läuft gut an unsere Bankunited...und der heftige Upmove gestern, zeigt das das üble Zahlenwerk scheinbar schon "verdaut" wurde....m.E. nach haben aber gerade die kleinen US Bank Stocks, zur Zeit mehr Potenzial, da ich hier mit eine Übernahme bzw. Konsoliduerungswelle hier rechne.

The thrift, based in Coral Gables, Fla., warned on Wednesday that it could be forced into receivership by the FDIC if it failed to raise $1 billion in fresh capital. BankUnited also estimated a massive loss of $443.1 million for the fiscal second quarter, according to a regulatory filing.
Two likely consortiums have emerged as acquirers of BankUnited, but neither would confirm that a bid has been submitted.
Canada's Toronto-Dominion Bank (TD) has teamed up with Goldman Sachs Group Inc. (GS) to buy the thrift, according to another person briefed on the matter. TD Bank would take over the branches and deposits, while Goldman would take a nominal role buying up some of BankUnited's distressed assets, the people said.
Billionaire investor Wilbur Ross' WL Ross & Co. has confirmed he plans to put in a bid through a consortium that includes private-equity firms Blackstone Group (BX) and Carlyle Group.
There has also been speculation that JC Flowers & Co., the New York-based investment firm run by J. Christopher Flowers, also might be interested. A spokesman for Flowers wouldn't comment on talk of a bid, and his attorney didn't return telephone calls.
The FDIC declined to comment.

BankUnited officials also declined to comment.
According to people familiar with the situation, the bidders include:
• Goldman Sachs, the New York-based investment banking firm, which joined with TD Bank of Cherry Hill, N.J.. Cherry Hill, N.J.-based TD Bank, which already has 30 offices in Florida, recently got nearly $1 billion in fresh capital from its parent company, TD Bank Financial Group, based in Toronto. Spokesmen for Goldman Sachs and TD Bank declined to comment.
• John Kanas, a senior advisor to New York-based WL Ross & Co., is leading a group of private equity firms that placed a bid for BankUnited. The group includes WL Ross, the distressed-asset firm founded by billionaire Wilbur L. Ross Jr., and private-equity firms Blackstone Group, Carlyle Group and Centerbridge Partners.
Kanas, who is former chairman and chief executive of North Fork Bancorp, joined WL Ross last year with plans to acquire and manage ailing financial institutions. He plans to become chief executive of BankUnited if his group wins. Melbourne, N.Y.-based North Fork, which had $59 billion in assets, was acquired by Capital One Financial Corp. in 2006 at a lofty price. A spokesman declined to comment.
The bidders almost certainly are seeking a loss-sharing arrangement under which the FDIC would shoulder a large portion of the loan losses.
BankUnited's fate began to come to a head on April 14 when the U.S. Office of Thrift Supervision gave it 20 days to merge or find a buyer.
The order, known as a ''Prompt Corrective Action Directive,'' required BankUnited to help federal regulators to market the institution to buyers.
BankUnited also agreed to help the FDIC to minimize losses by cooperating fully in the event of a government seizure of the institution. It authorized FDIC to share confidential information with others to help in the liquidation or other resolution of the bank. Regulators extended the deadline for bidders to send proposals to the FDIC to Tuesday.
For months BankUnited has been pushing hard to find an investor or buyer. It has also pressed for government assistance. But the federal government hasn't been willing to pump fresh capital into the existing thrift to make it attractive to private investors.

Nach den Worten eines Insiders verfügt die Private-Equity-Branche trotz Krise momentan über rund 400 Milliarden Dollar "Trockenpulver" für neue Übernahmen.
So rangiert Buyout-Unternehmer Wilbur Ross aus dem krisenfesten Mammon-Refugium Palm Beach auf der "Forbes"-Liste der 400 reichsten Amerikaner derzeit zwar "nur" auf Platz 262 - mit einem Privatvermögen von 1,8 Milliarden Dollar. Doch seine wahre Finanzkraft ist viel größer: Kürzlich erst schnappte er sich für 2,6 Milliarden Dollar zwei Hypothekenfirmen und eine Anleihenversicherung. Bank United wäre jedoch sein erster, größerer Ausflug in die Bankenbranche - nach dem kleineren Institut First Bank & Trust, an dem er die Mehrheit hält.

Ohne weitere Beteiligungsgesellschaften könnte aber auch Ross den Deal nicht stemmen. Ein halbes Jahr später übernahm die Regierung die kaputte Bank, TPG verlor am Ende fast 1,4 Milliarden Dollar.
Doch im Zuge der Finanzkrise beginnen die Investoren damit, auch die Banken wieder zu umkreisen, bei der Bank United liefern sie sich jetzt sogar einen Bieterkrieg. Die Institute gelten auf einmal als "die größte Beute der Rezession" ("New York Times"). Der US-Regierung wird dabei allmählich etwas mulmig. Zwar forciert sie private Beteiligung an der Geldindustrie neuerdings: Kernstück ihres jüngsten Bankenrettungsplans ist ein "öffentlich-privates Investitionsprogramm", bei dem der Staat den Privatanlegern unter die Arme greift, um die Problemkredite der Banken so abzustoßen.
Doch bisher erlaubt die zuständige US-Notenbank den Beteiligungsgesellschaften dabei nur Minderheitsbeteiligungen. Damit soll verhindern werden, dass es zu Zuständen wie Anfang des 20. Jahrhunderts kommt, als sich Wirtschaft und Geldwesen der USA unter der Kontrolle weniger Individuen befanden. Damals wurde ein Ausdruck für solche Querbeet-Übernahmen geprägt: "Morganisierung" - nach dem Eisenbahn- und Stahlmagnat John Pierpont Morgan, dem Gründer der Großbank JP Morgan.

Die Private-Equity-Unternehmen versprechen, das Bank-Business und den Rest ihrer Geschäfte weiter separat zu führen, indem sie Holdingfirmen für die Finanzbeteiligungen einrichten. Eine andere Option: "Club Deals" wie bei Bank United, bei denen sie sich mit anderen Investoren zusammentun. Jede Gesellschaft kauft dabei den gesetzlich erlaubten Höchstanteil, was sich am Ende dann zu 100 Prozent addiert.
Ein solcher Investorenclub kaufte sich auch bei IndyMac ein, einer der ersten Banken, die im Strudel der US-Hypothekenkrise untergingen. Die FDIC gab sie, unter strengen Auflagen, an ein Konsortium aus Christopher Flowers, den umtriebigen Hedgefonds-Milliardären George Soros und John Paulson sowie Michael Dell, dem Gründer des Computerkonzerns Dell .

gestern ist der kurs auf 50cent abgesackt... und das 2 minuten vor börsenschluss in us. innerhalb von 1min45sec ist der kurs dann wieder auf 72cent geklettert.... schätze da profitiert jemand von der panik.
dass einer der bieter bereits ausgestiegen ist, kann einerseits bedeuten dass die auflagen der fdic zu unattraktiv erscheinen, andererseits wäre es allerdings auch möglich, dass die gebote bereits zu hoch sind.
bin nicht groß investiert, daher bleib ich erstmal drin. sonst lägen meine nerven vermutlich auch schon blank....

The Miami Herald reported that Mr. Flowers shop had indeed made a bid, but DealBook reported Tuesday afternoon that the private equity firm didn’t seem to have made an offer as of the noon deadline.
The bidders for BankUnited, based in Coral Gables, Fla., with 95 branches around the state, are likely to insist on loss-sharing arrangements under which the FDIC would shoulder a big portion of the thrift’s loan losses, The Herald said.

Despite the bids, the F.D.I.C. is likely to put Bank United into receivership as part of the sale process, MarketWatch reported, citing a person familiar with the situation. Such a move would wipe out shareholders.
The bid deadline may also be extended again as regulators seek more buyers, The Wall Street Journal reported, citing a person familiar with the bidding
If the F.D.I.C. finds no satisfactory buyer, it could opt to run the institution for a period of time.

Ich stehe noch an der Aussenlinie, da ich gestern zu früh rein bin und durch SL rausgeflogen bin.
Wir müssen wohl auf die Amis warten, bis die sich für eine Richtung entschieden haben. Momentan gehts noch abwärts.

(NASDAQ:BKUNA) (the “Company”) received a non-compliance notice (the “May 15 Notice”) from the Nasdaq Stock Market (“Nasdaq”) stating that, because the Company did not timely file its Quarterly Report on Form 10-Q for the period ended March 31, 2009 (the “Form 10-Q”), it does not comply with the rules for continued listing, including Rule 5250(c)(1), which require the Company to file with Nasdaq, on a timely basis, all reports and other documents required to be filed with the Securities and Exchange Commission (the “SEC”).
The Company received on December 17, 2008 a non-compliance notice from the Nasdaq in connection with its Form 10-K, and a similar non-compliance letter in connection with its Quarterly Report on Form 10-Q for the fiscal quarter ended December 31, 2008 (the “2009 First Quarter Form 10-Q”). BankUnited Financial Corporation Receives Letter from Nasdaq Relating to its Late Form 10-Q
CORAL GABLES, Fla.--(BUSINESS WIRE)--BankUnited Financial Corp. (NASDAQ:BKUNA) (the “Company”) received a non-compliance notice (the “May 15 Notice”) from the Nasdaq Stock Market (“Nasdaq”) stating that, because the Company did not timely file its Quarterly Report on Form 10-Q for the period ended March 31, 2009 (the “Form 10-Q”), it does not comply with the rules for continued listing, including Rule 5250(c)(1), which require the Company to file with Nasdaq, on a timely basis, all reports and other documents required to be filed with the Securities and Exchange Commission (the “SEC”).
The Company received on December 17, 2008 a non-compliance notice from the Nasdaq in connection with its Form 10-K, and a similar non-compliance letter in connection with its Quarterly Report on Form 10-Q for the fiscal quarter ended December 31, 2008 (the “2009 First Quarter Form 10-Q”). On February 18, 2009, the Company submitted a plan to regain compliance through the filing of its Annual Report on Form 10-K for the period ended September 30, 2008 (the “2008 Form 10-K”) and the 2009 First Quarter Form 10-Q, and was granted 180 calendar days from the due date of the Form 10-K, or until June 15, 2009, to regain compliance for its delinquent filings. Federal regulators seized BankUnited on Thursday and placed control of the largest Florida-chartered bank into the hands of a private equity group led by John Kanas and WL Ross & Co.
With $12.8 billion in assets on May 2, BankUnited is the largest bank to fail this year. It is the first bank failure in South Florida since Net 1st National Bank, of Boca Raton, was shut down in 2002 – the same year Hamilton Bank failed in Miami.
The former head of North Fork Bank in Melbourne, N.Y., Kanas will lead the management of the newly acquired bank. The ownership includes WL Ross & Co., Carlyle Investment Management, Blackstone Capital Partners, Centerbridge Capital Partners, LaFrak Organization, the Wellcome Trust, Greenaap Investments and East Rock Endowment Fund.
The new BankUnited, led by the above partners, will assume $12.7 billion of the assets and $8.3 billion of deposits of the old BankUnited. The deal did not include the bank’s brokered deposits, which measured $348 million. The Federal Deposit Insurance Corp. will pay out those depositors directly.
As the new owners inject $900 million in capital to support the bank, the FDIC entered a loss sharing transaction on about $10.7 billion of the acquired assets. The FDIC estimated it will cost its insurance fund $4.9 billion.
“The loss-sharing arrangement is projected to maximize returns on the covered assets by keeping them in the private sector,” the FDIC said in a statement. “The agreement also is expected to minimize disruptions for loan customers as they will maintain a banking relationship.”
Founded in 1984 and led until October by former Chairman and CEO Alfred Camner, BankUnited expanded to 86 branches throughout Florida as it fed off years of growth in Florida. But, its risky lending practices during the last real estate boom and some investments that went sour spelled doom for the bank.
The seizure strips away the main asset that belonged to the holding company, BankUnited Financial Corp. (NASDAQ: BKUNA). Camner is the largest shareholder.
The bank has lost so much over the past year that its equity capital fell $477 million into the negative as of March 31.
BankUnited plays a high-profile role in the fabric of the South Florida community and is known for ads that say "it's a local thing."
The bank holds the naming rights to the University of Miami’s on-campus arena. BankUnited Executive VP Carlos Fernandez-Guzman is chairman of the Greater Miami Chamber of Commerce.
BankUnited was the sixth-largest holder of deposits in South Florida on June 30, with $6.25 billion in deposits, according to FDIC data. That was good for a 4.2 percent market share.
As of March 31, the bank had 1,083 employees. Besides its Coral Gables headquarters, it has an operations center in Miami Lakes.
BankUnited reported having about $8.78 billion in deposits on March 31, but only $328 million that weren’t paying interest to depositors – meaning most of them were carried at cost to the bank. During the first quarter, BankUnited paid out more in interest expense than it collected in interest income on loans and investments.

The Office of Thrift Supervision on Thursday closed BankUnited of Coral Gables and appointed the Federal Deposit Insurance Corporation as receiver.
BankUnited's 86 offices will open Friday during normal business hours. The new management team is headed by John Kanas, former head of North Fork Bank, who led a group that bid for the bank this week.
BankUnited, the largest bank based in Florida, was "critically undercapitalized and in an unsafe condition to conduct business," the OTS said in a statement. The bank reported losses of $1.2 billion in 2008.
Depositors' accounts at BankUnited are insured up to $250,000. Customers with questions can call the FDIC at (800) 451-1093.
BankUnited had $8.7 billion in deposits and 85 branches, including 23 in Broward County and 16 in Palm Beach County.
Customers can continue to use BankUnited checks, ATM cards and debit cards. Checks drawn on the bank will continue to be processed. Loan customers should continue to make their payments as usual.

Aber ist nicht das eingetreten worauf viele spekuliert haben? also der Kauf der Bank durch die Investoren und damit der Zugang zu frischem Kapital? oder wird trotz des Kaufes ein Konkursverfahren in Gang gesetzt bei dem am Ende evt. die Aktien wertlos werden?

Hmm... könnte so laufen wie bei WAMU. D.h. der Kurs dürfte dann aber auch nochmals deutlich nachgeben. Ich denke wir bleiben auf alle Fälle erstmal an der Börse. Nur wird es wohl drüben an die OTC gehen; weg von nasdaq und nyse.

The Federal Deposit Insurance Corp. was appointed as receiver of the $13.1 billion Coral Gables-based bank. The bank reported losses of $1.2 billion last year as its loan quality deteriorated, the OTS said in a statement.
Regulators said BankUnited FSB has $8.7 billion in retail deposits, nearly 1,100 employees and more than 80 branches, all of them in Florida. John Kanas, the former CEO of North Fork Bank, will lead the bank's management team, the FDIC said. The bank's new ownership group includes WL Ross & Co., Carlyle Investment Management, a unit of Blackstone Group (BX Quote), Centerbridge Capital Partners, LeFrak Organization, The Wellcome Trust, Greenaap Investments and East Rock Endowment Fund.
The new bank will be called BankUnited and will be a newly chartered federal savings bank. The new firm won't take on approximately $348 million in brokered deposits. The FDIC will pay the brokers directly, the agency said in a statement.
The FDIC estimated that the cost to its deposit insurance fund will be $4.9 billion. BankUnited FSB was the 34th FDIC-insured U.S. institution to fail this year and the third in Florida. bankunited wurde doch verkauft und nicht verschenkt. desweiteren glaub ich auch dass im artikel der hohe verlust des kurses gemeint ist. wird ja billig rein und nicht schon jahre lang shareholders die bei 20 $ rein sind. komisch ist nur warum die aktie aus dm handel genommen wurde. mag wohl an einer überschreibung bzw. der aktie in eine holding oder so liegen. keine ahnung kenn mich da auch nicht wirklich aus. was könnte es noch für gründe haben? und warum ist die aktie nicht komplett in den keller gesackt so auf 1 cent.....??? und enteignen bei einem verkauf ist doch unlogisch auch wenn man sich nicht auskennt!

New York banker John Kanas and a group of private equity firms won a bidding contest to acquire BankUnited in a sale run by the Federal Deposit Insurance Corp.
BankUnited, the largest financial institution based in Florida, will reopen all 85 branches for regular business hours Friday morning under the new ownership.
''Tomorrow it will be business as usual,'' said Kanas, the new CEO who envisions building the freshly capitalized institution into a dominant banking force in Florida. ``All the branches will be open and operating as normal.''
BankUnited, dragged down by risky home mortgages that fizzled in the housing downturn, is the largest bank to succumb to loan losses this year and the third-largest in assets to fail in the current downturn after IndyMac and Washington Mutual.
The collapse of the thrift will cost the FDIC insurance fund an estimated $4.9 billion. In the current downturn, only the IndyMac failure cost the FDIC fund more, with a hit of $11 billion.

BankUnited Financial Corp., the parent company that has about $550 million in debt, was expected to file for bankruptcy protection to provide a process to pay off creditors.
As federal seizures go, BankUnited's was a low-key affair. It offered none of the spectacle of the 1990 collapse of notorious CenTrust Savings Bank, where regulators marched into the downtown Miami tower and lit it up in red, white and blue.
Instead, a team of luggage-laden regulators from the Office of Thrift Supervision and the FDIC strolled into the headquarters at 255 Alhambra Circle in small groups over the late afternoon and evening hours. The most visible evidence of a seizure was a group of armed security guards waiting in cars outside.
In the penthouse, the regulators met cordially with CEO Ramiro Ortiz, who has been working closely with the Office of Thrift Supervision and the FDIC for months to find fresh capital for the thrift. Ortiz, who was nursing a cold, signed more papers than a typical home buyer taking out a mortgage.
''The real theme here is we have a recapitalized brand new bank,'' said Ortiz. ``Nothing changes here except we've got a lot of capital.''

Wir könnten im schlechtesten Fall "enteignet" bzw. unser gesamtes Kapital verlieren oder wir wechseln in die Pink Sheets und müssten vermutlich mit heftigen Kursverlusten leben oder im besten Fall (aber so wie ich hier die Meinungen verstehe sehr unwahrscheinlich) kommen wir mit 1- 1,5 USD pro Aktie raus.....bitte korrigiert mich wenn ich falsch liege.

Two additional companies owned by the holding company also filed Chapter 11 – BankUnited Financial Services and CRE America Corp. Peter Levitt, of Shutts & Bowen LLP in Miami, represents all three debtors.
“The bank was seized and sold,” Levitt said. “So, the bank is not involved. The parent company has its own assets and creditors, and that entity needs to have an orderly process for dealing with its creditors.”
The financial services entity has been involved in selling insurance and annuities.
“That’s a separate business, with about 20 employees in Coral Gables, and we’re hoping that can continue,” Levitt said. “Nothing is certain, but we’re going to make a real effort for that to continue. The rest of the bankruptcy is a question of maximizing the assets – which are mostly cash and claims.”
CRE America owns some real estate, but Levitt said he was not able to say what would happen to it yet.
Unlike some bank holding companies that have other subsidiaries, BankUnited Financial (NASDAQ: BKUNA) was totally reliant on its bank to keep operating.
The company said it did not know how many entities held the securities it listed in the petition:
* $273 million in trust preferred securities
* $184 million in convertible senior HiMeds units (a type of security developed by JPMorgan)
* $120 million in convertible senior notes
* $12.5 million in junior subordinated debentures, which have a lower claim on assets than senior notes
The petition listed one to 49 creditors and was signed by Bradley S. Weiss as chief restructuring officer. Weiss was vice chairman of BankUnited Financial Corp.
The law firms of Paul, Hastings, Janofsky & Walker LLP of Los Angeles and Shutts & Bowen will be handling the case.
The list of largest unsecured creditors was led by U.S. Bank, Wilmington Trust, Wells Fargo Delaware Trust and Bank of New York Mellon for several series of the trust preferred securities.
In many bankruptcy cases, such institutions are representatives for those who actually hold the securities.
Waterford Township General Employees Retirement System, which has a class action case against BankUnited Financial, also is listed as a creditor for an unknown amount.
Three Miami law firms – Tew Cardenas, Coffey Burlington and Stearns Weaver Miller Weissler Alhadeff & Sitterson – are listed as creditors for an unknown amount.
Trading in BankUnited Financial's stock was halted at 5:28 p.m. on Thursday to allow dissemination of the takeover news.

MIAMI, May 22 - Florida-based BankUnited, which was closed by the U.S. government and sold to investors, was conducting business as usual on Friday and there was no sign of panic among customers, its new chief executive said.
Banking industry veteran John Kanas, who also took over as BankUnited Financial Corp chairman, told Reuters in an interview that BankUnited plans no immediate layoffs among its work force of 1,100 and expects to expand branches in its Miami base, while closing branches outside the city.
U.S. bank regulators seized the Florida lender and sold it to some of the most powerful private equity firms in the world, including WL Ross & Co, Carlyle Group, Blackstone Group, and Centerbridge Partners, which put up $900 million of capital in the rescue.
The failure is the largest this year, and will cost the U.S. Federal Deposit Insurance Corp an estimated $4.9 billion.
All of the bank's 85 branches opened on Friday morning without problems after the transition and customers should see no immediate changes.
"With respect to customer-facing activities it is a complete yawn," Kanas said. "There are no lines anywhere, thank God. We don't have any panicky customers."
Kanas said there would be no immediate changes for the bank's 1,100 employees either.
"We don't have any layoffs planned," he said.
But the bank's geographic footprint may change, with the closure of some of the branches outside the Miami area and the opening of new branches within Miami. The bank's headquarters is in Coral Gables, a Miami suburb.
"The (branches on Florida's) west coast and other outreach areas probably don't make much sense in the grand scheme of things," he said, adding that the bank did not have a target number of new branches it would like to open.
Kanas said the collapse of the Miami property market weighed heavily on the failed bank, but its new management team saw opportunities going forward with plunging prices.
"We don't expect this market to pick up anytime soon," he said. "But there are a lot more lending opportunities now that values have been substantially deflated."

Dem US Federal Deposit Insurance Corporation-Einlagensicherungsinstitut (FDIC) gehen die Mittel aus. Seine Mitarbeiter ächzen unter der Arbeitsbelastung, denn sie müssen die Pleitewelle, die über amerikanische Banken hinwegschwappt, unter Kontrolle bringen. Deshalb scheint das Institut sich auf Notverkäufe verlegt zu haben. Erst im Januar hat das FDIC IndyMac zu einem verblüffenden Abschlag an ein Konsortium von Beteiligungsgesellschaften verscherbelt. Auch die in Florida ansässige BankUnited ging jetzt an eine große Gruppe von Private Equity-Firmen, darunter WL Ross, Carlyle, Blackstone und Centerbridge.
Das Konsortium erhält zweifelhafte Vermögenswerte über 12,7 Mrd. Dollar für eine Investition von nur 900 Mill. Dollar in bar. BankUnited verfügte zum 2. Mai über Kundeneinlagen im Wert von 8,3 Mrd. Dollar. Lässt man andere Faktoren unberücksichtigt, lässt dies darauf schließen, dass die Vermögenswerte um 28 Prozent überbewertet sind.
Doch gleichzeitig wird das FDIC bei der BankUnited einen größeren Anteil der Verluste übernehmen als bei IndyMac, sagen mit der Angelegenheit vertraute Personen. Das FDIC geht davon aus, dass seine Gesamteinbußen bei 4,9 Mrd. Dollar liegen werden.
Das mag vielleicht sogar noch ein fairer Preis sein - das Portfolio der BankUnited ist wirklich unterirdisch. Rund 80 Prozent des Kreditbuchs der Bank bestehen aus von Maklern hervorgebrachten, schlecht dokumentierten, optional zinsvariablen Krediten aus Südflorida. Das war schon eine ungeheuer leichtsinnige Art und Weise, eine Bank zu leiten. Die Immobilienwerte in dieser Region sind laut Case Schiller-Index gegenüber ihren Spitzenwerten im Jahr 2006 um mehr als 40 Prozent gefallen. Und ein Großteil der Informationen, die die Darlehensnehmer bei ihren Kreditanträgen angegeben haben, war falsch.
Vielleicht hätte das FDIC härtere Forderungen stellen können, doch das Institut steht unter enormem Druck. Die Mittel der Behörde beliefen sich Anfang des Jahres auf 18,9 Mrd. Dollar. Bisher sind in diesem Jahr 33 Pleiten zu verkraften gewesen, die Mittel werden rasch aufgezehrt. Über eine einmalige Aufstockung wird gerade nachgedacht.
Auch die personelle Ausstattung ist ein Thema. Das FDIC hat sich zwar auf die Pleitewelle eingestellt und im Lauf des vergangenen Jahres mehr Mitarbeiter an Bord geholt. Aber es ist nicht klar, ob die Behörde ausreichend auf das, was kommt, vorbereitet ist. C. Thomas Tew, who ran the shareholder meeting as counsel for BankUnited Financial, stymied Camner's efforts to install new directors, calling them ``out of order.''
Camner's wife, Anne Camner, stood in the wings, fretting that the bank's collapse had been an emotional jolt to her family. ''We devoted 25 years to building this company,'' she said in an interview. ``This was our baby.''
Anne Camner said her family was left in the dark. ''I found out yesterday at 5:15 p.m. that the bank had been seized,'' she said.
Camner, who resigned last October as chairman and CEO shortly after federal regulators slapped the bank with a cease-and-desist order, filed suit in Miami-Dade Circuit Court to force the company to hold a shareholder meeting.
ONE WAY, OR ANOTHER
Tew said the fight comes down to whether the parties in the bankruptcy case decide to divide the assets in an orderly fashion or enter into an extended fight.
In an interview, Tew said: ``We could spend $5 million chasing esoteric legal issues, or do creditors want to get their money and go home?''

Founder and top shareholder Alfred R. Camner gained three board seats on the six-member board of BankUnited Financial Corp., the former parent of BankUnited, at a shareholder meeting in Coral Gables Wednesday.
Camner's move appears to be aimed at protecting his interests in the bankruptcy proceedings.
BankUnited Financial Corp. filed to reorganize under Chapter 11 of the federal bankruptcy code last week after BankUnited, its crown jewel and main business, was seized by federal regulators and sold to a consortium of private-equity firms led by New York banker John Kanas.
With its $12-billion asset bank snatched away, it is unclear what BankUnited Financial has left to reorganize. ''The challenge for a company with no business is to convince the court there is a business to reorganize or some valid activity to do a Chapter 11 filing,'' said Thomas Tew, who represents BankUnited Financial.
Under Chapter 11, a company is protected from shareholder suits while it works out a plan to repay its creditors. Under a Chapter 7 filing, a company is liquidated to pay creditor claims.
Camner, who resigned last October as chairman and chief executive shortly after federal regulators slapped the bank with a cease-and-desist order, filed suit in Miami-Dade Circuit Court to force the company to hold the shareholder meeting.
At Wednesday's shareholder meeting -- the third session convened this month -- Lawrence H. Blum and Bradley S. Weiss resigned from the board as part of a settlement between the board and Camner.
Camner, who controls 45 percent of the shares of BankUnited Financial, named his daughter, Danielle Lindholm, to the board, which was trimmed to six members. He also named Doyle Bartlett, a Washington, D.C., lobbyist, and Lester Bliwise, a New York attorney.
Camner -- in an apparent bid to keep a tight rein on the company he founded -- then called for a recess until June 2, rather than allowing the meeting to adjourn. A bankruptcy hearing is set for June 8.
Continuing on the smaller board are Miami investor Allen M. Bernkrant; Dr. Neil H. Messinger; and Marc S. Jacobson, a Miami insurance executive.
In its bankruptcy petition, BankUnited Financial listed total assets of $37.7 million and total debts of $559.7 million, the bulk of it to bondholders and preferred shareholders.

Trading of the Company's securities was halted on May 22, 2009. From there, when the BK hearings start, and we see assets and expenses of the company, we'll know if we're wiped out totally, or a triple zero stock, or whatever.

unter Schwankungen langsam abwärts, irgendwann kurze Bodenbildung und Gegenzock mit Ziel +50-200% je nach Verlaufstief/vergangener Zeit. Danach neue Tiefs mit paar kleineren Zocks bis die Bude in der Versenkung verschwunden ist, das wäre normal für pinks.

Das Ding muss sich erstmal etwas beruhigen. Schaut Euch nur an, was an der OTC zu Beginn heute abging.
Aber 0,5 USD ist weit hergeholt. Meiner Meinung nach wird hier die nächsten Tage und Wochen gezockt. Volumenn und Niveau dann meiner Meinung nach wie WAMUQ.
Morgen kann man mal über einen Einstieg hier nachdenken.

Bei Bkuna war ich mit der Aussetzung auch wieder dabeiHabe dieses Mal gestern zu 0,10 nachgekauft.Der ZOCK wird auch hier wohl noch kommen.
