Corruption in Ghana: Lawyer in doggy deal with state ministers, public officials

Ghana though is a signatory to the United Nations Convention Against Bribery and Corruption the canker has taken root in business, and government sector. The investigations conducted by this reporter (coming soo) which will blow your mind indicates how some members of Ghana Bar Association and reputable practicing lawyers were aiding corruption and encouraging foreign companies to bribe ministers and public officials to have business advantage over others.
And any company that failed to compromise, how it is frustrated and sent packaging out of Ghana. In this story you see why things are not changing in Ghana and development remain as it was before 1957. We will play back to you how a foreign company’s management was asked by their local lawyer to dash out 10% of the company’s shares to him to use to bribe Government ministers and public officials and promises to hold trust for them before a business certificate was granted to them.
He is a member of the Ghana Bar Association and had represented and won several cases in court on behalf of his clients. But in 2011, complacency sets in and took control of his profession when the desire to become rich overrides the ethics of his profession. He had a sound of “Cofie” in his name.
He was contacted by a foreign mining company to guide it through legal processes of registering a company in Ghana. This company needed a legal document to prospect for precious metals in Ghana. However, this lawyer who is said to have fronted for many foreign companies to have their business certificates to commerce business operations in Ghana is among the alliance of corrupt government and public officials.
His confession and testimonies of how corruption works and who benefits from these corrupt deals and sharing formula used. As mandated he is supposed to help fight corruption, and injustices but as it stands now, he rather aid these evil things.

Sackey said there was a stable multi party democratic environment in the country for genuine investors to operate and urged Emmaland and Cardero Ghana Ltd not to shirk their huge social responsibility in the communities they had been granted concessions to operate.
Wal-lana of Yeni who represented the Ya Naa pledged the communities’ support to make the project a success.
Mr. Hens Van Alphen, Chief Executive Officer of Cardero Resources Corporation, Canada, in a brief remark, gave assurance of the company’s readiness to establish a lasting relationship with the government and people of Ghana, and also ensure adequate transparency and commitment in their operations.

Ich wünsche allen mutigen und stoischen Anteilseignern ein erlebnisreiches Jahr 2012 und ein robustes Gemüt für neue Überraschungen in den kommenden spannenden Monaten.
2012 ist nicht das Ende, sondern erst der Anfang (von was auch immer...). Henk hatte bisher Jahr für Jahr, immer ausreichend Talent, um Wein in Wasser zu verwandeln. Nun ja, wer die Historie von Palladon Ventures Ltd. in Utah und anderer Schürfbuden begleiten durfte, der weiß, dass in Vancouver täglich zahlreiche Manager mit dem falschen Fuß aufstehen und selbst überrascht sind, mit wie wenig Fachwissen es möglich ist die Karriereleiter empor zu hecheln. Vorbei die Zeit, als noch echte Visionäre wie "Silvervision" uns an die Hand nahmen und wir mit großen Kulleraugen einer kurzweiligen Cardero-Olmpic Dam Zukunft entgegensahen.

This is my first write up in 2012 and is dedicated to my cherish readers. Thank you all for taking time to follow me in 2011. I am promising you more exciting and interesting write ups this year. I have planned and is a promised to you all, that all investigative pieces of articles will appear here. They ranged from corruption of public officials in Ghana to armed smuggling syndicates to petty stealing and conflict of interest.
Here our judges and bailiffs will pop out and their roles in concealing corruption and acts consider heinous crime under the 1992 Constitution of Ghana clearly spell out. Please stay tuned. Today, i am beginning my write ups with the digestion of a press statement issued by the Ghana’s Attorney General and Minister of Justice Martin Amidu. That statement which i will leave a full text at the end of my analysis makes interesting reading.
Some of my readers must think i belong to any political party in Ghana, no i am just an ordinary anti-corruption crusader and very much concerned about our justice system. The analysis of Attorney General and Minister of Justice statement is not personal attack so what i will say is deduce from his statement not direct quote anyway.
First Martin should have realized that he was appointed because the appointing officer reposed trust on him and was hoping that he will deliver but that was not to be. In his statement, he said some ministers he called Criminals wanted him to relax the law to allow them transact their illegal businesses “(Daily Post publications of the 3rd January 2012 were planned by a colleague Minister of State, who perceived that my integrity and professionalism as a lawyer was a threat to the concealment of gargantuan crimes against the people of Ghana in which they might be implicated.)”
This alone indicates that Minister of Justice and Attorney General, who supposed to be master of law and keep everybody on check is probably aware and knows that there is illegal businesses going on and he probably knows the owners some happen to be his colleague ministers of state. What is the Justice Minister waiting for? that Npong should come and lay a complain before his office takes on that minister criminal? No our justice system is worse of to encourage people like me to try that.
No wonder Multi national Companies were doing what they are doing. They probably bought everybody including our justice system. It so painful that the law in Ghana only works on ordinary person fending for a living on the street.
What baffles me as an ordinary person is why cant the minister of Justice take action against these minister he claimed his being in Justice office was a threat to them? The minister knows that our constitution says “nobody is above the law and forbids illegal trading of whichever form”. Sorry, this man must be investigated and should be made to face the law and charge for conspiracy, connivance and concealing of facts and aiding illegal activities and hiding criminals in society. this can only be done if our government is serious and committed to the rule of law, justice and equality or we must release Atta Ayee and his armed robber gang and apologize to them with reward.
Martin brought this in public because there is pressure from corners agitating for his removal from office else nobody will know of these things until he leaves office. These are some of the things that start revolutionary movements: check Libya, Egypt, Tunisia, (that is why i always cherish Rawlings AFRC). we cant vote you into power and you begin to do what you want. Look, check in our prisons all those guys there are ordinary persons on the streets meanwhile Martin Amidu knows the criminals and wouldnt say or do a thing about them, well i hope people begin to realize this during 2012 elections.
The Attorney General claimed he is committed to rule of law so what prevents him from taken legal actions against those he says do illegal businesses in Ghana and wants him to relax the law? Mr. Minister, you cant fool all of us your silence to charge these people means to me that 1. that you are likely to be part of the gang 2. you likely to be benefiting from their activities 3. you are incompetent or you are confused.
He keeps on referring to NDC criminals and you expect us to vote the party back to power? Look, you are telling us Ghanaians that NDC party is full of criminals and like minds people including myself will ensure that we dont waste our vote on you criminals. You have totally destroyed your own party, the party that made you who you are now forever. what campaign message at all will Martin preach to Ghanaian to understand NDC policies if he the minister of Justice could not prosecute criminals?
Martin Amidu is one of the useless and senseless political leaders in the 21st century. If you were begged to handle this ministry doesn’t make you untouchable, un-removable. this doesnot give you free will to act or remain silence. It was because of performance that you were begged to take up the post that doesn’t make you exceptional to boast of. You have disappointed yourself for not performing, Martin, and i am sorry your children will not like to hear that in future that their father couldnt perform.
Since you came into office i am yet to read about your office arresting and prosecuting any person and or your office wining a case in court-what a flop! sorry you dont deserve to be in that office. If Martin Amidu is honorable as he claimed let him tender in his resignation letter. Seini Wayo, former MP for Tamale Central resigned as an MP when he realized the issues at the time was against his will and that is what some of us are expecting Amidu to do.
Martin we understand you are not taking action against criminals because your colleague Ministers will be implicated and that your position is a threat to them? well let hope that you name these people.
Full text of Minister of Justice and Attorney General Martin Amidu (His childish think, holding public office is nothing but a destiny which cant be changed)
This press release has been necessitated by three telephone calls from Bawku in the Upper East Region, Burma Camp and Tema both in the Greater Accra Region on the 9th January 2012 expressing support and urging caution for my personal safety because of the cowardly, malicious and libelous attacks against my well established reputation and integrity as a lawyer, a politician and the Attorney- General of the Republic of Ghana by a partisan and rented NDC press group who perceive that I am not performing the duties of my office in their partisan political interests.
I wish to assure the members and supporters of the National Democratic Congress who are still unequivocally and resolutely committed to the original ideas of the 31st December revolution of “Freedom, Justice, Probity and Accountability:,” enshrined in the preamble of the 1992 constitution that I remain steadfast to those principles, ideals and commitments as the foundation of the fourth republican constitution. I remember the gallant men and women who laid down their lives in diverse ways that this country must live and serve the cause of the majority of the ordinary people whose sweat has consistently been exploited by the elite and elitist politicians in the name of service to the people.
I appreciate the privilege and recognition accorded my integrity and honesty over the decades when I was invited on the 4th June 2011 to lay the wreath on behalf of the probity, transparency and accountability in memory of our fallen colleagues and heroes.
I have faith and believe in my Ministerial oath of office as a Minister of State and my cabinet oath that requires me to “uphold, preserve, protect and defend the constitution of the Republic of the Ghana as by law established…” Consequently, I wish to assure the people of Ghana that I still stand by my promise in spite of the fact that hard core criminals in our society today have made it a habit to hold paid membership cards of major political parties in the republic as an unconstitutional insurance against crime and criminal prosecutions.
I wish core members and supporters of the NDC who cherish the principles and ideas upon which the party was founded to know that the attacks against me which started in the Daily Post publications of the 3rd January 2012 were planned by a colleague Minister of State, who perceived that my integrity and professionalism as a lawyer was a threat to the concealment of gargantuan crimes against the people of Ghana in which they might be implicated. An alibi was consequently created on 30th December 2011 to unleash the gullible section of the NDC press on me by the leakage of official documents from my ministry through the perverse section of a rented NDC press to the pubic beginning the 3rd of January 2012.
That has back fired because the leaked official documents by the Daily Post; the Informer; the National Democrat; the Ghanaian Lens; etc have rather inadvertently supported my honesty and integrity in public office and my call for the prosecution of criminals regardless of their political party colorations or their social status.
I was deputy Attorney-General and Deputy Minister for Justice for upwards of twelve and half years and know it is not proper for an Attorney-General to execute the functions entrusted to him under article 88 of the constitution in the media instead of the courts of justice. I will speak to the media when it is absolutely necessary to do so but I will not discuss people’s rights and cases in the media to prejudice their eventual procedural rights to a fair trial.
The ethics of a legal profession and the Bar, of which I am a leader, are more sacred to me than that of young and inexperienced members of a communication team of the NDC who are absolutely ignorant of the functions of an Attorney-General under the Constitution of Ghana.
I wish to conclude in this press statement by stating that there is not a single criminal docket against any high political operative of the NPP which has been ready for prosecution in the Director of Public Prosecution’s office that I have failed or refused to prosecute as that Minister of State and the gullible NDC press want the whole world to believe. Fairness requires that NDC criminals be prosecuted by me as well, as an independent and impartial Attorney-General, albeit appointed by the NDC Government.
I have sufficient integrity and experience as a Ghanaian and a legal practitioner who has personally conducted several leading cases reported in the Law Reports of Ghana to naively send hearsay and newspaper accusations to the courts of Justice only to lose them as was the practice a few years past.
Cool heads are what are needed in the office of the Attorney-General and not emotions, inexperience and crass incompetence in the practice of the law.
As for the section of the rented NDC press calling for my removal or dismissal from office, I wish to assure them that I never begged to be appointed Attorney-General: I opposed it on four separate occasions. That criminal section of the NDC press should be assured that I am ready, able and willing for that eventuality. The inescapable fact is that at the end of the day truth will prevail over falsehood in the Republic of Ghana.
I do not fear for my personal safety in a cause I have fought for since I was 30 years old. I am now over 60 years and count myself lucky if I pay the ultimate sacrifice which my compatriots paid in 1979 and 1981 belatedly in the regime of the third NDC Government.
When you die you never know you never lived. Destiny can never be changed but the good people of Ghana and those who laid down their lives for them will forever live on.
Ghana as a nation can never and should never be allowed to be intimidated by charlatans in political disguise.

I remember the gallant men and women who laid down their lives in diverse ways that this country must live and serve the cause of the majority of the ordinary people whose sweat has consistently been exploited by the elite and elitist politicians in the name of service to the people.
I appreciate the privilege and recognition accorded my integrity and honesty over the decades when I was invited on the 4th June 2011 to lay the wreath on behalf of the probity, transparency and accountability in memory of our fallen colleagues and heroes.
I have faith and believe in my Ministerial oath of office as a Minister of State and my cabinet oath that requires me to “uphold, preserve, protect and defend the constitution of the Republic of the Ghana as by law established…” Consequently, I wish to assure the people of Ghana that I still stand by my promise in spite of the fact that hard core criminals in our society today have made it a habit to hold paid membership cards of major political parties in the republic as an unconstitutional insurance against crime and criminal prosecutions.
I wish core members and supporters of the NDC who cherish the principles and ideas upon which the party was founded to know that the attacks against me which started in the Daily Post publications of the 3rd January 2012 were planned by a colleague Minister of State, who perceived that my integrity and professionalism as a lawyer was a threat to the concealment of gargantuan crimes against the people of Ghana in which they might be implicated. An alibi was consequently created on 30th December 2011 to unleash the gullible section of the NDC press on me by the leakage of official documents from my ministry through the perverse section of a rented NDC press to the pubic beginning the 3rd of January 2012.
That has back fired because the leaked official documents by the Daily Post; the Informer; the National Democrat; the Ghanaian Lens; etc have rather inadvertently supported my honesty and integrity in public office and my call for the prosecution of criminals regardless of their political party colorations or their social status.
I was deputy Attorney-General and Deputy Minister for Justice for upwards of twelve and half years and know it is not proper for an Attorney-General to execute the functions entrusted to him under article 88 of the constitution in the media instead of the courts of justice. I will speak to the media when it is absolutely necessary to do so but I will not discuss people’s rights and cases in the media to prejudice their eventual procedural rights to a fair trial.
The ethics of a legal profession and the Bar, of which I am a leader, are more sacred to me than that of young and inexperienced members of a communication team of the NDC who are absolutely ignorant of the functions of an Attorney-General under the Constitution of Ghana.
I wish to conclude in this press statement by stating that there is not a single criminal docket against any high political operative of the NPP which has been ready for prosecution in the Director of Public Prosecution’s office that I have failed or refused to prosecute as that Minister of State and the gullible NDC press want the whole world to believe. Fairness requires that NDC criminals be prosecuted by me as well, as an independent and impartial Attorney-General, albeit appointed by the NDC Government.
I have sufficient integrity and experience as a Ghanaian and a legal practitioner who has personally conducted several leading cases reported in the Law Reports of Ghana to naively send hearsay and newspaper accusations to the courts of Justice only to lose them as was the practice a few years past.
Cool heads are what are needed in the office of the Attorney-General and not emotions, inexperience and crass incompetence in the practice of the law.
As for the section of the rented NDC press calling for my removal or dismissal from office, I wish to assure them that I never begged to be appointed Attorney-General: I opposed it on four separate occasions. That criminal section of the NDC press should be assured that I am ready, able and willing for that eventuality. The inescapable fact is that at the end of the day truth will prevail over falsehood in the Republic of Ghana.
I do not fear for my personal safety in a cause I have fought for since I was 30 years old. I am now over 60 years and count myself lucky if I pay the ultimate sacrifice which my compatriots paid in 1979 and 1981 belatedly in the regime of the third NDC Government.
When you die you never know you never lived. Destiny can never be changed but the good people of Ghana and those who laid down their lives for them will forever live on.
Ghana as a nation can never and should never be allowed to be intimidated by charlatans in political disguise.

Zu den gestrigen Filings gehört auch ein technical report zu sheini hills. Und da es bei King Npong insbesondere um das Thema "Lizenzierung" geht stellt unser heiner mal folgende Passage ein:
In 2008, the Minerals Commission of Ghana granted non-exclusive exploration permits to six companies (Gold Coast Resources Limited, Marula Mines Ghana Limited, Integrated Metals Limited, Azumah Metals Ghana Limited, Inland Ghana Mines Limited, and Minergy Resources Limited) to allow each of them to search for iron ore within the Sheini area by geochemical and photo-geological surveys or other remote sensing techniques within a specified period of time. The deadline for final reporting was the second half of March 2011. A further seven companies (Pan African Minerals Company Limited, RSP International Ghana Limited, Compass Resources Limited, Emmaland Resources Limited, Wesun-Lu Ghana Mining Limited, Trans Global Drilling, and Energy Exploration Limited) were granted similar permits in 2010, with the same deadline as the first six companies.
The size of the non-exclusive exploration permit granted was 178.81 square kilometres, coincident with Emmaland’s current Sheini Prospecting Licence and part of the Sheini North Prospecting License (Figure 6.3). The Minerals Commission of Ghana ran a competitive bidding process, with the Prospecting Licences being awarded to the company submitting the winning bid. A report was submitted by each company, including due diligence sampling results (where such work had been done), together with recommendations for multi-phase exploration and ultimate exploitation of the iron mineralization in the Sheini area.
The only company to undertake comprehensive due diligence work under the terms of the permit was Emmaland. The initial work was carried out by Emmaland, who hired three geologists from the GGSD (E. Cheremeh, S. Annum, and K. Ahumah). Their work included geological mapping, rock sampling, pit excavation (10 pits), and trench sampling.
In December 2011, Aurum Exploration Services, Ireland, was engaged by Emmaland to run a three-month exploration program to collect adequate data to submit a successful report to the Minerals Commission of Ghana. The exploration consisted of geological mapping and prospecting, locating historical exploration workings and boreholes, and cleaning, documenting, and re-sampling historical trenches. A total of 659 channel samples (755 samples including duplicates and blanks) were collected from the historical trenches and 307 samples were assayed. The details of this work are presented in Section 9.
The results of the work, together with recommendations for a further exploration program, were summarized in the report submitted to the Minerals Commission of Ghana before the deadline. On December 8, 2011, the Minerals Commission of Ghana issued three Prospecting Licenses covering the Project Area to Emmaland.

A report was submitted by each company, including due diligence sampling results (where such work had been done), together with recommendations for multi-phase exploration and ultimate exploitation of the iron mineralization in the Sheini area.
The only company to undertake comprehensive due diligence work under the terms of the permit was Emmaland. The initial work was carried out by Emmaland, who hired three geologists from the GGSD (E. Cheremeh, S. Annum, and K. Ahumah). Their work included geological mapping, rock sampling, pit excavation (10 pits), and trench sampling.
In December 2011, Aurum Exploration Services, Ireland, was engaged by Emmaland to run a three-month exploration program to collect adequate data to submit a successful report to the Minerals Commission of Ghana. The exploration consisted of geological mapping and prospecting, locating historical exploration workings and boreholes, and cleaning, documenting, and re-sampling historical trenches. A total of 659 channel samples (755 samples including duplicates and blanks) were collected from the historical trenches and 307 samples were assayed. The details of this work are presented in Section 9.
The results of the work, together with recommendations for a further exploration program, were summarized in the report submitted to the Minerals Commission of Ghana before the deadline. On December 8, 2011, the Minerals Commission of Ghana issued three Prospecting Licenses covering the Project Area to Emmaland.
