Mmmhhh, naja, unsichere Sache mit vielen Fragen. Und dafür setzt man den Handel aus. Da hatte ich mir mehr erwartet.
Schon SIEMENS hat SAINT GOBAIN verklagt und hat Recht bekommen:
Für die jeweilige Gegenseite könnte das richtig teuer werden. Saint Gaubain kann davon ein Lied singen. Schließlich mussten die Franzosen Siemens einen Schadenersatz in Höhe von 52,3 Mio. USD für die Verletzung eines Kristall-Patentes zahlen.

Siemens wins $52.3M PET/CT patent suit, Philips files another
A jury in the U.S. District Court of Delaware has found that Saint-Gobain Ceramics & Plastics infringed Siemens Medical Solutions USA’s patent rights concerning scintillator crystals used in PET/CT machines. The jury has awarded Siemens $52.3 million for the unintentional infringement.
In the lawsuit, which was filed in April 2007, Siemens asserted that Saint-Gobain infringed on its U.S. Patent No. 4,958,080 by selling patented Lutetium-based scintillator crystals to Philips Healthcare for use in Philips’ Gemini TF time-of-flight PET/CT scanners, according to Bloomberg.
The worldwide market for PET scanners is worth about $2 billion, according to Siemens' lawyer Gregg LoCascio.
U.S. District Judge Sue L. Robinson, in a pre-trial ruling in January, said the case didn't "weigh predominantly in plaintiff's favor" after the Siemens unit, based in Malvern, Pa., sought an order to stop Saint-Gobain Ceramics from selling its diagnostic PET crystals, Bloomberg reported.
In separate PET/CT patent-related news, Philips Healthcare confirmed that it filed for patent infringement on Sept. 3 against Siemens Medical, accusing the company of infringing a patent for technology used in various imaging systems, including PET/CT.
The Philips’ patent that Siemens allegedly is infringing is U.S. Patent No. 5,525,905, which concerns a multimodality patient table and a computer that can be used on different imaging systems, such as CT or PET.
While Philips confirmed the filing, both companies told Health Imaging News that they cannot comment any further on pending legal matters.
Philips claims that Siemens’ Biograph PET/CT scanner uses technology it developed and patented in 1996. Philips is seeking cash compensation and a court order to prevent further use of its invention, according to the complaint filed in U.S. District Court, Northern District of Ohio, Bloomberg reported.

Das Verfahren hat anscheinend von April 2007 bis spätestens October 2008 gedauert, also mehr als 1 Jahr.
Und wenn SIEMENS gegen SAINT GOBAIN geklagt hat und nun ZECOTEK nun auch SAINT GOBAIN meines Wissens wegen den gleichen Kristallen (LYSO) verklagt,
dann sind die Kristalle von SIEMENS und ZECOTEK ja wohl auch ähnlich oder gleich, oder versteh ich da was falsch?
Logischerweise müsste dann ja entweder SIEMENS auch ZECOTEK oder ZECOTEK auch SIEMENS verklagen?
Komisch.
Ich hatte mir mehr von einer Handelsaussetzung erwartet, ganz ehrlich.

I had to take some time to make sure that our patents are secured and we are well protected. The real question surrounding our patents is “Would we litigate?” The answer is yes. If someone, anyone, were to infringe on our technologies we are ready to go. We have well established legal firms behind us, who are ready to it on contingency. They have studied our patents and are determined when necessary."

Nur, weil ich hier Jahre nicht mitgelesen habe, "neckt" Ihr Feivel eigentlich, weil er jahrelang voll investiert die kleinen ups und die tiefen downs mit durchgemacht hat ? Ein echter "Titan" Long also, der seine Stimmungsbilder hier zeitweise postet ? Natuerlich sind "Trader" erfolgreicher aber ist nicht jemand wie Feivel ... dass Rueckgrat solcher Unternehmen und weiss er nicht vielleicht viel mehr ueber ZMS, als all die reinraus Flutschies ?
In diesem Falle wäre ich ziemlich glücklich darüber, nicht im Recht gewesen zu sein. Aber eine Schwalbe macht noch keinen Sommer. Die Sache hatten wir schon einmal und es kam nix dabei raus. Also sollte man abwarten, sich informieren und dann die Situation neu beurteilen.
