      NEW YORK - Back in the day, WorldCom and its chief, Bernie Ebbers, were known for their creative dealmaking; they were forever buying smaller--and sometimes larger--phone or data companies, usually with WorldCom shares. Now the U.S. Securities and Exchange Commission and a U.S. District Court are getting into the spirit of things by offering former WorldCom shareholders, or "victims of the fraud" as they are now called, $250 million in shares of the new WorldCom, in addition to the $500 million in cash they have been promised as part of the company`s reorganization.

      The idea was suggested at a hearing last month by Judge Jed Rakoff, one of the federal judges overseeing the WorldCom (nasdaq: WCOEQ - news - people ) bankruptcy, and was formally proposed by the SEC. Rakoff and a federal bankruptcy judge must still approve the plan, which is designed to give former shareholders a stake in the new reorganized company, to be known as MCI. It`s a novel idea because generally the interests of common shareholders are wiped out in Chapter 11 reorganizations and because the SEC usually demands penalties be paid in cash, not stock.

      But in WorldCom`s case, shareholders are also potential claimants in a fraud action since the WorldCom bankruptcy was precipitated by the revelation of accounting misdeeds that have already been valued at more than $9 billion and might reach $11 billion by the time the auditors sort it all out. The $500 million--plus the $250 million stock kicker--is part of an SEC-imposed penalty.

      The company once had a market value in excess of $180 million, but it had lost the vast majority of that total by the time the fraud was revealed in June 2002. The misdeeds had started perhaps three years earlier, but the fraud failed to stop a near-total reversal of fortune for WorldCom shareholders. Even before the accounting fraud came to light, the various bond-rating companies had downgraded WorldCom`s debt to "junk" status and the stock was selling for less than $2 a share.

      WorldComs`s planned reorganization estimates that the equity value of the company post-bankruptcy would be about $7.9 billion--though there are numerous caveats on that estimate, which was done by Lazard Freres, WorldCom`s financial adviser. The $250 million in shares the old shareholders would take away represents about 3% of that total.

      To date, the SEC has brought civil actions against four former employees of WorldCom: former controller David Myers, former director of general accounting Buford "Buddy" Yates Jr., and former accountants Betty Vinson and Troy Normand. Yates and the former chief financial officer, Scott Sullivan, have also been indicted on criminal charges. All the cases are pending. Ebbers, former CEO and chairman, has not been charged.

      MCI will 750 Mio USD an WorldCom-Aktionäre zahlen

      New York (vwd) - MCI, die frühere WorldCom Inc, will Aktionären, die aufgrund des WorldCom-Bilanzskandals Verluste erlitten haben, 750 Mio USD als Entschädigung bezahlen. Dies teilte MCI am Mittwochabend mit. Damit sei die ursprüngliche Summe von 500 Mio USD um 50 Prozent erhöht worden. Die Einigung sei mit der Börsenaufsicht SEC erzielt worden und müsse nun vom zuständigen Gericht genehmigt werden. Ein Drittel der Summe werde in MCI-Aktien bezahlt.

      Die Aktien sollen ausgegeben werden, sobald MCI reorganisiert ist und an der Börse gehandelt wird, wie es weiter heißt. MCI erwartet, im Herbst aus dem Verfahren von Chapter 11 entlassen zu werden. MCI habe die Entschädigungssumme erhöht, nachdem der zuständige Richter Jed Rakoff Bedenken geäußert hatte.

      ein teil der summe soll in mci aktien gemacht werden, also spekulieren die meisten auf die? ich würde da wohl eher die finger von lassen. beobachten werde ich sie aber weiter.

      vielleicht geht es ja manchen so wie mir
      Heute habe ich diese Mail an MCI/Worldcom geschrieben und
      schon habe ich die Antwort oder auch nicht

      Regarding yesterday`s announced revised settlement of $750 MIL with the SEC, the settlement is before Judge Rakoff in NYC for review. If he approves it, a court monitor will be appointed to determine who is eligible and oversee distribution of funds/stock. We do not know how this process will work. No distributions will be made until after the company emerges from bankruptcy in the fall. If Judge Rakoff approves the plan, there will be information about this up on our Web site shortly thereafter.

      Hallo zusammen,

      also hätte mal eine Frage bzgl. Worldcom (MCI):
      Welchem Kurs der alten Worldcomaktien entspricht denn die Sunmme von 750 Mio Dollar?

      Hab vor 2 Monaten aufgehört mich dafür zu interessieren aber jetzt scheint sichs wieder zu lohnen.
