Shares of Uber Technologies, Lyft, and DoorDash traded sharply lower Tuesday after the U.S. Department of Labor issued a rule proposal that could force the companies to classify their drivers as employees rather than contractors.
If implemented, that rule would likely substantially raise labor costs for food- delivery and ride-sharing companies, and for other employers that rely heavily on contract workers. Interested parties have 45 days to comment on the proposal.
The Labor Department said the new independent contractor rule is intended to “protect workers’ basic rights” and to make it easier for employers to properly classify their workers. In its request for comments on the proposal, the government says that “the ultimate inquiry is whether, as a matter of economic reality, the worker is either economically dependent on the employer for work (and is thus an employee) or is in business for themself (and is thus an independent contractor).”
Neither Uber (UBER) nor Lyft ( LYFT ) immediately responded to a request for comment. DoorDash (DASH) referred Barron’s to Flex, a trade group for ride-sharing and food delivery companies, which didn’t immediately respond. Both Uber and Lyft shares were down nearly 10% in morning trading, while DoorDash was off 8%.
