At appoximately 11:15 AM Eastern RMBS stock was sold off at the pace of $3 on 3M shares in a matter of minutes. For those of us that were following the sudden death roll, we witnessed what could only be described as a "guilty ruling of spoliation and Patents not enforceable by Judge Whyte". But then an interesting thing happened; December call options at strike prices from 15 to 22.5 received heavy volume. Then, after volume slowed and enough stop loss orders had been removed the price of RMBS moved 12% higher off it`s low. Most RMBS holders have seen this high volatility before but the difference this time was the sellers were the ones moving the option prices higher during the free fall. When enough stop loss orders had been removed and hundreds of thousands of dollars of call options had been purchased it was time to move the stock price higher via buy-covers. Many individual investors were left with jaws hanging on the floor trying to justify the actions they had witnessed. What conclusion can be drawn from such a chaotic event?
1)Never trust big money.
2)Never trust your broker. They work for the brokerage firm not you.
3)Never trust Market Makers. It`s a business for them and business is about making money.
4)Never and I mean NEVER use stop losses of any kind on volatile stocks. Either fly naked or pay the premium associated with protective puts!
5)Always have a clean pair of underwear close by for this type of day! This one should be obvious by now for RMBS investors.
The good news in all of this is that this type of chaos happens for one reason only. There is big news coming soon and that news is positive for the stock in question. For those of you that were burned today via stop losses, keep your chin up and get back on the bus because this time, it`s a one way ticket!

Rambus (RMBS:Nasdaq - commentary - research - Cramer`s Take) traded heavily Friday as investors fretted about its suit against Korean competitor Hynix Semiconductor.
Shares of Rambus opened sharply lower and traded as much as 17% below Thursday`s close before recovering ground to trade at $16.81, down 5%.
The flurry came a day after a federal judge accepted Samsung`s guilty plea in a related price-fixing case. In its deal with the Justice Department, Samsung, the world`s largest maker of memory chips, agreed to pay a $300 million fine for conspiring to fix memory chip prices. Hynix agreed to pay a $185 million fine earlier in the year, while Infineon Technologies (IFX:NYSE - commentary - research - Cramer`s Take) has agreed to pay a $160 million fine.
Rambus filed a patent infringement suit against Hynix in 2004, based in part on the price-fixing allegations involved in the government`s criminal investigation of the memory makers. The case is being heard by Judge Ronald Whyte in federal court in San Jose and is slated to go to trial in January.
While there have been no recent developments in Rambus` patent case, some investors may have interpreted the fact that Judge Whyte did not immediately throw out a motion by Hynix to dismiss the case in the wake of yesterday`s guilty plea as bad news.
"I think it`s pure speculation," said WR Hambrecht analyst Daniel Amir, who has no positions or business relationships with Rambus.
"People are just waiting for a ruling," said Amir. "And the stock trades on speculation."

Heute nachmittag habe ich tief in die Tasche gegriffen und Rambusaktien gekauft. Das mache ich jetzt seit Anfang 2000 und bisher hat es noch jedesmal gekracht.

Bis jetzt jedenfalls keine News. Große Shortpositionen mußten eingedeckt werden, bevor Whytes Urteil rauskommt.
Wie das aussieht, ist zumindest mir klar. Ich hab null Zweifel, dass das zu Gunten Rambus ausfällt. Selbst wenn "spoliation" von Whyte festgestellt werden sollte, was ich nicht glaube, wird Whyte "nur" eine Strafe gegen Rambus verhängen und nicht die Patente für ungültig erklären. Niemals! Eine Verbindung von vernichteten Dokumenten zur Beeinträchtigung der Verteidigung von Hynix konnte nicht aufgezeigt werden und das ist ein MUSS, zumindest bei Whyte.
Whyte kennt seine Pappenheimer und blickt hinter die Kulissen. Er lässt sich Zeit um das Urteil hieb- und stichfest zu machen. Keine Sorgen, es geht voran.
