Gerüchte von Neuverhandlungen bis Reduzierung auf 100 Mille laufen um.
Abwarten und Tee trinken.

What to expect from the court today

After reflection , it seems likely that the motions that were heard yesterday and today will not be decided until the conduct trial is over.
I recall Judge Whyte using the word "deferred" yesterday.
The reason is simple. There is no need to decide these motions now.
The summary judgmenet motions for the the "conduct " trial are much more pressing.
It does look like Judge Whyte is intent on keeping the last part of this trial on schedule and there was some discussion of the
timing of the final pretrial case management meeting.
As to the prejudgment interest and damages, I do not believe that Judge Whyte will alter the jury verdict. However, he appears to be using this isssue to pressure Rambus into being more serious about settlement talks. There does not appear to be anything wrong with the jury's verdict.
The written description JMOL motion has no legs. JUdge Whyte would have to go against the CAFC and the jury and also his own previous ruling to change anything here.
The invalidity JMOL issue also is simply a regurgitation of what has already been presented at trial.
In oredr for Hynix to prevail on the later two JMOL's they have to show by "clear and convincing" evidence that the jury was wrong and that the wriiten description does not support the claims and that the claims are invaled. This dog just waon't hunt.
The prejudgement interest has to be revisited later in order to recompute the damages when the judge enters a date for final judgement.
Thus the interest rate issue does not need to be decided until then. That is likely to be the end of Q3 for Hynix.
We are going to have another briefing at 2 today on the remaining infringement JMOL put forth by Hynix. However, these JMOL need not be decided today and probably will not be decided until after the end of the final "conduct" trial.
In the meantime, the Judge keeps pressure on both parties to settle this case.
Thus attention shifts now to the "conduct trial"
