TALLAHASSEE, Fla. (AP) - The recount of presidential balloting in Florida was to resume Thursday just hours after disputed Palm Beach County results came in and helped Al Gore (news - web sites) trim 843 votes off George W. Bush (news - web sites)`s lead in the presidential race.
Vice President Gore gained 1,189 votes Wednesday, compared with 346 votes gained for Bush. With 32 of the state`s 67 counties finished their recounts Wednesday, that meant Gore cut Bush`s lead by more than half, leaving Gore 941 votes behind the Texas governor.
The recount was triggered by state law because Bush led Gore by less than one-half of 1 percent. State officials expected to finish by the end of the day Thursday.
The world was watching Florida because its 25 electoral votes will decide the winner of the presidential cliffhanger.
Allegations of voting improprieties surfaced late Tuesday and throughout Wednesday, ranging from missing and confusing ballots to problems with tabulations and voter intimidation.
``If there are concerns, let the process work,`` said Gov. Jeb Bush, the younger brother of the Republican nominee. ``But don`t overexaggerate things.``
Throughout the state, Democrats and some voters complained of irregularities in the election.
In Palm Beach and Osceola counties, Democratic Party (news - web sites) lawyers and voters said ballots were confusing because of their configuration. Officials in Palm Beach announced 19,120 ballots in the presidential race were tossed out before they were counted because more than one candidate was picked. Only 3,783 voters made that mistake on the U.S Senate portion of the ballot.
``That total is a high number,`` said Palm Beach County Commissioner Carol Roberts, who is part of the canvassing board that is conducting the recount.
In Miami-Dade, Broward, and other counties, the Gore campaign complained about delays in the delivery of ballot boxes to counting places.
Democrats set up a toll-free number where Florida voters could report irregularities.
Jesse Jackson and NAACP President Kweisi Mfume said they received complaints that blacks had difficulty voting. Jackson said some voters were told there were no more ballots, or that polls were closed.
Jeb Bush said he has seen no indications of fraud. But Mfume called for federal marshals to oversee the ballot recount and asked the U.S. Justice Department (news - web sites) to investigate.
The latest Florida totals before the recount, including all absentee ballots that had been received, showed Bush with 2,909,135 votes and Gore with 2,907,351 - a difference of 1,784 in a state with 8.75 million registered voters.
Even as the recount proceeded, elections supervisors waited for an undetermined number of overseas ballots, primarily from military personnel and their families. The state counted about 2,300 overseas ballots in the 1996 presidential election and allows 10 days to count them, as long as they are postmarked no later than Election Day.
Because of his vested interest in the outcome, the Florida governor recused himself from the panel that will certify results of the recount.
The other members of the panel, Secretary of State Katherine Harris and state elections director Clay Roberts, are also Republicans. But the state`s top Democratic official, Attorney General Bob Butterworth, expressed confidence that the recount will be fair.
``All of us recognize the importance that every vote is correctly counted,`` Butterworth said. ``I can also assure the rest of the nation that there`s no way Gov. Jeb Bush or Secretary of State Harris would certify election results ... if they had any doubt at all that the election was not in perfect order.``

Republicans noted that the ballot was approved by Democrat Theresa LePore, the county supervisor of elections.
``The ballot was laid out within accordance with the statute,`` said Roberts, the state elections director. ``That`s a voting system that`s been in use for many years in many counties.``

So leid es mir wirklich tut, aber die Briefwaehler werden Gore das Genick brechen. Denn es handelt sich dabei vor allem um US Army overseas staff - und wen die waehlen, da duerfte wenig Zweifel bestehen. Deadline fuer die Briefwahl ist der Poststempel des Vorwahlabends - auch, wenn man in Suedkorea sitzt. Daher dauert das auch so lange... Trotzdem druecke ich natuerlich Al Gore fest die Daumen.

Hallo Lukanga, ich habe zwar nicht die gleichen Präferenzen wie du, aber ich freue mich, daß eindlich mal jemand sachlich (wenn auch nciht ausführlich) darlegt, warum er Gore vorzieht, ohne Bush grundsätzlich zu diskreditieren.
Aktuellees Zwischenergebnis:
Bush liegt nach 46 von 67 ausgezählten counties 793 stimmen vorne. Wenn die Entwicklung so weiter geht, wird es am Ende zwar knapp aber es reicht für Gore.

das werden sie müssen, wenn die differenz kleiner der zahl der noch zu erwartenden stimmen ist.

Aber soweit ich gelesen habe, sind die Briefwahlstimmen sowieso ca 2/3 für Bush, da z.B.viele Soldaten unter den Wählern sind...
Vielleicht fechten sie die Wahl an. Ist es möglich nur in Florida noch mal Abstimmen zu lassen? Am Ende muß sich einer vor Gericht als Präsident einklagen. Wie in ner Bananen Republik. Peinlich Peinlich.
Also es werden wohl noch so 2000-2500 Briefwahl-Stimmen ausstehen, das war zumindest die Erfahrung der letzten Wahl. Wenn man mal gaaaanz pessimistisch (aus Bush`s Sicht) davon ausgeht, dass die zu 60% Bush waehlen (werden wohl eher so um die 70% sein, sind alles Soldaten), dann kann George W. mit dem Feiern anfangen, wenn nach dem recount noch ein Vorsprung uebrig ist, denn von den Briefwaehlern kommen nochmal so um die 400 Stimmen Netto zu Bush`s Vorteil. Die Offiziellen werden aber mit an Sicherheit grenzender Wahrscheinlichkeit noch kein offizielles Ergebnis herausgeben, solange Bush nur ein paar 100 Stimmen Vorsprung hat und nicht alle Briefwahl-Stimmen da sind. Das dauert dann noch bis zum 17.11.!

Die einzig relevanten Stimmen hier können nur von Auslandsamerikanern kommen, die ihren Wohnsitz in Florida haben.
D.h.: Nur etwa 1/25 der insgesamt abgegben Stimmen fallen hier ins Gewicht.
Ob da wohl noch soviele austehen, dass Bush die rund 3.000 Gore-Stimmen, die irrtümlich auf Buchanan entfallen sind, aufholen kann?
Der Oberste Gerichtshof kann Gore jedenfalls diese/ eine ähnliche Stimmenanzahl zuerkennen (zumindest laut n-tv ist das so).

Na, da muss sich n-tv aber maechtig geirrt haben. Wahlen sind naemlich erstmal Angelegenheit der Bundesstaaten, in diesem Fall Florida. Und selbst wenn dieser Fall in Florida gehoert wird, hat er keine Chance auf Erfolg. Die Stimmzettel wurden vorher von Aussschuessen der Demokraten und Republikaner inspiziert und niemand hat Bedenken angemeldet. Schliesslich wurden die Stimmzettel dann von einer hohen Beamtin (die nebenbei auch noch Demokratin ist!!!!!!) genehmigt. Wenn dann 3000 Leute zu bloed sind, richtig zu waehlen, dann ist das deren eigene Schuld.
Sicherlich kann man jetzt seine Lehren daraus ziehen: In Zukunft muessen die Stimmzettel eben noch unmissverstaendlicher werden. Die Waehler sind ja im allgemeinen halbwegs intelligent, aber die 1% duemmsten Amerikaner kreuzen eben auf einem meiner Ansicht nach vollkommen unmissverstaendlichen Wahlzettel trotzdem noch das falsche an. Aber deswegen jetzt im nachhinein Stimmen an Gore zu verschieben ist schon aus Prinzip nicht moeglich. Dann wuerden sich in jedem der 3100 counties die Verlierer melden und mehr Stimmen fordern. Das totale Justiz-Chaos! Im Endeffekt wuerden dann die Obersten Richter eines jeden Staates und nicht das Volk den Praesidenten waehlen.
Ich möchte zur Überprüfung des Wahlergebnisses nachdrücklich für die Entsendung von UNO-Sonderbeauftragten in die USA plädieren.

WASHINGTON (CNN) -- On December 18, electors from all 50 states are scheduled to pick the president. An 1887 law fixes this as the date for electors to cast their ballots, constitutional law scholars said Friday.
Because Florida`s votes are still being counted and given the possibility of legal challenges blocking ballot certification, it is remotely possible that Florida may not appoint its share of 25 electors by December 18, the scholars said.
That means only 513 members of the 538-strong Electoral College would be available to pick either Democrat Al Gore or Republican George W. Bush to be the next president.
Can the remaining electors still pick the president with Florida shut out of the process?
Yes, according to Neal Katyal, a constitutional law professor at Georgetown Universitys law school. He said the 12th Amendment to the U.S. only requires a majority of the electors to vote and nothing in the Constitution says all electors must vote.
Such a scenario could help Gore, he said.
If all 538 members voted, the winner would need 270 votes to be named the next president. But if only 513 electors were present, the requisite majority would be reduced to 257, said Michael Glennon, a constitutional scholar at the University of California-Davis who has written a book on the Electoral College.
Gore is closer to 257 than Bush. In fact, until Friday evening, Gore had 260 electoral votes, compared to Bushs 246.
The likelihood of Florida electors being shut out
Joel Gora, an election-law specialist at the Brooklyn College of Law, said it is highly unlikely that Florida will fail to certify its ballot and appoint electors by December 18.
Soon after the votes are recounted November 17, I think the state would go ahead and certify unless there is a court order otherwise. And I think thats extremely unlikely as a practical matter, but it is possible.
He said allegations over a confusing ballot in Palm Beach County likely would not be sufficient for a Florida judge to put the statewide certification process on hold.
Gora also said the U.S. Supreme Court has not had a case requiring the justices to definitively interpret the 12th Amendments Electoral College provisions.
The prior constitutional crisis
The only time there was a potential constitutional crisis over the Electoral College issue was in 1876, Glennon said.
GOP candidate Rutherford Hayes won 185 electoral votes though Democrat Sam Tilden, who had 184 electoral votes, had won the popular election by a razor-thin margin of less than 1 percent, Glennon said.
Democrats in Congress overruled one of Hayes electors votes and in retaliation Republicans overruled 19 of Tildens electoral votes, Glennon said.
Faced with a constitutional crisis, politicians reached a compromise they appointed a special commission composed of five Democrats, five Republicans and five Supreme Court justices, he said.
After Hayes promised to withdraw Northern troops from the South, the commission awarded all 20 electoral votes to Hayes, making him the president, Glennon said.
To prevent future Electoral College disputes, Congress passed the Electoral Count Act in 1877. The law left the task of choosing electors to the states, but Congress reserved the power to reject any electors vote if a simple majority of members in the U.S. House and Senate agreed that the vote must not be counted, Glennon said.
Yet another scenario
Fast-forwarding to 2000, there is yet another scenario under which Florida electors could cast their votes even if the state fails to certify the ballot by December 18, according to Bruce Fein, a constitutional scholar and lawyer in McLean, Virginia.
Electors for Gore or Bush could still cast their ballots and leave it up to Congress to challenge individual votes if they choose to on January 6, when the electoral votes will be unsealed and tallied, Fein said.
Fein rejected the interpretation of the 12th Amendment and the 1877 law that says choosing electors is a state function. Because Congress has the ultimate authority to accept or reject an electors vote, the issue of whether an elector has been appointed is a matter of federal constitutional law, Fein said.
What`s most likely to happen (is) both the Gore and the Bush electors would go and cast the ballot whether or not there was an official certification by Florida, he said. Why would a state want to disenfranchise itself?

Nachdem jetzt ja am Wochenende auch Palm Beach seine Stimmen ausgezaehlt hat, betraegt der Vorsprung fuer George W. Bush immernoch 388 Stimmen. Die Handauszaehlung wurde zwar von einem Bundesrichter genehmgt, aber die Frage ist, ob sie ueberhaupt etwas nuetzt. In den vier counties wuerde die Handauszaehlung jeweils bis zum Wochenende dauern, jedoch ist nach den Gesetzen in Florida zwingend vorgeschrieben, dass die counties bis heute, Dienstag, 17:00 Uhr Ortszeit ihre Ergebnisse melden muessen. Sollte ein county bis dahin kein offizielles Endergebnis bereitstellen, dann werden alle Stimmen aus diesem betreffenden county fuer ungluetig erklaert. Das schreibt zumindest CNN:
"If county returns are not received by 5 p.m. on
the seventh day following the election," Harris
continued, "all missing counties shall be ignored
and the results on file (with the secretary of
state`s office) shall be certified."
In Palm Beach koennen sie also solange Handzaehlen, wie sie wollen. Wenn sie bis um 5 Uhr nachmittags nicht mit einem offiziellen Ergebnis rueberkommen, werden 425000 Stimmen (mehrheitlich fuer Gore) fuer ungueltig erklaert und letztenendes wird Bush dann mit ueber 100000 Stimmen Vorsprung das Rennen in FLorida fuer sich entscheiden.

Selbstredend klagen die Demokraten gegen die Frist - alles bleibt schön unübersichtlich, die Zahl der kriegsplätze steigt, die Verwiirrung nimmt zu

Wenn die das auf die 100% hochrechnen, frag ich mich, woher die Begründung kommt, dies sei nicht zu rechtfertigen.
So langsam drängt sich der Verdacht der systemaischen Stimmenunterschätzung bei Gore auf;
Spannend ist wohl der Gerichtsentscheid wegen der Frist - wenn die Frist vom gericht aufgehoben wird, wird es echt spannend; Entscheidung um 10:30 Ortszeit
