Amgens Prozessgewinn dürfte für die Biotechs einen Sprung nach oben bedeuten.
Amgen ist damit aus dem Abwärtstrend ausgebrochen. Ob es reicht, damit der
Abwärtstrend des ganzen Sektors gestoppt werden kann, bleibt offen. Ich halte
es fast für wahrscheinlich. Wenn Amgen einen Prozess gewinnt, wird auch IMNX
und BGEN usw. gekauft. Ob es Sinn macht, weiß ich nicht. Aber das ist so.
Genauso haben die positiver als erwartet ausgefallenen Zahlen von Intel dem
gesamten Soxx einen enormen Schub verliehen.

Der positive Impuls könnte am Montag auf die gesamte Nasdaq ausstrahlen.

"Der gesamte Biotech-Markt ist noch nicht mal so groß wie Pfizer allein. Keine Sorge - der tut dem Nasdaq überhaupt nichts", (Kostolany4 15.01.01 20:15:24) dann *könnte* er doch nicht mal ausstrahlen. Also, deine schnelle Fähigkeit zur Neueinschätzung möchte ich haben!

Du findest in jeder Suppe ein Haar, ich gewöhne mich langsam dran.

Es ist halt so, die Entwicklungen schreiten voran. Es ist eine persönliche
Einschätzung von mir, daß das Amgen-Urteil den gesamten Biotech (und Pharma-)
Bereich beflügelt. Ich hoffe es, denn alle Indizes müssen aus diesen technischen
Gefahrenzonen raus.

warum stellst du nicht einfach die Reutersmeldung rein - ist doch produktiv genug! Deine Charts selbst sind ja als Hilfsmittel auch immer ganz nett , muß man eben nicht selbst kramen.

Und wie stehst du nun zu deiner Einschätzung auf die gesamte NASDAQ? Korrigier` mich, wenn ich eine falsche Zahl nenne, aber meines Wissens hat der ^IXBT einen Anteil an 5% am ganzen Index. Die Divergenz zwischen beiden Indices war ja im Herbst überdeutlich.

Andererseits kann man Bio- und Chip-/Softwaresektor, wie schon früher bemerkt, aus sachlichen Gründen gar nicht so deutlich trennen (Lion **Bio**sciences?).

NEW YORK -- U.S. District Court Judge William Young ruled three of Amgen Inc.`s (AMGN)
covering claims for its erythropoietin product, Epogen, were valid and Transkaryotic Therapies
Inc. (TKTX) infringed these patents in developing its gene-activated version of the anti-anemia
product, Amgen spokesman Jeff Richardson said.

"To win infringement, we only had to win one of these claims," said Richardson.

A Transkaryotic Therapies spokesperson wasn`t immediately available for comment.

Transkaryotic spokeswoman Justine Koenigsberg said the company doesn`t have a comment at
this time, but is reviewing Judge Young`s decision.

According to the judgment issued, the judge found claims 2,3 and 4 of the `080 patent, protecting
the protein structure of Amgen`s erythropoietin product, valid, enforceable and infringed under the
doctrine of equivalents. This legal doctrine refers to a violation in spirit if not necessarily in the
words of the patent.

Judge Young also ruled that claims 1,3,4 and 6 of the `349 patent, which relates to vertebrate cells
capable of producing erythropoietin, the protein that stimulates red blood cell production, are
valid, enforceable, and literally infringed. He also found claim 1 of the `422 patent protecting the
pharmaceutical composition that describes a therapeutically effective amount of Epogen, valid,
enforceable and literally infringed.

However, the judge did not find Amgen`s other claims in its two other patents protecting its
blockbuster Epogen product infringed.

The entire biotechnology industry has been eagerly awaiting this decision since the showdown
ended in the Boston courtroom in September.

The patent infringement trial began in May with Amgen contending in opening arguments that
Transkaryotic wrongly copied the patented technology for Amgen`s top-selling drug, which
generated $1.8 billion in sales in 1999.

Amgen makes its red-blood cell boosting product by inserting a human gene into malignant cells
from hamster ovaries, which then produce the protein.

Transkaryotic makes its version by activating silent genes in human cells by inserting a viral
promoter into the genomic sequence that would then direct the cell to produce the protein.

The industry watched the case unfold not only because several billion dollars worth of drug
revenue was hanging on the outcome of the case, but because questions arose over the sanctity of
patents used by companies to protect their discoveries and products. The industry wanted to know
if creation of a new process for making a drug means that a company has developed a new drug.

"This is not only great news for Amgen, but it is great news for the biotech sector in general," said
CIBC World Markets analyst Matt Geller, adding that the judge`s opinion underscores the idea
that a strong patent estate for new discoveries will be upheld.

If Judge Young had ruled against Amgen in favor of Transkaryotic, some experts wondered if this
case would have allowed any company to use a slightly different means in its manufacturing
process to create the same product without infringing any patents.

But the decision handing a victory to Amgen removes the cloud that has shadowed the
biotechnology sector, despite the group`s strong overall fundamentals.

Biotechnology derives its value from the high barrier to entry: on both the research side and on
the patent side, said Camilo Martinez, co-manager of Dresdner RCM Biotechnology fund.

"This ruling prevents a company that is savvy in biology from making the same type of product
(as another) in a slightly different way because it shows that patents are enforceable," said
Martinez.

CIBC`s Geller anticipates companies that have strong patent estates, like those in genomics or
antibodies, will benefit from the ruling. Examples include Human Genome Sciences Inc. (HGSI),
Millennium Pharmaceuticals Inc. (MLNM) and Protein Design Labs Inc. (PDLI).
Many experts anticipate Transkaryotic will appeal Judge Young`s ruling. However, they note that
the ruling of infringement on three separate patents signals the strength of Amgen`s case and the
tough road Transkaryotic faces if the Cambridge, Mass., company chooses to appeal.

"One of the reasons Judge Young took so long in deciding the case was to make sure he had the
strongest possible ruling that would not be overturned," said Martinez.

On news of the victory, Amgen`s shares soared to $72.25 in after-hours trading from the 4 p.m.
EST close at $60, according to Island ECN.

Transkaryotic shares have been halted at $34 since 4:16 p.m. EST.
