The Department of Special Investigation (DSI) will scrutinise its own investigators after the Southern Bangkok Criminal Court acquitted executives of Picnic Corp Plc of a charge of accounting fraud. Kraisorn Baramee-auaychai, DSI acting director-general, said the investigators in charge will be put under the microscope by a sub-panel which will establish how the brother and sister of former deputy commerce minister Suriya Larpwisuthisin came to be acquitted of the charges.

If the probe finds no flaw, the DSI will go to the Appeals Court, he said.

The Securities and Exchange Commission (SEC), which filed the original complaint on June 30, 2005, said it will appeal.

The SEC accused Theeratchanon and Supaporn Larpwisuthisin and 20 associates of violating the 1992 Securities and Exchange Act through accounting fraud and embezzlement.

The two were accused of changing the company's revenue figure between April 1 and Sept 1, 2004 from 178 million baht to 400 million. They claimed the revenue came from the rental of gas tanks by other defendants and loan interest.

The court ruled that the evidence and witness testimony presented to the court by the prosecutor failed to prove the guilt of the accused. The accused, however, had presented to the court all lawful rental and loan contracts proving the sources of the company's rising revenue.

Prasong Vinaiphat, SEC deputy secretary-general, said the commission would consult the prosecutor handling the case about its appeal, and review its evidence to find weak points.

''The SEC had worked closely with the DSI in constructing the case against Picnic before forwarding it to the prosecutor, which accepted the case and took it to court.

''We'll review the court verdict, correcting the mistake before sending the case to the Appeals Court,'' Mr Prasong said.

Mr Kraisorn said he would raise the Picnic case as an example for DSI staff to be more prudent in future.

''Previously, I opposed issuing arrest warrants in cases of suspects being involved in irregularities related to the sale of financial institutions because I was concerned that if the evidence was incomplete, the court might acquit them. The Picnic case is a good example that DSI staff should be more circumspect,'' said Mr Kraisorn.

The Justice Ministry's permanent secretary Jarun Pukditanakul said he would review all important cases the DSI had concluded or forwarded to the National Counter Corruption Commission (NCCC).

Senior people should not intervene in the consideration of cases and DSI officials should not heed them, he added when asked if the Picnic case had been subject to requests from politicians.


Thirachai Phuvanatnaranubala, SEC secretary-general, said there are four other lawsuits at the Criminal Court the SEC has lodged against three companies _ Power P, Circuit Electronic Industries, and Picnic.

''The SEC made the accusation when we found wrongdoing. Another organisation is responsible for handing down the verdict,'' he said.

''If we didn't take action against wrongdoers, our staff would be liable to the charge of dereliction of duty;
