Napster To Stay Open
What You Can Do To Help

Thanks for being a member of the Napster community and for the support you have shown. As you have probably heard, the RIAA won a court battle this week that may keep you from using Napster to share music. Today the court of appeals stayed the judge`s order to shut down Napster until they consider our appeal, probably in September. We`ll keep you informed about any developments. In the meantime we will continue working to provide the best possible experience for the Napster community.
We`re getting a lot of questions about what people can do to help. Here are three things you can do right away.

1. Write the heads of the major record companies and tell them you are their best customers - loyal and active music fans -- and that you don`t want them to kill Napster. Here`s a link to their emails.

2. Show the companies your power. We`re calling for a positive "buy-cott". Support the artists who support Napster by going out and buying their CDs. Click here for a list. Be sure to let the record store know you came from Napster.

3. Keep coming back. We`ll keep you informed as time goes on….

A Message to the Napster Community from Hank Barry And Shawn Fanning - 7/28/00



Napster CEO Hank Barry today said:

"We`re gratified and appreciative of the 9th Circuit Court`s decision today to allow the Napster community to continue operating while our appeal of the injunction is pending. We want to thank the Napster community for their support during this period.

Napster Founder Shawn Fanning said:

A Message to the Napster Community from Hank Barry, CEO - 7/27/00

As you know, the recording industry has sued Napster in order to shut us down. Wednesday in federal court, the Judge issued an order that basically would have the effect of shutting down the Napster service as it currently exists.

We will appeal the Judge`s ruling to the Court of Appeals and will ask the Court of Appeals this morning to stay the Judge`s order during the appeal.

If we do not get a stay, then we have until midnight Friday to comply with the Judge`s order. Although we strongly and firmly disagree with the Judge`s decision, we will comply with that decision if it is not stayed.

The Judge`s ruling is essentially this: that one-to-one non-commercial file sharing violates the law.

We will fight this ruling in a variety of ways to keep the Napster community growing and strong. We will keep you informed and we will ask for your help. Please check our web site and our application for updates and what you can do.

We intend to see this through in every venue, in every court. We believe in Napster and we believe in the Napster community. Thank you for your support.

New Music Through Napster: Elwood


One of the unique aspects of Napster is the opportunity to discover new music through Hot Lists, chat, IM and our New Artist Program. In addition, Napster will from time to time showcase new artists, records and labels in a wide range of genres and cultures. Each of these artists supports the Napster community. We are happy to introduce you to Elwood, an exciting new artist on the Palm Pictures label.

Elwood, born in North Carolina, was an engineer at New York`s Greene Street recording facility in SoHo. At Greene Street, Elwood (aka Prince Elwood Strickland III) worked on records by Tricky, Mos Def, Pete Rock, and De La Soul. With his partner Brian Boland, Elwood recorded a seven-track demo that led to his deal with Palm. Rolling Stone has given a rave review to his debut album, "The Parlance of Our Time," calling it "a persuasive mix of hip-hop, rock, melodic pop and folk." Elwood`s first single, "Sundown," is currently playing on MTV and many radio stations nationwide. Now, the folks at Palm`s digital arm sputnik7.com have chosen to make the single "Sundown" publicly available for the first time by sharing it through the Napster community.

Palm Pictures and sputnik7 are the latest new ventures from Chris Blackwell. Many of you may know of Chris as the founder of Island Records. He grew up in Jamaica and was instrumental in bringing the music of Traffic, Bob Marley, U2, the Cranberries, and Tom Waits, among many others, to the world. Today, his companies are committed to the cutting edge of music, audio/visual entertainment, and the Internet.

Court Grants Napster Last-Minute Reprieve

SAN FRANCISCO (Reuters) - A federal appeals court on Friday granted a last minute reprieve to online music company Napster Inc., staying a judge`s order that had directed it to pull the plug on its online song-swapping service by midnight Friday.

Weighing into a landmark battle over copyright protection in cyberspace that could eventually touch books, movies and television, two judges from the 9th Circuit Court of Appeals said Napster could stay in business pending further examination of the case.

``The preliminary injunction issued by the district court in this matter is stayed pending further order of this court,`` the appellate judges said, noting that Napster`s lawyers had raised ``substantial questions`` about the injunction they said would put the service out of business.

The decision was a stinging defeat for the Recording Industry Association of America (RIAA), which in December sued Napster for facilitating wholesale music piracy.

``It is frustrating, of course, that the tens of millions of daily infringements occurring on Napster will be able to continue, at least temporarily,`` RIAA President and CEO Hilary Rosen said in a statement. ``We look forward to the day when the infringements finally cease.``

Online, the decision was greeted with glee by users of the wildly popular music service, which was founded by a teenager and in less than a year has attracted some 20 million devotees around the world.

``Long Live Napster!`` a user nicknamed ``Nytryx`` wrote in one Internet chat room devoted to the service. ``Napster Rulez!!!`` crowed another.

Napster Chief Executive officer Hank Barry promised to keep the company in operation while the broader appeal is argued, saying Napster was eager for a cooperative settlement with the recording industry.

``We think Napster is entirely compatible with the record industry,`` Barry said told Reuters. ``We are absolutely interested in trying to reach some agreement with the plaintiffs in this case...we think that Napster users are music`s biggest fans, and we think that when people have access to more music they go out and buy more music. That`s got to be good for the recording industry.``

EVERYTHING UP FOR DEBATE

The appellate court`s decision, signed by two judges, could mean a delay of up to several months in resolving a bitter feud between the Silicon Valley upstart and the giants of the recording industry, which has charged Napster with allowing wholesale piracy of copyrighted material.

Lead Napster attorney David Boies said the stay would allow the company to resubmit its argument that its users are legally sharing their own property and that Napster itself should not be held responsible.

``The individual user has an absolute right to share music,`` Boies said on CNNfn. ``The problem is the RIAA seems determined to kill this new medium. If that`s so, we`re not going to go quietly into that night. We`re going to fight.``

The appeals court decision put on hold a Wednesday directive by U.S. District Court Judge Marilyn Hall Patel which told Napster to stop online trading of songs covered by copyrights owned by RIAA members.

Among those companies covered by Patel`s decision are Seagram Co. Ltd.`s (VO.TO) Universal Music, Bertelsmann AG`s (BTGGga.D) BMG, Sony Corp.`s (6758.T) Sony Music Entertainment (7930.T) , Time Warner Inc.`s (TWX.N) Warner Music Group and EMI Group Plc. (EMI.L).

TECHNOLOGY OUTPACES LAW

The case has exposed the problems in applying traditional copyright law to services like Napster, which enable the online trading of MP3s, small computer files containing CD tracks that are easily swapped over the Internet.

It also marks one of the first major skirmishes over a whole new form of technology that is expanding rapidly. The Motion Picture Association of America is locked in its own Napster-like battle against Scour Inc. and other companies that provide film and video over the Internet, while other software services that specialize in digitally storing and transferring all forms of intellectual property are proliferating.

Opening the legal defense for these companies, Napster said its members do not violate copyright because their trades were all for personal, noncommercial use as defined by the Audio Home Recording Act of 1992. It also said that, because some of the files Napster users trade are not protected by copyright, it was being unfairly required to alter technology that had a legitimate purpose.

Patel, in her decision Wednesday, disagreed, saying that Napster was clearly set up to enable users to evade paying fees for copyrighted material.

The clash has shaken the multibillion dollar U.S. recording industry and split the artistic community, with some well-known artists like heavy metal band Metallica accusing Napster of promoting theft while other groups say it is simply broadening the popularity of their music.

In a development likely to unnerve the recording industry, one immediate side effect of the injunction order against Napster was to drive users to previously lesser-known services to find their free music.

One Web portal devoted to the ``peer-to-peer`` file sharing program Gnutella (http://www.gnutella.wego.com) saw 30,000 unique visitors flood to its site in the first hour after Patel`s ruling, with the numbers soaring to some 1.2 million hits over the next 24 hours -- compared with some 300,000 hits per day before the injunction came down.

And Napster itself kept humming. Allen Tsai of Keynote Systems Inc., which measures the performance of Internet sites, said the Napster.com site was swamped with users through the day on Friday, even after the court ruling.

Tsai estimated that 15 times more users than normal hit the site at peak hours Thursday and Friday ahead of the presumed deadline when Napster was supposed to be shut down. Even after the appeals court stayed the ruling, usage was heavy.

``Our data right now shows performance still degraded from heavy use,`` said Tsai, ``It will probably take a while for word of the stay to filter around to everyone.`` Reut21:33 07-28-00
