Ahold DRITTER Akt , morgen!!!

@Simonswald

Ahold Shares Fall 10% as Questions About Company Grow
By ERIC PFANNER
International Herald Tribune
ONDON, March 4 — Shares of Royal Ahold N.V. fell about 10 percent today as analysts questioned the embattled supermarket operator`s ability to survive as a going concern and investigations broadened on both sides of the Atlantic into accounting irregularities at the company.
A memo from Ahold`s legal department told employees that the United States Justice Department had issued subpoenas seeking a range of documents from the Dutch company, which operates the Stop & Shop and Giant supermarket chains in the United States.
The documents involve the company`s financial statements, audits, board meetings, promotional allowances offered by the company`s U.S. Foodservice subsidiary and the resignation of Ahold`s two top executives last week when the company announced that it had overstated its earnings by $500 million or more.
The Dutch Authority for Financial Markets, meanwhile, confirmed reports that Ahold, the world`s third-largest grocer, had told regulators about the financial irregularities four days before it disclosed them to investors and announced a new financing agreement with a group of banks.
Euronext Amsterdam, the European exchange on which Ahold shares are traded, said the company failed to inform it of the accounting problems at the same time that it discussed them with regulators. While delays in disclosure are sometimes permitted for companies that are restructuring their finances, the exchange must grant this permission, a spokesman said.
"When we were notified by Ahold, we stressed that there was this rule at Euronext regarding disclosure of information, and they told us that they were fully aware of it," said Seger Bijnenburg, a spokesman for the Dutch authority, which is conducting an investigation to determine whether Ahold insiders may have benefited from the information.
Ahold did not return repeated telephone calls seeking comment.
Ahold shares have fallen more than 65 percent since the company publicly disclosed the accounting problems, which center on U.S. Foodservice. They fell another 35 euro cents in Amsterdam today, to 3.25 euros. In New York, Ahold`s American depository receipts dropped 43 cents, to $3.63.
Analysts at Dresdner Kleinwort Wasserstein downgraded their rating on Ahold`s stock today to "sell," warning in a note to investors that pressures on the company`s finances are likely to grow. Some suppliers are likely to push the company for more rapid payments, the analysts said, and its debt-service costs are expected to grow after the ratings agency Standard & Poor`s Corporation downgraded Ahold`s debt to junk-bond status.
Though Ahold says it has received commitments for 3.1 billion euros in new financing, Dresdner analysts said the banks might make that contingent on asset sales.
European retailers like Tesco P.L.C. of Britain and Carrefour S.A. of France refused to comment on speculation that they or other rivals might be interested in a bid for Ahold.
In the meantime, inquiries on both sides of the Atlantic are continuing.
Among other things, the Authority for Financial Markets is investigating an anonymous letter sent to Dutch newspapers that makes charges of bribes at Ahold`s Argentinian subsidiary, Disco, and "secret bonuses" paid to executives at U.S. Foodservice.
