Ein US-Berufungsgericht bestätigt die Gültigkeit eines Patents zur Eingabe von Informationen ohne Tastatur. Den von der Vorinstanz festgelegten Schadenersatz lehnt es als überhöht ab. Das Urteil betrifft Outlook, Money und Windows Mobile.

Ein Berufungsgericht in Washington D.C. hat ein Urteil gegen Microsoft und damit auch die Gültigkeit eines von Alcatel-Lucent eingeklagten Patents bestätigt. Allerdings hat das Gericht entschieden, dass der in der Vorinstanz festgelegte Schadenersatz von 358 Millionen Dollar überhöht ist.

Das ursprünglich von AT&T-Ingenieuren beantragte Patent beschreibt Methoden zur Eingabe von Informationen ohne die Verwendung einer Tastatur. Lucent hatte anfänglich im Jahr 2002 den Computerhersteller Gateway wegen Patentverletzungen verklagt. In der Folge hatte sich Microsoft eingeschaltet. Ein weiterer Beklagter ist Dell.

Dem Urteil zufolge verstößt ein Tool zur Auswahl von Kalenderdaten in Outlook sowie ähnliche Funktionen in Microsoft Money und Windows Mobile gegen das vom Gericht als "Day Patent" bezeichnete Schutzrecht. In Bezug auf den Schadenersatz urteilte das Gericht, dass es keinen Beweis für eine weit verbreitete Nutzung des Tools bei Kunden und somit für die Berechnung des Schadens gebe.

Alcatel-Lucent hatte acht Prozent der von Microsoft mit Outlook erzielten Umsätze gefordert, während der Softwareanbieter 6,5 Millionen Dollar angeboten hatte. Das Patent verletzende Feature sei nur ein kleiner Teil eines umfangreichen Programms und daher sei "der Anteil des Profits, der dem Tool zugeordnet werden kann, äußerst gering", heißt es im Urteil.

Beide Parteien zeigten sich zufrieden mit der Entscheidung des Gerichts. "Wir freuen uns, dass das Gericht den Schadenersatz aufgehoben hat", sagte Microsoft-Sprecher Kevin Kutz. Alcatel-Lucent hingegen begrüßte die Bestätigung seiner Patentansprüche durch das Berufungsgericht.

Der Fall ist nur eine von mehreren Patentrechtsstreitigkeiten zwischen den beiden Unternehmen. In den letzten Jahren trafen sich Alcatel-Lucent und Microsoft auch wegen Patenten für das MP3-Format, Kommunikationstechnologien und Verfahren zur digitalen Sprachkompression vor Gericht.

DÜSseldorf - Die WestLB hat die Aktie von Alcatel-Lucent von "Neutral" auf "Reduce" abgestuft und das Kursziel auf 2,50 Euro gesetzt. Die Aktie des Technologiekonzerns habe sich in den vergangenen Monaten sehr gut entwickelt und das Kursniveau spiegele zur Zeit einen überbordenden Optimismus wider, schrieb Analyst Thomas Langer in einer Studie vom Dienstag. Der Markt für Telekomausstattung werde auch im kommenden Jahr schwach bleiben. Eine mittelfristige Verschmelzung von Alcatel und NSN sei nicht auszuschließen. Dennoch sei eine Übernahmeprämie derzeit noch nicht gerechtfertig

Wie die auf eine mögliche Verschmelzung von NSN und Alcatel kommen, ist mir ein Rätsel. Macht für mich keinen Sinn, nochmals zwei Schwache zu einem Grossen zusammenzuführen. Den gleichen Fehler hat man schon einmal gemacht. Die Huawei-Kiste ist viel plausibler.
Interessant für den Kurs sind solche Spekulationen aber allemal.

Der Kurs mag zwar etwas überhitzt sein, aber die zwei fuffzig der WestLB finde ich untertrieben, dafür ist viel zu viel Fantasie in diesem Wert (LTE, IP-TV etc.).
