      MCI Issues October 2003 Monthly Operating Results









      ASHBURN, Va., December 15, 2003 - MCI (WCOEQ, MCWEQ) today filed its October 2003 monthly operating report with the U.S. Bankruptcy Court for the Southern District of New York. During the month of October, MCI recorded $1.977 billion in revenue, essentially flat with September revenue of $1.951 billion.

      The Company had a net loss in October of $194 million, of which $136 million relates to prior period transactions identified as part of the Company`s ongoing restatement process. The net loss reflects a $102 million increase in miscellaneous expense primarily from prior period transactions, as well as a decline in the Company`s operating income.

      In October, the Company reported an operating loss of $35 million, primarily reflecting an increase in the costs of services and products of $32 million as well as an increase in access costs of $51 million resulting from higher volumes and the impact of favorable accrual adjustments in the prior month. Results reflect a reclassification of certain selling, general, and administrative expenses to costs of services and products which had no net impact on operating loss.

      During the month of October, MCI recorded capital expenditures of $74 million. October`s cash balance increased to $5.4 billion from $5.3 billion in September.

      The financial results discussed in the October 2003 Monthly Operating Report exclude the results of Embratel. On November 12, 2003, the Company announced its intentions to sell its investment stake in Embratel. Until MCI completes a thorough balance sheet evaluation, the Company will not issue a balance sheet or cash flow statement as part of its Monthly Operating Report.

      ASHBURN, Va., December 16, 2003 - MCI (WCOEQ, MCWEQ) today announced it has expanded its remote access services to provide traveling and remote workers with additional high-speed wireless access points and the ability to access information from a personal digital assistant (PDA) through a roaming agreement with Boingo Wireless. With the addition of more than 2,000 global wireless hot spot access points to its existing 600 U.S. Wi-Fi locations, MCI is able to provide customers with the tools necessary to conduct business from almost anywhere in the world.

"By expanding our hot spot capabilities internationally and making it possible for workers on-the-go to remain connected, our customers no longer worry about missing important messages no matter where they are."

      MCI Remote Access customers will be able to access corporate networks, applications and email from a personal digital assistant (PDA). By expanding MCI`s Access Manager client to work on a PDA, customers can access the same features and functionality they have come to expect from their remote access solution on a personal computer. Adding PDA accessibility to MCI`s Remote Access solution allows customers to take the functionality of their PC out of the office in a handheld device.

      Through its roaming agreement with Boingo Wireless, MCI has expanded its Wi-Fi remote access capabilities to more than 2,600 global hotspots including hotels, airports, restaurants and convention centers. MCI plans to add an additional 3,000 wired and wireless hotspot locations in 2004.

      MCI Announces Allocation of Note Maturities and Extension of Expiration Date for Election Forms











      ASHBURN, Va. - December 18, 2003 - MCI (WCOEQ, MCWEQ) today announced that the principal amount of the senior notes the Company will issue on its emergence from bankruptcy will be allocated 35 percent to the three-year notes, 35 percent to the five-year notes and 30 percent to the 10-year notes.       Glaube ich nicht, da die Handelsaussetzung vorab bekanntgegeben werden muß. Diese Firma ist ziemlich groß (20 mio Kunden und einige davon wohl auch Aktionäre) und hat die Shareholders bereits arglistig getäuscht, so daß sie sich eine "Nichtmitteilung" einfach nicht erlauben kann, zumal jetzt tendieren die Aktien ja gegen 0. Wenn ich es mir mal rechnerisch überlege, dann komme ich nur auf eine Summe von ca. 32,5 Mio Euro für alle 2,96 milliarden Aktien; es ist wirklich lächerlich billig.

      MCI Teams With North American Aerospace Defense Command To Track Santa`s Journey On Christmas Eve










      --Toll-Free Hotline Enables Children to Connect to NORAD Santa Tracking Team --

      ASHBURN, Va., December 22, 2003- MCI (WCOEQ, MCWEQ) today announced it has once again teamed with the North American Aerospace Defense Command (NORAD) to provide toll-free calling to the NORAD Tracks Santa hotline, so children can track Santa Claus`s global Christmas Eve journey. Beginning December 24 at 7:00 a.m. (MST) through December 25 at 1:00 a.m. (MST), children across the U.S and Canada can call 1-877-HI-NORAD, to determine Santa`s exact location throughout Christmas Eve.

      Using advanced radar and satellite tracking technology, the men and women of NORAD will begin tracking Santa`s worldwide travels in the early morning of December 24. More than 400 volunteers, including MCI employees, will be continuously manning the NORAD Santa Tracking hotline. Callers residing in the local Colorado Springs, Colo. calling area can reach the hotline by dialing 719-474-2111.

      Through its relationship with MCI, NORAD is able to provide toll-free calling for the second time in its 49-year history. Children across America and Canada will be able to access the NORAD Santa Tracking hotline without incurring long distance charges. In 2002, nearly 27,000 calls were received.

      "We`re proud to be donating our time and services to a tradition that warms the hearts of children all over the country," said Jerry Edgerton, senior vice president of MCI Government Markets. "The annual NORAD Tracks Santa Hotline is a creative use of MCI`s toll-free calling service that captures the imagination of children while teaching them how the communications system connects us to individuals and information."

      Real-time information on Santa`s exact location - in English, French, Spanish, Portugese, Italian and Japanese - complete with radar maps and streaming SantaCam video images documenting his global journey past some of the world`s most famous landmarks - are available via the Internet at the "NORAD Tracks Santa" Web site (www.noradsanta.org).

      NORAD is the bi-national U.S.-Canadian military organization responsible for the aerospace defense of the United States and Canada. NORAD was created by a 1958 agreement between Canada and the United States. The agreement has been renewed nine times, most recently in 2000.

      NORAD`s Santa tracking tradition started by accident in 1955 after a local newspaper ran a department store advertisement featuring a special `Santa Hotline` phone number. But instead of ringing a phone at the store, the phone number turned out to be the `Operations Hotline` to Continental Air Defense Command (NORAD`s predecessor).

      The senior officer on duty at the time was Colonel Harry Shoup (who still resides in Colorado Springs). Colonel Shoup took the first call and quickly figured out what had happened after hearing six-year-olds asking if they could speak to Santa. The colonel said he was helping Santa, telling the children he could see Santa on the radar screens heading south from the North Pole.

      Local news media learned of the calls and reported the story. The next year, calls came flooding into Continental Air Defense Command from children who wanted to know where Santa was on Christmas Eve. Thus, a tradition was born - a tradition NORAD assumed in 1957. Since then, the program has gradually grown over the years, expanding to the Internet in 1997 and the introduction of toll-free calling in 2002.

      MCI Enables US Troops in Iraq to Call Home for the Holidays











      Company to Provide Free Phone Calls December 22 - January 5

      ASHBURN, Va., December 22, 2003 - In an effort to bring military families, friends and loved ones together this holiday season, MCI is providing free telephone calls December 22 through January 5 to US Armed Forces personnel stationed in Iraq. In addition, MCI is distributing prepaid calling cards, reducing calling rates and making resources, technology and employee support available around the world for military personnel and their families. "When you can`t be home for the holidays, a phone call can lift your spirit and ease your mind," said Jerry Edgerton, senior vice president of MCI Government Markets. "MCI is proud to help bring families together this holiday season, especially for the service men and women defending our country."

      For those service members in Iraq, MCI has established calling locations at strategic military sites in the country. The MCI calling centers will be outfitted with more than 45 phones and military personnel will be able to make free calls 24 hours a day, seven days a week. In addition, the calling centers will be connected to a network MCI built in Iraq to specifically support morale phone calls.

      In an effort to help those military troops and families traveling through, stationed or recuperating in the United States, MCI has provided more than 93,000, 100-minute pre-paid calling cards to military support groups for distribution this holiday season. Calling cards have also been provided to Walter Reed and Bethesda Medical centers and for distribution at Baltimore Washington and Atlanta Hartsfield airports.       MÜNCHEN (COMPUTERWOCHE) - Den gigantischen Bilanzskandal hat die US-Beschaffungsbehörde General Services Administration Worldcom/MCI schnell verziehen: Das Unternehmen wurde von einer schwarzen Liste genommen, die ihm verbot, um neue Regierungsaufträge mitzubieten oder bestehende Kontrakte zu verlängern. Dort war MCI seit Juli vergangenen Jahres aufgeführt. Gutes Timing, denn in vier Tagen steht ein Großvertrag von MCI über die Bereitstellung von Telefonie-, Daten und Videodiensten für verschiedene Behörden zur Erneuerung an. Der als "FTS2001" bekannte Deal gehört zu den größten der öffentlichen US-Hand und brachte MCI laut GSA-Sprecher David Drabkin im vergangenen Jahr rund 400 Millionen Dollar Umsatz. Die anstehende Verlängerung um ein Jahr bezeichnete Drabkin als "wahrscheinlich".
      MCIs Chairman und CEO, der frühere Compaq-Chef Michael Capellas, erklärte in eine Stellungnahme, sein Unternehmen habe alles unternommen, um sich zu rehabilitieren: "Die heutige Entscheidung der GSA ist ein Zeichen für Vertrauen in die neue MCI."       Presse: Insolvente WorldCom plant Abbau von weiteren 1.700 Stellen







      LONDON (dpa-AFX) - Der US-Telekommunikations-Konzerns WorldCom Inc. plant laut einem Pressebericht, weitere 1.700 Stellen im Rahmen seines Insolvenzverfahrens zu streichen. Dies entspreche etwa drei Prozent der gesamten Belegschaft, berichtete die Tageszeitung "Washington Post" am Freitag unter Berufung auf informierte Kreise. Allgemein wird mit der Entlassung des Unternehmens aus dem Gläubigerschutz in wenigen Wochen gerechnet.

      Das Unternehmen habe seit Beginn des Insolvenzverfahrens bereits mehr als 22.000 Stellen gestrichen, hieß es in dem Bericht weiter. WorldCom war in einen der schlimmsten US-Bilanzskandale verwickelt. Die Gesellschaft hatte Verluste von rund elf Milliarden US-Dollar verheimlicht./jkm/FX/jb/sk

      MCI Issues November 2003 Monthly Operating Results













      ASHBURN, Va., January 16, 2003 - MCI (WCOEQ, MCWEQ) today filed its November 2003 monthly operating report with the U.S. Bankruptcy Court for the Southern District of New York. During the month of November, MCI recorded $1.79 billion in revenue versus $1.98 billion in October 2003, reflecting fewer business days during the month and non-recurring equipment sales in October 2003.

      November`s operating loss of $21 million was $14 million better than October, with lower access costs and a sales, general and administrative (SG&A) reduction of $144 million which more than offset the lower revenue levels.

      The Company had a net loss in November of $23 million, an improvement of $171 million from October. The improvement resulted from lower restatement items compared to October.

      During the month of November, MCI recorded capital expenditures of $90 million. November`s cash balance increased to $5.7 billion from $5.4 billion in October.

      The financial results discussed in the Monthly Operating Reports exclude the results of Embratel. On November 12, 2003, the Company announced its intentions to sell its investment stake in Embratel. Until MCI completes a thorough balance sheet evaluation, the Company will not issue a balance sheet or cash flow statement as part of its Monthly Operating Report.

      MCI Provides 2004 Financial Guidance








      Company on track for February 2004 emergence from Chapter 11

      ASHBURN, Va., January 22, 2004 - MCI (WCOEQ, MCWEQ) today provided financial guidance for full-year 2004. MCI expects to generate revenue between $21 billion and $22 billion, a decline of approximately 10 to 12 percent versus expected 2003 results, primarily reflecting overall industry conditions and continued declining trends in the consumer market. Operating income is expected to be between $1.1 billion and $1.3 billion, which includes depreciation and amortization of $1.7 billion and restructuring charges of approximately $100 million, resulting in an increase of $300 million to $400 million versus expected 2003 results. Net operating cash flow is expected to exceed $1 billion, after capital expenditures of 6 to 8 percent of revenues, but including proceeds from the sale of certain non-core assets.

      The Company remains focused on delivering an innovative set of products and services which take advantage of advancements in converged voice and data networks, as well as an aggressive cost reduction program, which includes a reduction of sales, general and administrative (SG&A) expense by 15 to 20 percent versus expected 2003 results. The Company expects to achieve this reduction through increased on-net utilization, selective outsourcing, attrition and workforce reductions as necessary. MCI remains on track to emerge from U.S. Chapter 11 protection in February 2004.

      Business Markets revenue, which includes sales to U.S. domestic enterprise customers, is expected to decline 6 to 8 percent versus 2003. Continued competitive pricing pressure, especially in Small and Medium-sized Business and traditional long-distance services, is expected to be partially offset by gains in new product offerings, such as multi-protocol label switching (MPLS) and other Internet-protocol (IP)-based services, as well as a broad range of Managed Services offerings.       MCI Files for an Extension to Conclude Chapter 11 Process












      Extension to Ensure Accuracy and Quality of Filings

      ASHBURN, Va., Feb. 11 /PRNewswire-FirstCall/ - MCI (WCOEQ, MCWEQ) today announced it has filed in U.S. Bankruptcy Court for a 60-day extension, from the current February 28, 2004 deadline, to formally emerge from Chapter 11. The extension would give the company sufficient time to complete its filings with the Securities and Exchange Commission (SEC), the last significant task to be completed before the company emerges. It would expand the time period for MCI to satisfy all conditions necessary to emerge from 120 days to 180 days, which is a common timeframe for large Chapter 11 cases. MCI would be able to file and emerge at any time during the 60-day extension period.

      With the exception of completing its financial filings, MCI has satisfied all significant tasks required for its emergence, including obtaining all federal and state regulatory approvals. The Company has also secured approval from its creditors.

      MCI Reacts To Triennial Review Ruling















      BACKGROUND: The U.S. Court of Appeals for the District of Columbia Circuit today released its ruling on the Federal Communications Commission`s (FCC) "Triennial Review" local telephone competition order. This order established the framework under which competitors can access the Bell-controlled public phone network. MCI and other competitive local exchange carriers joined with the FCC in defending portions of the order that ensure consumer choice in the local telephone market.

      The court sharply restricted the ability of MCI and other companies to offer local phone service to residential customers by denying competitors the right to lease the facilities still controlled by local Bell monopolies. Without access to those facilities, MCI and others simply cannot continue to offer lower prices and better residential services. The D.C. Circuit also denied competitors the ability to provide innovative broadband services on fiber facilities. If the Court’s opinion is not stayed, consumers will be impacted in as few as 60 days.

      The following statement should be attributed to Stasia Kelly, MCI general counsel:

      "Congress had envisioned that the Telecom Act would open local markets to competition and ensure that consumers have freedom of choice when it comes to local residential service. Yet, eight years later, local phone competition is still under attack.

      "Eliminating the FCC`s local competition rules scraps the significant progress we have made to deliver consumers lower rates and innovative service. Three and a half million consumers have chosen MCI for local service over the Bells, and more than 19 million households now use a local phone provider other than the Bells. Additionally, local competition has spurred network investment and created tens of thousands of jobs.

      "The D.C. Circuit`s decision leaves us with little choice but to seek an emergency stay and full review from the U.S. Supreme Court.

      "It is imperative that the FCC continue the fight to preserve competition, by taking this case to the Supreme Court for a definitive decision. Millions of Americans will pay the price if the FCC does not act to protect their interests."

      MCI Completes Restatement And 2002 Audit













      Financial Filing Successfully Finalizes One of the Last Remaining Steps to Emerge from Chapter 11

      ASHBURN, Va., March 12, 2004 - MCI (WCOEQ, MCWEQ) today announced it has filed its annual report on Form 10-K for the year ended December 31, 2002 with the Securities and Exchange Commission.

      The report contains the Company`s consolidated financial statements for 2002. In addition, the report contains financial statements for 2001 and 2000 that are restatements of previously reported financial results.

      The restatement process included revalidation and correction of accounting records, review of the accounting for all major acquisitions dating back to 1993, reassessing the propriety and appropriateness of the application of accounting principles, and a re-audit of the financial statements. The restatements have no impact on the Company`s current operations or liquidity.

      "This filing culminates the largest and most complex financial restatement ever undertaken," said Bob Blakely, MCI executive vice president and chief financial officer. "It is one of the last remaining milestones on our path to emerge from Chapter 11 protection. We appreciate the dedication and hard work of the MCI employees, as well as those at Deloitte & Touche, who participated in this process, and KPMG who audited the financials."

      The restatement process resulted in adjustments to revenues, expenses and earnings as well as write-downs of assets and adjustments to liabilities. These adjustments and write-downs resulted in a cumulative net reduction of $74.4 billion to previously reported pre-tax income for 2000 and 2001.

      "While these restatement adjustments are substantial they do not have any impact on our current substantial liquidity position," said Blakely. At the end of 2003, the Company`s consolidated cash and cash equivalents was approximately $6 billion. The largest category of restatement adjustments is impairment charges resulting from write-offs of goodwill and write-downs in the carrying value of other intangible assets and property, plant and equipment in 2000 and 2001. The impairment charges for 2000 and 2001 total $59.8 billion.

      Other significant restatement adjustments are related to the Company`s review of significant acquisitions as far back as 1993. As part of this review, fair value allocations and purchase price calculations were re-performed. Restatement adjustments to correct errors in the application of purchase accounting for the acquisitions totaled $5.8 billion during 2000 and 2001.

      The remaining restatement adjustments to 2000 and 2001 pre-tax income total $8.8 billion. Included in this amount are $4.8 billion of charges to pre-tax income to correct access costs that had been reduced either by the improper capitalization of the expenditures as additions to property, plant and equipment or by inappropriate reductions to accrual balances.

      As restated, consolidated revenues were $32.2 billion in 2002, $37.7 billion in 2001, and $39.3 billion in 2000. These results include the revenues of Embratel, the Company`s Brazilian affiliate. The Company had a net loss of $9.2 billion in 2002, $15.6 billion in 2001, and $48.9 billion in 2000, including the restatement adjustments.

      The Company is continuing work on its 2003 financial statements and expects to emerge from Chapter 11 protection in April 2004.

      Role of non-executive Chairman created as part of Company`s corporate governance reforms

      ASHBURN, Va., March 16, 2004 - MCI (WCOEQ, MCWEQ) today announced its Board of Directors has elected former U.S. Attorney General Nicholas Katzenbach as non-executive Chairman of the Board, effective upon MCI`s emergence from Chapter 11 protection. Katzenbach has been an MCI Board member since July 2002.

      Concurrently, Michael Capellas, who has been MCI chairman and CEO since December 2002, will become MCI president and CEO. The separation of the chairman and CEO roles is part of MCI`s corporate governance reforms.

      MCI Statement on Workforce Reduction Plans









      Background: MCI today announced that it is reducing its workforce by approximately 4,000 employees as part of its ongoing cost reduction program. The majority of this reduction comes from closing three consumer call centers and reducing staffing in three others, in large part due to the effects of "Do Not Call" telemarketing laws. MCI announced earlier this year that it expects to reduce costs by 15 to 20 percent.

      The centers being closed are located in Denver; CO; Phoenix, AZ; and Niles, OH. Staffing is being reduced at MCI facilities in Alpharetta, GA; Colorado Springs, CO; and Springfield, MO.

      The following statement can be attributed to MCI:

      "As a result of the impact of federal and state `Do Not Call` laws, as well as ongoing telecom market trends, we need to take this action in order to improve our overall cost structure. These actions will in no way impact our ability to serve our customers."

      Die Aktien werden zu neuen Höhen aufsteigen und so mancher wird feuchte Augen bekommen vor Begeisterung. Es herrscht bezüglich Aktien alt/neu auch Nachrichtensperre bei Worldcom/MCI. Deshalb die Ruhe vor dem Sturm. Es ist etwas " im Busch" !
      Wie bei so vielen anderen Aktien in Ch.11 in der Vergangenheit sind nun einige 100% nach oben drin. Eine formidable Lizenz zum Geld drucken. Viel Spaß uns allen beim Geld machen...

      MCI Reaches Agreement on Framework for Negotiations











      Background: MCI today announced that the company has reached an agreement with Qwest on a framework for transparent and mediated negotiations regarding access to the public telephone network. These open negotiations will be monitored by Cheryl Parrino, former Chair of the Wisconsin Public Service Commission and former CEO of the Universal Service Administrative Company. This agreement came in response to MCI approaching Qwest and the other Bell companies in the wake of MCI CEO Michael Capellas` April 1 letter to the FCC accepting the commissioners` call for mediated negotiations.

      MCI Board of Directors Adopts Shareholder Rights Plan










      ASHBURN, Va., April 20, 2004 - MCI, Inc., (MCIAV.PK) today announced its Board of Directors has adopted a Shareholder Rights Plan designed to protect company shareholders in the event of takeover activity.       MCI Signs Amended Embratel Sale Agreement with TELMEX












      ASHBURN, Va., April 21, 2004 - MCI Inc. (MCIAV.PK) today announced that it has signed an amended agreement with Teléfonos de México, S.A. de C.V. (NYSE: TMX; NASDAQ: TFONY) for the sale of MCI`s equity stake in Brazilian telecommunications provider Embratel Participações (NYSE: EMT). The new agreement, which has been approved by the MCI Board of Directors, increases the cash purchase price to be paid by Teléfonos de México (TELMEX) to $400 million from $360 million and establishes a $12.2 million transaction termination fee.

      The amended agreement also provides for a $50 million up-front payment to MCI by TELMEX - which would be retained by MCI if the proposed transaction cannot be consummated because of the inability to obtain regulatory approvals.

      MCI has filed the amended sale contract with the U.S. Bankruptcy Court for the Southern District of New York and has requested a hearing to approve the termination fee on April 26, 2004. If the termination fee is not approved by the Court, TELMEX will have the option of reducing the purchase price to $360 million.

      The Bankruptcy Court hearing for approval of the sale to TELMEX is scheduled for April 27, 2004.

      MCI Updates 2004 Earnings Guidance






      ASHBURN, Va., April 29, 2004 - MCI, Inc. (MCIAV.PK) today updated earnings guidance for 2004 following the filing of its 2003 Form 10K. Changes in guidance reflect the application of Fresh Start accounting, the anticipated sale of the Company`s interest in Embratel Participacoes S.A., and continuing competitive industry fundamentals.

      MCI expects to generate revenue in 2004 at the lower end of previous guidance of $21 billion to $22 billion. In 2003, the Company reported revenue of $27.3 billion, which included $3.0 billion from Embratel. The Company announced in March 2004 its plans to sell its Embratel interest and, accordingly, will classify Embratel as a discontinued operation in the second quarter of 2004. Projections for 2004 discussed in this release exclude the operations of Embratel.

      MCI expects revenue from its global, high-end enterprise and government markets businesses to decline approximately 7 percent versus 2003, outperforming the overall Business Markets segment, which remains exposed to a challenging wholesale pricing environment. Overall Business Markets revenue is expected to decline 12 percent to 14 percent compared to 2003 revenue of $14.1 billion.

      International revenue is expected to decline 2 percent in 2004, reflecting stable volumes in the Europe, Middle East and Africa region (EMEA), new entries into emerging markets and an assumed favorable effect of foreign currency exchange. In 2003, International revenue (excluding Embratel) was $3.9 billion. MCI continues to operate the largest facilities-based network, with the highest number of Company-owned points-of-presence of any international carrier.

      The Company continues to expect Mass Markets revenue to decline 20 percent to 25 percent, reflecting the negative impact of Do Not Call legislation, increasing wireless substitution and ongoing pricing pressure. To offset these challenges, Mass Markets will continue to focus on U.S. local services and expects to launch a voice-over Internet protocol (VOIP) initiative this year. In 2003, Mass Markets revenue was $6.4 billion.

      "Our solid enterprise customer base, industry-leading IP strengths and ability to serve businesses globally positions us as a strong competitor in a fast-changing market," said Bob Blakely, MCI executive vice president and chief financial officer. "We believe our strong balance sheet and positive cash flow will allow us to weather the difficult environment that prevails in the telecommunications industry today."

      Operating income before depreciation, amortization and expenses associated with the early retirement of assets is estimated at $2.1 billion to $2.3 billion in 2004, compared to $3.0 billion in 2003, exclusive of Embratel, which contributed $552 million in 2003. The reduction reflects margin compression driven by continued pricing pressure and the anticipated unfavorable effect of regulatory changes on access costs. Selling, general and administrative expenses are expected to decline 8 percent to 10 percent in 2004.

      Depreciation and amortization expense will increase sharply to approximately $2.2 billion in 2004 from $1.7 billion contemplated in previous guidance, reflecting the adoption of Fresh Start accounting. In 2003, MCI recognized depreciation and amortization expense of $2.6 billion. The Company also anticipates that it will incur approximately $150 million to $200 million of non-cash expense related to the early retirement of assets.

      MCI expects to incur net interest expense of $415 million to $425 million in 2004.

      MCI estimated that costs associated with its reorganization will be approximately $100 million in 2004. Other non-operating costs are estimated at $50 million to $65 million. MCI projects a tax rate of approximately 39 percent for 2004.

      Although aggressive cost reductions and network consolidation initiatives are expected to return the Company to profitability in the second half of 2004, MCI currently expects to generate a net loss for the full year.

      The Company`s cash position remains strong. On its December 31, 2003 balance sheet, the Company reported cash and equivalents of $6.2 billion, or $5.6 billion exclusive of Embratel. Of this total, approximately $2 billion will be disbursed to fulfill emergence claims. In 2004, cash flows provided by operating activities plus proceeds from the sale of non-core assets less capital expenditures is expected to exceed $800 million. The $2 billion expected to be disbursed for emergence claims is not included in the estimate of cash flows provided by operating activities.

      According to the assumptions included in the Company`s plan of reorganization, MCI will issue approximately 326 million shares to meet reorganization claims.

      Capital Expenditures
      MCI has invested $38 billion in its network during the last six years, placing it in a strong position to benefit from the industry`s move toward IP. Today, MCI`s IP network can connect customers to more places, more directly than any other IP network in the world. Continuing to invest for the future remains a high priority, and the Company expects 2004 capital expenditures to equal approximately 5 percent of revenue. MCI is expanding its MPLS footprint that supports the convergence of voice and data, as well as investing in network security products and advanced applications features.

      Fresh Start Accounting
      On April 20, 2004 the Company emerged from bankruptcy. MCI implemented Fresh Start accounting to its financial statements effective December 31, 2003, in accordance with generally accepted accounting principles (GAAP). Accordingly, the company adjusted its balance sheet to a new basis of accounting. The most important mechanics of this process include adjusting assets values, liabilities and shareholders` equity for the effects of the Company`s plan of reorganization.

      This process also impacted the 2003 income statement and resulted in a $22.1 billion gain on the line item "Reorganization Items, net." This gain is composed primarily of the discharge of debt obligations, offset partially by the amounts of new debt and stock issued to settle the claims of creditors, as well as other reorganization items.

      First Quarter Results
      MCI plans to release first quarter operating results on May 10, 2004.

      The MCI-Qwest agreement -- reached after five weeks of mediated negotiations between the carriers -- comes less than 90 days after the D.C. Circuit Court issued a decision vacating Federal Communications Commission (FCC) wholesale pricing rules. Today`s agreement provides for both wholesale pricing continuity for MCI and a guarantee that such services will continue to be available.

      "This is a historic day for our industry. Qwest and MCI proved that two companies, that are direct competitors, can embrace the principals of a free-market economy and reach a commercial services agreement that will allow them, together, to serve customers well," said Richard C. Notebaert, Qwest chairman and chief executive officer. "While this agreement was forged without any regulatory assistance, we would like to thank FCC Chairman Michael Powell, for his continued support and encouragement to identify a solution to this complex industry issue."

      "It has been MCI`s position that good faith commercial negotiations can result in agreements that reflect the changing industry landscape and avoid complex regulatory proceedings and litigation," said Michael D. Capellas, president and chief executive officer of MCI. "This agreement proves that a negotiated outcome is not only possible, but mutually beneficial."

      Good Faith Negotiations

      Both companies expressed their commitment to good faith negotiations early in the process. In an April 1, 2004, letter to the FCC, MCI`s Capellas endorsed carrier-to-carrier negotiations and the concept of a suitable mediator, as long as negotiations were conducted openly and transparently. On April 15, 2004, Qwest invited all of its wholesale customers to participate in mediated negotiations, and, together with MCI, jointly hosted industry negotiations. At that time, Qwest was the only ILEC to agree to mediated, as well as group, negotiations.

      The companies worked together closely to select a mutually acceptable mediator, with both agreeing on Cheryl Parrino, former chairman of the Public Service Commission of Wisconsin and president of the National Association of Regulatory Utility Commissioners. MCI has participated in both mediated group forums and one-on-one mediated negotiations with Qwest. This deal is a product of those negotiations.

      "The mediation process worked well because MCI and Qwest came to the negotiations with a desire to find a solution that would work for both parties," said Parrino. "I was very impressed both with the desire of the participants to understand and address each others` business needs and their ability to find creative solutions to some of the most difficult issues."

      The agreement, which is unique within the industry, maintains existing prices through December 31, 2004; creates a reasonable transition period through January 2007; provides for incremental price adjustments at scheduled points within the transition period; and eases MCI`s transition to facilities-based service offerings.

      To better reflect market conditions, the deal includes a residential and business price split which addresses the unique market needs of these very different customers and results in a smaller rate increase for CLECs that serve residential customers in Qwest`s territory. Additionally, rates are geographically sensitive. In total, rates for Qwest`s "Qwest Platform Plus" (QPP) -- which will replace the unbundled network element (UNE) platform that MCI currently buys under regulatory rules -- will increase an average of less than $5 - including both residential and business customers -- by the end of the transition period. Certain non-recurring charges that MCI incurs to move its customers to its own facilities will decrease.

      The agreement includes Qwest DSL services, as well as other services not previously available with a combined wholesale service, providing MCI with the opportunity to access new features and functionality at a discount - specifically, Advanced Intelligent Network (AIN) services and Qwest Voice Messaging services.

      Provisions aimed at enabling MCI to transition customers to its own facilities include mutually agreed upon pricing for batch hot cuts -- the process through which multiple customer lines are moved from a Qwest switch to a competitor`s switch. The batch hot cut prices may be discounted based on the total number of lines in service. The deal also includes new electronic scheduling and online status tools to make the batch hot cut process more efficient and cost effective for both parties. Additionally, the agreement includes commercial-quality-assurance measures to ensure MCI continues to receive the highest-quality wholesale service.

If the FCC`s rules are allowed to lapse and wholesale rates rise MCI may be forced to raise prices in some markets and pull out of others.

      Nationwide, more than 19 million consumers have already switched their residential phone service from the monopoly Bell to a competitive provider, including more than 3.5 million who have chosen MCI`s all-distance service, The Neighborhood. The Administration`s decision will clearly disrupt the marketplace. Without competition, consumers will soon find themselves with higher rates, lower quality of service and less innovation."

      ASHBURN, Va.; LINTHICUM, Md; LOWELL, Ma. - JUNE 15, 2004 - In an unprecedented joint industry effort, MCI, Inc. (MCIA.PK), CIENA® Corporation (NASDAQ: CIEN) and Mintera Corporation today announced they have achieved the world`s fastest Ultra Long-Haul (ULH) connection at 40 Gigabits Per Second (Gbps) - four times faster than the highest-speed ULH routes deployed today. Utilizing an MCI long-haul network route spanning more than 1200 km, the technology trial highlights how the MCI network can seamlessly activate 40 Gbps ULH wavelengths to facilitate the roll-out of next-generation IP-based services over its existing 10 Gbps backbone.

      The technology trial took place over MCI`s ULH Dense Wavelength Division Multiplexing (DWDM) optical network route between Sacramento, CA and Salt Lake City, UT. This network route was selected because it uses the company`s existing fiber plant, and includes a mix of fiber - TrueWave Classic, Dispersion Shifted Fiber (DSF), Long Span Fiber (LS) and Single Mode Fiber (SMF), illustrating the real-world scalability of the MCI network. Mintera`s production quality MI 40000 40 Gbps DWDM fiber optic transport terminals interoperated directly on CIENA`s CoreStreamTM Agility optical transport system, which provides an automated ULH backbone for the MCI network. MCI demonstrated true "plug and play" capability of 40 Gbps transmission with the ULH system. The 40 Gbps wavelength was commissioned in less than an hour, and then performed error-free on the same optical fibers already carrying 10 Gbps wavelengths throughout the trial.

      Auf keinen Fall sinnvoll, denn eine wertlose Ausbuchung bedeutet, daß Du auf alle weiteren Ansprüche, die sich ggf. nach Beendigung der noch ausstehenden Verfahren gegen WorldCom ergeben könnten, verzichtest. Bedenken solltest Du auch, daß Du nach einer `wertlosen Ausbuchung` des Aktienbestandes den Verlust steuerlich nicht geltend machen kannst (die letzte Möglichkeit, die Aktien zu verkaufen, war der 23.04.2004). An Deiner Stelle würde ich die Aktien behalten und abwarten.

      Kennt jemand diese Mitteilung? Ab wann muss man die Aktien besitzen? Denn wenn es wirklich so wäre, wäre die angebotene Ausbuchung unklug.

Using an Ethernet over SONET infrastructure, MCI will provide carrier-grade service reliability backed by 100 percent availability and a two-hour Mean Time To Repair (MTTR) service level agreement (SLA) for On-net services.

      MCI`s Metro Private Line Ethernet Service provides a dedicated, highly reliable point-to-point service between locations within the same LATA through a standard, high speed Ethernet interface, while supported by a 100 percent network availability SLA for On-net services.       While most VoIP services offer a "9-1-1 like" solution, MCI has provided "true 9 1 1," or E9 1 1, capabilities by utilizing the existing 9-1-1 network to route calls to the appropriate Public Safety Answering Point (PSAP) since 2001. This allows the VoIP caller`s location and phone number to be automatically displayed in front of the 9-1-1 call taker so emergency assistance can be dispatched to a location even if the caller cannot communicate. In addition, it ensures that 9-1-1 calls are routed to the local emergency response teams for the area where the call was placed.

      "It is our goal to have all the 9-1-1 calls utilize the E9 1 1 systems," said Roger Hixson, National Emergency Number Association (NENA) Technical Issues Director. "If the public is able to make a telephone call from a broadband VoIP `telephone service,` they should be able to reach 9-1-1 services in an emergency. MCI`s deployment of its VoIP service is proof that true 9-1-1 services, including location identification, can be provided today for customers at fixed locations."

      The "9-1-1 like service" provided by others in the VoIP industry compromises a customer`s ability to access emergency services via 9-1-1 because calls route to an agency`s 10-digit telephone number that may not be answered at the same priority as a 9-1-1 call. In addition, the caller`s telephone number and location may not be displayed and if a caller is unable to respond or does not know their current location information, emergency response could be delayed or worse, fail to respond.

      "Having important information, such as caller`s location, display automatically is invaluable when it comes to responding to an emergency situation where every second counts," said Richard Atkins, Assistant Director, Tarrant County 9-1-1 District in Fort Worth, Texas.       Ashburn, Va., August 5, 2004 - MCI, Inc. (NASDAQ: MCIP) today reported its operating results for the three-month period ended June 30, 2004 (second quarter).

      Revenues in the second quarter were $5.2 billion, a decline of 4 percent sequentially and 15 percent from the same period last year.

      MCI`s sales, general and administrative (SG&A) expenses were $1.3 billion in the second quarter, an improvement of 18 percent sequentially and 17 percent versus second quarter 2003. The Company realized operating income of $41 million versus a $265 million loss in first quarter 2004 and operating income of $324 million in second quarter 2003. Reported operating income also included depreciation and amortization of $569 million in second quarter 2004.

      MCI`s net loss for the period was $71 million or ($0.22) per share versus a net loss of $388 million or ($1.19) per share in first quarter 2004 and net income of $8 million in second quarter 2003.

      "We did what we said we would do. By executing against our business plan, we produced second quarter results that reflect solid, measurable progress and significant financial improvements," said Michael D. Capellas, MCI president and chief executive officer. "To remain competitive we will continue to drive operational improvements, deliver unparalleled customer service and introduce new IP-based products and services to the marketplace."

      The results of Embratel, a Brazilian affiliate, were classified as discontinued operations in the second quarter and, therefore, are excluded from continuing operations. MCI reached an agreement in March to sell its 19 percent stake in Embratel for $400 million to Telmex, $50 million of which was received prior to June 30, 2004. The sale was completed on July 23, 2004 and the Company received the remaining balance of $350 million.

      With these results the Company has initiated segment reporting by its three business segments. These are:

      Enterprise Markets, which incorporates its largest global corporate and government customers, MCI Solutions and Conferencing;
      U.S. Sales and Service, which incorporates national accounts, and small and medium businesses that comprise its Commercial business, as well as its Mass Markets business; and
      International and Wholesale, two separate businesses utilizing its voice telecommunications, data services, Internet and managed network services.
      Liquidity

      On March 31, 2004, MCI`s cash and cash equivalents totaled $5.9 billion, excluding Embratel. During the second quarter the Company paid approximately $1 billion of bankruptcy claims. On June 30, 2004, cash and cash equivalents totaled $5.4 billion excluding Embratel, which has been classified as an asset held for sale.

      Total debt of $6 billion included approximately $295 million of capitalized leases. MCI issued $5.7 billion of Senior Notes on April 20, 2004, which have not yet been rated by credit rating agencies. The Company has initiated discussions with the rating agencies and presently expects the process to be completed by the end of 2004.

      On May 19, 2004, MCI announced that its Board of Directors had initiated a study of the Company`s liquidity requirements with a view toward identifying any excess cash as defined in Section 5.07 of the Plan of Reorganization. Today the Board declared excess cash of $2.2 billion and initiated a return of capital in the form of a quarterly cash dividend of $0.40 per share. The first dividend will be paid September 15, 2004 to shareholders of record on September 1, 2004.

      Chance für Worldcom-Anleger

      Der US-amerikanische Bankkonzern Citigroup hat im Mai 2004 einem Vergleich zugestimmt, der Worldcom-Aktionären und –Anleihebesitzern insgesamt 2,65 Milliarden US-Dollar bringen wird. Das ist die zweithöchste Summe, die je im Rahmen einer US-Sammelklage („class action“) ausgehandelt wurde. Jetzt liegt das Formular vor, mit dem die Anleger ihre Ansprüche anmelden können.

      Das Geld wird unter allen Anlegern aufgeteilt, die ihre Papiere in der Zeit vom 29. April 1999 bis zum 25. Juni 2002 („class period“) gekauft haben und ihre Ansprüche rechtzeitig geltend machen. Unabhängig davon, ob sie selbst an der Klage beteiligt waren oder nicht. Angemeldet werden die Ansprüche mit dem so genannten „proof-of-claim-and-release-Formular“, das ab heute bei der Deutschen Schutzvereinigung für Wertpapierbesitz (DSW) unter der Telefonnummer 0211/6697-02 kostenlos angefordert werden kann. „Alle Anleger, die während der class period Worldcom-Papiere erworben haben, sollten diese Chance unbedingt nutzen“, sagt DSW-Hauptgeschäftsführer Ulrich Hocker.

      Der Citigroup war vorgeworfen worden, noch zum Kauf von Worldcom-Aktien geraten zu haben, als in der Bank die desolate Lage des Telekomunternehmens bereits bekannt war. Worldcom war aufgrund massiver Falschbuchungen in Höhe von rund 11 Milliarden US-Dollar in eine dramatische Schieflage geraten.

      ASHBURN, Va., September 28, 2004 - The European Court of First Instance in Luxembourg today overturned a June 28, 2000 decision by the European Commission that blocked the company, then known as WorldCom, from merging with Sprint. The decision has been in the appeals process for the past four years. The Court ruled that the European Commission`s (EC) decision was procedurally defective, removing it as a legal precedent.

      MCI: Weitere Banken einigen sich mit ehemaligen WorldCom-Aktionären








      Wie ein Rechnungsprüfer des US-Bundesstaates New York am Mittwoch bekannt gab, haben vier ausländische Banken im Rahmen eines Vergleichs mit den Aktionären der ehemaligen WorldCom Inc. der Zahlung von insgesamt 428,4 Mio. Dollar zugestimmt. In einer Sammelklage werfen die Aktionäre der heutigen MCI Inc. den Kreditinstituten vor, auf Risiken, die später zum Zusammenbruch der zweitgrößten US-Telefongesellschaft für Fernverbindungen geführt haben, nicht hingewiesen zu haben.

      Demnach teilte der Rechnungsprüfer Alan Hevesi mit, dass die ABN AMRO Inc., die US-Tochter der niederländischen ABN AMRO Holding N.V., 278,4 Mio. Dollar zahlen wird. Die Mitsubishi Securities International plc, die britische Sparte der japanischen Mitsubishi Tokyo Financial Group Inc. (MTFG), wird 75 Mio. Dollar zahlen, während die BNP Paribas Securities Corp, die US-Sparte der französischen BNP Paribas S.A., und die Mizuho International plc, die britische Sparte der japanischen Mizuho Financial Group Inc., jeweils eine Zahlung von 37,5 Mio. Dollar leisten werden.

      Die Bank of America Corp., die drittgrößte Bankgesellschaft in den USA, teilte vor einer Woche mit, dass sie 460,5 Mio. Dollar zahlen wird, um sich mit den ehemaligen WorldCom-Aktionären zu einigen. Im Vergleich zur Bank of America hat die Citigroup Inc., die größte Bank in den USA, im vergangenen Jahr 2,58 Mrd. Dollar im Rahmen eines Vergleichs gezahlt.

      Vergangene Woche gab zudem die Lehman Brothers Holdings Inc. bekannt, dass sie sich mit einer Zahlung von 62,7 Mio. Dollar einigen wird, während die Credit Suisse Group Inc., die Goldman Sachs Group Inc. und die UBS AG die ehemaligen WorldCom-Aktionäre jeweils mit rund 12,5 Mio. Dollar abfinden werden.

      Zu weiteren Banken, die in der Sammelklage der WorldCom-Investoren involviert sind und sich noch nicht geeinigt haben, zählen die J.P. Morgan Chase & Co. und die Deutsche Bank AG.

      Der WorldCom-Konzern hatte im Juli 2002 Gläubigerschutz nach Chapter 11 beantragt. Im vergangenen Jahr konnte der Konzern als MCI Inc. aus dem Gläubigerschutz austreten und ist derzeit Gegenstand einer Übernahmeschlacht zwischen den Telefongesellschaften Verizon und West.

      Die Aktie von MCI schloss gestern an der NASDAQ bei 23,64 Dollar (-0,38 Prozent). Die Aktie von ABN AMRO Holding notiert in Amsterdam derzeit bei 20,59 Euro (-0,72 Prozent), die von BNP Paribas in Paris bei 55,30 Euro (+0,09 Prozent). Die Anteilsscheine der MTFG und der Mizuho Financial Group beendeten den Handel in Tokio heute bei 955.000 Yen (-0,72 Prozent) bzw. 522.000 Yen (-1,32 Prozent).

      krieg ich da evtl. auch was oder nicht?
      hab bisher keine anträge weggeschickt und hatte die aktie frühjahr 2000 gekauft und dezember 2000 wieder verkauft. damals noch 14,45 euro pro stück :-)

      Wenn du an der Class-Aktion bzw. das Proof of Claim and Release- Formular Achtung: Frist zur Einreichung der Unterlagen in den USA ist der 04.03.2005, dann kannst du auch keine Ansprüche mehr stellen!!!!!!!!!!!!!!
      Nur wenn du an der Anspruchsanmeldung im Rahmen der US-Sammelklage teilgenommen hast , besteht die MÖGLICHKEIT ; --WAS VON DEINEM GELD-- zurück zu bekommen.

      US-Sammelklagen: Auch deutsche Anleger können profitieren

      Die Regelungen zum Schutz der Privatanleger im deutschen Kapitalanlage- und Aktienrecht sind bekanntlich unzureichend. Insbesondere die Möglichkeit, Schadenersatzansprüche gegen pflichtwidrig handelnde oder fehlerhaft informierende Vorstände durchzusetzen, ist in Deutschland heute faktisch nicht gegeben. Erst durch die Umsetzung des 10-Punkte-Plans der Bundesregierung soll dieser Missstand aufgehoben werden.



      Blickt man in die USA, so bieten sich dem Anleger weitreichendere gesetzliche Grundlagen und zudem die Möglichkeit einer kollektiven Anspruchsstellung. Grundlage der meisten schadensersatzrechtlichen Verfahren in den USA ist § 10 (b) des Securities Exchange Act (SEA). Dieser sieht vor, dass marktrelevante Tatsachen nicht vorsätzlich oder fahrlässig unrichtig und unvollständig dargestellt werden dürfen. Wurde gegen diese Vorschrift verstoßen, haben die Anleger die Möglichkeit, in einer Gemeinschaft ihre Vermögensschäden ersetzt zu verlangen.



      Die Vorteile derartiger Sammelverfahren sind vielschichtig.



      Neben dem Kostenvorteil ist vorgesehen, dass das jeweilige Unternehmen gezwungen werden kann, alle Dokumente vorzulegen, die mit dem Rechtsstreit in Zusammenhang stehen. Es bedarf also nicht einzelner Beweisanträge, wie dies im deutschen Zivilprozessrecht der Fall ist. Daher werden viele Verfahren durch einen vorzeitigen Vergleich beendet.

      Eine der wesentlichsten Vorteile für die betroffenen Anleger ist, dass diese nicht zwingend notwendig selbst als Kläger auftreten müssen, um in den Genuss etwaiger Schadenersatzzahlung zu gelangen. Wird ein Vergleich geschlossen oder ein Urteil verkündet, so haben auch die nicht bis dahin nicht aktiven Anleger die Möglichkeit, ihre Ansprüche befriedigt zu erlangen. Notwendig ist dann allein, dass die geschädigten Aktionäre ihre Ansprüche ähnlich dem deutschen Insolvenzrecht anmelden.



      Besonders zu betonen gilt, dass die betroffenen Anleger kein Kostenrisiko zu tragen haben. Dieser Umstand beruht darauf, dass im Gegensatz zu der deutschen Regelung US-amerikanische Anwälte ein Erfolgshonorar verlangen und dieses von der im Vergleich oder im Urteil festgesetzten Schadenersatzsumme vor Verteilung abgezogen wird.



      Für die deutschen Anleger besteht regelmäßig die Schwierigkeit, von derartigen Sammelverfahren oder von deren Ausgang Kenntnis zu erlangen. Der Anleger ist gehalten, sich die entsprechenden Informationen selbst zu beschaffen. Dies ist möglich über die Homepage der betroffenen Aktiengesellschaft. Diese ist nach dem US-Recht verpflichtet, über die sie betreffenden Sammelverfahren zu berichten.



      Zudem ist die DSW betroffenen Anlegern behilflich bei dem Erhalt und Ausfüllen der in englisch gehaltenen Anmeldeformulare. DSW-Mitglieder erhalten diese nebst einer in deutsch verfassten Ausfüllanleitung bei der Düsseldorfer Zentrale oder per Emailanfrage hier.

      Meine Bestätigungspostkarte von der Garden City Group ist heute gekommen. Habe das Formular alleine ausgefüllt - ohne DSW und ohne Ebay - und schon größte Bedenken weil ich solange nichts gehört habe. Nach 4 Wochen hätte man ja wegen der ausbleibenden Postkarte nachfragen sollen, aber es scheint ja noch alles in bester Ordnung zu sein.

      Gute Nachrichten für Worldcom-Geschädigte


      Jetzt sind 6,1 Milliarden Dollar im Topf. Die zuständigen US-Richter haben entschieden, dass die 14 Vergleiche, die in erster Linie Banken im Zuge der Worldcom-Pleite mit geprellten Anlegern geschlossen hatten, zu einem einzigen Verfahren zusammengefasst werden. „Das sind sehr gute Nachrichten für die geprellten Investoren. Der Aufwand sinkt dramatisch. Statt 14 Anträge stellen zu müssen, reicht jetzt einer. Zudem eröffnet dies allen, die bisher noch nicht aktiv geworden sind, die Chance, ihren Teil der 2,65 Milliarden Dollar zu bekommen, die die US-Großbank Citigroup zahlen muss", kommentiert der Hauptgeschäftsführer der DSW (Deutsche Schutzvereinigung für Wertpapierbesitz), Ulrich Hocker, die Entscheidung.

      Ansprüche auf Schadenersatz aus dem Citigroup-Vergleich konnten eigentlich nur bis zum 22. März geltend gemacht werden. Jetzt ist für den gesamten 6,1-Milliarden-Dollar-Topf der 26. August 2005 maßgeblich. „Wer bereits einen Antrag in Sachen Citigroup-Verfahren gestellt hat, muss nicht mehr aktiv werden", erklärt DSW-Experte Marc Tüngler.

      Ebenfalls verlängert wurde die Anmeldefrist für Ansprüche auf die 750 Millionen Dollar, die das Unternehmen MCI, Rechtsnachfolger von Worldcom, nach einer Einigung mit der New Yorker Börsenaufsicht SEC (Securities and Exchange Commission) an die Betroffenen zahlt. Galt bisher der 19. Juli als Schlussdatum, haben die Anleger jetzt Zeit bis zum 19. August.

      Anspruch auf das Geld haben in beiden Fällen ausnahmslos alle Anleger, die ihre Worldcom-Papiere in der Zeit vom 29. April 1999 bis zum 25. Juni 2002 gekauft haben. Die für die Anmeldung notwendigen „proof-of-claim-and-release-Formulare" können von der Internetseite der DSW (www.dsw-info.de) unter dem Menüpunkt „Anlegerschutz" kostenlos herunter geladen werden. „Wer kein Internet hat, kann die Unterlagen unter 0211/6697-01 natürlich auch telefonisch anfordern", sagt Tüngler.

      NEW YORK (Dow Jones)--Bernard J. Ebbers, ehemaliger CEO der Worldcom Inc, ist
      am Mittwoch von einer New Yorker Distriktrichterin zu einer Haftstrafe von 25
      Jahren verurteilt worden. Für die Zeit nach seiner Entlassung wurde eine
      weitere dreijährige Überwachung für den heute 63-Jährigen
      angeordnet. Bereits im März hatte eine Jury den Manager des Betrugs im
      Zusammenhang mit dem Bilanzskandal für schuldig befunden. Worldcom hatte
      nach Bekannntwerden der Bilanzfälschung Insolvenz anmelden müssen.
      Beobachter erwarten, dass Ebbers gegen seine Verurteilung in Berufung geht.

      In der laufenden Woche hatte der ehemalige CEO bereits den Großteil
      seines Vermögens abgegeben, um eine Sammelklage gegen ihn im Zusammenhang
      mit dem Bilanzskandal beizulegen.

      ACHTUNG: Sofern Sie eine Korrekturaufforderung des Administrators erhalten, beachten Sie die 30-Tage-Frist zur Einreichung der fehlenden Unterlagen





      Derzeit besteht weder im Rahmen des Sammelklageverfahrens noch im Rahmen des VictimTrust-Verfahrens die Möglichkeit, Ansprüche anzumelden. Eine Anspruchsanmeldung war zuletzt bis spätestens zum 12. September 2005 eröffnet.

      Nachträglich einen Antrag bei den Administratoren einzureichen, ist nach unseren Erfahrungen wenig sinnvoll. Ob zu einem späteren Zeitpunkt die Möglichkeit einer Anspruchsanmeldung wieder eröffnet sein wird, ist eher unwahrscheinlich.



      Aktuell registrieren und prüfen die Administratoren im Sammelklageverfahren und auch im VictimTrust-Verfahren die Vollständigkeit und Richtigkeit der von den Antragstellern übermittelten Anträge.



      Wurden beim Ausfüllen Fehler gemacht oder sind die verlangten Angaben nicht vollständig eingetragen, erhalten Sie in den nächsten Wochen auf dem Postweg eine Aufforderung des Administrators zur Ergänzung oder Korrektur Ihrer Angaben. Sofern Sie ein solches Schreiben des Administrators erhalten, überprüfen Sie bitte genau, welche konkreten Angaben der Administrator von Ihnen verlangt.

      Die Schreiben der Administratoren sind üblicherweise so aufgebaut, dass auf der ersten Seite mittels Ziffern dargestellt wird, welche Angaben in Ihrem Antrag fehlen oder aber nicht nachvollziehbar sind. Die jeweiligen Kennziffern werden im Anhang dann erläutert.



      Hinweis:

      Eine sehr häufige Fehlerquelle ergibt sich im steuerlichen Bereich. So müssen Sie nachweisen, dass Sie kein Bürger der Vereinigten Staaten sind und auch nicht dort residieren. Sofern Sie unserer Aufforderung gefolgt sind und eine Kopie Ihres Personalausweises Ihrem Antrag beigefügt haben, sollten diesbezüglich keine Probleme auftauchen. Vielfach wurde jedoch die Beilage einer Kopie des Personalausweises vergessen oder diese Voraussetzung war nicht bekannt. In diesem Falle werden Sie aufgefordert, Ihre Sozialversicherungsnummer, EIN oder ein so genanntes W-8BEN Formular für „nicht US-Bürger“ an den Administrator zu senden.



      Von den drei angeführten Varianten erscheint uns die Sendung eines W-8BEN Formulars am geeignetsten. Dieses Formular finden Sie bitte unter auf dieser Seite zum Download eingestellt. Das Formular ist sehr einfach aufgebaut. Letztendlich müssen Sie allein Ihre persönlichen Daten dort eintragen und nochmals mit Ihrer Unterschrift bestätigen, dass Sie nicht Bürger der USA sind.
