wohl etwas anders.

Jury finds Affymetrix infringed Oxford patent

WILIMINGTON, Del., Nov 10 (Reuters) - A federal jury on Friday found that biotechnology firm
Affymetrix Inc. (NasdaqNM:AFFX - news) infringed an Oxford Gene Technology Ltd. patent for
technology that quickly determines the activity of genes.

A second trial will now be scheduled on Santa Clara, Calif.-based Affymetrix`s allegation that the
patent is invalid.

If Affymetrix, which leads the market for gene chip arrays used to determine gene activity, loses, there will be a third trial on
Oxford`s claim for up to $40 million in damages.

Affymetrix shares, which were off nearly nine percent, or $7-9/16, to $78-1/8 on the Nasdaq Friday, were halted for news
pending.

Last week, Affymetrix stock rose about 40 percent after a British appeals court ruled that as of June 1, 1999, Affymetrix had
the right to use the technology through its acquisition of a Beckman Coulter Inc. (NYSE:BEC - news) unit, which had a
license for the privately held Oxford patent.

Oxford`s patent, an invention of Dr. Edward Southern of Oxford University in the U.K., is for an ``Apparatus and method for
analyzing polynucleotide sequences and method of generating oligonucleotide arrays,`` which was issued Dec. 23, 1997.

The DNA arrays, or chips, allow researchers to conduct in a few weeks experiments that would otherwise take years to
complete.

At issue in this week`s trial is whether Affymetrix infringed the patent and whether infringement was ``willful``, for the 17
months from the time it was issued until the Beckman acquisition last year.

Meiner Ansicht nach hat sich fundamental an der Firma
überhaupt nichts geändert.
Patentstreitigkeiten werden in Zukunft vermehrt aufkommen.
Und würde daß nicht so sein,dann wäre es keine gute Firma.
Ob da der Kurs -20% oder + 20% gehandelt wird ist wurscht!
Alle wollen in 1 Jahr Reich werden.
Das kann man sich in Zukunft aus dem Kopf schlagen.

Euer alibert! Denkt doch auch mal bis 2003!

Unter der webseite www.biospace.com gibt es zu Affymetrix Pressemeldungen zu den Ereignissen von gestern.Vielleicht kann einer das reinkopieren.( Sorry,keine Ahnung wie man das macht).Seit doch mal ehrlich, nach dem der Kurs gestern ausgesetzt war hatten wir doch alle schon mit einem Kurssturz bis zu 30 % gerechnet.Wenn ich mir das Handelsvolumen am gestrigen Tag anschaue, können die 9% Kursverlust nicht nur Verkäufe gewesen sein.

Affymetrix Infringed Ed Southern`s Microarray Patent


OXFORD, England, Nov. 10 /PRNewswire/ -- The following release was issued
today by Oxford Gene Technology:

The US District Court for the District of Delaware today gave judgement in
a patent infringement action brought by Oxford Gene Technology Limited (OGT)
against Affymetrix, Inc (Nasdaq: AFFX). A jury of eight decided today that
Affymetrix`s process for making and using its GeneChip arrays infringes OGT`s
DNA microarray patent, number US 5,700,637.
The US Court upheld the ruling of the English Court of Appeal delivered
last week that Affymetrix has a licence under OGT`s patent from no earlier
than 1 June 1999 by virtue of its purchase of Beckman Coulter`s array
business. OGT is seeking to appeal that ruling to the House of Lords. If the
House of Lords reverses the Court of Appeal`s decision the US court will apply
the new ruling, so that Affymetrix`s infringement will be continuing. The
present position is that OGT can claim substantial damages for the period up
until the licence was transferred to Affymetrix. If the licence is upheld
today`s ruling means that Affymetrix will be liable for 10% royalties on their
entire future array sales.
It is significant that the trial revealed that Affymetrix technology is
seriously flawed. Dr. Fodor admitted under oath that Affymetrix products
absolutely do not have discrete cell locations. Dr. Fodor stated that
Affymetrix process is simply not capable of producing discrete cells, unlike
printing processes such as those used by OGT and other licensees that do
produce discrete cell locations. Affymetrix also admitted during the trial
that a defect called "light leakage" from the masks used in Affymetrix`s
photolithography process means that the DNA probes on its GeneChip products
are not confined to separate and distinct areas but are scattered all over the
surface. This raises serious questions not only about the effectiveness of
Affymetrix`s products, but also about the validity of Affymetrix`s own
patents, which claim that their process creates "discrete known regions" on
the array.
OGT holds fundamental patents which recognise Professor Edwin Southern`s
pioneering role in the microarray field covering both in situ synthesis and
deposited oligonucleotide probes. OGT wishes to see microarrays used as
widely as possible. OGT does not believe that Affymetrix`s microarray patents
are valid to the extent that they claim broad rights over microarrays in
general.

In addition to its licensing activities OGT has established an operational
arm to develop and commercialise its technology and capabilities. OGT has the
fastest, most flexible technology platform currently available for producing
custom-synthesised DNA microarrays. It has a capacity to produce up to
2 million different custom-specified oligonucleotide sequences per day on DNA
microarrays, translating into an ability to investigate about 60 million base
pairs. These flexible microarrays, which can be used in a trial and error
method, are proving to be the research tool of choice in genomic research,
with considerable advantages over other microarray platforms. As well as
empirically optimised probe sets for the conventional microarray applications
of gene expression analysis and genotyping, OGT is finding a large variety of
other uses specific to individual research projects. Its clients include
major companies in the pharmaceutical, biotech, genomic, agricultural and food
sectors.

Court Finds No Literal or Willful Infringement of `637 Patent
SANTA CLARA, Calif., Nov. 10 /PRNewswire/ -- Affymetrix, Inc. (Nasdaq: AFFX - news) said today that a verdict was returned in the first phase of a suit brought by Oxford Gene Technology Limited (OGT) in the United States District Court in Delaware. The validity of the patent has not yet been addressed, and will be considered in the next phase of the trial. The Company also reported that the same Delaware Court confirmed that Affymetrix holds a valid license to the OGT patent.

The jury found that there was no literal or willful infringement of OGT`s Patent No. 5,700,637 but did say there was infringement under the ``doctrine of equivalents.`` The Court has under consideration motions that if granted would eliminate the finding of infringement under the ``doctrine of equivalents.``

``The most significant news today is the position taken by the Court on the validity of our license,`` said Vern Norviel, Senior Vice President and General Counsel of Affymetrix. ``We will now proceed to challenge the validity of the patent as well as other issues including patent misuse, fraud, and anti-trust violations arising from OGT`s relationship with certain Affymetrix competitors.``

Norviel said that the next phase of the trial will consider Affymetrix` assertion that the OGT patent is invalid and unenforceable.

Depending on the outcome of this second phase, the question of damages may be considered; however, there will be no triple damages or attorney`s fees awarded.

``It is important to note that because the jury found Affymetrix` actions were not willful and the Court held Affymetrix holds a valid license, any potential financial exposure is substantially reduced,`` Norviel said. ``On the other hand, if the patent is found invalid or unenforceable, Affymetrix may be relieved of obligations to pay royalties to OGT.``

Die meisten Analysten äußerten sich positiv zu Affy trotz des Urteils.
Das war meiner Ansicht nach auch der Grund, weshalb sich Affy von dem Tief bei ca 73$ bis zum Handelsschluß auf ca 79$ erholen konnte. Wenn man bedenkt, das Affy sich erholte, obwohl der Markt in den USA noch stärker nachgab (auch Biotec`s Bsp. Millenium über 4% Minus), ist das doch gar keine so schlechte Leistung.

P.S. Affy ist in der vergangenen Woche ca 40% gestiegen, was sind da
-8,2% bei schlechter Börse und schlechten News.

Vorab erstmal, hatte eigendlich vor AFFX längerfr. zu halten. 3-5 Jahre

Mit Stop loss arbeiten ist in moment keine gute Idee bei Affx, ich kann mir vorstellen
das es in den nächsten Tagen sehr Volatil wird.
Aus Charttechnischer sicht sollte es nicht mehr weiter runter gehen, denn der Charttechnische
wiederstand bei 78 - 80$ wurde erst vor kurzen nach oben durchbrochen und ist jetzt als unterstützung
anzusehen.
Wobei man im augenblick den Chart bei AFFX mal eher außen vor lassen sollte.

Werde dir jetzt mal posten was ich machen bzw. bisher gemacht habe.

Kauf xxx zu 55$ ein Tag vor den Quartalszahlen.
Verkauf 2/3 xxx zu 98€
1/3 zurückgekauft zu 92,10€
+- 0 = ca. 52$ also noch ein gutes Polster nach unten hin und eigendlich schon wieder sauer das ich
am Fr. nicht nachgekauft habe zu 73$.

Jetziger bestand wird gehalten, abwarten ist angesagt nur keine Panik.
Schätze das spätestens am Mo. einige Bankhäuser zu AFFX ihre einschätzung abgeben werden.
Dies kann dann in die eine od. andere richtung gehen. Who know´s

Servus zusammen,

AFFX ist ein Basisinvest im Biotechbereich aber man sollte auch mal einen Blick auf die Werte der zweiten
Reihe werfen! Hier tummelt sich GENE LOGIC (corp. mit AFFX) die mit nicht so guten Zahlen in den letzten
Monaten stark runtergeprügelt wurden(zu unrecht?). GLGC ist ein Invest das sich auf eine Scicht v. 12
Monaten auszahlt! Besser wäre natürlich ein Zeitraum von 36 Monaten. GLGC hat einen Cashanteil von
zur Zeit 230 Mil. Dollar!(pro share 9$!!!) Daher sehe ich zur Zeit ein maximales Risiko von 25% einen
Verlust zu erleiden, dagegen sind die Gewinnchhancen astronomisch, natürlich auf eine Sicht von 36
Monaten. Kurzfristig sind bei dementsprechender Nachrichtenlage (2 Kunden sollen noch im Gespräch sein)
schnelle 50% zu erzielen.

Fazit: Ein Zukunftswert mit Wahnsinns Potential
