Injunction Request

With all the major permits in hand, Barksdale only needs an approved Plan of Operations ("PoO") to proceed with its planned drilling program at Sunnyside. The USFS estimated that this would be complete in July. In an attempt to prevent Barksdale from drilling, the Plaintiffs threatened to file a temporary restraining order ("TRO") with the USD Court. The TRO process is very quick (occurs within a few days) and involves oral arguments to the presiding judge. The judge then needs to make a decision based on minimal data and with little background. Rather than risking a poor outcome based on limited information and a quick timeframe, both Barksdale and the nearby project management have independently agreed to a voluntary delay of drilling activity until a preliminary injunction ("PI") request can be heard by the USD Court. The PI process is effectively a "mini trial" where all parties submit evidence, and the judge is given an opportunity to digest the information prior to making a ruling.

The PI process involves the following steps: 1) the Plaintiffs will file a motion for preliminary injunction by July 14; (ii) Barksdale/USFS and the other project management will file responses in opposition to Plaintiffs' motion for preliminary injunction by August 4; (iii) Plaintiffs shall file a reply by August 18; (iv) oral arguments are scheduled on August 24; and (v) the USD Court will issue a decision, hopefully before September 15. Please note that these dates have been agreed to by USFS/Barksdale/Plaintiffs' and have been agreed to by the USD Court. The Plaintiffs will need to demonstrate to the USD Court that they are likely to succeed on the entire lawsuit, intimating that the proper process was not followed by the government and that Barksdale's drilling activities will cause irreparable harm. This is a very high bar for projects that already have existing road networks, existing drill pads and historic drilling.

Weiterhin wurde sich darauf geeinigt mit dem Bohrbeginn bis zum 15.09. zu warten. (siehe oben). Barksdale kann beginnen zu bohren, wenn das PI positiv ausgeht. Die übergeordnete Klage soll schätzungsweise 12-18 Monate dauern.

informed that an action has been filed in the United States District Court against the United States Forest Service ("USFS") by various non-profit and environmental groups seeking to set aside the USFS' recently issued Environmental Assessment, Decision Memorandum and Finding of No Significant Impact related to the Company's proposed Sunnyside copper-lead-zinc-silver exploration program in Arizona. Barksdale is not a party to the lawsuit but will endeavor to assist the USFS as much as possible as they move forward.

The United States Forest Service ("USFS") has issued a Decision Memorandum ("DM") and Finding of No Significant Impact ("FONSI") for Barksdale's proposed seven-year exploration drilling program at Sunnyside. The Company expects the Plan of Operations ("PoO") to be approved shortly, after which the Company can proceed with its planned drilling program at Sunnyside. The Company has plans and contracts in place to commence exploration work shortly after the PoO is approved. The approved DM is the culmination of years of environmental, land use, and other analyses conducted under the National Environmental Policy Act.

Barksdale Provides Sunnyside Permitting Update

("USFS") has continued to move through the final permitting steps. On March 13, 2023, the 45-day Objection Period concluded, and resulted in two objections from parties that made previous comments during the USFS public comment period in 2021. The USFS confirmed with the Company that it completed the mail-out of objection responses on May 26, thereby ending the Objection Response Period.

The final steps of the permitting process will take place over the next few weeks and include finalizing the administrative record and making any necessary updates to the Plan of Operations ("PoO"). Once the Final DM and FONSI are issued and the Reclamation Performance Surety Bond is in place, the USFS will approve the Company's PoO, thereby allowing the start of the drilling program. Having selected its drill contractor, the Company plans to initiate a drilling program as soon as practical, based on drill rig and crew availability. Further updates will be made in due course.
