Die Situation ist jedenfalls komplexer geworden, inwieweit vielleicht Insiderverkäufe oder eventuell die Eutelsat-Präsentation für die heutige Marktreaktion ausschlaggebend waren, vermag ich nicht zu beurteilen.

Die Analystenkonferenz von Intelsat am Dienstag war jedenfalls stark von der C-Band-Diskussion geprägt.

Intelsat rechnet mit Clearingkosten, die auf die CBA zukommen würden, in Höhe von 2,5 bis 3 Millarden Dollar, es würden 8/9 (4 Intelsat / 4 SES) Satelliten benötigt, hinzu kämen organisatorische Kosten und Equipmentausgaben:

„Our current view is that, it will take eight satellites. It may take more as we finalize our plans, but not materially more, perhaps one more. And the clearing cost for the 300 megahertz obviously has increased from what we've stated before. And so, we're looking at a range of $2.5 billion to $3.5 billion in total costs, which includes all of the equipment that we would have to implement the satellites, the implementation of filters and all the labor required to achieve all those goals….So the satellites that we're talking about are CBA. Let's call them CBA satellites that would be procured both by Intelsat and SES…. 8 (combined) for both companies.“

Durch die Erhöhung von 200 MHz auf 300 MHz erwartet man höhere Einnahmen (26:50 im Call), klarerweise ohne diese zu quantifizieren.

„… on the aggregate spectrum and proceeds, if I understand your question correctly, we do believe that the total proceeds of the auction will be higher in a 300-megahertz world as opposed to a 200-megahertz world. We see incremental marginal value to the spectrum from the buyer community. It is very difficult today to tell how much incremental value exists, but we believe the total proceeds will be higher.“

Eutelsat ist nach wie vor eingeladen bei der CBA mitzumachen.

Anmerkung: Die haben in ihrer Mitteilung an die FCC vor ca. 10 Tagen mitgeteilt, das die CBA am ehesten in der Lage wäre, den Übergang zu organisieren, man wolle allerdings nicht, dass - Migrationskosten mitberücksichtigt - mehr als 50% der restlichen Einnahmen an das amerikanische Finanzministerium gehen.

„Eutelsat also noted the C-Band Alliance (“CBA”) remains in the best position to facilitate a transition, subject to appropriate Commission guidance to ensure that any transition process is fair, transparent, and equitable. ….
….If the Commission deems it necessary to require a contribution of any portion of the proceeds of an auction to the U.S. Treasury, it should impose that requirement only after the customer transition costs discussed above are addressed. Given the substantial impact on eligible satellite operators and the fundamental change to their authorizations, Eutelsat does not support a contribution mandate greater than 50 percent of the remaining proceeds“

Über diese Zahl war man bei Intelsat überrascht. Die CBA hat mit der FCC und mit verschiedenen Regierungsstellen über eine Abgabe ans Finanzministerium diskutiert, von einer Offenlegung wird abgesehen, aber diese sei kein Hindernis für einen FCC-Beschluss (32:29), könnte allfällig auch separat konkret beschlossen werden, allerdings zeitgleich mit dem Clearing-Beschluss.

„The CBA has had discussions on the contribution to the U.S. Treasury in a number of places within the U.S. government. I don't want to comment on anything specific except to say those conversations have been constructive. And we don't see that as an impediment to bringing this overall order in for a landing that's acceptable to the CBA….I'm not so sure if it will be embedded in an order, but we would expect it to be defined at the time of the order. Let's just put it that way. That's what our expectation is.“


Vor allfälligen Klagen, sollte die FCC im Sinne der CBA entscheiden, fürchtete sich der Intelsat CEO gegenwärtig nicht, bis zur letztinstanzlichen Klärung, die dauern könne, wolle man das Projekt weiter vorantreiben.

„Well, look the, if there is a suit outside of this day period that does not impede the progress on the project. We continue to move forward. How long will it take? Look, we know how fast the courts move, it takes years and so it doesn't mean that we can't make substantial progress in the meantime.“

Inzwischen hat die CBA grundlegende Aspekte für eine private Auktion unter FCC-Aufsicht dargelegt und hierfür u.a. von Verizon Unterstützung erhalten.

Eine Verlängerung der Diskussion, u.a. aufgrund von politischen Interventionen, ist nicht ausgeschlossen. Ein Unterausschuss des Repräsentantenhauses, welcher sich mit Kommunikation und Technologie befasst, beschäftigt sich derzeit, neben dem oben zitierten Senatsausschuss, mit den Auktionsformalitäten. Eine private Auktion zur Spektrumsvergabe sei laut dem Vorsitzenden F. Palone nicht der richtige Weg und es sei laut Communications Act Aufgabe der FCC sich um Auktionen zu kümmern, um Einnahmen für das Finanzministerium zu generieren.

“This would be an unprecedented departure from the way Congress has instructed the FCC to reallocate spectrum in the past,” House Energy and Commerce Committee Chairman Frank Pallone (D-NJ) said. “Under the Communications Act, we required the FCC to run auctions that provide revenue to the treasury, which is critical to ensuring the American people benefit from these auctions.”

Am 24. Oktober haben parteiübergreifend Mitglieder des Repräsentantenhauses einen Entwurf zur Ergänzung des Communications Acts vorgelegt, der eine zwingende FCC-Auktion im C-Band vorsieht:

„Four House members — Reps Mike Doyle (D-Pa.), Doris Matsui (D-Calif.), Bill Johnson (R-Ohio), and Greg Gianforte (R-Mont.) — introduced a bill Oct. 24 to mandate the commission conduct the C-band auction itself.“

Der Entwurf H.R. 4855 sieht ein Clearing und eine anschließende Verteilung (an die Gewinner einer FCC-Auktion) von mindestens 200 MHz und maximal 300 MHz bis 30. September 2022 vor. Dabei fällt sofort auf, das eine Entscheidung der FCC noch in diesem Jahr direkt zu einem Clearing von 200 MHz bis Mitte 2021 führen könnte, wodurch eine um mindestens ein Jahr frühere Verfügbarkeit gewährleistet wäre. Da dem Entwurf zufolge die aktuell im C-Band angesiedelten Dienstleistungen den Kunden weiterhin zur Verfügung stehen müssen, müssten die Satellitenbetreiber die Migration in den verbliebenen Teil des C-Bandes organisieren und vermutlich auch noch selbst bezahlen. Schwer vorstellbar.

Bei einer Anhörung gab es sehr viele kritische Stimmen zu einer privaten Auktion, allerdings merkte ein Repräsentant regionaler, ebenfalls im Ausland ansässiger Satellitenbetreiber an, dass die FCC z.B. erst 2017 eine C-Band-Lizenz vergeben hatte und deshalb eine Verwertung bis jetzt noch nicht möglich gewesen sei, weshalb auch diese Interessen im Falle einer vorzugsweise privaten Auktion zu berücksichtigen seien. Bei den Anschaffungen hätte man sich schließlich auf die FCC verlassen.

„Frownfelter advocated for a private spectrum auction, but using a plan put forward by Bermuda-based ABS, Spanish operator Hispasat and Brazilian operator Embratel Star One…. ABS received its FCC license to provide C-band services in the United States in 2017, meaning the company, which has global ambitions, didn’t have time to monetize its U.S. C-band coverage, he said….All three operators “have invested a fortune in reliance on FCC rules and have done everything right,” Frownfelter said.“

Angesichts so vieler Interessen ist eine schnelle Lösung zum Spektrum-Clearing, wie sie sich FCC-Chairman Pai mit dem 5G Fast Plan vorstellt, bestimmt eine Herausforderung. Vom Konzept bis zur effektiven Realisierung wird es wohl noch etwas dauern. Ein wesentlicher Faktor dabei könnte sein, ob man gesetzgeberische Maßnahmen (Einbringung, Annahme Repräsentantenhaus, Senat, Unterschrift Präsident) abwarten muss.

Intelsat CEO Spengler zeigte sich zuversichtlich, dass eine zügige 5G-Implementierung im C-Band dank der guten Koordinierung zwischen den Satellitenbetreibern sowie der stärkeren Verbreitung von Kompressionstechnologien möglich sei. Bestehende Kunden würden geschützt. Mit dem CBA-Plan könne auch eine Finanzierung für eine Aufrüstung der Infrastruktur sichergestellt werden, falls die FCC einer privaten Auktion zustimmt.

Senator Kennedy (vgl. obige Beiträge) hat im Juli einen Brief an den amerikanischen Präsidenten geschrieben, in welchem er sich skeptisch zu einer allfälligen privaten Auktion für einen Teil des C-Bandes äußerte. Ein Abfluss von Geldern in Milliardenhöhe an ausländische Konzerne mit ausgeprägtem Eigeninteresse müsse angesichts eines wachsenden amerikanischen Schuldenberges verhindert werden, weshalb einer transparenten FCC-geführten Versteigerung der Vorzug zu geben sei.

„...[it] would allow four foreign-owned satellite companies to reap billions of dollars in profits by selling valuable C-band spectrum (3.7-4.2 GHz). It seems preposterous to me that given our growing national debt we would send a significant portion of the proceeds from a sale of public spectrum to foreign owned businesses. Second, allowing the foreign satellite companies to oversee the sale of this important spectrum - rather than letting the FCC run a transparent public auction - would put our 5G future in the hands of foreign-owned companies who have every incentive to put their own financial self-interests above our own national security and economic priorities.“

=> Durch ein schrittweises Clearing, zunächst 200 MHz, irgendwann 300 MHz, käme es zu einer Preissteigerung, einerseits aufgrund einer erhöhten Nachfrage in der Zukunft, weil nicht genügend für 5G bereitgestellt werde, andererseits weil es zu einer Verknappung verfügbarer Frequenzen für Video-Services käme, die die Amerikaner zahlen müssten.

„These companies want to clear 200 MHz out of the available 500 MHz, which would constrain supply, artificially drive up prices, and allow the satellite companies to raise prices later when they eventually sell the remaining 300 MHz that are currently available. The C-Band Alliance proposal will cause Americans to pay more for video services,...“

Die strategische Bedeutung der 5G-Implementierung im C-Band deutete er im Wettlauf mit China wie die einstige Rückgabe des Panamakanals, der eine wichtige wirtschaftliche und sicherheitspolitische Infrastruktur darstellte.

„I fear that we will look back on this spectrum as our generation's "high-tech" Panama Canal where we abdicate control over a critical infrastructure asset to the detriment of our nation's economic and national security.“

Eine Kopie des Schreibens ging damals an FCC-Chairman Pai, der nun am 18. Oktober darauf geantwortet hat und dabei wie bereits oben aufgezeigt sein Vier-Punkte-Programm präsentierte. Diesen Zusammenhang sollte man im Auge behalten.

Als CBA wird man auch den Anteil für das Finanzministerium kurzfristig konkretisieren müssen.

In den letzten Tagen haben sich sehr viele interessierte Parteien schriftlich an die FCC gewandt, um ihre Standpunkte in Bezug auf eine Öffnung des C-Bandes für 5G darzulegen. Dabei gibt es einige Gegner, aber auch ein paar Befürworter des CBA-Konzepts.

For the acquirements of spectrum, look, I would say, strong interest and, and particularly as the CBA's plan becomes more and more prominent I think what we see is stronger and stronger engagement from the acquirers of spectrum and that is relatively broad based at this point in time which is good to see. This is, I would say mandatory for anybody looking to deploy a capable 5G network in the US. This, this mid band spectrum is the best spectrum available for that, it is high power and unencumbered, and so, as you would expect, there is, you know, there is interest consistent with the fact that this is among the the highest priced spectrum in the market and then with respect to timing, I mean, we have said all along that we do not control the timing, it is obviously very much the prerogative of the FCC and the chairman, you know, he has sort of said, look, we expect progress on the fall. Could it slip a month? Absolutely, but my expectation is still that we will see something this year.

Als man ihn darauf ansprach, dass vielleicht schlussendlich nur wenige Interessenten eine Auktion bestreiten könnten (mit entsprechenden Folgen für die Gebote), wirkte Collar meiner Meinung nach in einem ansonsten sehr selbstbewussten Auftritt etwas überrascht, aber richtigerweise wird man das abwarten müssen. Mit den präsentierten Zahlen sollte auf man auf einem guten Weg sein, die Guidance für 2019 zu erreichen.

Der interessanteste Aspekte ist meiner Meinung nach O’Rielly´s Prioritätenliste

Zum wiederholten Male:

„While not my priority, it is also possible that an auction can generate money for the U.S. Treasury. To be clear, our primary objective should be to ensure that the spectrum gets into the hands of those who can put it to use as quickly as possible in order to compete not just domestically but internationally as well.“

Geld für das Finanzministerium ist für Commissioner O’Rielly offensichtlich nicht prioritär. Für Chairman Pai und den Senatsunterausschuss von John Kennedy ist das hingegen ein wichtiges Kriterium.
