Peptech leaps as row settled

SHARES in Peptech leapt more than 30 per cent during intra-day market trade yesterday after settlement of a long legal dispute with US company Centocor.
The settlement allows biotechnology company Peptech to use its own anti-TNF (tumour necrosis factor) patent for its own research.
Peptech settled a similar dispute with Chicago-based Abbott Laboratories in 2002.
Peptech executive chairman Mel Bridges said yesterday the company now expected to make a net profit in the year to September 30, 2005, of between $18 million and $21 million.
"That now makes Peptech the second-most-profitable biotech after CSL," he said.
Peptech shares rose 31 per cent during trade to $2.20 and closed 35c higher at $2.03 – up 22 per cent for the day.
"Our licence agreements with Centocor and Abbott Laboratories are non-exclusive and pertain only to particular discoveries within our TNF patent portfolio," Mr Bridges said.
"This allows us to further exploit these patents."
Peptech`s improved earnings would be based on continued licence revenue from Abbott and Centocor and from its male dog contraceptive, Suprelorin, expected to be released in Australia at the end of this year.
Research spending would be increased on Peptech`s anti-cancer program with joint-venture partner Biosceptre and on trails for Suprelorin in the US and Europe, Mr Bridges said.
Peptech had licensed its patents for anti-TNF antibodies to Centocor on a non-exclusive basis in January, 2001.
TNF is a natural hormone contributor to inflammatory diseases such as rheumatoid arthritis and Crohn`s disease.
Centocor is a subsidiary of pharmaceutical giant Johnson & Johnson and stopped paying royalties to Peptech in late 2002, claiming Centocor`s own anti-TNF antibody, Remicade, did not infringe Peptech patents.
Peptech began formal arbitration with Centocor in September, 2003, to determine whether Remicade fell within the scope of the licensed Peptech patents in the US and Europe.
Peptech reported a $28.3 million annual profit earlier this month after losing $15.8 million the previous year.

ich meine den Kurs 1,92 ich danke dem Herren, dass
der Patentstreit nicht verloren gegangen ist.
Die große Frage ist wieviel hat J&J überwiesen?????
21 Mio AUD Profit nach R&D und Steuern.
Abbott zahlt wohl zwischen 6-10 Mio AUD.
An Domantis beträgt die Rate glaub 7,5 Mio AUD.
20 MIO AUD R&D sind wohl drinnen.
Vielleicht 41 Mio AUD. Würde dem Kurs helfen.
Denke heute geht es nochmal runter.
Bis Jahresende hoffe ich auf 3 AUD.
