wird Wulff zufolge untersagt.

Eine Entscheidung über Einzelheiten des Vertrags werde es am 13. Dezember bei einer weiteren Sitzung der Ministerpräsidenten geben. Anschließend müsse das Abkommen dann von den Länderparlamenten genehmigt werden.

Mit dem Staatsvertrag will die Mehrheit der Länder das staatliche Wettmonopol erhalten. Dies war vom Bundesverfassungsgericht in Frage gestellt worden. Die Richter hatten es nur für den Fall als akzeptabel bezeichnet, dass der Staat die Werbung für Glücksspiele einschränkt und die Spielsucht stärker bekämpft.

Private Wettanbieter besonders betroffen

Der erwartete Vorstoß der Ministerpräsidenten trifft besonders private Wettanbieter und Spielvermittler. Deren Geschäftsmodell basiert fast ausschließlich auf dem Internet. Zudem werden deutsche Wetter auch an Firmen ins Ausland vermittelt, wo es kein staatliches Wettmonopol gibt.

Die Aktien von Glücksspielfirmen Tipp24 bet-at-home.com Fluxx und Cashbet waren bereits am Vormittag wegen des erwarteten Beschlusses unter Druck geraten.

Bwin aus Österreich hatte Wetten in Deutschland noch unter Berufung auf eine Lizenz aus den letzten Tagen der DDR angeboten. Das sächsische Innenministerium hatte dies im August untersagt, ein Gericht das Verbot aber zunächst wieder aufgehoben. Solange der Rechtsstreit läuft, können Internet-Wetten weiter angeboten werden.

Kann mir jemand sagen ob diese Zahlen richtig sind ??

Wenn ja, dann halte ich die Aktie auf aktuellem Niveau nicht mehr für ein Schnäppchen. Allerdings waren die $ 150 Mio. Umsatz für den 6-Monats-Zeitraum ein Plus von 150% !! Und das würde bedeuten das man für den selben Zeitraum 2005 "nur" $ 60 Mio. hatte. Also das die 2.te Jahreshälfte mit $ 90 Mio. stärker war. Davon abgeleitet könnte man (hochgerechnet) auch Ende 2006 bei rd. $ 375 Mio. landen.

Wenn für 2007 "nur" ein Wachstum von 50% erreicht wird....dann kann man hier auf Sicht von 12 Monaten nicht viel falsch machen.

Allerdings sollte man diese Aktie streng im Auge behalten

The European Gaming and Betting Association (EGBA) was launched in Brussels this week, replacing the European Betting Association (EBA).

The EGBA has been launched with some big names participating, including online gambling giants PartyGaming, Unibet, Interwetten, Expekt, Carmen Media Group, BWin and Bet-at-Home.

The EGBA plans to be a strong voice in the European debates regarding the rights of regulated European-licensed operators to offer their services unrestricted throughout Europe. They are launched on a wave of optimism, following the recent European Court of Justice decision on the Plancania case in Italy, where the ECJ ruled that a bookmaker licensed in Britain should be allowed to offer their services in other EU countries without needing supplementary licenses.

The EGBA wants to bring a level of responsibility and legitimacy to online gambling operations, ensuring a high standard of consumer protection as well as being aware of protecting minors and problem gamblers.

The participating online gambling operators have all agreed to abide by a strict Code of Conduct listing "a common set of strict rules enforcing socially responsible internet gaming and betting". These standards, audited by specialized external bodies, supplement each member\'s national licensing requirements imposed by its home European regulator.

EGBA aims at continuing a constructive dialogue with all stakeholders including regulators, EU and national authorities, state operators and consumers. Sigrid Ligné, the new Secretary General of EGBA, commented: "It\'s time now that all stakeholders put on the table their real concerns and expectations. EGBA has a strong commitment to lead the way to a regulated and transparent European market for the benefit of consumer choice and protection."

The world's largest listed online gaming company, PartyGaming, Plc., is getting serious about protecting its brand, and has enlisted noted Internet intelligence company Envisional to help them bring the hammer down on any misuse.

A long-term affiliate monitoring contract has now been signed that gives online giant PartyGaming - owner of PartyPoker and PartyCasino, among others - access to internet fraud and brand abuse specialist Envisional's patented A3I intelligent search technology.

The world-class technology allows automated searching for text, logos or images across the entirety of the Web, including newsgroups, blogs, B2B auction sites, trade boards, Internet Relay Chat channels and peer-to-peer networks.

The result: All claims of affiliation to the six main PartyGaming Web sites and all instances of counterfeiting or misuse of PartyGaming's name and brands can be found instantly and ranked according to urgency or importance.

Ich glaube spätestens im Jahre 2008 - nach den nächsten Wahlen (sollten die Demokraten gewinnen), wird sich einiges ändern. Partygaming wird meiner Meinung nach wieder in die USA zurückkehren, vielleicht eben auch schön früher. Dann geht es aber in lichte Höhen.

Five European public online gambling companies, which together took in some $1.4 billion from U.S. customers in 2005 alone, watched their share prices tank and profits collapse when a bill banning Internet gambling payments was signed into law last October by President George W. Bush (see BusinessWeek.com, 10/02/06, "Party's Over for Online Gambling").

The carnage was perhaps even worse than predicted. One company, London-based BetOnSports.com, saw its shares suspended after Chief Executive Officer David Carruthers was arrested and recently pleaded guilty to federal racketeering charges in the U.S. Another, Empire Online, based in Tortola (British Virgin Islands), gave up its online gambling activities entirely and became an investment company (see BusinessWeek.com, 8/21/06, "Online Gambling Hedges Its U.S. Bets").

Others, including Sportingbet.com, 888 Holdings, and PartyGaming, which bought Empire Online's poker customers, have weathered the fallout by shifting their focus to Western European gamblers. But their share prices haven't come close to recovering: Most are now trading at around a quarter of their peaks in the summer of 2006, though they've risen some in recent months.

U.S. Rethinking Ban
An odd coalition of antigambling conservatives, Las Vegas interests, and law enforcement were behind the passing of the 2006 ban, but now that the bill's impact is registering—little decrease in overall gambling levels, and a shift away from aboveboard operations to more shadowy outfits—some analysts believe the U.S. may reverse its stance. That could open the door for European operators to reenter the lucrative U.S. market.

The possibility of legal and legislative relief in the U.S. could help the kings of online gambling get a second shot at being hot-growth stocks. In March, Sportingbet struck a deal with the state of Louisiana to drop charges of "gambling by computer" that had been filed against its former chairman, Peter Dicks.

And both 888 Holdings and PartyGaming publicly acknowledged this week that they are negotiating with the U.S. Attorney's Office for the Southern District of New York to obtain amnesty for having offered online gaming inside the U.S. prior to October, 2006, when the ban went into effect. (Neither company returned calls from BusinessWeek on June 5.)

PokerStars advises its customers in an online statement that it has "received extensive expert advice from within and outside the U.S." concluding that U.S. law "does not in any way prohibit you from playing online poker. Therefore our business continues as before—open to players worldwide, including the U.S."

With lots of offshore gambling services continuing to target U.S. customers, the total spent by U.S. citizens gambling online has decreased by only 20% since the ban went into effect, says Professor Leighton Vaughan Williams, director of the Betting Research Unit at Britain's Nottingham Business School. "As we have learned from previous cases of prohibition, the Internet ban doesn't actually prevent gambling," he says. "All it does is transfer the gambling spending to a nonregulated environment," (see BusinessWeek.com, 10/19/06, "Online Gambling Goes Underground").

"Puritanism and Protectionism"
Vaughan Williams calls the 2006 U.S. ban an ill-conceived mixture of "puritanism and protectionism." The legislation, he says, never would have passed had it not been tacked onto an antiterrorist bill. "You could not be for online gambling without being pro-Al-Qaeda, which is not something you want to do just before the congressional elections," he quips. Vaughan Williams believes U.S. legislators eventually will pass a bill requiring online gambling sites to be licensed and pay taxes in the U.S.

Ed Barton, a games and gambling analyst at London-based research company Screen Digest, agrees that the U.S. will likely allow a regulated form of online gambling.

The European online gambling companies clearly could use the help. While there is still some growth to be found in Western Europe, uneven legislation has made it difficult to expand services uniformly. By contrast, the U.S., with its high broadband penetration, large number of credit-card users, and relatively homogenous market of people with similar gambling habits, remains the biggest prize.

Giving the U.S. a Slice
European outfits such as PartyGaming and 888 Holdings got significant U.S. experience before the ban went into effect. If allowed back in by U.S. authorities, they would attempt to reconnect with their hundreds of thousands of previous customers, says Screen Digest's Barton. But, he warns, the playing field is likely to be vastly different than it was before the ban went into effect.

For one thing, under new legislative scenarios, European companies probably would have to set up operations in the U.S. and agree to pay U.S. taxes. They also would likely face stiff competition from new competitors in Las Vegas, which could be allowed to launch brand-name online gambling services for the first time, Barton says.

What's more, if permitted to under new legislation, the various state lotteries in the U.S. might follow the example of Britain's national lottery and branch out into areas such as online scratch cards. That could provide even more competition for the Europeans.

Still, there is a lot of growth potential for a post-prohibition U.S. market. Given the chance to come back, Europe's beleaguered online betting sites will readily take the gamble.

In Bezug auf andere Unternehmen (z.B. bwin) verstehe ich den derzeitigen Kursverlauf-/Stand von PG einfach nicht. Auch ohne den US Markt müsste sich hier eigentlich mehr tun. Die Zukunftsaussichten für PG sind meiner Meinung nach nicht die schlechtesten - absoluter Wachstumsmarkt und PG selbst stellt sich in letzter Zeit gut auf. Sehe ich das falsch ?!

WASHINGTON, DC -- Two more bills to repeal an Internet gambling ban were introduced Thursday as a House panel prepared for a hearing today on the $13 billion online wagering industry.

Rep. Jim McDermott, D-Wash., unveiled a measure to tax Internet gambling companies if they are licensed and regulated in the United States.

McDermott said his bill would dovetail with a bill introduced last month by Rep. Barney Frank, D-Mass., which would require the Department of Treasury to regulate online betting web sites.

"If we decide, as a nation, to enable gambling online, the billions of dollars flowing out of the country should remain here to help us fund schools and bridges, and a host of social programs that need more than luck to succeed," McDermott said in a statement.
McDermott's bill would produce up to $25 billion for the federal treasury within five years, according to a group called the Safe and Secure Internet Gambling Initiative.

The American Gaming Association, which opposes the Internet gambling ban and supports a study of the online wagering industry, voiced concern about McDermott's bill.

"We have not yet seen this legislation so cannot comment on it fully. Historically, however, the American Gaming Association has been opposed to any federal taxation of the commercial gaming industry," said AGA President Frank Fahrenkopf.

Rep. Shelley Berkley, who has offered her own bill to roll back the Internet gambling ban, went further, saying she could not support McDermott's bill.

"A federal tax on gaming is the camel's nose under the tent," Berkley said.

Rep. Robert Wexler, D-Fla., also proposed a bill Thursday which would exempt poker and other "skill games" from the Internet gambling ban signed into law in October by President Bush.

"Poker is a game, not a crime," Wexler said in a statement.

"Millions of Americans enjoy competing with each other in games of skill on the Internet," Wexler said. "We should protect the freedom of law-abiding adults to participate in these great American pastimes."

The McDermott and Wexler bills make a total of four measures proposed so far this year to roll back the federal prohibition against the use of credit cards, checks and other bank instruments to pay for online wagers.

One week after Frank introduced his bill in May, Berkley and Jon Porter, R-Nev., offered legislation calling for a one-year study of Internet gambling by the National Research Council of the National Academy of Sciences.

Frank is chairman of the House Financial Services Committee, which is scheduled to conduct a hearing this morning on his bill.

Rep. Bob Goodlatte, R-Va., a leading opponent of Internet gambling, said he is confident the ban will not be repealed.

"Three hundred and seventeen members of Congress, including House Speaker Nancy Pelosi, (D-Calif.), and House Majority Whip Jim Clyburn, (D-S.C.), voted for an even stronger ban on Internet gambling than was eventually enacted by Congress," Goodlatte said in a statement.

"Proponents of repealing the ban will have a very tough time overturning that act," he said.

Meiner Meinung nach ist Partygaming in 1-2 Jahren wieder top oben
Wenn der US-Markt wieder geöffnet wird, und damit rechne ich, wenn im nächsten Jahr die Demokraten das Rennen um die Präsidentschaft machen, dann wird Partygaming in schwindelnde Höhen steigen. Ich rechne dann mit bis zu 10 Euro.

Mit einem Tageshoch von 26,75 Pence - einem Plus gegenüber Vortag von immerhin 8 % - hat sich die Aktie des britischen Anbieters von Online-Glücksspielen Partygaming am Donnerstag zumindest zeitweise deutlich von dem kürzlich erreichten Rekordtief von 22,75 Pence abgesetzt. Das dürfte allerdings nur ein schwacher Trost für die Anleger und Analysten gewesen sein, die sich in den letzten Wochen Hoffnungen auf eine Stabilisierung gemacht haben.

Trotz zuversichtlicher Aussagen des Unternehmens und unter Missachtung der zwischen 30 und 60 Pence liegenden Kursziele der Analysten ist der Titel gegenüber dem Jahreshoch von 60,25 Pence vom April kontinuierlich abgesackt. Jedoch werden sich die Mienen in der nächsten Woche möglicherweise aufhellen, worauf einige Marktakteure gestern wetteten. Partygaming wird am Mittwoch Halbjahreszahlen vorlegen. Dresdner Kleinwort erwartet einen um 33 % auf 202 Mill. Dollar erhöhten Erlös und ein um 15 % gestiegenes Ebitda (Ergebnis vor Zinsen, Steuern und Abschreibungen) von 30 Mill. Dollar. Entscheidend sei angesichts des herannahenden saisonbedingt starken vierten Quartals der Ausblick. Die Kursschwäche sei zum Teil auf die sinkenden Kundenzahlen von Pokersitescout zurückzuführen. Allerdings bedeute dies nach starken Kundenzahlen vom ersten Quartal und angesichts von Saisoneinflüssen eine enge Korrelation zwischen Kundenzahlen und Erlös. Daher sei die negative Kursreaktion übertrieben. Die Analysten empfehlen den Titel mit einem Kursziel von 60 Pence zum Kauf. Sie errechnen auf Basis ihrer Schätzungen für die Jahre 2007/2008 Kurs-Gewinn-Verhältnisse von 25 und 12,5. Mit 12,5 wäre der Titel preiswert, auch wenn man die Risiken berücksichtigt.

Chief Executive Officer, Mitch Gerber has reportedly announced, that the online gambling group PartyGaming is open for approaches from Las Vegas based casinos regarding a sale.

The online news website FT.com reported that Garber, speaking in a one-to-one interview during the EIG 2007 i-Gaming conference in Barcelona, has announced the Gibraltar-based online gaming group is keen to entertain buyout offers from the major casinos in Las Vegas. PartyGaming is the parent company of Party Casino and Party Poker and also offers online Backgammon, Bingo and Sportsbetting.

At its peak, PartyGaming was the world’s largest online gambling company, valued at almost $10 billion at one stage. They were hurt badly by the UIGEA, after their Board of Directors decided it would be prudent to withdraw from the US market (which provided the majority of their customer base) late last year. The company now has a market cap of around $2.5 billion and Garber believes his company could be a viable purchase option for a major Las Vegas land-based casino looking to enter the global online betting market.

When asked if PartyGaming was already in talks with a potential buyer, Garber refused to comment. Competitor 888, themselves the target of a failed merger with Ladbrokes earlier this year, has been touted as a possible buyer. FT.com reported 888 also refused to comment on a possible merger.

PartyGaming is currently in protracted talks with the US DoJ over its activities in the US prior to their withdrawal, and industry analysts believe that any merger cannot progress until the outcome of those talks becomes clear. PartyGaming and 888 could both still be facing heavy fines from the US DoJ, if their treatment of NETeller this year is any indication. NETeller was forced to pay a $136 million fine which it paid in order to avoid being de-listed by the AIM trading index.

Nevertheless, despite its fall from previous lofty heights, PartyGaming continues to trade profitably and has been slowly recovering in an increasingly competitive market. A large casino group like Mirage or Bellagio might be interested in picking up PartyGaming on the cheap, perhaps on the gamble that Rep. Barney Frank’s IGREA bill will be ratified by Congress, effectively negating the UIGEA.

Shareholders in PartyGaming are an optimistic bunch, but many have questioned why the company’s CEO continues to exercise his options and sell off his shares. To a layman observer like this reporter, it might seem the CEO has no faith in his own company and is offloading his holdings. And now he wants to sell the whole company?

With the SP rising and falling like a blackjack player’s stack of green and red chips, PartyGaming is truly a stock for gamblers. But maybe, just maybe, “the count is good” – some large purchases have been made today around the 32p mark and perhaps the SP is on its way up.

Barney Frank Questions Online Game Study

Barney Frank has 37 co-sponsors and is still gaining ground.

Rep. Barney Frank (D-Mass) has publicly questioned what value there is to be gained from studies into online gambling, yet will continue to co-sponsor Rep. Shelley Berkley’s (D-Nev) bill calling for a one-year study of online gambling in the US.

Rep. Frank is slowly building support for his own bill, the Internet Gambling Regulation and Enforcement Act of 2007 (IGREA), which seeks to regulate online gambling in the US. As Chairman of the House Financial Services Committee, Rep. Frank has been outspoken in his criticism of the highly-controversial Unlawful Internet Gambling Enforcement Act (UIGEA), which was passed last year on the back of the must-pass Safe Ports Act.

Frank has only 37 co-sponsors for his bill, and has admitted support for regulation of online gambling has stalled. Yet he could receive a strong surge of support when the European Union makes their claim for damages against the U.S., after Antiqua won their appeal against the U.S. at the WTO (World Trade Organization).

Antigua claimed the US was in breach of their GATS commitments when they attempted to block foreign online casino operators from accessing the US market through the UIGEA. The US claimed they made a mistake when they signed up to their agreements a few years ago. The WTO ruled in favor of Antigua, the US appealed the decision and lost. As a result, WTO members are lining up to claim compensation from the US with some analysts estimating the EU claims could be as high as $100 billion. If the EU presses for full compensation, Frank could well get a surge of co-sponsors which could result in the IGREA being rushed through Congress.

Barney Franks said “I know the pressure is going to increase. I don’t know where it ends, but they are going to be asking big bucks from us”.

Frank is a co-sponsor of Rep. Berkley’s bill, which will commission the National Academy of Sciences to carry out an independent study of online gambling in the U.S., of which Frank is a co-sponsor of this bill as well. Frank said “What’s to study? Whether or not I should be able to make my own bet with my own money?”

Berkley has 64 co-sponsors for her bill. Which calls for the one year study of online gambling.

US faces US$100 billion fine for web gaming ban

A Brussels think-tank has accused the US government of reneging on commitments made to the World Trade Organisation (WTO) over internet gaming.

Panellists at a trade forum levelled harsh criticism at the US, focusing on a burgeoning trade clash between the US and Europe over internet gaming.

The forum believes that the US could be liable for up to US$100 billion in trade concessions to European industries after placing illegal discriminatory trade restrictions on European gaming operators.

The disputed concessions arise from Antigua's victory earlier this year when the WTO ruled that the US violated its treaty obligations by excluding online Antiguan gaming operators, while allowing domestic operators to offer various forms of online gaming.

Instead of complying with the ruling, the Bush administration withdrew the sizeable gambling industry from its free trade commitments.

As a result, all 151 WTO members are considering seeking compensation for the withdrawal equal to the size of the entire US land-based and online gaming market, estimated at nearly US$100 billion.

The European Union, along with India and five other countries, has filed notice that it intends to seek compensation.

"The US decision is a major threat to a rules-based international trading system," said Nao Matsukata, former director of policy planning for the Office of the US Trade Representative.

"If more countries follow the US lead and do the same thing, the entire WTO system could implode and that would be extremely dangerous for US economic interests and for free trade generally.

"Part of what makes the US such a formidable opponent in international negotiations is its credibility. That credibility is now at stake for the US government not just in the trade area but in foreign relations generally."

Lode Van Den Hende, a trade lawyer at Herbert Smith in Brussels, criticised the US for prosecuting foreign online gaming companies while letting domestic online gaming interests operate with impunity.

"This is absolute discrimination against foreign operators that the WTO has found to be illegal," he said.

"It is exactly the kind of practice that the WTO was set up to eliminate, and now the US is violating this very basic principle that it fought hard to put in place at the inception of the organisation."

The law makes it unlawful for banks and credit card issuers to process payments to Internet-based gambling businesses outside the U.S. for the types of gambling that violate federal, state or local statutes. Online poker is still technically legal; however, without actual cash on the line, Pappas said, the game is diminished.

"The wagering and making decisions based on what your wagers are are a significant part of the skill of the game. Whether you're playing for pennies or dollar bills, there has to be some sort of corresponding loss for you to make in order for you to make appropriate decisions," he explained.

If passed, Franks' proposal, the Internet Gambling Regulation and Enforcement Act, will replace the total ban on all forms of gambling with regulations that would require companies seeking to provide the service to undergo criminal background checks and financial disclosures. The licensing and regulating mechanism created by the bill is intended catch those intent on pursuing unscrupulous activities as well as protect minors and problem gamblers while at the same time allowing "responsible adults" to enjoy online poker, according to the PPA

HR 2610, the Skill Game Protection Act, proposed by Rep. Wexler, is more narrowly focused on games of skill, such as mahjong and bridge, as well the companies providing these online games. The bill would require these businesses to install age verification technology to prevent minors from accessing for-money play, flag compulsive users and provide counseling referrals, prove they are not at risk from money laundering by criminals or terrorist and collect applicable taxes.

'Perfect Storm'
The National Coalition Against Legalized Gambling (NCALG) calls Internet gambling, including poker, a "perfect storm of harm."

"It brings together all of gambling's addictive power and mixes in the greatest potential for crime, corruption and economic instability," according the group's Web site.

"We feel that there's been enough studies that show that putting these games online is one of the most addictive forms of gambling. The studies show that the faster the play, the more addictive it is," Dr. David Robertson, NCALG spokesperson, told the E-Commerce Times

Poker advocates love their game, but what makes it great is sitting across from other players who could be bluffing and outwitting them. Online poker contains none of the elements that make it a compelling game in real life, he said.

"Legalizing any form of Internet gambling is like opening a mainline for addiction into schools, homes and businesses," he continued.

To legalize this is the worst possible thing the U.S. could do, according to Robertson. The only people pushing for this legislation are those who stand to make millions or even billions of dollars from online gambling, he asserted." target="_blank" rel="nofollow ugc noopener">More Skill Than Chance
Poker enthusiasts, including the PPA's 800,000 professional and amateur members, are working to convince members of Congress that poker, unlike blackjack, roulette and other casino games, is more a game of skill than of luck. They say poker is more properly grouped with games such as bridge and backgammon.

"The game is completely reliant on mathematics, logic, reasoning, money management and psychology," Pappas told the E-Commerce Times. "The mere fact that I can sit and debate with you who the top poker player in the world is, but you and I couldn't sit and debate who is the best lottery picker or the best roulette player in the world, is a strong indication."

If passed, Franks' proposal, the Internet Gambling Regulation and Enforcement Act, will replace the total ban on all forms of gambling with regulations that would require companies seeking to provide the service to undergo criminal background checks and financial disclosures. The licensing and regulating mechanism created by the bill is intended catch those intent on pursuing unscrupulous activities as well as protect minors and problem gamblers while at the same time allowing "responsible adults" to enjoy online poker, according to the PPA

HR 2610, the Skill Game Protection Act, proposed by Rep. Wexler, is more narrowly focused on games of skill, such as mahjong and bridge, as well the companies providing these online games. The bill would require these businesses to install age verification technology to prevent minors from accessing for-money play, flag compulsive users and provide counseling referrals, prove they are not at risk from money laundering by criminals or terrorist and collect applicable taxes.

'Perfect Storm'
The National Coalition Against Legalized Gambling (NCALG) calls Internet gambling, including poker, a "perfect storm of harm."

"It brings together all of gambling's addictive power and mixes in the greatest potential for crime, corruption and economic instability," according the group's Web site.

"We feel that there's been enough studies that show that putting these games online is one of the most addictive forms of gambling. The studies show that the faster the play, the more addictive it is," Dr. David Robertson, NCALG spokesperson, told the E-Commerce Times

Poker advocates love their game, but what makes it great is sitting across from other players who could be bluffing and outwitting them. Online poker contains none of the elements that make it a compelling game in real life, he said.

"Legalizing any form of Internet gambling is like opening a mainline for addiction into schools, homes and businesses," he continued.

To legalize this is the worst possible thing the U.S. could do, according to Robertson. The only people pushing for this legislation are those who stand to make millions or even billions of dollars from online gambling, he asserted.

Online Gambling Legislation The European Commission's online gambling compensation claim against the US took another step forward this week when EU Trade Commissioner Peter Mandelson arrived in Washington to address the issue with US legislators.

Reuters reports the EU's top trade official has headed to Washington as part of a concerted effort to persuade Congress to repeal the Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA), which places restrictions on US financial houses in regards to online gambling transactions.

Mandelson reiterated that the UIGEA was unfair to Europe, where many of the world's largest online gaming companies are based. The World Trade Organization has already twice ruled that

the UIGEA breaches WTO rules, allowing the EU to pursue compensation from the US. Some analysts have predicted the EU claim could reach as high as $100 billion.

Mandelson told reporters the US must change their online gambling laws to remove discrimination against EU operators:

Mandelson could well have been referring to industry leaders PartyGaming and 888, who both decided to withdraw from the US market late last year as a result of the new legislation. Online gambling has largely continued to prosper in the US, only now the companies raking in the profits are privately owned and not subject to stringent regulation.

The tiny Caribbean island of Antigua took the US to task over the UIGEA at the WTO and won the fight, with the WTO ruling compensation was due. Mandelson echoed this ruling, stating:
"When a member of the WTO defaults on its commitments, compensation is due. That's the case of online gambling."

Das Verwaltungsgericht Köln hat das staatliche Monopol für Sportwetten für europarechtswidrig erklärt und aus diesem Grund einem Sportwettenvermittler Vollstreckungsschutz gegen eine Untersagungsverfügung der Stadt Köln gewährt (Beschluss vom 7. November 2007, Az. 1 L 1538/07). Der von der Rechtsanwaltskanzlei ARENDTS ANWÄLTE (www.wettrecht.de) vertretene Vermittler kann daher weiterhin Verträge über Sportwetten an einen in der EU (hier Gibraltar) staatlich zugelassenen und dort laufend behördlich überwachten Buchmacher vermitteln. Das Gericht folgt damit den Verwaltungsgerichten Mainz und Arnsberg, die kürzlich ebenfalls Sportwettenvermittlern Vollstreckungsschutz gewährt hatten.

Das Verwaltungsgericht Köln verweist auf die Rechtsprechung des Europäischen Gerichtshofs (EuGH). Die strafrechtliche Sanktionierung der binnengrenzüberschreitenden Vermittlung von Sportwetten ist demnach unverhältnismäßig und damit rechtwidrig, wenn staatlich zugelassene national Einrichtungen zur Teilnahme an Sportwetten ermutigten. Dies sei in Deutschland der Fall.

Nach der Rechtsprechung des Bundesverfassungsgerichts erfasse die Unverhältnismäßigkeit des staatlichen Wettmonopols auch den Ausschluss der Vermittlung privater Wetten. Durch den Hinweis der Bundesverfassungsgerichts auf die Parallelität der Anforderungen des Verfassungsrechts zu den europarechtlichen Vorgaben ergebe sich zwingend, dass das Sportwettenmonopol auch gegen die Dienstleistungs- und Niederlassungsfreiheit verstoße (Art. 43 und 49 EG-Vertrag).

Die rein tatsächlichen Änderungen der Sportwettenpraxis der staatlichen Wettunternehmen sei zur Beseitigung des Gemeinschaftrechtsverstoßes nicht ausreichend. Eine neue rechtliche Ausgestaltung des staatlichen Wettmonopols sei bislang nicht erfolgt. Die Frage einer Verwirklichung des Straftatbestandes des § 284 StGB (unerlaubtes Glücksspiel) könne sich erst dann stellen, wenn die Zulassung einer Veranstaltung von Sportwetten im Einklang mit den Grundsätzen des europäischen Gemeinschaftsrechts geregelt worden sei.

Der Anwendungsvorrang des europäischen Gemeinschaftsrechts gelte uneingeschränkt. Eine temporale Durchbrechung des Anwendungsvorrangs, d.h. die zeitweise Nichtanwendung des Europarechts (wie vom OVG NRW versucht), widerspreche der Rechtsprechung des EuGH. Auch gebe es – anders als vom OVG NRW angenommen – keine inakzeptable Gesetzeslücke. Eine Gefährdung wichtiger Allgemeininteressen sei nicht erkennbar. So habe die Spielsucht bei der jahrelangen Duldung privater Wettanbieter nicht in gefährlicher Weise zugenommen. Auch sei für das Gericht nicht erkennbar, dass der Verbraucherschutz bei privaten Wettanbietern nicht gewährleistet gewesen wäre.

I think prty has picked up too many retail investors and the market is simply trying to scare them off the share by dropping the price in the short term. Dont be scared off hold on and in the next month the price will be back above the 30p level, save for a drastic recession event in the market as a whole. The share price seems to be centred around the prospect of the Americans legalising online gambling, and a potential takeover in the industry. It seems 888 is the odds on favourite for a takeover at the moment, in the eyes of the market, being cheeper than prty. However this is short term, prty has a strong marketing campaign, a strong customer base and is increasing the number of customers from other areas of the world than America. IMHO still a strong buy."

Als aktiver Pokerspieler kann ich behaupten ,dass Party an sich ne tolle Seite ist - gaben ja auch noch Casino und Sportwetten-aber für Vielspieler absolut nicht zu gebrauchen ist weil es sehr schwierig ist auf leicht erhöhtem Niveau Tische zu finden.

Ich sehe auch , dass die Seite von Stars und full tiltimmer besser und grösser wird .

Party muss sich bald mal bekennen. so hat es doch echt keinen Sinn.
Würde Party die Leute auch wieder zulassen würde der Kurs sich mindestens mit dem Faktor der neuen Mitglieder multiplizieren.

Besteht eigentlich theoretisch die Möglichkeit , dass das Gesetzt bei einem neuen Präsidenten gekippt wird?

also AGs können sich rechtlich sicherlich nicht so viel leisten als private Gaming Firmen, da sie ja auch den Aktionären verpflichtet sind......


seit der US schliessung hat nun nach pokerstars auch fulltilt vor kurzem partygaming, bei den Spielern überholt.........


weiters halte ich partygaming derzeit noch für stark überbewertet......


beschäftige mich schon lange mit bwin und im vergleich dazu ist partygaming für mich stark überbewertet........

Bwin hat meiner Meinung nach auch ein so starkes Namensbranding- zumindest in Deutschland- dass ich denke , dass die Aktie deutlich unterbewertet ist.

Jeder kennt BWIN und man wird permanent mit Bwin konfrontiert- Bandenwerbung, Gutscheine , die bei Amazon beigelegt werden,etc...:

Kenne selber auch viele Sportwettenseiten und denke , dass Bwin nicht die besten Quoten hat , dafür aber die mit Abstand beste Livewettenseite.

Aber was solls.Da die rechtliche Seite auch hier absolut nicht geklärt ist , steckt eben noch viel Gefahr im Kurs.Wie weit ist eigentlich die Firma Ongame schon abgeschrieben?

EM könnte ein absoluter Kursbringer werden.

Aber , dass Party sich so kampflos die Butter vom Brot nehmen lässt ist schon komisch.

PartyGaming FY07 Profit Falls; Says Confident In FY08 Forecast; CEO Mitch Garber To Resign In 2009 - Update [PRTY.L]

3/5/2008 6:34:43 AM Wednesday, online poker and betting firm PartyGaming Plc (PRTY.L, PYGMF.PK) announced its fiscal 2007 preliminary results, reporting a fall in profit, owing to significantly lower income from discontinued operations. On a continuing operations basis, the company swung to profit from loss last year. Total net revenue plunged 57%, while net revenue from continuing operations grew 46.5%.

Further, PartyGaming said its Board will not recommend a final dividend in the current environment. Going ahead, the company noted that it remains confident about the fiscal 2008 outlook. Separately, PartyGaming said Chief Executive Officer Mitch Garber intends to resign on May 1, 2009, citing personal reasons, and that the Board has initiated a process to find a replacement.

For the year, the company's profit was $41.6 million that plunged from $128.4 million a year earlier. Total basic earnings per share were 1.0 cent, down from 3.4 cents in the previous year.

The year 2007 results included profit from discontinued operations of $27.7 million, down from $211.8 million last year.

On a continuing operations basis, profit was $13.9 million or 0.3 cent per share, compared to loss from continuing operations of $83.4 million or 2.2 cents per share in 2006.

Before reorganization costs, non-recurring adjustment to revenue, charges relating to share-based payments and release of tax provision, total Clean earnings per share fell to 1 cent from 12.9 cents a year ago. Continuing Clean earnings per share were 1.6 cents, higher than 0.4 cent in the previous year.

In the year, the company's pre-tax profit from continuing operations of $6.7 million, compared to loss of $77.4 million in 2006.

Total net revenue fell 57% to $476.0 million in the year from $1.11 billion in the prior year, reflecting the termination of all real money games to players based in the US from October 13, 2006.

Net revenue from continuing operations increased to $476 million from $325 million last year. Net revenue before non-recurring item climbed 41% to $457.8 million from $325 million a year ago, driven by strong growth mainly in Europe.

Average daily revenue for the year as a whole increased 41% to over $1.3 million per day from $890 thousand in 2006.

Among divisions, net revenue from Poker rose 10% to $295.0 million from last year's $268.4 million. Revenues from Casino soared 188% to $146.7 million from $51.0 million in 2006, driven by the acquisition of certain casino assets from EOL and IOG in January 2007, and a substantial improvement in the quality of the company's PartyCasino software. Sports Betting revenues went up 188% year-over-year to $16.1 million.

Total Clean EBITDA in the year fell 84% to $87 million from $550.7 million in the previous year, reflecting the loss of US revenue. Continuing Clean EBITDA climbed 119% to $111.7 million from $50.9 million in the prior year.

PartyGaming's total operating loss was $20.7 million, compared to profit of $138.7 million in 2006. Meanwhile, operating profit from continuing operations was $5.3 million, compared to loss from continuing operations of $77.6 million a year ago.

Commenting on the results, Chairman Michael Jackson said, “During the past year we have succeeded in growing revenue and Clean EBITDA and transforming ourselves into a more broadly based and internationally focused business. These results are a testament to our chosen business strategy, keep us at the forefront of the industry and provide us with a robust and scaleable platform for growth.”

Regarding the dividend, PartyGaming said its Board believes that it would be imprudent to recommend a final dividend for the year 2007 in the current environment. The company has not declared an interim dividend for the period ended June 30, 2007. The Board will continue to review the appropriate dividend policy for the company going forward, it said.

For the five weeks ended March 3, 2008, PartyGaming's average gross daily revenue increased 4% to $1.78 million from January. In the four weeks ended January 28, average gross daily revenue was $1.71 million. The company noted that the growth in net revenue has been lower than expected, however, Clean EBITDA is in line with expectations and the company remains confident about the full year outlook.

Going ahead, Jackson said, “Whilst our approach means that we continue to forego revenue opportunities in the short-term, we believe that such revenue streams are at risk and we remain confident that our chosen strategy will generate superior returns for shareholders over the long-term. These initiatives, together with encouraging regulatory developments at the European Commission level in recent months and a solid start to the current financial year, provide us with confidence for 2008.”

In a separate statement, PartyGaming said Chief Executive Officer Mitch Garber has informed the Board that he does not intend to renew his employment and services contract beyond May 1, 2009, as he and his family have decided to return to North America in the year. Garber will remain in his role until a successor is found.

The Board has initiated a process to find a replacement and will engage an executive search firm for an internal and external review of candidates.

Mitch, who joined the company two years ago, has guided through the completion of three acquisitions, and an extraordinary turnaround following the enactment of the UIGEA.

PRTY.L is currently trading on the LSE at 25.00 pence, down 2.50 pence or 9.09%, on a volume of 5.6 million shares.

Partygaming seeks US resolution



Online gambling firm Partygaming is in talks with US authorities over bets it took before legislation in 2006 wiped out its trade in the United States.
The US law reforms effectively made it illegal for Partygaming to trade there.
Partygaming has been talking to justice officials to end threats of prosecution for accepting US bets prior to 2006.
Partygaming's shares fell as it also said recent revenues were disappointing and that chief executive Mitch Garber was to leave the firm.
'Constructive' talks
The firm said it could not predict the outcome of the US talks, but that a conclusion may arise in the "foreseeable future".
Any possible settlement could also remove the worries of banks that are refusing to lend to firms like Partygaming for fear of offending US authorities.
The talks, said Mr Garber, were "moving down a very good and constructive path".
Meanwhile, Partygaming said current trading had seen lower growth in revenues than expected.
But the firm - which runs the Partypoker, Partybets, Partycasino, Partybingo and Partygammon websites - said underlying earnings were still in line with expectations.
Shares in the firm fell 9% to 25 pence on Wednesday afternoon. At their peak at the beginning of 2006 their shares hovered around 155p.
The US move in 2006 caught the industry off guard, and set in motion sweeping changes which saw Gibraltar-based Partygaming withdraw from the US market where at the time it collected most of its revenue and profit.

The substantial appreciation of the US dollar has adversely impacted our revenues but has had a corresponding benefit on our costs, most of which are incurred in Euros and Sterling. Consequently, the Clean EBITDA margin achieved in this nine-month period is in line with previous guidance of 29-30%. We have continued to generate good cashflow in the period and retain a strong balance sheet. The Board remains confident of delivering full year Clean EBITDA in line with our expectations.”

The Group delivered total revenue of $117.7m in the third quarter of 2008. Casino, sports betting and bingo grew revenue year-on-year by 25%, 19% and 143% respectively. However, total revenues were flat versus the same period in 2007 due to a 15% decline in poker.

Seasonality and a deferral of some marketing spend until the relaunch of PartyPoker resulted in a 12% decline in the number of new poker player sign-ups versus the previous quarter. However, a concerted marketing push in casino, bingo and sports betting meant that total sign-ups were up by 6% versus the prior year. The total number of unique active players grew by 5% with increases in casino, sports and bingo being partially offset by a reduction in poker. The average number of daily players fell by 11% to 63,900 due to reduced frequency of play, particularly in respect of poker and casino. The reduced frequency of play also affected yields. The yield per active player day increased by 12% but the yield per unique active player in the quarter fell by 5% to $218.5 (2007: $230.9). Overall, across all products, net revenue per day in the third quarter of 2008 averaged $1,279,400, which was marginally lower than the same period in the prior year (2007: $1,282,200).

The sharp rise in the US dollar that began in August 2008 and continued into September, together with the early effects of the economic downturn resulted in lower than expected customer deposits and revenue which was 6% lower than in the second quarter.

While total revenues were softer than expected during the third quarter, marketing costs were also lower and as a result, the Board reaffirms its previous guidance for distribution expenses of approximately 40% of revenue for the full year.

In poker, revenue was down by 15% to $65.0m (2007: $76.3m) reflecting lower yields driven by a reduction in the number of unique active players and their frequency of play. The Group’s biggest challenge in poker continues to come from sites that still take bets from customers in the US. Trading in the period was also impacted by some adverse reaction to our new customer loyalty programme and by unplanned downtime in August and planned downtime for the launch of the next generation of PartyPoker. An improved loyalty and VIP programme, incorporating extensive player feedback, will be launched next month.

Total casino revenue increased by 25% to $45.9m (2007: $36.7m). New games such as Top Gun and The Godfather helped to increase player yields that were up by 22% versus the prior year to $46.3 (2007: $37.8), as well as attract new players to PartyCasino. The number of unique active players increased by 11% year-on-year thanks to a strong increase in the number of new casino sign-ups, but fell 16% versus the previous quarter, reflecting seasonality and the softer performance in poker that continues to be the main source of casino players.

Sports betting revenue increased by 19% to $5.1m (2007: $4.3m), primarily due to increased betting volume that was up 42% on the prior year. The benefit of a 25% increase in player numbers year-on-year was reduced by a fall in the gross win margin from 5.7% to 5.2% reflecting growth in live betting which has a lower margin. A number of new features were introduced to PartyBets.com at the end of September 2008. These features and other upgrades over the coming weeks are expected to improve performance further.

Bingo delivered strong year-on-year growth with revenue up by 143% to $1.7m (2007: $0.7m), driven by growth in new player sign-ups which were up by 486% primarily due to the success of ITV Bingo, the Group’s bingo white label in the UK. The growth in new player sign-ups drove a 63% increase in the daily average number of players versus the prior year.

Trading Update

The relaunch of the next generation of PartyPoker at the end of September 2008 as well as the normal seasonal pick-up resulted in a material uplift in player numbers. However, the economic slowdown and the further strengthening of the US dollar, which against Sterling is now 22% higher than the average for the third quarter of 2008 and 16% up against the Euro, continue to affect the Group’s revenue performance. In addition, bonus rates have increased due to several retention and reactivation campaigns surrounding the launch of the next generation of PartyPoker.

In the 6 weeks ended 11 November 2008, average gross daily revenue had fallen by 7% from that achieved in the third quarter to $1,492,000 (Q3 08: $1,598,000). New poker player sign-ups averaged 1,220 per day (Q3 08: 1,000), and there were on average 57,950 active poker players per day (Q3 08: 50,600) generating average gross daily poker revenue of $807,900 (Q3 08: $816,200). In casino, average gross daily revenue was $586,000 (Q3 08: $686,800) and bingo was $19,900 (Q3 08: $25,700) while in sports betting, gross win per day was $77,700 per day (Q3 08 $69,200).

Material Events, Transactions and Financial Position

As at 30 September 2008, the Group had no bank borrowings or other loans and had total cash (and cash equivalents) of $195.5m against client liabilities of $129.9m.

Discussions with the Department of Justice are progressing and the Group remains focused on seeking a satisfactory resolution to these discussions as soon as practicable.

There have been no material events, transactions or changes in the financial position of the Group since the half year other than as outlined in this statement.

Der Konzern hat insgesamt einen Umsatz von $ 117.7m im dritten Quartal 2008. Casino, Sportwetten und Bingo wuchsen die Einnahmen im Vergleich zum Vorjahr um 25%, 19% und 143% zu belassen. Allerdings wird die Gesamtmenge der Einnahmen wurden flache gegenüber dem gleichen Zeitraum in 2007 aufgrund eines 15% Niedergang in Poker.

Saisonale Schwankungen und eine Zurückstellung von einigen Marketing-Budget bis zum Relaunch von PartyPoker führte zu einer 12% Rückgang der Zahl der neuen Poker-Spieler-Anmeldungen gegenüber dem Vorquartal. Allerdings ist eine aufeinander abgestimmte Marketing-Push-in-Casino, Bingo und Sportwetten bedeutete, dass insgesamt Sign-ups wurden um 6% gegenüber dem Vorjahr. Provider sollen Glücksspiel-Seiten sperren
Die Wunschliste nach Sperrungen von Webseiten wird immer größer: Mitten in der von Bundesfamilienminister Ursula von der Leyen (CDU) entfachten und gerade wieder angefeuerten Debatte um die Blockade kinderpornographischer Inhalte im Netz sollen deutsche Internetprovider nun auch Glücksspiel-Seiten von Nutzern hierzulande fernhalten. So trat das hessische Innenministerium vergangene Woche im Rahmen eines "internen Gesprächs" an fünf der größten Zugangsanbieter heran mit der Forderung, eine "freiwillige Selbstverpflichtung" zum Sperren von rund 25 ausländischen Webseiten mit illegalen Lotterien einzugehen. Trotz der Ankündigung von staatlicher Seite, dass dem Appell der Erlass von Sperrungsverfügungen folgen könnte, lehnten die Provider das in vergleichbarer Weise schon einmal an sie herangetragene Anliegen aber allesamt zunächst ab.

"Wenn die Tore erst einmal geöffnet sind, müssen wir bald alles sperren", fürchtet Andreas Maurer, Sprecher der an der trauten Runde beteiligten 1&1 Internet AG. Zumal die geforderte Blockade auf Basis des Domain-Name-Systems (DNS) "technisch unsinnig" sei. Wie der Fall YouPorn gezeigt habe, bei dem sich Arcor zunächst freiwillig am Ausschluss eines Portals mit teils harten pornographischen Inhalten ohne ernsthafter Hürden für Kinder oder Jugendlich übte, würden die Seiten dann rasch umziehen und über andere Wege wieder erreichbar sein. Noch schlimmer wäre eine Sperre anhand einer IP-Adresse. Da 1&1 genauso wie viele andere Webhoster mehrere Netzkennungen auf einem Server im "Shared Hosting"-Verfahren unterbringe, würden "99 Unschuldige mit einem Schuldigen hängen". Ähnlich sehen dies etwa die Anbieter Deutsche Telekom oder Hansenet.

Hintergrund des Vorstoßes aus Hessen ist der neue Glücksspielstaatsvertrag, der Anfang 2008 in Kraft trat. Damit werden nach einer Übergangszeit von Januar 2009 an praktisch alle nicht-staatlichen Lotterien, Sportwetten und Spiele wie Pokern im Internet unzulässig. Offiziell soll damit das Entstehen von Süchten verhindert werden. Es geht aber auch um die Aufrechterhaltung und Durchsetzung des lukrativen staatlichen Lotterie-Monopols. Hessen führt die Glücksspielaufsicht für die Länder durch und hat sich bei seiner Sperrinitiative zum Ausschluss unliebsamer Konkurrenz technisch unter anderem von der staatlichen Einrichtung "Lotto Bayern" beraten lassen.

Marita Strasser, Sprecherin des Verbands der deutschen Internetwirtschaft eco, unterstützt die großen Anbieter in ihrem Nein zu dem Unterfangen. "Wir haben immer wieder betont, dass Blocking die Inhalte nicht aus dem Internet entfernt und auch nicht unerreichbar macht", bringt sie gegenüber heise online prinzipielle Bedenken gegen die immer wieder auflebenden Vorstöße zu Websperren vor. "Wenn man einmal damit anfängt, stehen alle auf der Matte". Die Provider könnten sich dann von Blockadeforderungen durch Jugendschützer, Rechteinhaber oder einzelne Nutzer bei Nachbarschaftsstreitigkeiten oder bei der Auseinandersetzung über Persönlichkeitsrechte nicht mehr retten. Dies würde zu Einschränkungen der technischen Funktionsfähigkeit des Internet führen.

Gerade hybride Sperren in einem Mix aus DNS-Blockaden und Einbezug einzelner IP-Adressen, bei denen die Anbieter noch einzelne Serien von Angeboten auf Erreichbarkeit prüfen müssten, erfordern laut Strasser hohe Rechenleistung und entsprechende Technik. Folge wäre auf jeden Fall zumindest eine spürbare Verlangsamung des Netzverkehrs. Darüber hinaus kämen die Provider aber auch rechtlich in die Bredouille. Ungeklärt seien etwa die Haftungsrisiken, mit denen sie bei "Kollateralschäden" durch die Sperren unweigerlich konfrontiert wären. Bei einer gesetzlichen Verpflichtung wiederum könnten Sanktionen drohen, wenn die Blockade erwartungsgemäß nicht recht funktioniere. Generell würden die Zugangsanbieter für Probleme in Anspruch genommen, für die sie als reine Zwischeninstanzen nicht verantwortlich seien. Es fehle insgesamt an einem rechtsstaatlichen Verfahren, was die von eco und Medienexperten kritisierten Sperrinitiativen bei Kinderpornographie genauso betreffe wie die noch weniger moralisch besonders begründeten Versuche zur Durchsetzung des staatlichen Glücksspielmonopols mit Hilfe der Provider.

White label agreement signed with DM plc




PartyGaming, the world's leading listed online gaming company, today announces that it has entered into an exclusive agreement to create a bingo and casino service for DM plc, the AIM-listed direct marketing group specialising in customer recruitment and database management in the UK.




The gaming service will be DM branded and is PartyGaming's second 'white label' agreement this year. A leader in gamecards and direct mail in the UK market with a database of several million customers, DM will promote the service through its own marketing channels.
