Re: Here'a a great blog on vcsy....(By Portuno)

And what's fascinating we can watch this ongoing interchange between VCSY longs and the blogger on Raging Bull.

      http://ragingbull.quote.com/mboard/boards.cgi?board=VCSY&rea…

The blogger makes a well reasoned view of the stock from a day trader side. The RB VCSY longs are typically looonnnggg term holders and accumulators who decry any demonstrated lack of understanding about VCSY's background.

If you approach VCSY from a financial knowledge point of view, you will reject the stock for not meeting certain financially vial criteria.

If you don't dig farther you won't find out about a small company that survived the dotcom bomb and emerged to own an intellectual property Microsoft settled to use. And, settled the day before the Markman Hearing... if VCSy was such a "nuisance" Microsoft would have bought the company's debt (something Al steadfastly avowed would happen guaranteed) or they could have let the lawyers drag VCSY out into bankruptcy (other suggestions abound as to the predicted demise of VCSY... where are all those posters now?).

But, VCSY survived against all odds to cause MSFT to settle when Microsoft is well known to settle only when they absolutely need the intellectual property (MSFT released Silverlight 1.0 the business day after they settled with Eolas for the video automation patent). The Eolas thing was virtually silent. This situation is potentially explosive for the MSFT war machine as many of those who've missed the story up to now will miss the settlement entirely based on VCSY's demonstrated desire to keep things quiet and Microsoft's understandable desire to spin this settlement as an amiable agreement between two technology companies.

That's fine. As long as they acknowledge they have been using VCSY's technology all along. Oh, they now have a "fully paid up" license? OK. Check that criteria off the list.

Now, please explain why Microsoft, which has sold so much .Net and Sharepoint in the past few years the thing exceeded even MSFT's own expectation, and using VCSY's technology to pull that off (read the patent http://www.google.com/patents?vid=USPAT6... and then you can argue), why would Microsoft suspend such operations?

It was very obvious the items Microsoft used in their software was an anemic version of 744 claims. They would have been able to declare pausible deniability they were doing this development on their own. So, what Sharepoint has been able to do up to now can be magnified exponentially with a full set of claims and free access to the technology for the future.

Do you really think MSFT shut down Sharepoint for the future?

Nuisance case? The thing declared .Net and Sharepoint were built on infringed patent material. Nuisance? Hell yes. Do you think MSFT was looking forward to Monday morning after the Markman Hearing with still no license with which to get their development people into gear and then facing a judge's wrath for bringing such a weak case?

Nope. MSFT wanted this "nuisance" case out of the way because they needed it out of their way and they need the technology.

Now, what did that fact do for Mister Wade's negotiating position? Up or Down?

It's funny how reviewing a few facts can make one see a dead-sure situation into a "hmmmm" situation.

The ongoing conversation should make for illuminative reading as we watch the progress on the blog: http://welcometothegutter.blogspot.com/2008_08_01_archive.ht…

The blogger may become famous for being the first writer on the train.
