      Lucent Sues Micron Over Licensing Fees

      Lucent Technologies has sued Micron Technology, saying the Boise, Idaho, memory-chip maker has refused to pay licensing fees for the past two years.
      At issue are seven patents Lucent says Micron has been using in the circuit-design and manufacturing processes of some of its DRAM and SRAM products under a patent license agreement (PLA) it forged with AT&T in 1988.
      When AT&T spun off its systems and technology business to form Lucent in 1996, it obtained the same rights AT&T had prior to its reorganization, the Murray Hill, N.J., company said in documents filed the U.S. District Court in Delaware late last month.
      However, Micron stopped paying royalties for use of those patents in July 1997, the lawsuit alleges.
      In the lawsuit, Lucent says Micron owes it at least $7 million in royalties and late fees. Lucent also says it has terminated all licenses granted to Micron under the 1988 accord because it has refused "numerous opportunities" to remedy its breaches of the PLA.
      "Efforts to resolve this patent issue have been fruitless," a Lucent spokeswoman said. "Micron has continued using Lucent`s patents, and refuses to abide by the terms of its contracts. We have been forced to take legal action in an effort to protect our intellectual-property rights."
      The Lucent patents in question include a memory-chip circuit design that uses multiplexed row and column address lines, a memory-chip circuit design with improved column access, two process technology patents applying to deep-UV lithography techniques, as well as deposition techniques, tungsten metallization, and low temperature deposition of silicon oxides for device fabrication.
      In the court documents, Lucent also denies Micron`s allegations that Lucent is infringing on six of Micron patents that are incorporated into some of its communications devices.
      Lucent said Micron acquired those patents during the spring and summer of 1997, and then immediately accused Lucent of infringing them.
      "Micron has made detailed accusations of infringement against Lucent, and Lucent continues some or all the activity Micron erroneously complains is infringing," the lawsuit says. "Accordingly, Lucent is in reasonable apprehension of imminent suit."
      A Micron spokesman said Lucent`s claims were without merit, and the company planned to mount a vigorous defense against the lawsuit.

      Lucent, Micron Settle Suit Over Microchip Infringement Claims

      Wilmington, Delaware, Sept. 22/99 (Bloomberg) -- Lucent Technologies Inc., the world`s biggest maker of telephone equipment, settled a lawsuit with smaller rival Micron Technology Inc. over seven Lucent patents for making computer chips.
      Murray Hill, New Jersey based Lucent sued Boise, Idaho-based Micron in June 1999 in federal court in Delaware, claiming the Idaho company was wrongly using technology protected by patents awarded to Lucent between 1985 and 1997 without paying royalties. Micron, meanwhile, accused Lucent of infringing Micron patents.
      After negotiations, Lucent and Micron agreed to settle the case out of court, and the lawsuit was dismissed earlier this month, Lucent spokeswoman Debra Lewis said.
      ``The terms are confidential, (but) there was an exchange of patent licenses as part of the settlement,`` according to Lewis.
      Shares of Lucent, with more than 150,000 employees and $38.3 billion in 1999 sales, fell 19 cents to 31.81 on the New York Stock Exchange after falling to a 52-week low of 31.69 earlier today.
      Micron, which has 15,700 employees and reported 1999 sales of $3.76 billion, fell 3.50 to 51.63 on the New York Stock Exchange. The shares rose to a 52-week high of 97.50 in July.

      Hyundai Group has tried to turn a blind eye to what has been long coming.
      The result was its brush with fate Tuesday when its holding firm, Hyundai Engineering and Construction, narrowly escaped payment default.
      Despite the episode, the group apparently has not learned its lesson.
      A spokesman said, ``The creditors take away whatever cash is available.
      ``Under these circumstances, we can`t but face cash flow problems,`` he said. Asked whether it intends to opt for a debt to equity swap by the creditors, he said, ``No way.``
      He claimed that Hyundai Construction is making operating profits so once ``mismatches`` in cash flows are straightened out, it will regain normalcy.
      Hyundai`s reactions by and large show that it considers what is happening to it is not its fault and the creditors are making the problem more complicated.
      Perseverance was once Hyundai`s strong point. Now it appears to be emerging as the cause of its fall.
      And the markets are still trying to get their message across. Their message is that Hyundai`s approach is just a stop-gap measure that could make the problem grow bigger.
      C.J. Kim of Jardine Fleming said, ``The course has been set but the problem is that Hyundai still doesn`t listen.``
      The future course for Hyundai Construction propagated by C.J. Kim and other market watchers is clear.
      His remedy, agreed to by other analysts, is that the creditors, in consultation with Hyundai Construction, should conduct a massive capital decrease before swapping its debts with equity. The outcome would be a Hyundai Construction under the control of the creditors.
      Another analyst, who wished to remain anonymous, said that Hyundai founder Chung Ju-yung, and his fifth son and successor Chung Mong-hun should cough up their private assets amounting to 300 billion won prior to the creditors-initiated debt for equity swap.
      Kim welcomed the government`s tough stance with some reservations in its latest dealing with Hyundai Construction but cautioned against diverting from the course.
      He and other analysts believe that, should the Hyundai Construction case be mishandled, it could entail grave consequences.
      ``The government should stay on course,`` Kim said. ``Should it veer from its path, it could turn Hyundai into another Daewoo.``
      Other analysts said that mishandling the Hyundai Construction problem will have adverse effects on the troubled Hyundai Electronics Industries and Hyundai`s financial units. ``But I suspect that Hyundai Motor and Hyundai Heavy Industries could be affected due to their mutual ties that have yet to be severed, as shown in the case of the toppled Daewoo Motor.``
      But Hyundai faces other flashpoints too.
      Hyundai`s top concern is its three embattled financial units _ Hyundai Securities, Hyundai Investment Trust and Securities, and Hyundai Investment Trust and Management.
      Hyundai is trying to sell the controlling stakes of the three to the U.S.-based American International Group (AIG)-led consortium at a price of $1 billion. But AIG is demanding a major concession from the government in return, challenging the government`s principle of no provision of state funds for a private firm.
      However, more interesting in the AIG`s bid is W. Ross, a vulture specialist which is a member of the consortium. AIG has been the object of attention since its bid for Hyundai Securities was disclosed because it is an insurance specialist, not a securities brokerage.
      But stock market watchers say that Ross specializes in the takeover, repair and sellback of troubled firms. Its reputation is quite notorious, they said.
      ``Ross would not settle for unfavorable terms from the beginning,`` one market watcher said. ``Hyundai, however desperate, might be befriending the wrong guy.``
      In addition, Hyundai Electronics could be a time bomb ticking fast to the designated time of explosion. Its total debts amount to 8 trillion won with 2 trillion won maturing by the first quarter of next year, a burden that could sag the shoulders of a very healthy corporation.
      ``Hyundai Electronics could be a bigger problem than Hyundai Construction,`` one market analyst said.
      Perhaps even bigger than all flashpoints combined is the fact that Chung Mong-hun, Hyundai`s new leader, has been absent without leave, spending most of his time away overseas after his group started undergoing difficulties.
      Chung has been traveling in the United States and Japan to drum up support to help his group ride over the largest storm it has faced, group officials said.
      ``What could he do, even if he were here?`` a Hyundai spokesman said. But it is natural that Hyundai`s drift is related to the long absence of its captain. On his behalf, Hyundai Construction president Kim Yun-kyu and his deputy Kim Jae-soo are running the show.
      Considering Korea`s chaebol management structure, the absence of an owner could spell disarray for rank and file members.
      Some say that his absence is related to his May 31 vow to quit group management, declared by his father and founder Chung Ju-yung but this speculation doesn`t wash, considering the grave danger the group is in.
      While his son and successor is making himself scarce, his ailing 85-year-old father was said to be attending to the business. Group officials said that the old Chung expressed disappointment at the news that Hyundai Construction failed to meet maturing obligations, calling on his former lieutenants to check up on the situation.

      ...and why IMO Hyundai will be announcing a settlement very soon. Also that Hyundai is now shipping RDRAM is telling the story. This is HUGE HUGE NEWS!!!

      Hyundai needs to move on with business. Samsung is growing by leaps and bounds. I predict that Samsung will have 50% of the market in 2-3 years with Elpida (NEC/Hitachi) and Toshiba the rest. The others would have been bought out or gone out of the memory business. Read what`s going on with Hyundai: s.o..

      Mein Tipp: vorgerichtliche Einigungsreihenfolge, wahrscheinlich noch 2000, außer eventuell den starrköpfigen Deutschen!:
      1.Hyundai (denen steht das Wasser bis zum Hals, einen Prozess können die sich zur Zeit gar nicht leisten, und ein Importverbot schon gar nicht)
      2.Micron
      3.Infineon (stehen dann ziemlich allein auf weiter Flur)

      hallo noch jemand im board oder feiert ihr das comeback?
      noch konnten meine nerven sich nicht ganz entspannen, da fehlt noch einiges an anstieg. das war doch zu viel in der letzten zeit.

      Sag mal desti, das sieht ziemlich "Briefing-mäßig" aus was da von Dir ganz oben steht. Oder ist es nur eine (optische) Täuschung ?

      Wie auch immer ich bin da vor einer Stunde @ 67 Euros (vielleicht zu früh aber wer kann das schon wissen ...) raus.

      vorbörslich mit ca. 45$!!! (wir waren short um
      63$) eingedeckt, Plus 30%!!!. Es gibt hier ein Paar
      schlechte Nachrichten für RAMBUS. Jetzt RMBS
      kaufen? Auf keinen Fall!!! Dieser Wert besteht
      ausschließlich aus heisser Luft und sollte in ca.
      6-18 Monaten bei unter 10$ aufschlagen - für uns
      als "Kurzfristinstitut" zu lange..., sollte der Wert
      jedoch nochmals stärker ansteigen (was jederzeit
      geschehen kann, deshalb sind wir mit Plus 30%
      erst einmal `draußen..), sind wir wieder mit
      Leerverkäufen dabei...


      mal sehen, ob wir noch solch einem blutigen tag für shorties nochmals von ihnen hören.
      heiße luft definiere ich anders. und die 10 us$ sehe auch nicht.
