(CNN) -- Aides to Vice President Al Gore say he will study a U.S. Supreme Court order that delivered a major blow to his presidential aspirations, before he makes any public comment Wednesday.

The federal high court late Tuesday reversed a Florida Supreme Court order to manually recount votes in that state`s presidential contest. The nation`s highest court sent the case back to the Florida judges, asking them to craft a statewide standard to determine what is a legal vote. (Read the opinion)

The 7-2 decision fell short of signaling a clean end to the 5-week-old post-election presidential battle because it only agreed that there were "constitutional problems" with the recount as ordered by the Florida Supreme Court.

The court said the recount was unconstitutional because uneven methods and standards would be used in counting the votes.

The justices were divided on virtually every other point, most significantly the crucial question of a remedy.

While the justices didn`t rule out the validity of hand counts, a 5-4 majority insisted that December 12 was the deadline for Florida to appoint a "conclusive" slate of electors. That suggests that any recount would had to be completed by midnight Tuesday, but the four dissenters said the date is not a genuine deadline.

The five justices said: "That date is upon us, and there is no recount procedure in place under the state Supreme Court`s order that comports with minimal constitutional standards." (More on the ruling)

In a dissent, Justice John Paul Stevens wrote, "Although we may never know with complete certainty the identity of the winner of this year`s presidential election, the identity of the loser is perfectly clear. It is the nation`s confidence in the judge as an impartial guardian of the law."

      BL
