A Tesla Inc. plan to purchase hard-to-get construction materials is being investigated by US prosecutors, who are looking at whether the project was an appropriate use of company funds.
The US Attorney’s Office in New York has sent subpoenas to a number of current and former employees at the EV-maker in recent weeks seeking information related to the materials, according to people familiar with the probe. The requests for information focus on correspondence with Omead Afshar, a key lieutenant to Elon Musk and the individual at the center of an internal Tesla probe into the issue, said the people, who asked not to be identified because the matter is private.
Prosecutors are reviewing a 2022 purchase order for construction material which was identified as suspicious by company officials. The order, for a special kind of glass, was flagged to Tesla’s finance and internal audit groups earlier last year.

Tesla braces for its first trial involving Autopilot fatality
The 2019 crash, which has not been previously reported, killed the driver and seriously injured his two passengers, including an 8-year-old boy.
https://www.nbcnews.com/business/business-news/tesla-braces-…
...
Tesla is set to defend itself for the first time at trial against allegations that failure of its Autopilot driver assistant feature led to death, in what will likely be a major test of Chief Executive Elon Musk’s assertions about the technology.
Self-driving capability is central to Tesla’s financial future, according to Musk, whose own reputation as an engineering leader is being challenged with allegations by plaintiffs in one of two lawsuits that he personally leads the group behind technology that failed. Wins by Tesla could raise confidence and sales for the software, which costs up to $15,000 per vehicle.
Tesla faces two trials in quick succession, with more to follow.
...
Tesla won a bellwether trial in Los Angeles in April with a strategy of saying that it tells drivers that its technology requires human monitoring, despite the “Autopilot” and “Full Self-Driving” names. The case was about an accident where a Model S swerved into the curb and injured its driver, and jurors told Reuters after the verdict that they believed Tesla warned drivers about its system and driver distraction was to blame.
...
The stakes for Tesla are much higher in the September and October trials, the first of a series related to Autopilot this year and next, because people died.
...
Tesla filed an emergency motion in court late on Wednesday seeking to keep deposition transcripts of its employees and other documents secret. Banner’s attorney, Lake “Trey” Lytal III, said he would oppose the motion.
“The great thing about our judicial system is Billion Dollar Corporations can only keep secrets for so long,” he wrote in a text message.

So far, Cracked_Tesla (+) has not heard of any other cases like the one involving his BEV. Although even the Model Y owner wishes his car to be the only one affected, that is very unlikely. Giga Grünheide faced 60% of rejected cast parts about a year ago. There are pictures of these rejected parts pilling up in Fremont. If NK's Model Y received a component that should also have been discarded by quality control, others may have reached production units as well.

Cybetruck: "extremely difficult"

Tesla investors to get about $12,000 apiece in Musk’s SEC deal
https://finance.yahoo.com/news/tesla-investors-12-000-apiece…
...
A group of Tesla Inc. investors stands to recover an average of about $12,000 a head for losses they incurred from Elon Musk’s famous 2018 tweet that he had “funding secured” to take the carmaker private at $420 a share — and then didn’t.
The US Securities and Exchange Commission aims to pay the investors the $40 million plus interest that Tesla’s chief executive officer and the company agreed to as civil penalties to settle a lawsuit by the regulator. That’s just over half the $80 million the SEC reckons they lost from the stock’s gyrations after the tweet — and a mere sliver of the $12 billion in losses an expert witness for a class of Tesla investors calculated earlier this year in a separate class action trial.
The SEC asked a judge for final approval of the plan in a court filing Wednesday evening.
A total of 3,350 claims will be paid out of the fund set up from the settlement if the plan is approved, according to the filing. That works out to just under $12,400 an investor, on average. The judge said Thursday he would sign off on the plan on Sept. 1 if there are no objections from Tesla or Musk, the world’s richest person.
What accounts for the huge gap in estimated losses between the $80 million and the $12 billion? It’s not entirely clear, but the expert’s number applied to losses by all Tesla investors over 10 days after the Aug. 7, 2018, tweet. The SEC’s number covers just over 27 hours after the tweet, excludes options and derivative trades and applies only to Tesla common stock. And not every eligible investor filed a claim.
The investors in the class action case lost at trial in February, when the jury took just two hours to clear Musk of their claim that he defrauded them with the tweet. The case was one of the few corporate securities fraud claims to go to trial. The vast majority are thrown out or settled.
The investors are appealing. (gemeint ist der letztere Prozess im California Northern District Court, Case No. 3:18-cv-04865-EMC,
"In re Tesla Inc. Securities Litigation", nicht dieser hier: New York Southern District Court, Case No. 1:18-cv-08865-AJN, United States Securities and Exchange Commission v. Musk
