      Liebe Mitleser und Mitinteressierte,

      nach langer Aufbauarbeit und auch der Umbenennung der Firma ist Counterpath Solutions mit aktuell 210 Kunden in 49 Ländern auf dem Weg im aktuellen Geschäftsjahr die 10-Millionen-Dollar-Umsatzmarke zu durchbrechen und somit auch erstmals profitabel zu werden.

      Kunden wie z.B. Cisco Systems oder British Telecom sollten einen erahnen lassen, welches Potential in dieser Firma steckt.

      Gutes Teamwork und wenig Public Relations zeichnen die Vergangenheit aus allerdings werden die weiteren Quartalsberichte das ihrige dazu beitragen, den Kurs auf seinen Weg zu bringen.

      Interessante und respektvolle Diskussionen verbunden mit etwas Humor sollen den Geist hier in diesem Forum ausmachen.

      Und dass der Vorstand an das Unternehmen glaubt kann man an den Insiderkäufen sehen! Aber ob die Jungs sich mit ihrem VoIP durchsetzen werden ist schwer einzuschätzen - also risikoreich!

      Ja, genau das denke ich sieht man an den immer besser werdenden Quartalsberichten. Ein eindeutiger Aufwärtstrend !


      Und wie Du auch richtig erkannt hast kaufen die Insider.


      Es gibt viele Gründe warum Insider verkaufen, allerdings nur einen warum Sie kaufen - Sie erwarten steigende Kurse !


      Wenn man sich den Kursverlauf der letzten Monate ansieht, dann erkennt man auch ganz klar, dass jetzt sensationelle Einstiegskurse vorhanden sind. Kurse, die um einiges noch besser sind als zu Beginn des Jahres.


      Ein weiteres Indiz für den bevorstehenden Erfolg sind meines Erachtens die namhaften Kunden: Deutsche Telekom, At&T, Cisco Systems, British Telecom usw.


      Seit September ist Mrs. Leila Neale für Public Relations zuständig.


      Wir werden sehen wie schnell die Bekanntheit wachsen wird... ;)

      ja ja die alte CTPS. bin schon auf den quartalsbericht gespannt. dabei sollten die deals mit BT, australian Telecom usw. erstmals spürbar sein. wird so wie damals bei gshf. zuerst rumdümplen und dann kaufen auf einmal alle wie die verrückten.

      nicht zu vergessen sind die projekte mit IPTV.

      sollte es wirklich zu 10mill umsatz kommen sehe ich hier eine schöne performance kommen.

      Financial Results - Unaudited
      (All amounts in U.S. dollars and in accordance with U.S. GAAP unless
      otherwise specified)
      For the three months ended July 31, 2006, we generated $1,760,881 in revenue compared to $827,296 for the three months ended July 31, 2005. This represents an increase of $933,585 or 113% from the same period last year. We generated $1,409,719 in software revenue for the three months ended July 31, 2006 compared to $710,678 for the three months ended July 31, 2005, representing an increase of $699,041 or 98% over the same period last year. The increase in software revenue was attributable to an increase in both the number of customers we sell to and the revenue per customer. For the three months ended July 31, 2006, we generated $351,162 in service revenue compared to $116,618 for the three months ended July 31, 2005 representing an increase of $234,544 or 201% over the same period last year. The significant increase in service revenue reflects the increase in services we provide primarily to our larger customers to enable them to deploy our software. Our total number of customers that have deployed our software increased by 22 over the quarter to 213 as at July 31, 2006.

      Total expenses for the three months ended July 31, 2006 were $2,239,023 compared to $1,137,100 for the previous three months ended July 31, 2005, representing and increase of 97% or $1,101,923. Expenses for wages, commissions and benefits during the quarter were $1,156,218 compared to $695,253 for the three months ended July 31, 2005 reflecting the addition of engineering staff required for research and development and the addition of sales and marketing staff. Other expenses include a $266,429 non-cash expense for stock-based compensation compared to $72,586 recorded in the same quarter last year. During the quarter, we began expensing the fair value of our employee stock options.

      The net loss for the three months ended July 31, 2006 was $478,142 ($0.01 per share) compared to $309,804 ($0.01 per share) recorded for the three months ended July 31, 2005.

      ich hätte hier gerne die Analyse der Candlesticks von Americanbulls hereingestellt, doch bei Counterpath bringt diesss nichts.

      Seit dem 18,7.2006 sind, mit einer Ausnahme, alle Kauf/Verkuafssignale falsch. Counterpath macht fast immer das Gegenteil.

      Jetzt wird Counterpath nach der kleinen Erholung auf hold gesetzt, da erwarte ich also bei Counterpath das Gegenteil..

      This installment of TMCnet's "Executive Suite," a feature in which leading executives in the Voice over Internet Protocol/communications industry discuss their companies’ latest developments as well as providing analysis on industry news and trends.


      Technology Marketing Corporation President and Editor-in-Chief Rich Tehrani recently interviewed Donovan Jones, President & Chief Operating Officer of CounterPath.


      The entire communications industry is experiencing colossal change as both businesses and consumers continue to adopt IP as their primary means of communication. Much of this change is being driven by SIP-based converged communications. In fact, at ITEXPO in San Diego last month, hardly a moment passed when the terms “convergence” or “mobility” were unheard. Indeed, they were the subjects of many a keynote and conference session.

      As a developer of SIP-based softphones for the service provider community, CounterPath is among the many companies that has enjoyed recent growth, driven by the changes and developments in the communications industry. The Vancouver-based firm is also keenly aware that change is certain to continue and that developers and service providers alike must remain focused on what ultimately matters — the end user experience.

      I had a chance to speak with Donovan Jones, who heads up the sales, marketing, development, and operations activities at CounterPath. Donovan explained some of the factors that drive growth in the communications space, as well as how ongoing change plays out in the relationship between developers, service providers, and end users.

      RT: Your company has gone through a period of growth. To what do you credit that progress?

      DJ: We’ve had five quarters of consecutive 20% growth, so we are pretty excited, and I think there are four real factors driving that growth. There’s the strength of our engineering team; we really have some of the most capable guys in the industry, and when you have a core set of people like we do, they can really punch above their weight. We’re able to do a lot of things that we wouldn’t necessarily do with other teams.

      We also have a high quality product, which has been in the market since 2003 — the founders focused on SIP very early. Many people face challenges six months to a year after launching a product, because it gets laden down with bugs, but through a lot of comprehensive testing, we have beaten the bugs out of our product pretty well. Our product also has been downloaded more than two million times, so it’s got a following, a recognized brand. When you look at SIP, it allows you to interoperate with the large infrastructure providers, like Alcatel (News - Alert) , Siemens, Lucent, Nortel, Cisco.

      Change in the market has also been a factor. Everybody talked about IP taking off from a telco perspective and from the consumer perspective a few years ago — we’re seeing it now and we are positioned very well to take advantage of the growth. There are all kinds of statistics, but a 50% year over year increase in broadband households in the U.S. shows how adoption is being driven from the consumer level.

      The fourth factor is probably our strategy. Five quarters ago, we said we were going to focus on service providers, cable companies, OEMs, and large ITSPs, and we were going to build around our core engineering team and our core products. We were going to build capabilities to deliver to those segments, with our customer engineering team, our sales team, and our support team all serving them — and we’ve had pretty good success.

      RT: You’ve recently had some major customer wins. Can you talk about them briefly?

      DJ: Tying into our strategy of focusing on large service providers, cable companies, and OEMs, I’ll mention three. British Telecom is one of the world’s most recognized brands and certainly one of the leading brands in Europe; we launched product with them in late June. They’ve got a softphone, called BT Softphone, and it’s our technology powering it. This is the start of something really significant with BT, which is in the middle of a complete network and architecture refresh, a project called 21CN, and I think they are spending around $18 billion on network infrastructure, maybe more.

      At the end of July, coinciding with our 10k filing, we disclosed Cisco as a customer. Our software development kit is being used in a number of their offerings, including the Unified Communicator product. We are very excited about that relationship. Then, in September, we helped AT&T bring its softphone, part of the Call Vantage service line, to market, adding another globally recognized brand.

      These new relationships are truly a testament to our engineering team, which was able to give each of these companies a carrier-grade product that really fits with what they’re looking to do in the market.

      RT: How does your relationship with Intrado (News - Alert) benefit your customers and fit into your business plan?

      DJ: Intrado is really pioneering E-911 solutions, and is at the heart of recent FCC (News - Alert) requirements for carriers. Given our strategic focus on helping these large carriers get the right kind of SIP-based products and solutions in the hands of their customers, it’s a natural fit. It allows our customers to get a solution out quickly — and the Intrado solution works.

      In terms of our business model, we see ourselves focused on delivering carrier-grade SIP applications to carriers. These need to go through substantial interoperability testing, and they need to meet all of the high-level feature requirements as well as basic core requirements, like 911. When you think about what the technology does, it enables our softphone to integrate directly with Intrado’s systems to automatically know when a 911 call is made. That 911 call can be directed to the appropriate PSAP and emergency operators can link the caller’s location with the number, which is very important when you start talking about the mobility offered by a cell phone or by a SIP-based application. You need to be able to really track these people down when they’re making 911 calls.

      RT: How has the growing demand for mobility and wireless IP services affected Counterpath?

      DJ: This is driving a lot of the interest in this space and a lot of what you hear around fixed/mobile convergence, a lot of what is being touted by the new IMS providers. We’ve had a product, the Pocket PC, in the market for some time. We’re really focusing on tightening up our desktop offer around Windows, Mac, and Linux. We’re focused on the next step, which is an embedded solution.

      Windows Mobile 5 is certainly at the forefront there. We’ve got several partnerships with FMC-focused companies on delivering kind of a converged user experience across an application running on the desktop and an application running on a mobile device. So if you think about Windows Mobile 5 and then Windows XP and you blend the experience, so that wherever you are, you get to have all of your contacts, you get to have all of the way you’ve set up your experience independent of devices. We’re very much focused on pushing our application onto mobile devices.

      RT: IPTV (News - Alert) is at the forefront of many service providers minds. How does that fit into your product set?

      DJ: This is actually an interesting question. We actually recently demoed an IPTV solution running in our application. We see IPTV as a natural extension of the real power of a SIP-based application streaming content to a panel or a flat screen or a monitor running off of a very high powered server. So this, for us, is certainly an interesting opportunity.

      From the market perspective, I think we are not quite there. I think that the kind of server that you’d need in your house in order to really deliver the high-quality content isn’t quite there. That set-top box is a little further ahead, but, in terms of IPTV, it’s absolutely on the roadmap. Our carrier customers are looking at ways of working with their customers set to stave off, if you will, the cable companies who are coming at them from the voice services side. They want to come at them from the streaming content side, and that is very interesting for us and you will see more in the coming months and quarters.

      RT: What can we expect from CounterPath in the coming months?

      DJ: You’re going to see continued execution of our plan. We’ve, for five quarters, been locked on this plan, which is to build solutions and support capabilities around our core product and focus them on large carriers and OEMs. This is going to continue to roll out. On the product side, you’re going to see Frontier, which is a code name for a new version of our user interface. That will be very interesting.

      Frontier has a contact-based look and feel. EyeBeam, the product that’s out there now is a dial-pad centric user interface. We’re going to have a contact-centric user interface and we think that it will create a lot more flexibility, in terms of creating different integration with, say, CRM packages or streaming content like IPTV through the user interface. We don’t have the same challenges that we had with eyeBeam, where the dial-pad is kind of static and everything happens on the wings. This you can collapse, you can expand, you can create, you can take it down to just a toolbar, you can actually, from the user side, use the software however you like. It can be your entire desktop, it can be just in your toolbar, and you can still have all of the great user experience for making calls. We are pretty excited about that.

      You are going to see mobile and embedded approaches for us as we move with some of our partners and all of our product and solution lines into the embedded mobile space. We’ve already got a great Mac story. You’ll see more of this with Frontier. We are working with a number of our partners on really implementing this. It’s been nice to have, and now we’re really pushing it and our partners and customers are quite receptive to our approach.

      RT: How do you envision the IP communications world evolving in the next five years?

      DJ: That is a combination of I and we — we being the company and I being me. I think it’s going to be more about the consumer, the end user. Traditionally, you’ve seen this IP space evolve such that the providers have tried to replicate a TDM or legacy experience using VoIP. They’ve, in fact, taken what I think is a far superior technology in all kinds of different facets, and dumbed it down, almost making it appear cheaper, completely changing the value proposition. What I actually think they are missing is it actually is about the experience. When you create the richness of an application and then you start to use it, it becomes very interesting for how things are going to evolve.

      The other thing that’s important here is once users become more receptive to applications, it will open up the way people communicate. You’ll get to select exactly how you prefer to communicate. You won’t be forced to use or a particular handset or a particular desktop unit, and so forth. Rather, you’ll be able to use whatever device you like. You can have one presence-enabled, and then you can do what some people are talking about, which is to go from your LAN at home to an EV-DO network while you’re in transit to your high-speed LAN at work, all on one device.

      You’ll be able to use applications to do file transfer, file sharing, you’ll be able to integrate with your CRM package like our product does now where you’ll be able to make calls from within the CRM package as well as integrate it with what you’re doing. You’ll be able to do multiple IMs, multiple chats, video conferences at the same time, put them up on a plasma screen, have presentations. It’s really going to be about the flexibility that’s afforded by the technology and then by what the user really wants.

      I think the users are going to have more and more control in determining how an infrastructure company, like Cisco, builds. From the service provider perspective, there’s going to be a real initial influx of different kinds of service, from Google (News - Alert) offering Google-Talk, to someone like AT&T offering IM and streaming content, and many others, all going after the same set of users. It’s going to be quite interesting.

      Initially it will be a proliferation and then we probably will start to see some consolidation, but it will be centered around what people want. The companies that are going to be successful are really going to need to understand the needs of consumers and the needs of businesses and really deliver tight value proposition around those needs, because the access to information and the access to choice is really going to be more and more in the hands of consumers, particularly when you start to think about the way IP is rolling out.

      Nachdem Anaconda Gold nach Wiederaufnahme des Handels mit 0,44 Euro gestartet war, fiel die Aktie bis gestern auf 0,26 Euro. Anscheinend sind viele Anleger nach der langen Handelsaussetzung verunsichert und denken sich: „Lieber vorsichtshalber mal verkaufen, wenn die Aktie so lange ausgesetzt war.“ Dies eröffnet für längerfristig orientierte Anleger, die auf die fundamentalen Rahmendaten der Fusion mit Colorado achten, schöne Abstaubermöglichkeiten.

      Ein Bericht aus Rohstoffraketen vom 31.05.2006
      Am Kursverlauf von Anaconda Gold kann man gut die Psychologie der Investoren bei Explorationsaktien nachvollziehen. Als Anaconda Gold noch vor wenigen Monaten ein kleiner Explorer war, befand sich die Aktie in einem stabilen Aufwärtstrend. Die Aktie stieg nach unseren Erstempfehlungen von unter 0,20 Euro bis auf 0,60 Euro in der Spitze.
      Noch am zweiten Februar zeichneten kanadische Fonds ein Private Placement über 2 Millionen Aktien zu 0,65 CAD
      (ca. 0,45 Euro), welches 1,6 Millionen CAD in die Kasse spülte. Damit soll der Weg in Produktion des Damoti Lake-
      Goldprojektes weiter finanziert werden. Aus dem 3.258 Hektar großen Gebiet, welches zu Doublestar Resources
      (Kanada Kürzel an der TSX: DSR) gehört, erhält Anaconda 55 %, da man 2,5 Millionen CAD über vier Jahre dort verbohrte. Die festgestellten Ressourcen liegen im Measured & Indicates—Bereich bei 34.200 Unzen und in der Kategorie Inferred bei weiteren 9.400 Unzen Gold. Der Durchschnittsgehalt liegt bei sehr guten 26,2 Gramm Gold je Tonne Erz in der Kategorie Measured & Indicated. Der vorläufige Plan für die Produktion sieht bei einem Goldpreis von 400 USD einen Cash Flow von 9,65 Millionen USD vor (siehe auch Homepage unter www.anacondagold.com). Interessant: Bei einem Goldpreis von 500 USD würde der Cash Flow schon bei 16,2 Mio. USD liegen. Eine entsprechende Hebelwirkung dürfte auftreten, wenn der Preis noch weiter steigt. Die Kosten für die Produktion werden mit 260 USD je Unze veranschlagt. Mit 39 Millionen ausstehenden Aktien ist Anaconda aktuell mit 11 Millionen Euro an der Börse bewertet. Für mehr als 40.000 Unzen, die Anaconda ab drittem Quartal beginnen wird, aus dem Boden zu holen, ist die Aktie damit nicht überbewertet. Insbesondere, wenn man berücksichtigt, dass wohl auf dem Gebiet weitere Vorkommen liegen dürften, die aber nicht mit Explorationsmethoden „offiziell“ bestätigt sind. Anaconda ist von der Entwicklung weiter als die meisten Explorer.


      Geht man von einem Goldkurs von 640 US-Dollar aus, so entspricht der Umsatz bereits 19 Mio. US-Dollar!


      Empfehlung aus dem Pennystockreport vom 07.06.2006:
      Die Analysten empfehlen erneut die Anaconda Gold Corp. (WKN: A0B9BQ / ISIN: CA03240N1033), einen in Kanada tätigen Goldexplorer.

      Aktuell verfügt Anaconda Cold Corp. über ein diversifiziertes Portfolio.
      Das auch unter Bezeichnung "Horse Mountain Properties" geführte Explorationsvorhaben Carlin Project ist von immensem Potential für einen lukrativen Goldabbau.. Anaconda hat eine Option die Anteile zu 100% zu erweben. Dabei ist festzuhalten, dass für das gesamte Carlin Project eine sehr günstige geologische und stark Geochemische Anomalie vorliegt, die sehr prägnante Ähnlichkeiten mit den Goldabbaugebieten des Nevada Talbecken aufweisen. Bei einem geochemischen Analyseverfahren wurden viel versprechende Probewerte mit Spuren von Gold, Quecksilber und Antimon gefunden. Insgesamt wird in Goldanteil von 1,2 G pro Tonne geschätzt.

      In den Jahren 2004 und 2005 wurden beim Pine Cove Gold Project zahlreiche Untersuchungen durchgeführt, die über immense Goldvorkommen berichteten. Anaconda traf daraufhin die Entscheidung zum Jahresende 2006 mit der Goldexploration zu beginnen. Die sensationellen Prognosen gehen von einem Vorkommen von 207.000 Oz Gold aus. Des Weiteren, werden innerhalb des Pine Cove Gebietes 66.700 Tonne Gestein mit einem Anteil von 2,43 Gramm pro Tonne angenommen. Die Explorationskosten betragen dabei lediglich 290 USD pro Tonne im ersten Jahr.

      Fazit:
      Die Anaconda Gold Corp. (WKN: A0B9BQ / ISIN: CA03240N1033) wird sich mit zwei Projekten dieses Jahr zum Goldproduzenten entwickeln! Zusätzliche Erschließungen sind kurzfristig zu erwarten. Das absehbare Volumen ist schon heute als gigantisch anzusehen und kann für eine sehr profitable Zukunft sorgen. In der Annahme, dass kommende Vorhaben wie erwartet verlaufen, ist mit einem deutlich ansteigenden Aktienkurs zu rechnen. Das Kursziel sehen die Analysten des Pennystockreports aktuell bei 0,70 Euro.

      ich bin hier nicht drinnen, verfolge aber alles.
      Hat diese Firma nicht einen Vertrag mit der Telekom Österreich abgeschlossen? Dann dürfte sie sehr gute Aussichten haben.
      Die Telekom steht finanziell sehr gut da und ich könnte mir vorstellen, daß sie in Osteuropa zukauft.Und da könnten sie dann auch mitgehen.
      Als 2. Standbein zur Pension bekommt der Anleger Prozente vom Staat, der Fonds oder Versicherung müssen aber, ich glaube es sind 40 %, in inländische AGs anlegen. Das stärkt die Wirtschaft.
      Warum ist diese AG aber so weit runtergekommen?

      ja mit A1 super deal gutes produkt. ist aber noch in der pilot phase. telekom wird bzw ist im osten in bulgarien usw gut vertreten und hat soweit ich weiss in slowenien zugekauft.

      die aktie bzw VOIP aktien waren die letzten monate nicht gerade der renner. siehe Vonage, YAK, 8x8, aber jetzt starten sie wieder. 8x8 hätte man schon ca 250% machen können.

      bei CTPS war bei 60cent eine massive short attacke und der glaube an die bude sank extrem. wenn aber die zahlen und deals anschaust (BT,AT,DT, cisco, 8x8 usw) dann sollte sie meiner Ansicht bei 1,50- 2,50 dollar stehen.

      2005 Q4 1,467 mill revenues.... Accounts receivable 477,814

      2006 Q1 1,766 mill revenues.... Accounts receivable 1,664,858


      zähle ich nun die 1,766 plus 25% die wir sicher steigerung haben dazu bin ich bei 2,21 mille. dazu muss man jetzt aber noch die ungewöhnlich hohen accounts dazurechen nehme da 1,2mille die über normal sind.

      2,21 + 1,2mill = 3.41mille ich denke wir sehen gut 3,5mille diese Quartal und ein nulldefizit.

      IPTV Take-up in Mainland China Will Exceed 23 Million Subscribers by 2012
      January 18, 2007 - Technological innovations are rapidly redrawing the Chinese telco landscape and operators are compelled to diversify in order to thrive in the competitive environment, says ABI Research.

      The November 2006 announcement of Jiangsu Telecom's network expansion effort to meet subscribers' demand for IPTV, VOD, and other advanced IP services was just the latest in a similar series of moves to support multi-play service offerings.

      According to ABI Research's broadband research analyst Serene Fong, "More operators than ever are offering multiple services in an attempt to retain customers and to increase revenue. Telecom operators are venturing into the TV industry, while cable operators move into the voice business."

      IPTV is the Chinese government's platform of choice because it is aligned to its long-term plan of unifying broadband, Internet, and television. Hence the future of the industry continues to be viewed optimistically. More resources will also be allocated to making IPTV a success because it is to play an important role in multimedia communications and upcoming major events in China.

      According to Fong, "The growth of IPTV will remain modest for now, and take off only after 2008. Adoption will be boosted by major events such as the Beijing Olympics in 2008, and then the 2010 World Expo in Shanghai."

      At the same time, China's flourishing broadband environment paves the way for IPTV to reach out to the potentially huge addressable market. In a new study, ABI Research forecasts the IPTV take-up in mainland China to pass the 23 million subscriber mark by 2012.

      For now, however, IPTV has to cope with certain bottlenecks that have been restricting growth. "While the IPTV service is regarded by the industry as a potential revenue generator, lack of content may prove a short-term barrier to increasing uptake rapidly," says Fong. "Current program content, which is strictly controlled by media authorities and the government, is not rich enough to attract paying users, and overseas content, which is restricted and difficult to get approval for, does not help alleviate the situation."

      ich glaub aber die meinsten investoren stehen lieber auf hardware. die werden sich noch wundern denk ich wenn sie teuer kaufen müssen. telekom austria übernimmt den service fix im frühling. dazu kommen ja in etwa 10millionen potenzielle kunden. natürlich auf längere sicht, weil in bulgarien und rumänien usw. erst noch breitband internet standard werden muss.

      So, so, da schreibt das weltbekannte Mirtschaftsmagazin Forbes davon, dass die Deutsche Bank, UBS, Goldman Sachs, Credit Suisse, Bank of Amerika, Bear Stearns, Bank of New York, Merrill Lynch, und die Citigroup angeklagt wurden, weil sie allesamt in "Nakte Shortverkäufe von Aktien" verwickelt sein sollen. Also auf gut deutsch gesagt, es wird diesen Banken vorgeworfen Aktien verkauft, oder ausgeliehen zu haben, die sie in Wirklichkeit gar nicht besitzen, oder besassen. Es sollen sogar mehr Aktien short verkauft worden sein als im Falle von Overstock.com überhaupt existierten

      3.5 Milliarden US Dollar will der betroffenen Kläger von diesen 10 Banken als Entschädigung haben!

      Ich wünsche Patick Byrne viel erfolg in seinem Kampf ums Recht gegen nakt shortende Banken, und das möglichst schnell neue Gesetze geschaffen, und in Kraft treten werden, dass solche in ihrer Wirkung betrügerische nakte shortverkäufe, oder auch nakte, fraktionelle Ausleihungen von Aktien zukünftig verunmöglicht werden.

      Naked Short Victim Strikes Back

      Overstock.com filed a $3.5 billion lawsuit in California state court Friday accusing 10 of the largest U.S. securities firms of participating in a "massive, illegal stock market manipulation scheme" to distort its stock.

      The Salt Lake City online retailer, whose Chief Executive Patrick Byrne has been crusading against stock market trading abuses not just in Overstock shares but as a broad, pervasive market problem, said the banks\\' actions caused "dramatic distortions" in how Overstock (nasdaq: OSTK - news - people ) shares were traded and lead to a dramatic decline in its price.

      Overstock shares are down 77% in the past two years.

      "These manipulative activities have caused tremendous damage to Overstock," Byrne said in a statement Friday. "I believe that this conduct is harming our company and our shareholders deeply."

      Overstock\\'s lawsuit says the amount of stock that was improperly shorted has exceeded the company\\'s entire supply of outstanding shares. "It\\'s about rigging the system," says Overstock\\'s attorney, James Christian.

      Overstock\\'s suit names Morgan Stanley(nyse: MS - news - people ), Goldman Sachs(nyse: GS - news - people ), Bear Stearns(nyse: BSC - news - people ), Bank of America(nyse: BAC - news - people ), Bank of New York (nyse: BK - news - people ), Citigroup (nyse: C - news - people ), Credit Suisse(nyse: CS - news - people ), Deutsche Bank(nyse: DB - news - people ), Merrill Lynch(nyse: MER - news - people ), and UBS (nyse: UBS - news - people ) as defendants. None of the defendants had any immediate comment on the suit.

      Byrne\\'s self-described crusade against trading abuses over the last two years has brought a heap of criticism down on him, but regulators have acknowledged that there are loopholes that make the system ripe for abuse.

      Going after the so-called prime brokers, the securities firms that provide stock lending and financing services to hedge funds, is another way to tackle the problem of naked short-selling, a manipulative trading tactic that can drive down share prices artificially and threaten the viability of small publicly traded companies.

      Prime brokerage is one of the hottest businesses on Wall Street but little understood outside the world of finance. It essentially is the business of catering to hedge funds, acting as their trading counterparties, financing those trades, and loaning stock and other securities for funds to execute short-selling strategies.

      According to Vodia Group, a New York firm that analyzes securities lending portfolios for traders at hedge funds and other asset managers, securities lending rakes in between $8 billion and $10 billion in annual revenues for Wall Street.

      In regular short-selling, a trader borrows stock, sells it, and waits (or prays) for the price to drop before buying shares back to repay that loan and pocket the difference. There are rules for assuring that the shares have been properly borrowed, and everyone is supposed to abide them.

      In naked short-selling, the trader sells the shares without properly borrowing the stock. When the stock isn\\'t properly borrowed, the buyer at the other end of that short-sale doesn\\'t get delivery of the shares within the mandated three-day window. The buyer also loses out on voting rights and tax-advantages until the short-seller closes out the position.

      Now, fast working market makers are allowed to sell without borrowing to keep orderly markets. But naked short-selling as a strategy in and of itself is illegal. It is, however, highly tempting for both prime broker and hedge fund trader.

      From the prime broker\\'s perspective, fees can be made by lending out the same sought-after shares to multiple traders at the same time. So prime broker A has 100 shares of Company A and lends 100 shares to trader X, 100 shares to trader Y and 100 shares to trader Z. Obviously 200 of those loaned-out shares don\\'t actually exist, and will result in a trade delivery failure.

      From the trader\\'s perspective, a naked short can be less costly, since they have to pay more to borrow hard-to-borrow shares that are usually the choice targets of short-sellers anyway.

      Having all those excess shares in the market artificially reduces the price of a stock, Overstock contends in its lawsuit. Overstock has been a regular on a list of Nasdaq-listed stocks that have large and persistent failures-to-deliver since that list started being published in January 2005.

      It\\'s tough to say who is more at fault in naked short-selling, the hedge fund executing the short strategy without properly borrowing the shares, or the prime broker for either assisting or turning a blind eye to the practice.

      In two suits filed last year in New York federal court, a small hedge fund and a small brokerage accused the same 10 banks named in Friday\\'s Overstock suit of charging them for services they never received. In other words, the prime brokers supposedly took their fees for stock lending services, but never properly lent them shares for their legitimate shorting strategies, unbeknownst to them.

      Last summer, 40 investors in the Kansas City real estate investment trust Novastar Financial (nyse: NFI - news - people ) filed suit in California court against the same prime brokers, saying they were responsible for artificially suppressing Novastar stock by skirting stock lending and clearing and settlement rules.

      Byrne has spent the last two years pushing legislators, regulators, and anyone else who will listen to reform the system. The Securities and Exchange Commission is combing through comment letters on proposed amendments to short-selling rules that could close some loopholes, but efforts in state legislatures to clamp down on brokerages have largely failed.

      Last year, sympathetic lawmakers in Overstock\\'s home state of Utah shoveled a bill through the state legislature and got it signed into law after a special session in May. The new law would have forced brokerages to report trade delivery failures in shares of Utah companies to the state\\'s securities director within 24-hours, or face paying a sort of fine to those issuers.

      But the Securities Industry and Financial Markets Association, Wall Street\\'s trade group in Washington, threatened a lawsuit in federal court and got the governor of Utah to capitulate on enforcing the law until June, supposedly to give the SEC time to reform the rules on a national level.

      Several other bills in legislatures across the country have been stalled in the last few weeks by a similar threat of litigation by the industry group.

      After thinking about this all day, I'm leaning to the theory of "a rising tide raises all ships." Let's face it, the revenue isn't where we'd like it, and the same is true for every company in this sector. Everyone is losing money right now. We're in a transition from the old way of communicating to the new way. I think it's finally damned on people that, for better or for worse, this is the sector in which to be because it's the hottest growth sector out there, bar none. Yes, even healthcare.

      I think I mentioned this once before (but you may want to scan my prior posts to verify...chuckle)I've seen stocks that were absolutely worthless with a snowball's chance in a campfire of ever being profitable, go from sub-dollar to over $20 just on herd mentality. Many that were even outright scams. Now none of them were able to sustain the PPS and eventually dropped like a rock, but let's face it, that's why they have things like trailing stops.

      CounterPath, of a certainty, isn't a scam. It's the real deal. The jury is still out on whether or not it will ever be profitable, but whether it is or isn't, if it ever hits $20, you can be absolutely certain of this: that I'll to be holding one heck of a lot less shares on the way back down than I held on the way up.

      Who knows? This may be the summer of VoIP. All of the analysts think so, and I think the reward to risk ratio at this stage makes holding as many shares of CTPS as you can stand makes a whole lot of sense.

      Debo, as you may know if you have been reading posts here Webe is either on his meds or off. One minute he claims "it's gonna be a monsta" and the next minute he's selling off.

      I'm still constructive. We still have connections with great customers and our product continues to improve. It does not look like the engineering people have let us down. I'm encouraged.

      Concerning the recent development of Jajah and Intel. I think CTPS chose the right path in lining up big providers, and their modifiable product for customers is a good strategy. Give the lady what she wants.

      I think management missed a chance when earnings were still good to publicize the stock and get the stock going. It would aid in the fight against dilution, make getting more money easier, and engender more confidence in the company.

      Also, I don't know why we haven't logged any cable companies, but that's where the growth is at the moment.

      But you are going to needs nerves of steel, the next earnings report may be nothing to write home about. Huawei revenue was probably logged already.

      I bought this company for the video telephony thing, and that has not even taken off yet.

      I think you're seeing the glass half empty again. I think it was the 70s when Levis were selling overseas for $40-$50. They were still $12.99 or so in America. Gas wars brought our gas from .37 to .24 while it sold in Europe at the same time for ten times that. And...who is our biggest customer now??? BT, of course. Do you use a softphone? I don't either. But, guess where they are using the Counterpath softphone as I type. On many college campuses across America. I happen to know that they are using Counterpath extensively on the Michigan State campus and are holding mini training seminars regularly to learn what to do with it. Those college kids are the future business people who will come out of college understanding the importance of using VOIP. America might be the land of opportunity, but we are slow as molasses. Things will get stronger from here.

      Our old friend Todd Hanas
      was in the room when the interview occurred which was printed in the previous post. Todd's notes follow:

      Sir Terence Matthews has to be seen and heard to be believed. He is a passionate entrepreneur, a "rock star" investor with an incredible track record. He took Mitel from a $3 stock to over $660. He is Chairman of the board of only two other companies (Mitel and March Networks) besides CounterPath, so you can tell he is serious about the new CounterPath or he wouldn't have his name at the top of the management team list.

      He intends to get CounterPath off the OTC market as soon as possible, with a move to the Toronto exchange likely.

      Greg Pelling and Sir Terry are taking their show on the investment group road. They have already scheduled meetings with numerous investment analysts to tell their story.

      They are also already working the marketing aspect hard, and Nokia is one of their latest customers (not yet announced). In addition, they are very interested in working the Asian markets, especially China and Pakistan.

      In conclusion, "this stock is going to move" and "could easily be a 6-8 bagger."

      So now we know what is driving the buying today.

      A call from Hanas...

      Well everyone...it has been a while since I posted on here, but I must post today.

      I got a call from Mr. Todd Hanas today and he went on and on about the meeting that TN wrote about. He talked over and over about Terry Mathews and Greg Pelling and about how they are stronger than ever...the timing, according to Mathews is "now."

      Yes, the price is approaching higher places today and maybe that meeting sparked some buying...Hanas stressed that $9 million in the bank, others going out of business, but CounterPath is still growing in revenue...

      Well, let's get the comments going. I am not quite ready to jump all the way back in. I have a couple toes in, but not my whole foot. I sure hope things go north!
