deshalb mein Kursziel fuer 12/2009 can $ 9.20.

      Menschen an MS.

Endpunkt erreicht. Cladribin-Tabletten seien die erste orale Behandlungsform für
Multiple Sklerose, die eine zweijährige Zulassungsstudie durchlaufen
      hätten./ep/wiz

      Dear Mr. Reindl,

Thank you for your email and your continued interest in BioMS Medical.

The article you refer to discusses the Phase III results of Cladribine, which is a therapy for the treatment of patients with Relapsing Remitting Multiple Sclerosis.

BioMS Medical's therapy, dirucotide, is in Phase III trials for patients with Secondary Progressive Multiple Sclerosis (SPMS), for which there is currently no treatment, and it is currently the only novel agent for SPMS in Phase III clinical trials.

I hope this answers your question. Please do not hesitate to contact me if you have any additional questions.

BioMS Medical reports results of exploratory phase II trial of dirucotide in relapsing remitting multiple sclerosis
Friday January 30, 7:00 am ET

      Toronto Stock Exchange Symbol: MS
EDMONTON, Jan. 30 /CNW/ - BioMS Medical Corp. (TSX: MS - News), a leading developer in the treatment of multiple sclerosis (MS), today announced results from MINDSET-01, an exploratory phase II clinical trial evaluating dirucotide in patients with relapsing-remitting MS. The lead clinical development program for dirucotide is for secondary progressive MS where it is being evaluated in two ongoing phase III trials in the United States, Canada and Europe, with results from the Canadian and European MAESTRO-01 trial expected in the second half of 2009.

The results of the MINDSET-01 study showed that dirucotide did not meet its primary endpoint, annualized relapse rate or associated secondary MRI endpoints. Dirucotide did meet certain secondary endpoints related to the progression of the disease, including mean change from baseline in the Expanded Disability Status Scale (EDSS) and the Multiple Sclerosis Functional Composite (MSFC) score. The EDSS is a method of quantifying disability in MS, while the MSFC evaluates additional functional parameters. Measuring changes in EDSS and MSFC are primary and secondary outcomes in the ongoing phase III secondary progressive MS trials.

The data also showed that dirucotide was generally well tolerated. The most common side effects reported were redness and burning sensation at the injection site. No patients withdrew due to adverse events.

BioMS and its partner Eli Lilly & Company (Lilly) will continue to analyze the results of this exploratory phase II trial. Under the terms of the licensing agreement with Lilly, no milestone payment was associated with this trial.

"We are encouraged that dirucotide has demonstrated an effect on certain clinical measures of disease progression, this time in the earlier form of the disease," said Kevin Giese, President and CEO of BioMS Medical. "Dirucotide was developed as a potential treatment for patients with progressive MS and we believe that these results are consistent with the nature of the therapy, and what is understood about dirucotide's method of action."

      About MINDSET-01 Study
      ----------------------

The MINDSET-01 study was a fifteen month, phase II, double-blind, placebo-controlled trial designed to evaluate the efficacy and safety of dirucotide in patients with relapsing-remitting MS. The trial enrolled 218 patients at 24 sites in 6 European countries, with eligible patients randomized on a equal 1:1 basis to receive a total of three single intravenous doses of either drug or placebo at 0, 3 and 9 months. The study enrolled patients into two sub-groups: 154 patients testing positive for the HLA-DR2 and/or HLA-DR4 immune response gene; and 64 patients testing negative for the HLA-DR2 and HLA-DR4 gene. The study was designed to additionally have a 12 month active treatment open label extension period which will provide further safety and efficacy data.

Jan 30 (Reuters) - Canada's BioMS Medical Corp (MS.TO) said its lead drug for the treatment of multiple sclerosis failed to meet the main goal of a mid-stage study.

The drug dirucotide, which was being tested in patients with relapsing-remitting multiple sclerosis, was, however, well tolerated and met certain secondary endpoints related to the progression of the disease.:D

Multiple sclerosis, a condition where the immune system of the body attacks the protective cover of the nerves, is one of the leading causes of neurological disability in young adults.

BioMS, which signed a licensing and development deal with Eli Lilly (LLY.N) in 2007 for dirucotide, said it will continue to analyze the results of the mid-stage trial.

Dirucotide is also being studied in two late-stage trials -- in the United States and across Europe and Canada -- as a treatment for secondary progressive multiple sclerosis (SPMS).

The drug had received fast-track status from U.S. health regulators for the SPMS indication last September, a designation that is reserved for products intended to treat serious or life-threatening conditions with the potential to address unmet medical needs.

Shares of the Canadian biotechnology company closed at C$3.43 Thursday on the Toronto Stock Exchange. (Reporting by Vidya L Nathan in Bangalore; Editing by Himani Sarkar)

ca 50% aller Erkrankungen gehen in SPMS ueber.

TORONTO, Jan 30 (Reuters) - BioMS Medical Corp (MS.TO) (MS.TO) said its lead drug for the treatment of multiple sclerosis failed to meet its main goal in a mid-stage study, sending the company's shares down more than 50 percent.

The small biotech said the results of the study showed the drug dirucotide did not meet the primary endpoint, in terms of annualized relapse rate, and its associated secondary MRI endpoints.

"We have long believed that the outcome of this study would be very uncertain, given that this trial was statistically underpowered and that the compound was not previously tested on humans for this indication," Maher Yaghi, an analyst at Desjardins Securities in Montreal, said in a research note.

Yaghi downgraded BioMS stock to "hold" from "buy" earlier this week in anticipation of the test results. However, he maintained his price target of C$5.75 a share.

The shares were down 38.8 percent at C$2.10 by late morning, after touching a low of C$1.51 earlier in the day.

The drug, which was being tested in patients with relapsing-remitting multiple sclerosis (RRMS), was, however, well tolerated and met certain secondary endpoints related to the progression of the disease, BioMS said.

"The results are more positive than negative," said Douglas Loe, an analyst at Versant Partners. "The aspects by which the drug did perform well in this trial are those that which are germane to performance in its pivotal secondary progressive MS trial, which is a separate clinical program."

Loe said that program is seen as key to partner Eli Lilly (LLY.N), which signed a licensing and development deal with BioMS in 2007.

Multiple sclerosis, a condition in which the body's immune system attacks the protective cover of the nerves, is one of the leading causes of neurological disability in young adults.

BioMS said it will continue to analyze the results of the mid-stage trial.

Dirucotide is also being studied in two late-stage trials -- in the United States and across Europe and Canada -- as a treatment for secondary progressive multiple sclerosis (SPMS).

This, Yaghi said, is where the company might find more success.

"The firm may benefit from the drug's potential in SPMS, given that the Phase III studies in this indication are more powered to detect significance (vs the RRMS study) and, in our view, have higher odds of success."

The drug had received fast-track status from U.S. health regulators for the SPMS indication last September, a designation that is reserved for products intended to treat serious or life-threatening conditions with the potential to address unmet medical needs.

BioMS President and Chief Executive Kevin Giese shrugged off the stock performance on Friday. Continued...

BioMS Medical Announces 2008 Year End Results
Tuesday March 17, 8:00 am ET

      Toronto Stock Exchange Symbol: MS
EDMONTON, March 17 /CNW/ - BioMS Medical Corp. (TSX: MS - News), a leading developer in the treatment of multiple sclerosis (MS), today announced financial and operational results for the year ended December 31, 2008.
"Dirucotide has demonstrated the ability to safely affect MS progression in previous studies and we look forward to the results of the Canadian/European trial (MAESTRO-01) in the second half of this year," said Kevin Giese, President and CEO of BioMS Medical. "Our hope is that the results of this trial will confirm that dirucotide is able to significantly slow the progression of MS, specifically in patients with secondary progressive multiple sclerosis."

Currently, BioMS is conducting two clinical trials and one open-label follow-on trial of dirucotide for the treatment of secondary progressive MS (SPMS):

      - MAESTRO-01: On January 22, 2007, BioMS announced that this pivotal
phase III trial, being conducted in Canada and Western Europe, had
completed full recruitment of 611 SPMS patients at 47 trial sites
in ten countries. To date, there have been nine positive safety
reviews from the Data Safety Monitoring Board (DSMB). The primary
clinical endpoint for MAESTRO-01 (and MAESTRO-03) is defined as a
statistically and clinically significant increase in the time to
progression of the disease as measured by the Expanded Disability
Status Scale (EDSS), in patients with HLA-DR2 and/or HLA-DR4
      immune response genes.

On August 13, 2008, the DSMB conducted a scheduled interim
analysis of efficacy and safety and recommended that the trial
continue to completion. The interim analysis evaluated the first
200 patients to complete MAESTRO-01 and assessed the likelihood of
the study reaching its primary endpoint at the end of the trial.
Based on the DSMB decision, Eli Lilly and Company (Lilly) provided
a US $10 million milestone payment to BioMS as part of the terms
of the licensing and collaboration agreement.

BioMS anticipates MAESTRO-01 will be completed in 2009 with
results from the trial expected in the second half of this year.

      - MAESTRO-02: Eligible patients who have successfully completed
MAESTRO-01 may choose to receive dirucotide on an un-blinded basis
in this open-label follow-on study. To date, approximately 95% of
the eligible patients who have successfully completed the
MAESTRO-01 trial have enrolled in this follow-on study.

      - MAESTRO-03: Enrollment was initiated in June, 2007 and completed
on August 1, 2008 for this pivotal U.S. phase III trial of
approximately 510 SPMS patients at 67 sites across the U.S. To
date, the DSMB has conducted three reviews of the data from this
trial and recommended it continue. The next DSMB review is
expected to take place in the second quarter of fiscal 2009.

      - MINDSET-01: MINDSET-01 was a randomized, double-blind study that
recruited 218 relapsing-remitting MS patients at 24 trial sites in
six countries across Europe. BioMS recently announced that the top
line results of this exploratory study did not meet its primary
endpoint of effecting annualized relapse rate or associated
secondary magnetic resonance imaging (MRI) endpoints. Dirucotide
did meet certain secondary endpoints related to the progression of
the disease, including mean change from baseline in the EDSS and
the MS Functional Composite (MSFC) score. Changes in EDSS and MSFC
are primary and secondary outcomes in the ongoing phase III SPMS
      trials.

The data also showed that dirucotide was generally well tolerated.
The most common side effects reported were redness and burning
sensation at the injection site. No patients withdrew due to
      adverse events.

Eligible patients in this trial are now receiving dirucotide on an
un-blinded basis to the end of their 27th month in the trial.

Licensing and Development Agreement with Lilly
On December 17, 2007, BioMS entered into a licensing and development agreement (the "Agreement") granting Lilly exclusive worldwide rights to dirucotide. The transaction closed on January 25, 2008 and BioMS received an upfront payment of US $87 million. In September 2008, BioMS received a development milestone payment of US $10 million as a result of the positive interim analysis from the DSMB for MASESTRO-01. BioMS has the potential to receive future development and sales milestones up to US $400 million and escalating royalties on sales if dirucotide is commercialized.

Not later than sixty (60) days following receipt of the final written report of the results of the MAESTRO-01 trial, Lilly shall notify BioMS in writing whether Lilly will terminate the Agreement or alternatively Lilly shall bear 100% of any and all continuing development costs incurred by Lilly or BioMS for dirucotide.

      HYC750 and BioCyDex

On May 9, 2008, BioMS entered into a Royalty and Assignment Agreement with Orcrist Bio. Inc. for HYC750, a technology based on hyaluronic acid that has a number of potential therapeutic uses and is being developed as a treatment for the side effects of chemotherapy. BioMS held an exclusive worldwide license to HYC750 from the University of Alberta. As a result of the Royalty and Assignment Agreement, BioMS terminated its license with the University of Alberta and the University entered into a direct license with Orcrist. BioMS assigned all BioMS owned patents relating to HYC750 and transfered all HYC750 assets to Orcrist. Under the terms of the agreement, BioMS will receive certain milestone payments in addition to a royalty on net sales of products which otherwise would have infringed on patents related to the HYC750 technology.

BioMS also ceased all development activities with respect to BioCyDex. Future development or licensing activities will be the responsibility of BioCyDex.

      Financial Results

The consolidated net loss for the year ended December 31, 2008 was $0.5 million or ($0.01) per share compared with a consolidated net loss of $47.2 million or ($0.56) per share for the previous year. The consolidated net income for the three months ended December 31, 2008 was $0.3 million or $0.01 per share compared with a net loss of ($11.7) million or ($0.13) per share for the previous year.

Revenue of $52.6 million was recorded for the year ended December 31, 2008 compared to $Nil for the year ended December 31, 2007. The revenue is the result of the amortization of the upfront payment and development milestone received from the Agreement with Lilly. Investment income earned on funds invested for the year ended December 31, 2008 increased to $2.4 million from $1.6 million for 2007 due to the increase in cash and cash equivalents as a result of the Agreement with Lilly. The increase was partially offset by a general reduction in interest rates experienced in the market. The investment income is earned from the short-term investment of cash reserves in low risk term deposits and bankers acceptance notes.

Total consolidated expenses for the year ended December 31, 2008 were $61.9 million compared with $48.0 million for 2007. Total consolidated expenses for the three months ended December 31, 2008 totaled $16.5 million as compared to $12.1 million in the same quarter the previous year.

Research and development expenses for the year ended December 31, 2008 totaled $46.5 million compared with $38.9 million in 2007. Research and development expenses were $13.9 million for the three months ended December 31, 2008 compared to $9.3 million for the same quarter the previous year. The increase in expenses was the net result of: achieving full enrolment of clinical sites and patients in the MAESTRO-03 trial; increased costs for the MAESTRO-02 trial as patients enter the trial; reduced costs of the MAESTRO-01 and MINDSET-01 trials as more patients complete these trials; a decrease in drug manufacturing expenses as the manufacture of validation batches is completed; a licensing bonus payment related to the Agreement with Lilly, and; additional expenses related to alliance management and support.

At December 31, 2008, cash and cash equivalents and short-term investments totaled $90.4 million as compared to $37.9 million at December 31, 2007. At December 31, 2008, the Company had working capital of $81.3 million as compared to $32.8 million at December 31, 2007. Management estimates that the current working capital is sufficient for the Company to meet its obligations in respect of the currently initiated clinical trials.

As at December 31, 2008 there were 91,009,323 Class "A" common shares of the Company issued and outstanding.

      * Panel urges continuation of dirucotide trial

      * Shares rise as much as 12.6 percent

(Adds analyst comments, details; updates share price)

TORONTO, April 14 (Reuters) - BioMS shares jumped more than 12 percent on Tuesday after an independent safety drug board recommended the biotech company continue trials of its multiple sclerosis treatment.

The company said the U.S. Data Safety Monitoring Board completed a safety analysis of its phase 3 Maestro-03 trial of dirucotide, used for the treatment of secondary progressive MS, (SPMS) and ruled that the company should continue.

SPMS is characterized by a steady progression of clinical neurological damage, with or without superimposed relapses and minor remissions.

Dirucotide is being studied in two late-stage trials -- in the United States and across Europe and Canada -- as a treatment for SPMS. Key results are due later this year.

"We believe the Data Safety Monitoring Board's decision today to continue the trial bodes well for the safety of the drug, but in our view does not impact the potential efficacy results coming out, which we continue to believe to be risky, but if it works could be a major positive catalyst for the stock," said Maher Yaghi, an analyst at Desjardins Securities in Montreal.

Yaghi said positive results could propel the company's stock to as high as C$15 a share.

BioMS shares were up 8.3 percent at C$2.49 on the Toronto Stock Exchange on Tuesday morning, after rising 12.6 percent to C$2.59 earlier in the session.

The shares tumbled more than 50 percent in late January after studies showed the treatment failed to meet a main goal in a mid-stage study.

The study, when used by patients suffering from relapsing-remitting multiple sclerosis (RRMS) showed the drug did not prevent symptoms from coming back. People who took the drug were just as likely to have symptoms return after 15 months as patients who did not take it.

The drug, did, however, show signs of slowing down the progression of the crippling disease.

      Toronto Stock Exchange Symbol: MS
EDMONTON, April 21 /CNW/ - BioMS Medical Corp. (TSX: MS - News), a leading developer in the treatment of multiple sclerosis (MS), today announced that the independent Data Safety Monitoring Board (DSMB) for the Company's pivotal phase III MAESTRO-01 Canadian/European trial of dirucotide in patients with secondary progressive MS has completed a safety analysis and recommended that the trial continue as per the protocol.

This was the final:eek: scheduled review by the DSMB prior to the completion of MAESTRO-01. The purpose of the DSMB is to provide objective, independent safety monitoring of the trial. Results from MAESTRO-01 are expected in the second half of this year.

      About MAESTRO-01
      ----------------
MAESTRO-01 is a multi-center, double-blind, placebo-controlled trial designed to evaluate the safety and efficacy of dirucotide in patients with secondary progressive MS. The study is being conducted at 47 sites across Canada and nine countries in Europe and includes 611 patients being administered either dirucotide or placebo intravenously every six months for a period of two years. The primary clinical endpoint for the trial is defined as a statistically and clinically significant increase in the time to progression of the disease, as measured by the Expanded Disability Status Scale (EDSS), in patients with HLA-DR2 and/or HLA-DR4 immune response genes (up to 70% of all MS patients are HLA-DR2 and/or HLA-DR4 positive). Time to disease progression in patients with other HLA-DR types will be assessed separately as an exploratory arm of the same study.

BioMS Medical Announces First quarter 2009 results
On Monday May 11, 2009, 5:30 pm EDT
      Buzz up! Print
      Toronto Stock Exchange Symbol: MS
EDMONTON, May 11 /CNW/ - BioMS Medical Corp. (TSX: MS - News), a leading developer in the treatment of multiple sclerosis (MS), today announced financial and operational results for the first quarter, ended March 31, 2009.

"We remain on track to obtain the results from MAESTRO-01, the first of our two pivotal trials evaluating dirucotide in patients with secondary progressive multiple sclerosis, in the second half of 2009," said Kevin Giese, President and CEO of BioMS Medical. "We have demonstrated in previous trials that dirucotide has shown to be well tolerated and has the capacity to slow the progression of disease in certain genetically pre-disposed MS patients. If our pivotal trials confirm these results, we believe dirucotide could represent the first drug with blockbuster potential for the treatment of secondary progressive multiple sclerosis."

Currently, BioMS is conducting two pivotal clinical trials and one open-label follow-on trial of dirucotide for the treatment of secondary progressive MS (SPMS):

      - MAESTRO-01: On January 22, 2007, BioMS announced that this pivotal
phase III trial, being conducted in Canada and Western Europe, had
completed full recruitment of 611 SPMS patients at 47 trial sites in
ten countries. The primary clinical endpoint for MAESTRO-01 (and
MAESTRO-03) is defined as a statistically and clinically significant
increase in the time to progression of the disease as measured by the
Expanded Disability Status Scale (EDSS), in patients with HLA-DR2
      and/or HLA-DR4 immune response genes.

On April 21, 2009 the DSMB conducted a scheduled safety analysis and
recommended that the trial continue to completion. To date, there have
been ten positive safety reviews from the Data Safety Monitoring Board
(DSMB) and this was the final scheduled review by the DSMB prior to
the completion of the trial. BioMS anticipates results from the trial
will be reported in the second half of 2009.

      - MAESTRO-02: Eligible patients who have successfully completed MAESTRO-
01 may choose to receive dirucotide on an un-blinded basis in this
open-label follow-on study. To date, approximately 95% of the eligible
patients who have successfully completed the MAESTRO-01 trial have
      enrolled in this follow-on study.

      - MAESTRO-03: Enrollment was initiated in June 2007 and completed on
August 1, 2008 for this pivotal U.S. phase III trial of approximately
510 SPMS patients at 67 sites across the U.S. To date, the DSMB has
conducted four reviews of the data from this trial and recommended it
      continue.
      Financial Results

Revenue of $13.1 million was recorded for the three-months ended March 31, 2009 compared to $12.8 million for the three-months ended March 31, 2008. The revenue is the result of the amortization of the upfront payment and development milestone received from the licensing and development agreement with Lilly.

Total consolidated expenses for the first quarter ended March 31, 2009 were $14.8 million compared to $22.2 million for the first quarter of 2008. Research and development expenses for the first quarter of 2009 totaled $11.5 million compared to $13.1 million for the first quarter of 2008. The decrease in expenses was the net result of: increased costs for the MAESTRO-03 trial; increased costs for the MAESTRO-02 trial as patients entered the trial; increased investigative and analysis costs associated with the completion of the MINDSET-01 trial, and; additional expenses related to alliance management and support. Expenses in the first quarter of 2008 also included a licensing bonus payment related to the licensing and development agreement with Lilly.

The consolidated net loss for the three-months ended March 31, 2009 was $1.4 million or ($0.02) per share compared to a consolidated net loss of $6.7 million or ($0.07) per share for the three-months ended March 31, 2008.

As at March 31, 2009, cash and cash equivalents and short-term investments totaled $78.4 million compared to $90.4 million at December 31, 2008. As at March 31, 2009, the Company had working capital of $69.3 million compared to $81.3 million at December 31, 2008. Management estimates that the current working capital is sufficient for the Company to meet its obligations in respect of the currently initiated clinical trials.

As at March 31, 2009 there were 91,009,323 Class "A" common shares of the Company issued and outstanding.

BioMS Medical will hold its Annual General Meeting on Wednesday May 27, 2009, at 2:00 p.m. (MT) at the Delta Edmonton South Hotel in Edmonton, Alberta.

The results of the MINDSET-01 study showed that dirucotide did not meet
its primary endpoint, annualized relapse rate or associated secondary MRI
endpoints. Dirucotide did meet certain secondary endpoints related to the
progression of the disease, including mean change from baseline in the
Expanded Disability Status Scale (EDSS) and the Multiple Sclerosis Functional
Composite (MSFC) score. The EDSS is a method of quantifying disability in MS,
while the MSFC evaluates additional functional parameters. Measuring changes
in EDSS and MSFC are primary and secondary outcomes in the ongoing phase III
      secondary progressive MS trials.

      Press Release
      Source: BioMS Medical Corp.
On Friday July 17, 2009, 5:00 pm EDT
      Buzz up! 0 Print

      Toronto Stock Exchange Symbol: MS
EDMONTON, July 17 /CNW/ - BioMS Medical Corp. (TSX: MS - News), a leading developer in the treatment of multiple sclerosis (MS), today announced financial and operational results for the three and six months ended June 30, 2009.

"The pivotal phase III MAESTRO-01 trial has completed the last patient last visit, and we are expecting results from this study within the second half of this year. This is the first of our two pivotal trials evaluating dirucotide in patients with secondary progressive multiple sclerosis and with a positive outcome, our drug could represent a valuable new treatment for MS patients," said Kevin Giese, President and CEO of BioMS Medical.

Currently, BioMS is conducting two pivotal clinical trials and one open-label follow-on trial of dirucotide for the treatment of secondary progressive MS (SPMS):

      - MAESTRO-01: This pivotal phase III trial is being conducted in Canada
and Western Europe, involving 611 SPMS patients at 47 trial sites in
ten countries.

      - MAESTRO-02: Eligible patients who have successfully completed
MAESTRO-01 may choose to receive dirucotide on an un-blinded basis in
this open-label follow-on study regardless of whether they were
previously on placebo or drug. To date, approximately 95% of the
eligible patients who have successfully completed the MAESTRO-01
trial have enrolled in this follow-on study.

      - MAESTRO-03: Enrollment was initiated in June 2007 and completed on
August 1, 2008 for this pivotal U.S. phase III trial of approximately
510 SPMS patients at 67 sites across the U.S. To date, the DSMB has
conducted four reviews of the data from this trial and recommended it
      continue.

*MS drug study fails to meet goals

      *Partnership with Lilly in doubt

      *Shares drop 90 pct

TORONTO, July 28 (Reuters) - Shares of BioMS Medical Corp plunged 90 percent on Tuesday after the company and Eli Lilly and Co said their multiple sclerosis treatment failed to delay the progression of the disease in a late-stage trial.

The companies also said they were scraping all remaining studies of the treatment, prompting speculation that Lilly, the big U.S.-based drugmaker, would scrap its partnership agreement with the small Canadian biotechnology company.

The companies, which have been working together on the drug dirucotide since late 2008, said late on Monday the trial had involved 612 patients with secondary progressive multiple sclerosis (SPMS).

Multiple sclerosis, a condition in which the body's immune system attacks the protective cover of the nerves, is one of the leading causes of neurological disability in young adults. The global market for MS treatments is estimated at about $9 billion.

In addition to failing its primary goal of delaying the time it took for the disease to worsen in patients, the drug also failed secondary goals, the companies said.

BioMS was not immediately available for comment.

Shares of the Edmonton, Alberta-based company dropped 88.2 percent to 32 Canadian cents by midmorning on the Toronto Stock Exchange.

"We believe the negative results ... and the quick termination of the remaining trials indicate that it is unlikely Lilly will continue to pursue this license agreement," Desjardins Securities analyst Maher Yaghi wrote in a note to investors.

"Overall, the prospects for dirucotide as a development compound are dim at present."

Lilly must notify BioMS no later than 60 days after receiving a final written report of the results of the trials expected in October or November.

Yaghi said an end to the partnership would leave BioMS a choice of either investing its cash balances toward new drug development molecules, or wind down the company by paying a cash dividend to existing shareholders. ($1=$1.09 Canadian) (Reporting by Scott Anderson; Editing by Frank McGurty)

      Was hat BioMs zubieten ?

      1. Sepsis Produkt in Phase 3 (start 1.Halbjahr 2010)
      2. Cash liegt 44 Mio C$

SPECTRAL DIAGNOSTICS RAISES $14 MILLION AND ENTERS INTO STRATEGIC COLLABORATION WITH BIOMS MEDICAL TO COMMERCIALIZE TREATMENT FOR SEPSIS

      - BioMS Medical makes strategic investment of $12 million in Spectral -

Toronto, Ontario and Edmonton, Alberta, December 17, 2009 – Spectral Diagnostics Inc. (TSX: SDI) and BioMS Medical Corp. (TSX: MS) today announced that BioMS Medical (“BioMS”) and a syndicate of investors have invested $14 million in Spectral Diagnostics (“Spectral”, or the “Company”) to advance Toraymyxin™, a treatment for severe sepsis, towards regulatory approval and commercialization in the United States.

Spectral obtained exclusive rights for the Toraymyxin™ device in the US from Toray Industries Inc., of Japan, in March of 2009 and, following the closing of the financing (the “Closing”), anticipates initiating a pivotal US clinical trial in the first half of 2010. Toraymyxin™ has been used in more than 70,000 patients globally and has demonstrated in clinical trials that it safely and effectively removes endotoxin and reduces mortality in patients with severe sepsis. There are approximately 125,000 patients who develop endotoxemia related severe sepsis in the US each year and who currently face a high risk of mortality with limited treatment options, representing a potential market opportunity in excess of $1 billion per annum.

“We are now focused on obtaining clearance from the FDA to initiate the pivotal US trial - a randomized double blinded prospective trial, comparing standard of care versus standard of care plus Toraymyxin ™, in patients with proven endotoxemia,” said Dr. Paul Walker, President and CEO of Spectral. “The resources from this investment, combined with the clinical, regulatory and capital market expertise of the BioMS team, will assist Spectral to effectively conduct its anticipated pivotal trial in the US.”

“The use of a specific diagnostic test, the EAA™, to identify endotoxin, a substance that is known to be harmful to the body, and proceed to remove it with the Toraymyxin™ column makes this study unique in the history of sepsis clinical trials,” said Dr. R. Phillip Dellinger, Professor of Medicine, University Medicine and Dentistry New Jersey, Head, Division of Critical Care Medicine, Department of Medicine, Cooper University Hospital, Camden New Jersey and primary investigator for the study. Cooper University Hospital will also be the coordinating center for the clinical trial.

“BioMS is very pleased to support Spectral and its management team in the development of Toraymyxin™ in the US. This once again positions BioMS with a unique opportunity that addresses a significant unmet medical need and has blockbuster potential,” said Kevin Giese, President and CEO of BioMS Medical. “In addition, this relationship highlights the value of our experienced team, which will play a key role in helping Spectral to advance Toraymyxin™ from a clinical, regulatory and commercial perspective.”

      About Toraymyxin™, Endotoxin and Sepsis
Spectral’s Endotoxin Activity Assay (EAA™) is the only FDA cleared assay for the measurement of endotoxin in the bloodstream. Toraymyxin™ is a therapeutic hemoperfusion device that removes endotoxin from the bloodstream. The anticipated US pivotal trial will use Spectral’s EAA™ to identify patients with severe sepsis who have elevated endotoxin in the blood and will most likely benefit from treatment with Toraymyxin™.

Sepsis affects approximately 750,000 patients in the US each year. It accounts for approximately 1 in 10 ICU admissions at an annual cost to the US healthcare system of $17 billion. Sepsis is the 10th most common cause of death in the US, ahead of acute heart attacks and breast cancer.

Results of a randomized controlled trial (the EUPHAS trial) were recently published in the Journal of the American Medical Association (JAMA. 2009; Vol. 301 No. 23, 2445-2452). The results demonstrated that Toraymyxin™ absorbs endotoxin from the bloodstream, and when added to conventional therapy, significantly improved hemodynamics and organ dysfunction, and reduced 28-day mortality in patients with severe sepsis and septic shock in comparison to those patients in the conventional therapy group.
