BATTERY GRAPHITE BUSINESS UPDATE:

Unser Geschäft mit Batteriegraphit ist weiterhin auf dem Weg zum Betrieb einer Pilotanlage, die voraussichtlich im vierten Quartal 2020 Batteriegraphit in großen Mengen herstellen wird.
Am 21. November 2019 gab Westwater bekannt, Dorfner Anzaplan, einen international anerkannten und angesehenen Spezialisten für hochreine industrielle und strategische Metallgeschäfte, beauftragt zu haben, die Entwicklung und das Design von Graphitprodukten für das Coosa Graphite Project zu beschleunigen. Im ersten Quartal 2020 haben Westwater und Dorfner zusammengearbeitet:
Festlegung der Methode, Ausrüstung und Betriebsparameter sowie der Anforderungen für die Graphitreinigung;
Festlegung von Betriebsparametern und Geräten für nachgeschaltete Prozesse, die zur Herstellung der Batterie-Graphit-Produkte von Westwater erforderlich sind; und
Entwurf des Pilotprogramms von Westwater.
ENTWICKLUNGEN DES SCHIEDSVERFAHRENS - ANTRAG DER TÜRKEI ABGELEHNT

Das am 27. Januar 2020 eingereichte Westwater's Memorial stellte Reparationen in Höhe von 36,5 Mio. USD zuzüglich Gebühren fest.
Am 11. März 2020 reichte die Türkei einen Antrag auf Aufteilung des Schiedsverfahrens ein, und am 30. März 2020 reichte Westwater eine Antwort gegen den Antrag der Türkei auf Aufteilung ein.
Am 28. April 2020 lehnte das Schiedsgericht den Bifurkationsantrag der Türkei ab.
Aufgrund dieser Entscheidung muss die Türkei am oder vor dem 20. Juli 2020 ein Gegendenkmal einreichen. Eine Anhörung zu den wesentlichen Fragen und Schäden ist nun für September 2021 geplant.
URANIUM-GESCHÄFTSENTWICKLUNGEN:

Die Uranpreise sind von einem Tief von 24 USD pro Pfund auf 33,40 USD pro Pfund am 11. Mai 2020 gestiegen, dem höchsten Stand seit Februar 2016. Die Nachfrage nach Kernbrennstoffen dürfte den Preis in naher Zukunft weiter ansteigen lassen.
Der Bericht der Präsidenten-Arbeitsgruppe für Kernbrennstoffe zielt darauf ab, die kurzfristigen Risiken eines Verlusts der amerikanischen Uranproduktionskapazität aufgrund von Marktfaktoren zu mindern und gleichzeitig Maßnahmen zu erwägen, die das gesamte Frontend des Kernbrennstoffkreislaufs unterstützen würden. Der Bericht enthält einen 10-Jahres-Vorschlag der Bundesregierung, ab dem Geschäftsjahr 2021 Finanzmittel für eine wettbewerbsfähige Beschaffung der US-Uranproduktion bereitzustellen. Dies würde die Verfügbarkeit von Uran im Falle einer Marktstörung sicherstellen und strategische Fähigkeiten des US-Kraftstoffkreislaufs unterstützen.

Westwater Applauds Federal FY 2021 Budget Proposal for Uranium

$150 million set aside for new Uranium Reserve

CENTENNIAL, Colo., February 10, 2020 – Westwater Resources, Inc. (Nasdaq: WWR), an energy materials development company, is pleased to support the Federal Fiscal Year 2021 budget proposal to set aside $150 million to establish a domestic Uranium Reserve.

Christopher M. Jones, President and Chief Executive Officer, said, “We believe this is an important development for the U.S. uranium industry that provides a real-time opportunity for Westwater. The Federal FY2021 budget, announced today, provides for a mechanism to build a strategic stockpile of uranium to secure our nation’s defensive needs. $150 million has been allocated for that new Uranium Reserve which addresses immediate challenges to the production of domestic uranium. Westwater stands ready to participate using our large uranium resource portfolio and two fully licensed facilities and wellfields in Texas.

“We also support the continued efforts of the Administration and the Nuclear Fuel Working Group to continue to evaluate issues related to the uranium supply chain and fuel supply,” concluded Mr. Jones.

Westwater Resources’ Uranium Portfolio

Westwater’s holdings in New Mexico encompass approximately 188,700 acres and include:

· The Cebolleta and Juan Tafoya properties immediately west of Albuquerque;

· Nose Rock, Ambrosia Lake and West Largo properties located in the prolific Grants Mineral Belt where much of the uranium produced in the United States over four decades was sourced; and

· Parts of the Santa Fe Railroad minerals rights checkerboard between Grants and Gallup, New Mexico.

Westwater’s holdings in Texas encompass approximately 11,000 acres and include:

· Two processing plants with unlimited licenses to produce uranium; and

· Wellfields in place as well as permits in hand to develop added capacity.

Westwater believes that the uranium business in the United States is producing at what may be an all-time low level, and one that is not capable of satisfying domestic demand for nuclear power. With uranium designated by the Federal Government as a Critical Mineral, this low production level is at odds with the security of the United States – something that is clearly stated in the Government’s position paper. Westwater Resources looks forward to further bulletins from the Administration over coming months as they apply to the uranium business and how the Nuclear Fuel Working group intends to recommend implementation of the program for purchases of uranium for the Uranium Reserve. Westwater stands ready to implement production restart plans as soon as prices support.

On February 4, 2020, Westwater Resources, Inc. (“Westwater”) announced that it has submitted a Claimant’s Memorial (the “Memorial”) in its arbitration proceeding against the Republic of Turkey (“Turkey”). The Memorial relates to Westwater’s request for arbitration submitted to the International Centre for the Settlement of Investment Disputes (“ICSID”) in December 2018 as a result of Turkey’s unlawful actions against Westwater’s investments at the Temrezli and Sefaatli uranium projects owned by Westwater’s Turkish subsidiary Adur Madencilik Limited Sirketi.

The Memorial sets forth the basis for Westwater’s claims under the treaty between the United States and Turkey concerning the reciprocal encouragement and protection of investments and international law generally, as well as the basis for the jurisdiction of the tribunal constituted on May 1, 2019 following ICSID’s registration of Westwater’s request for arbitration. The Memorial also establishes the reparations owed by Turkey for breach of its international obligations towards Westwater, consisting of no less than $36.5 million, plus costs and post-award interest, as compensation for Westwater’s resulting loss of its investment. Accompanying the Memorial is an expert report regarding the reparations owed to Westwater. In determining the amount of Westwater’s loss, the expert report considered (i) the projected future cash flows from the expropriated projects, discounted to present value by a risk-adjusted discount rate, (ii) valuations from transactions for similar projects, and (iii) in the case of the Sefaatli project, the amounts invested in the project.

Turkey may respond to Westwater’s Memorial on or before March 9, 2020 with a request for bifurcation, or proceed with filing a Counter-Memorial on or before June 15, 2020. Schedules for additional filings are dependent upon the approach taken by Turkey and the decision of the ICSID tribunal on any request for bifurcation. For example, if bifurcation is requested and denied, a hearing on the merits will be scheduled for September 2021. Alternatively, if bifurcation is not requested, a hearing on the merits will be scheduled for May 2021. Finally, if bifurcation is requested and granted, a hearing on jurisdiction only will be scheduled for March 2021.
