Received from A. Clifton Hodges, here's the PDF of a formal letter, detailing Michael Cottrell's response to statements made by Benjamin Fulford, including in Fulford's by-subscription newsletter for November 27.
In short, the letter says "...the battle is now joined -- we will file suit in every available jurisdiction and prosecute the litigation to the fullest."

Assuming the three judges rule that Al has the right to appeal, he will again make his case to the Ninth Circuit Court that they should hear his case as he has submitted it. e.g. as a Bivens-based law suit. If they agree, we would go into the Discovery Phase, and Al would finally be able to ask the hard questions to various SEC staff and other people he thinks have useful information to fully make his case.
However, if the Court stays with their original decision, Al would then be free to take his appeal to the Supreme Court.
How important is Discovery? Imagine if Al could get Leslie Hakala under deposition, under threat of criminal liability if found lying to the court (e.g. Perjury), where he can ask the following questions:
Ms. Hakala, can you tell me when you first became aware that CMKM Diamonds was not meeting its reporting requirements? “What did you do about it?
When were your Superiors notified about this? Did you inform them? What did they say to you?
Ms. Hakala, can you tell me when you first became aware that CMKM Diamonds was promoting its stock at various professional racing and other promotional events? Were you concerned since they weren’t meeting their reporting requirements? Why not”
When were your Superiors notified about this? Did you inform them? What did they say to you?
Ms. Hakala, can you tell me when you first became aware that John Edwards and other insiders were selling their Shares. When did you start to investigate this issue? Did you have any concerns about how they could be selling so many shares? When did you become concerned that they were running a massive Pump and Dump Scam.
When were your Superiors notified about these concerns? Did you inform them? What did they say to you?
Ms. Hakala, can you tell me when you first became aware that CMKM Diamonds was selling Billions of shares on a daily basis? Were you aware that more shares were selling on some days than the rest of the stocks in the market combined? If Not: “Why didn’t you know this”? If you were aware: “Did you think you should research this company further… and did you?”
When were your Superiors notified about this? Did you inform them? What did they say to you?
Ms. Hakala, can you tell me when you first became aware that CMKM Diamonds was claiming Naked Short Selling of their Stock? Did you personally investigate this claim? What did you find?
When were your Superiors notified about this claim? Did you inform them? What did they say to you? Were they at all concerned about Naked Short Selling of CMKM Diamonds securities? Why or why not?
Ms. Hakala, can you tell me when you first became aware that CMKM Diamonds was being used to support a Government Sting? Was the SEC a participant in this sting? If so, what role, if any, did you play in the sting?
If the SEC was not involved in the Sting, when where your Superiors notified about this claim? Who informed them? What did they say to you about the sting?
Ms. Hakala, (assuming there was a sting) to the best of your knowledge, tell us what the sting was about. E.g. was proving Naked Short selling a goal of the sting. To the best of your knowledge, was the sting successful? Who were the major Brokers who were caught in the Sting? What legal recourse was offered to the Brokers? Did the Brokers comply?
Ms. Hakala, (assuming there was a sting) to the best of your knowledge, were funds collected from the Brokers? What became of those funds? What role did the SEC have in managing the collection and distribution of those funds? Have your superior’s ever given you a reason why those funds were not distributed to the shareholders? What were those reasons?
And, depending on Ms. Hakala’s answers, I suspect many more interesting questions could be asked. IMO, this is the reason the government has done everything they can to keep this court hearing from moving forward into Discovery.

The December 4th court case was a scheduled oral hearing to allow each side to present their information so that a decision could be made whether to dismiss the case as requested by the SEC or rule that the case has met the requirements to allow the case to be heard.
(2) Standards. Oral argument must be allowed in every case unless a panel of three judges who have examined the briefs and record unanimously agrees that oral argument is unnecessary for any of the following reasons:
(A) the appeal is frivolous;
(B) the dispositive issue or issues have been authoritatively decided; or
(C) the facts and legal arguments are adequately presented in the briefs and record, and the decisional process
Attorney Hodges posted the following ..
"The court is of the unanimous opinion that the facts and legal arguments are
adequately presented in the briefs and record and the decisional process would not
be significantly aided by oral argument. Accordingly, the court orders this matter submitted without oral argument."
The ruling was in Attorney Hodges favor.
