guten Abend Kalle,

also die Post bekommt ab Jan. 08 bös Konkurrenz mit Dumpinglöhner am Ende der Ernährungskette. Die privaten Firmen sind schon aufgestellt und in Auktion um die restlichen "Felder" gleich mit zu übernehmen wie ( Wertguttransporte aller Art u.v. mehr)
Und die Löhner am Ende der Kette sind 13-14 Std. täglich unterwegs und bekommen so um die 800.-€ auf die Hand gedrückt. Das perfide an deren System ist, je mehr Postbriefe einer am Tag schafft umso weniger in € Cent bekommt dieser angerechnet ! nur mit der Pflichmenge kann Keiner leben !

Und wie ich diese Tage mitbekommen habe wird den 8000 Austrägern in Baden W. einer Firma (X) auch noch ein neuer AT Vertrag aufgedrückt mit 20 % weniger, oder man ist gleich mit gekündigt !

na das ist doch menschlich richtig Klasse !
gut dass hat jetzt nix mit usxp zu tun, aber ich denke die Marsche dürfte überall gleich sein !
Ganz abgesehen von dem Schicksal der bisherigen Postangestellten !
Also in der Branche arbeiten zu müssen ist gnadenlos !

wenn man sich die Firmen von usxp mal ansieht haben alle etwas miteinander zu tun und verzahnen sich zu einem kompaktem Bild.
( mal ganz vom aktuellem Kurs abgesehen )


Also der Rahmen wäre fertig. nun fehlt nur noch das Bild !!!
und dass könnte es dann sein !!!!

Von diesem Rutsch wird sich der Euro m.E. in den nächsten 2-3 Tagen nicht so schnell erholen und wenn er am Freitag unter 1,4180 schließt, kann er auch noch bis 1,3760 fallen in den nächsten Wochen. Dann evtl. Erholung zum Jahresende und im Januar kommt dann vielleicht der Bruch des langjährigen Aufwärtstrends, was eine Anlage in US-Aktien vor allem für Nicht-US_Bürger immer attraktiver macht

On August 31, 2007 Federal District Judge Gerard E. Lynch of the Southern
District of New York appointed a Receiver over the operations of Universal
Express, Inc. and its subsidiaries. The Receivership resulted from rulings
Of the court in SEC v. Universal Express et al, Case 1:04-cv-2322(GEL).
The Receiver has been actively engaged in evaluation of the company's
Operations and its financial condition but is unable to complete the
Process in time to meet the deadline for filing.

Altomare offers to settle fine as investigation starts again

Former Universal Express CEO Richard Altomare told a federal judge he'd sell his Highland Beach condo to pay the judgment against him, but his civil penalties aren't his only problem. The U.S. Attorney's Office is again investigating his actions.

Faced with a $3.1 million judgment after the judge ousted him from the Boca Raton-based company, Altomare made the offer in New York federal court on Oct 12. He bought the 4,600-square-foot unit in November 2006 for $3.1 million and had $300,000 to $800,000 equity in it. Altomare and his wife also own a home near Boca Raton.

Altomare offered to pay $30,000 up front, $10,000 a month and a
percentage of his future salary toward the fine. That prompted Judge Gerard Lynch to postpone until January the decision of whether Altomare and former company general counsel Chris Gunderson were in criminal contempt. In April, the Securities and Exchange Commission won its case finding the company and those officials liable for illegally selling unregistered securities and issuing misleading press releases.

The SEC's motion for contempt claims Altomare and Gunderson continued this after Lynch's ruling. Universal Express raised $9.5 million selling unregistered securities this year while Altomare took a $1 million salary from the money-losing luggage shipping firm, according to Miami attorney Jane Moscowitz, the company's receiver, who will liquidate its assets and examine Altomare's finances.

Now federal authorities are investigating possible criminal conduct by Altomare and Gunderson. In his failed motion on Oct. 11 to delay the following day's contempt hearing, their Miami-based attorney, Arthur Tifford, said he spoke to officials with the U.S. Attorney's Office and the Federal Bureau of Investigation in September. They told him they had a criminal investigation into both clients and asked to depose Altomare.

The U.S. Attorney started investigating the case in 2004, when the SEC filed suit, but stayed its proceedings, Tifford wrote in his motion. He added that stock trader Tarun Mendiratta, a co-defendant in the SEC case awaiting trial, appeared to be cooperating with the SEC and the U.S. Attorney.

Tifford said the criminal investigation forced him to withdraw as Gunderson's attorney. "The only reasonable explanation for the U.S. Attorney's sudden reappearance is Messrs. Altomare and Gunderson's announced intention and expressed reference to presenting a strong and meaningful opposition to the SEC's motion for civil contempt. And to chill that intent through circumstances that amount to unfairness and trigger prejudice." Tifford didn't return a call for comment.
Altomare and Gunderson have appealed the damages.

Das Büro des US-amerikanischen Rechtsanwalts untersucht wieder seine Handlungen. Konfrontiert mit einem Urteil von 3.1 Millionen $ nachdem vertrieb der Richter ihn aus der Boca Raton-basierten Gesellschaft, Altomare machte das Angebot im New Yorker Bundesgerichtshof am 12. Okt. Er kaufte die 4.600-Quadratfuß-Einheit im November 2006 für 3.1 Millionen $ und hatte 300.000 $ bis Billigkeit von 800.000 $ darin. Altomare und seine Frau besitzen auch einen Haus- in der Nähe von Boca Raton. Altomare erklärte sich bereit, 30.000 $ Vorderseite, 10.000 $ pro Monat und einen Prozentsatz seines zukünftigen Gehaltes zur Geldstrafe zu bezahlen. Dieser veranlasste Richter Gerard Lynch, um bis Januar die Entscheidung dessen zu verschieben, ob Altomare und der ehemalige Firmengeneral Anwalt Chris Gunderson in der kriminellen Geringschätzung waren. Im April gewannen die Wertpapiere und Austauschkommission seinen Fall, der die Gesellschaft und jene Beamten verantwortlich dafür findet, nicht registrierte Wertpapiere ungesetzlich zu verkaufen und irreführende Presseinformation auszugeben. Die Bewegung des SEC für die Geringschätzung fordert Altomare, und Gunderson setzte das nach herrschendem Lynch fort. Universaler Schnellzug erhob 9.5 Millionen $, nicht registrierte Wertpapiere in diesem Jahr verkaufend, während Altomare ein Gehalt von 1 Million $ vom Geld verlierenden Gepäck-Schiffsunternehmen, gemäß dem Miami Rechtsanwalt Jane Moscowitz, dem Empfänger der Gesellschaft nahm, der sein Vermögen liquidieren und die Finanzen von Altomare untersuchen wird. Jetzt untersuchen Bundesbehörden mögliches kriminelles Verhalten durch Altomare und Gunderson. In seiner erfolglosen Bewegung am 11. Okt, um das Geringschätzungshören des folgenden Tages zu verzögern, sagte ihr mit Sitz Miami Rechtsanwalt, Arthur Tifford, dass er mit Beamten mit dem Büro des US-amerikanischen Rechtsanwalts und der Amerikanischen Bundespolizei im September sprach. Sie sagten ihm, dass sie eine kriminelle Untersuchung in beide Kunden hatten und baten, Altomare abzusetzen. Der US-amerikanische Rechtsanwalt fing an, den Fall 2004 zu untersuchen, als der SEC Klage erhob, aber seine Verhandlungen blieb, schrieb Tifford in seiner Bewegung. Er fügte hinzu, dass Aktienhändler Tarun Mendiratta, ein Mitangeklagter im SEC Fall, der Probe erwartet, schien, mit dem SEC und dem US-amerikanischen Rechtsanwalt zusammenzuarbeiten. Tifford sagte, dass die kriminelle Untersuchung ihn zwang, sich als der Rechtsanwalt von Gunderson zurückzuziehen. "Die einzige angemessene Erklärung für das plötzliche Wiederauftauchen des US-amerikanischen Rechtsanwalts ist Herr Altomare und die bekannt gegebene Absicht von Gunderson und ausgedrückte Verweisung auf das Präsentieren einer starken und bedeutungsvollen Opposition gegen die Bewegung des SEC für die Zivilgeringschätzung. Und diese Absicht durch Verhältnisse abzukühlen, die sich auf die Unbilligkeit belaufen und Vorurteil auslösen." Tifford gab einen Aufruf nach Anmerkung nicht zurück. Altomare und Gunderson haben die Schäden appelliert.

A U.S. judge has refused to dismiss a US$6-billion lawsuit launched
in 2006 by Toronto's Fairfax Financial Holdings Ltd. against S.A.C.
Capital Management and 22 defendants.

Fairfax is suing S.A.C. and others for financial damages that
resulted from the alleged creation of a short-selling disinformation
conspiracy designed to drive down Fairfax stock.

S.A.C. and a group of lawyers claimed there was no conspiracy and no
wrongdoing, and that their trading was legal.


But Judge Deanna Wilson did not agree.

"I hope that this didn't happen, because it's a scheme of tremendous
proportions," said Judge Wilson at the hearings two weeks ago. She
rejected motions for dismissal and ordered the matter to proceed to
trial under RICO -- U.S. organized-crime law --and other statutes.

Fairfax alleges S.A.C. and various affiliates, with US$40-billion in
assets under management, attacked the company after it was listed in
2002 on the New York Stock Exchange. In the first few weeks, Fairfax
stock was driven down by 15%, or US$14 per share.

By spring 2003, it had rebounded from US$50 to US$96, but then
allegedly was attacked again in summer, 2006. It now trades around
$230 and has a market capitalization of US$4-billion. The insurance
conglomerate is Canada's 49th-largest corporation by revenues.

The attacks caused financial damage to shareholders over the years
and to the company's reputation, the company says.

"It was a massive and fraudulent disinformation campaign," reads
Fairfax's statement of claim, which alleges "dirty tricks," fronts,
aliases and bear attacks were used to try to ruin the company's
reputation and price.

One defendant is analyst Spyro Contogouris. The lawsuit alleges he
and others were hired to spread disinformaton to journalists, online
chat rooms, regulators, auditors and rating agencies, and even
harassed Prem Watsa, Fairfax chief executive and chairman.

"The amended complaint alleges a shocking scheme against a prominent
Canadian company and its American subsidiary," said Fairfax lawyer
Marc Kasowitz in a telephone interview yesterday. "The decision,
denying the motions to dismiss, is very important because it confirms
that the legal challenges to the amended complaint are without merit
and that this case can now proceed aggressively to discovery and
trial."

S.A.C. was accused of another "bear raid" short-selling conspiracy by
Canada's Biovail Corp., which has also sued the hedge fund and others
for US$6-billion. That matter is on hold in a New Jersey court, Mr.
Kasowitz said.

Short selling is a legitimate strategy but, if proven, a whispering
campaign against Fairfax spreading false information would be

Da finden m.E. Short-Eindeckungen statt und das wäre die einzige Hoffnung für USXP. Woher soll da sonst ein Anstieg kommen ?
Bei ASIA und den anderen Aktien, die z.Zt. so steigen, können auch Short-Eindeckungen eine Rolle spielen.
Deshalb darf man die m.E. ruhig auch im USXP-Board erwähnen.

Überhaupt sollte man versuchen, sich nicht zu ärgern. Mein Mann hat sich den ganzen lieben langen Tag über unseren neuen Drucker nach den Patronenwechsel geärgert, der hat immer nur schwarze Ränder gemacht, jede Menge davon, dabei ist gar niemand gestorben und soll auch lieber nicht. Aber jetzt dem wohlwollenden Willen zarter Hände....wollte er sich nicht widersetzen,der Drucker, fing nach der zarten Berührung des Einschaltens an, sich neu zu justieren und druckte brav ein posting aus, samt smiley, in der richtigen Farbe und dafür ohne Rand.

Zum Thema USXP:
Sie könnte durchaus bald hochzucken. Es ist auffällig, daß sie immer wieder die 2 als Schlußkurs schafft; der Slow Stochastik seit längerem immer zwischen 50 und 100 % bleibt, in den letzten Tagen die Umsätze angezogen haben (bis auf heute) und nach den Kaufsignalen im daily, weekly und monthly nun auch noch der quarterly chart kurz vor einem Kaufsignal steht.

Da die Firma insolvent ist, könnte die Aktie m.E. nur
1. durch Shorteindeckungen (NSS) oder
2. durch den Mantelkauf (vielleicht durch einen Michael Jackson Fan ?)
steigen.

Im übrigen gehört z.B. das mit ZIXI sehr wohl in diesen thread, weil sie zusammen mit USXP auf der Liste der NSS-Opfer stand und jetzt gerade ein shortsqueeze stattfindet !

Es ist ja auch immer noch nicht ganz geklärt, ob die Charttechnik bei OTC-Werten anwendbar ist oder nicht.
PLKC und PBDY steigen ja auch.

Das Thema USXP ist eben ein weites Feld und nicht so leicht von anderen zu trennen.

Manche Leute finden es leider interessanter und eher zum Thema gehörend, hier öffentlich ständig zu gähnen !

es gab in letzter Zeit immer mal wieder so 2-3-4 Tage, wo die Umsätze anzogen.

Nee, da müssen handfeste, GUTE Meldungen her (z.B. USXP win against SEC 700 Mio. ODER Saudi-Deals etc ...)

Ich denke auch, es köchelt im Hexentopf von USXP

keine Anlageberatung

(Und im richtigen Topf köchelt ein sehr magerer Rinderbraten still vor sich hin, und meine Männer freuen sich schon auf die selbstgemachten Semmelknödel und die leckere Sauce mit selbstgesuchten getrockneten Steinpilzen,dazu Preiselbeeren ;als Nachtisch ist panna cotta mit Erdbeergrütze- mit ganz vielen Stückchen vorgesehen, ist schon fertig im Kühlschrank; zum Kaffee gibt es dann heute Apfelkrapfen.

Da kannst Du man schauen, ob es das woanders auch gibt

RA, die drecksratte bezahlt die kaution und die strafe mit der kohle, die er noch im sommer uns abgenommen hat, als er die outstanding shares von vermutlich 21 milliarden auf ca. 40 milliarden hochgejubelt hat.

Dear Judge Lynch:

On behalf of several concerned shareholders of Universal Express, Inc. (USXP.OB) (see list below), I am sending you this letter by certified mail requesting your Honor to urgently consider three very important points relative to the case of SEC vs USXP et al. (Case 1.04-cv-02322-GEL). Hopefully, you have received by mail and had a chance to read a copy of the petition we sent to Ms. Moscovitz, dated October 11, 2007. In that petition, we requested her to please make sure the “Shell” for this company that now remains is preserved at all costs and, more importantly, the OTC Bulletin Board status of USXP is properly maintained by filing the requisite forms (10-KSB/A) to keep the company’s filing status current with the SEC.

The first point concerns the large judgments that are still forthcoming to the company. In the name of the rights of common shareholders who have gotten the short end of the stick thus far, we beseech you, as we did Ms. Moscovitz, to make sure the shell for this company is kept alive for a certain time so as to benefit from any collection of judgment-related funds in the near future and, more importantly, from any potential benefit of short covering in this equity from the “alleged” naked shorts over the next month or so, when the full effects of the recently revoked “Grandfather Clause” come into play. If the naked shorting is as severe as the company and many shareholders believe it is, this should become readily apparent under these circumstances.

A second point we would like to bring to your Honor’s attention concerns how we shareholders simply fail to understand why you did not ask the SEC to simply open their books and lay to rest, once and for all, the mystery behind whether there existed rampant naked shorting in this company's equity. We are told the SEC has this information available to it and it alone, and it is a simple matter for it to open its books and settle this matter once and for all. After all, the allegation of naked shorting has been the clarion call of this company ever since the historic July 2001 and April 2003 judgments against stock manipulators in its favor. Das Konkursverfahren hat traditioneller Weise die Liquidierung des insolventen Rechtsträgers zum Ziel. Sämtliches Vermögen des Schuldners soll unter allen Gläubigern gleichmäßig aufgeteilt werden. Im Gegenzug wird der Schuldner auch von den Schulden befreit, die durch die Liquidierung seines Vermögens nicht gedeckt worden sind.

Gründe für einen Konkurs sind die Zahlungsunfähigkeit oder Überschuldung. Es sind sowohl der Schuldner selbst als auch die einzelnen Gläubiger legitimiert, einen Konkursantrag einzubringen. Voraussetzung für ein Konkursverfahren ist das Vorhandensein von kostendeckendem Vermögen auf Seiten des Schuldners, ein Gläubiger kann jedoch die Kosten vorschießen. Nach einem erfolgreichen Konkursantrag wird der Konkurs eröffnet und mittels Edikt (Insolvenzdatei) öffentlich bekannt gemacht. Sämtliche Gläubiger haben ihre Forderungen binnen einer Frist anzumelden. Die Konkurseröffnung bewirkt auch eine Prozess- und Exekutionssperre, sämtliche Gläubiger müssen sich zur Durchsetzung ihrer Forderungen am Konkursverfahren beteiligen. Der Gemeinschuldner verliert mit Konkurseröffnung außerdem seine Verwaltungs- und Verfügungsbefugnis über sein Vermögen. Rechtshandlungen vom Schuldner über sein Vermögen sind daher unwirksam und können angefochten werden.

Haven't verified the filings yet, but this is a post by cbeemer on RB, and from years of experience I've never seen him post lies as facts:

Bunch of new filings. Seems Federal Marshalls seized 24 items of jewelery Altomare has been selling. Getting pretty nasty as some of the filings accuse Altomare of theft from the company as the receiver has tied transfers from company accounts to the jeweler. Filings also claim that Altomares attorney (Tifford) misrepresented the facts at the comtempt hearing stating that the jewelery was Barbara Altomares as they have Richard Altomares thumb print and affidavit from Estate Sellers stating that he was the owner. Goes on to says they believe some of Tifford's legal expenses were paid with proceeds of jewelery.
Of the 24 items the marshalls seized one was a 11 karat diamond ring which Altomare paid $500,000 for out of USXP accounts in 2006!

In support of this Motion, the SEC relies upon the Declaration of Leslie J. Hughes with exhibits attached, the Memorandum submitted with this motion, and the following grounds:
I. Background
1.
SEC commenced this action on March 24, 2004 against defendants, including defendant Richard A. Altomare (“Altomare”), Universal Express Inc., (the “Company”) and others, alleging violations of the federal securities laws [Doc. No. 1]. This Motion pertains to Altomare and the Company.

2.
On March 8, 2007, this court entered Final Judgment Against Universal Express, Inc., Richard A. Altomare, and Chris G. Gunderson, [Doc. No. 179]. (“Judgment”). The Judgment ordered Altomare to pay disgorgement of $1,419,025 plus prejudgment interest of $283,073, and a civil penalty of $1,419,025. The Judgment remains wholly unpaid.

On September 4, 2007, this court appointed a Receiver to take custody, control and possession of the property and other assets of Universal Express, Inc. (the “Company”). [Doc. No. 203].

On October 4, 2007, a Writ of Execution was issued as to Altomare for judgment #07,0605 in the amount of $1,419,025. (“Writ”) The Writ was signed by the Clerk of the Court,


J. Michael McMahon, on October 4, 2007.


II. Execution of the Writ

Pursuant to Fed. R. Civ. P. 5, notice of issuance of the Writ was served electronically through the Electronic Court Filing System on Altomare on October 4, 2007. The Writ commanded the Marshals Service to seize the goods and chattels of Richard A. Altomare including jewelry possessed by Kravit Estate Buyers, Inc. to pay the Judgment.

On October 4, 2007, counsel for the SEC faxed a copy of the Writ to the Marshals Service in Boca Raton, Florida.

7.
On October 10, 2007, the Marshal served the Writ on The Estate Department, Inc., located at 7775 Glades Road, Boca Raton, Florida 33434, and seized the following twenty-four items of property which The Estate Department had obtained from Richard Altomare (collectively referred to as the “Seized Property”):

A report titled Seized Property and Evidence Control with photographs prepared by the Marshal on October 10, 2007, is attached as Exhibit C.
8. On October 10, 2007, the Marshal delivered the Seized Property to the Receiver for safekeeping.
III. Richard Altomare Purchased Some of the Seized Property with Funds Stolen from Universal Express, Inc.
9. On or about April 13, 2006, Richard Altomare purchased an 11.02 ct emerald-cut diamond from Les Bijoux LLC in Boca Raton, Florida for approximately $500,000. (Item 20 of the Seized Property listed above in paragraph 7.) Richard Altomare paid Les Bijoux for the diamond with wire transfers from the bank account of Universal Express, Inc. in the following amounts: on April 13, 2006 a wire for $325,000, on April 26, 2006 two wires for $30,000 and $40,000, on June 5, 2006 a wire for $33,900, on July 27, 2006 a wire for $30,000 and on August 21, 2006 a wire for $50,000. Richard Altomare misappropriated these funds from Universal Express, Inc. to pay for this diamond. In the annual report for Universal Express that Mr. Altomare signed on March 27, 2007, he did not list any of the payments to Les Bijoux as part of his annual compensation. See the Summary Compensation Table at page 41 of 49 in the Company’s annual report on Form 10-K for the year ending June 30, 2006, which is attached as Exhibit H. The only compensation that Mr. Altomare identified for 2006 in Exhibit H is his cash salary of $650,000, which was paid to him in bi-weekly payroll checks.
10. On or about January 26, 2007, Richard Altomare purchased from Les Bijoux a
7.00 ct radiant cut fancy yellow SI1 diamond ring set in platinum for $85,000 (Item 21 of the Seized Property listed above in paragraph 7), a Jaeger LeCoultre Atmos Clock for $40,000,1 and a FP Journe Chronometre Souverain platinum watch for $20,000 (Item 14 of the Seized Property listed above in paragraph 7). Richard Altomare made partial payment for these items in three wire transfers of funds from the bank account of Universal Express in the following amounts: $20,000 and $40,000 on January 26, 2007, and $20,000 on May 16, 2007. As of approximately September, 2007, Altomare owed Les Bijoux $65,000 for these three items. Richard Altomare misappropriated the funds from Universal Express, Inc. to pay for these three items. In the annual report on Form 10-K for the year ending June 30, 2006, which was filed on March 26, 2007, Altomare represented that he was currently employed under an employment contract that provides an annual base salary of $650,000. 11. On October 31, 2007, the Receiver made demand upon Altomare, through
counsel, to reimburse the Company for $558,900, the amount misappropriated from the The Jaeger LeCoultre Atmos Clock was not seized on October 10, 2007.
Company to purchase the Property. Exhibit G. Altomare has not reimbursed the Company, so the Property belongs to the Company.

IV. Altomare Fraudulently Conveyed Property to The Estate Department Inc.
12. The Estate Department is a Second Hand Dealer licensed and doing business at 7775 Glades Road, Boca Raton, Florida 33434. On an unknown date in September 2007, Richard Altomare signed a Second Hand Dealers Property Form with The Estate Department selling them a “Fancy Yellow Diamond Ring 7.85 approx ct” for $56,000 “with GIA cert.2 needed – without [GIA cert.] full refund on ring,” an aquamarine broach for $10,000, two silver bars for $2,400 and a diamond straight line bracelet for $21,600, which together total of $90,000. When Mr. Altomare signed the Form he represented that:
“I verify that I am eighteen years or older, and I am the rightful owner of the above described property which is being sold or pledged, or that I am entitled to sell or pledge such property; and that the property is clear of all liens and encumbrances, including liens for past due child support, if proven otherwise, I promise full restitution, and understand that I will be criminally prosecuted to the fullest extent of the law.”
The Form also appears to be signed by Mark Kravit on behalf of The Estate Department.
13.
The $56,000 price the Estate Department paid for the fancy yellow diamond ring is substantially less than its purchase price of $85,000 or the diamond straight line bracelet purchased for approximately $100,000. The price of the aquamarine broach, and silver bars is currently unknown.

14.
At the time of Mr. Kravit’s purchase, on behalf of The Estate Department, of the items listed above in paragraph 12 from Mr. Altomare, Mr. Kravit telephoned Greg Osipov, one of the managing members of Les Bijoux, LLC. Mr. Kravit was known to Mr. Osipov through previous business dealings and identified himself as the person speaking during the telephone call. Mr. Kravit informed Mr. Osipov that Richard Altomare was in the office of Mr. Kravit and

trying to sell a ring and that Mr. Kravit needed the GIA certificate from Les Bijoux for the diamond ring that it had sold to Mr. Altomare. Mr. Osipov advised Mr. Kravit during the telephone conversation that Mr. Altomare could not sell the ring because Mr. Altomare still owed $65,000 on the purchase price of the ring.

After the telephone call, Mr. Kravit came to the business location of Les Bijoux and demanded that Mr. Osipov produce the GIA certificates for the diamond ring and the emerald cut diamond bracelet, and turn over an old diamond that Mr. Osipov possessed as collateral for the amounts owed by Mr. Altomare. Mr. Kravit asked Mr. Osipov to come to his car, where he produced the Jaeger LeCoultre Atmos Clock, which Mr. Altomare had previously purchased for $40,000. Mr. Osipov was angered by Mr. Kravit’s demand and called Mr. Altomare who confirmed that he had told Mark Kravit to return the clock, which was damaged in transport back, to Les Bijoux. As a result of his conversations with Mr. Osipov, Mr. Kravit knew that Mr. Altomare owed money to Les Bijoux for his purchase of the yellow diamond ring.

On or about September 24, 2007, Richard Altomare entered into a second transaction with The Estate Department, in which he sold twenty-one additional items including his collection of expensive watches for $481,000. The items included 1) a diamond necklace, 2) diamond bracelet, 3) pear-shaped diamond ring, 4) cultured pearl necklace and 5) pearl earrings, 6) A. Lange & Sohne watch, 7) Jaeger LeCoultre watch, 8) Franck Muller steel watch, 9) diamond eternity band ring 9 ct, 10) Breguet 18 K yellow gold watch, 11) Rolex 18k gold watch, 12) A. Lange & Sohne steel watch, 13) A. Lange & Sohne watch, 14) Corum 18k yellow gold watch, 153) F.P. Journe watch, 16) Audemars Piguet watch, 17) Rolex Cellini watch, 18) 18K yellow gold necklace, 19) Diamond Bracelet, 20) cultured pearl and diamond necklace, and 21) loose emerald cut diamond 11.02 ct. Mr. Altomare signed another Second Hand Dealers

Property Form in which he acknowledged receipt of $411,000 in cash with the balance of $70,000 due on October 5, 2007. This Form was subsequently signed by Barbara Altomare when she received the additional $70,000 in cash.

17.
The price that The Estate Department paid for the 11.02 ct emerald cut diamond (along the other twenty items) of $481,000 is substantially less than the purchase price of the diamond alone which was approximately $500,000, and the F.P. Journe platinum watch which was purchased for $20,000.

18.
Mr. Altomare’s conveyance of these items of jewelry, watches and precious metals were made without fair consideration at a time while he was a defendant in an action for money damages and a judgment had been docketed against him. He knew at the time of the transactions that he had not satisfied the Judgment entered against him on March 8, 2007.

19.
Mr. Altomare conveyed these items of jewelry, watches, and precious metals with actual intent to hinder, delay or defraud the Securities and Exchange Commission, which is a present creditor. He and his wife requested payment for the items be made in cash rather than a check. Although Altomare clearly represented on the Second Hand Dealer’s Property Form that the property was his to sell, he did not advise The Estate Department of the existing Judgment obtained by the Securities and Exchange Commission on March 8, 2007. Moreover, at the hearing on October 12, 2007, Mr. Altomare’s attorney misrepresented to the Court that proceeds from the jewelry sales belonged to Barbara Altomare, when in fact Mr. Altomare had purchased part of the jewelry with money stolen from Universal Express, and he represented in the transactions with The Estate Department that these items were his property. He placed his thumb print on the report as the seller of the property. Upon information and belief, Mr. Altomare paid part of the proceeds from these sales to his attorney for legal services in this case.


V. Multiple Claimants Claim an Interest in the Property

The SEC claims an interest in the Property to satisfy the Judgment.

The Receiver claims the Property belongs to the Company.

22.
The Estate Department claims to have an interest in the Property.


23.
The SEC has given notice of this Motion to The Estate Department, who is represented by counsel. The Estate Department’s counsel has informed the SEC that The Estate Department will intervene to be heard on this Motion. The SEC will not object to The Estate Department’s motion to intervene.

24.
This matter is in the nature of an interpleader and pursuant to 28 U.S.C. § 2361, the SEC requests that the Court enter an Order restraining all claimants from instituting proceedings affecting the property until further order of the court.


WHEREFORE, SEC requests entry of an Order: 1) setting aside the fraudulent transfer of jewelry, watches and precious metals from Richard A. Altomare; 2) directing the United States Marshals Service for the Southern District of Florida to sell Mr. Altomare’s fraudulently conveyed property seized from Kravit Estate Buyers d/b/a/ The Estate Department, Inc.; 3) directing the deposit of the proceeds from the sale into the registry of the court; 4) determining the proper application of the proceeds and 5) restraining all claimants from instituting proceedings affecting the property until further order of the court.

Former Universal Express CEO Richard Altomare told a federal judge he'd sell his Highland Beach condo to pay the judgment against him, but his civil penalties aren't his only problem. The U.S. Attorney's Office is again investigating his actions.

Faced with a $3.1 million judgment after the judge ousted him from the Boca Raton-based company, Altomare made the offer in New York federal court on Oct 12. He bought the 4,600-square-foot unit in November 2006 for $3.1 million and had $300,000 to $800,000 equity in it. Altomare and his wife also own a home near Boca Raton.

Altomare offered to pay $30,000 up front, $10,000 a month and a percentage of his future salary toward the fine. That prompted Judge Gerard Lynch to postpone until January the decision of whether Altomare and former company general counsel Chris Gunderson were in criminal contempt. In April, the Securities and Exchange Commission won its case finding the company and those officials liable for illegally selling unregistered securities and issuing misleading press releases.

The SEC's motion for contempt claims Altomare and Gunderson continued this after Lynch's ruling. Universal Express raised $9.5 million selling unregistered securities this year while Altomare took a $1 million salary from the money-losing luggage shipping firm, according to Miami attorney Jane Moscowitz, the company's receiver, who will liquidate its assets and examine Altomare's finances.

@Kalle: Ich kenne USXP schon so lange, da hast Du noch gar nicht gewusst was Börse ist. Das 700mio Judgement - mit dieser Nachricht hat doch alles angefangen. Damals war USXP wirklich noch sexy, als keiner gewusst hat wie es um Altomare steht. Damals konnte man auch noch richtig Geld verdienen. 1.000% hab ich mitgenommen.
Aber mit der Zeit kam mir Altomare sehr sehr spanisch vor weil einige Pressemitteilungen einfach den Verdacht erwägten: Da stimmt irgendwas nicht. Ich habe mich dann - gottseidank- rechtzeitig verabschiedet. Obwohl ich auch geglaubt hab der Stock könnte auf $1 rennen - ne ne ne......da war schon irgendwas faul.
Das Problem ist USXP wird NIEMALS NIE die 700mio Dollar bekommen. Altomare hat mal gesagt: EVENTUELL wäre EIN KLEINER TEIL "collectable". Kann aber sein dass nix collectable ist - dann wird man den Betrag als steuerlich als Verlust abschreiben können. Zumindest hab ich das damals so verstanden. Ist aber schon wieder 3 oder 4 Jahre her. Vergiss es. Irgendwann musst Du mal zur Einsicht
kommen dass hier nix mehr zu holen ist.

Kannst Du eigentlich kein englisch????

After more than three years of legal battles with the SEC, Boca Raton-based Universal Express has ceased operations.

Receiver Jane Moscowitz, who was appointed by the New York federal judge in the civil case brought by the SEC, arrived on Sept. 7 and dismissed most of the 20 employees after a few hours, according to an account from a former Universal Express employee who did not want to be named.

The employee hired Boca Raton attorney Andrew Schwartz because he is owed three weeks' salary. The receiver happened to arrive before payday.

"She put these people on the street," Schwartz said. "That's not the proper way to do that. Employees aren't the ones who participated in the alleged fraud."

The SEC won $25.7 million in damages against Universal Express, CEO Richard Altomare and general counsel Chris Gunderson over selling unregistered securities and issuing false and misleading press releases. The defendants have appealed the ruling and hope to bring the case before a jury.

The former employee said Universal Express staff was aware of the SEC case, but didn't think the company would be shut down so suddenly. The business is no longer taking orders for luggage shipments and the only employees left were tying up loose ends.

Altomare was still there when the employee left and appeared to be cooperating with the receiver.

The phone message at Universal Express during business hours said the business was closed.

Responding to an e-mail, Moscowitz said she is at Universal Express. She didn't answer a question about what will happen to the employees and Altomare.

Broker hopes foreign developers jump on edgewater project

"The Tiziano/Edgewater project is exactly what any developer is looking for," touts the LoopNet.com ad for a tract of land and the design for a 54-unit condo building on Biscayne Boulevard in Miami.

Apparently not.

The 16,000-square-foot project, originally slated for development by Edgewater LLC, has been on the market for two months and has received no interest, Fortune International Realty broker Manuel Chamizo III said. Chamizo has not lowered the asking price - more than $3.5 million - but admitted that prospects for selling the project to local developers look grim. "It's just the market right now," Chamizo said, citing the usual suspects of taxes and high insurance as causes for Edgewater's exit.

Chamizo's next plan is to market the 54-unit project to foreign developers. He will travel to Caracas on Sept. 18 to see if investors will jump on the deal.

"Edgewater used Kobi Karp, who is a very highly regarded architect, and spent a lot of money to get plans approved," Chamizo said. "We'll go to Venezuela, Mexico and Argentina and talk to the developers there. It's my job to find markets that are actively developing."

Nein, konkurs wäre z.B. Chapter 11
aber das würde bedeuten dass USXP solange
arbeiten kann bis es die Kohle zusammen hat
um die Schuldner zu bezahlen. Das USXP aber
seit Jahren rote Zahlen schreibt und hohe Verluste
einfährt glaube ich kaum dass es soweit kommt.
Receivership heisst einfach: Altomare ist als CEO
abgesetzt und die Liquidation übernimmt ein "insolvenzverwalter".
in dem Fall Anwältin Moscowitz.

Die SEC hat schon vor Jahren angefangen zu ermitteln.
Die haben sich richtig schön Zeit gelassen und Albtraumare
hat's nicht geblickt. Millarden von Shares hat er auf den
Markt geschmissen - sich davon 1mio Dollar Lohn/Jahr zahlen
lassen, Diamanten und Schmuck für mehrere hunderttausend gekauft,
Uhren für zigtausend Dollar gekauft usw. usw.

DU hast die Aktien gekauft die Albtraumare auf den Markt geschmissen
hat und ER hat das Geld kassiert und sich ein schönes Leben gemacht.

Meine Fresse wann kapierst Du das endlich?

Sogar sein eigener Anwalt hat sich von ihm zurückgezogen. Der Anwalt der die SEC verklagt hat.

MOTION IN THE NATURE OF INTERPLEADER FOR AN ORDER DIRECTING MARSHAL TO SELL PROPERTY BEING HELD BY THE RECEIVER

Plaintiff U.S. Securities and Exchange Commission ("SEC"), respectfully moves this court for an order: 1) setting aside the fraudulent transfer of jewelry, watches and precious metals from Richard A. Altomare; 2) directing the United States Marshals Service for the Southern District of Florida to sell Mr. Altomare's fraudulently conveyed property seized from Kravit Estate Buyers d/b/a/ The Estate Department, Inc.; 3) directing the deposit of the proceeds from the sale into the registry of the court; and 4) determining the proper application of the proceeds. In support of this Motion, the SEC relies upon the Declaration of Leslie J. Hughes with exhibits attached, the Memorandum submitted with this motion, and the following grounds:

I. Background

1. SEC commenced this action on March 24, 2004 against defendants, including defendant Richard A. Altomare ("Altomare"), Universal Express Inc., (the "Company") and others, alleging violations of the federal securities laws [Doc. No. 1]. This Motion pertains to Altomare and the Company.

2. On March 8, 2007, this court entered Final Judgment Against Universal Express, Inc., Richard A. Altomare, and Chris G. Gunderson, [Doc. No. 179]. ("Judgment"). The Judgment ordered Altomare to pay disgorgement of $1,419,025 plus prejudgment interest of $283,073, and a civil penalty of $1,419,025. The Judgment remains wholly unpaid.

3. On September 4, 2007, this court appointed a Receiver to take custody, control and possession of the property and other assets of Universal Express, Inc. (the "Company"). [Doc. No. 203].

4. On October 4, 2007, a Writ of Execution was issued as to Altomare for judgment #07,0605 in the amount of $1,419,025. ("Writ") The Writ was signed by the Clerk of the Court, J. Michael McMahon, on October 4, 2007.

II. Execution of the Writ

5. Pursuant to Fed. R. Civ. P. 5, notice of issuance of the Writ was served electronically through the Electronic Court Filing System on Altomare on October 4, 2007. The Writ commanded the Marshals Service to seize the goods and chattels of Richard A. Altomare including jewelry possessed by Kravit Estate Buyers, Inc. to pay the Judgment.

6. On October 4, 2007, counsel for the SEC faxed a copy of the Writ to the Marshals Service in Boca Raton, Florida.

7. On October 10, 2007, the Marshal served the Writ on The Estate Department, Inc., located at 7775 Glades Road, Boca Raton, Florida 33434, and seized the following twentyfour items of property which The Estate Department had obtained from Richard Altomare (collectively referred to as the "Seized Property"):

A report titled Seized Property and Evidence Control with photographs prepared by the Marshal on October 10, 2007, is attached as Exhibit C.

8. On October 10, 2007, the Marshal delivered the Seized Property to the Receiver for safekeeping.

III. Richard Altomare Purchased Some of the Seized Property with Funds Stolen from Universal Express, Inc.

9. On or about April 13, 2006, Richard Altomare purchased an 11.02 ct emerald-cut diamond from Les Bijoux LLC in Boca Raton, Florida for approximately $500,000. (Item 20 of the Seized Property listed above in paragraph 7.) Richard Altomare paid Les Bijoux for the diamond with wire transfers from the bank account of Universal Express, Inc. in the following amounts:
on April 13, 2006 a wire for $325,000, on April 26, 2006 two wires for $30,000 and $40,000, on June 5, 2006 a wire for $33,900, on July 27, 2006 a wire for $30,000 and on August 21, 2006 a wire for $50,000. Richard Altomare misappropriated these funds from Universal Express, Inc. to pay for this diamond. In the annual report for Universal Express that Mr. Altomare signed on March 27, 2007, he did not list any of the payments to Les Bijoux as part of his annual compensation. See the Summary Compensation Table at page 41 of 49 in the Company's annual report on Form 10-K for the year ending June 30, 2006, which is attached as Exhibit H. The only compensation that Mr. Altomare identified for 2006 in Exhibit H is his cash salary of $650,000, which was paid to him in bi-weekly payroll checks.

10. On or about January 26, 2007, Richard Altomare purchased from Les Bijoux a 7.00 ct radiant cut fancy yellow SI1 diamond ring set in platinum for $85,000 (Item 21 of the Seized Property listed above in paragraph 7), a Jaeger LeCoultre Atmos Clock for $40,000,[1] and a FP Journe Chronometre Souverain platinum watch for $20,000 (Item 14 of the Seized Property listed above in paragraph 7). Richard Altomare made partial payment for these items in three wire transfers of funds from the bank account of Universal Express in the following amounts:
$20,000 and $40,000 on January 26, 2007, and $20,000 on May 16, 2007. As of approximately September, 2007, Altomare owed Les Bijoux $65,000 for these three items. Richard Altomare misappropriated the funds from Universal Express, Inc. to pay for these three items. In the annual report on Form 10-K for the year ending June 30, 2006, which was filed on March 26, 2007, Altomare represented that he was currently employed under an employment contract that provides an annual base salary of $650,000. See Exhibit H at page 42 of 49.

[1] The Jaeger LeCoultre Atmos Clock was not seized on October 10, 2007.

11. On October 31, 2007, the Receiver made demand upon Altomare, through counsel, to reimburse the Company for $558,900, the amount misappropriated from the Company to purchase the Property. Exhibit G. Altomare has not reimbursed the Company, so the Property belongs to the Company.

IV. Altomare Fraudulently Conveyed Property to The Estate Department Inc.

12. The Estate Department is a Second Hand Dealer licensed and doing business at 7775 Glades Road, Boca Raton, Florida 33434. On an unknown date in September 2007, Richard Altomare signed a Second Hand Dealers Property Form with The Estate Department selling them a "Fancy Yellow Diamond Ring 7.85 approx ct" for $56,000 "with GIA cert.[2] needed - without [GIA cert.] full refund on ring," an aquamarine broach for $10,000, two silver bars for $2,400 and a diamond straight line bracelet for $21,600, which together total of $90,000.

When Mr. Altomare signed the Form he represented that:
"I verify that I am eighteen years or older, and I am the rightful owner of the above described property which is being sold or pledged, or that I am entitled to sell or pledge such property; and that the property is clear of all liens and encumbrances, including liens for past due child support, if proven otherwise, I promise full restitution, and understand that I will be criminally prosecuted to the fullest extent of the law."
The Form also appears to be signed by Mark Kravit on behalf of The Estate Department.
[2] GIA cert. refers to a report from the Gemological Institute of America.

13. The $56,000 price the Estate Department paid for the fancy yellow diamond ring is substantially less than its purchase price of $85,000 or the diamond straight line bracelet purchased for approximately $100,000. The price of the aquamarine broach, and silver bars is currently unknown.

14. At the time of Mr. Kravit's purchase, on behalf of The Estate Department, of the items listed above in paragraph 12 from Mr. Altomare, Mr. Kravit telephoned Greg Osipov, one of the managing members of Les Bijoux, LLC. Mr. Kravit was known to Mr. Osipov through previous business dealings and identified himself as the person speaking during the telephone call. Mr. Kravit informed Mr. Osipov that Richard Altomare was in the office of Mr. Kravit and trying to sell a ring and that Mr. Kravit needed the GIA certificate from Les Bijoux for the diamond ring that it had sold to Mr. Altomare. Mr. Osipov advised Mr. Kravit during the telephone conversation that Mr. Altomare could not sell the ring because Mr. Altomare still owed $65,000 on the purchase price of the ring.

15. After the telephone call, Mr. Kravit came to the business location of Les Bijoux and demanded that Mr. Osipov produce the GIA certificates for the diamond ring and the emerald cut diamond bracelet, and turn over an old diamond that Mr. Osipov possessed as collateral for the amounts owed by Mr. Altomare. Mr. Kravit asked Mr. Osipov to come to his car, where he produced the Jaeger LeCoultre Atmos Clock, which Mr. Altomare had previously purchased for $40,000. Mr. Osipov was angered by Mr. Kravit's demand and called Mr. Altomare who confirmed that he had told Mark Kravit to return the clock, which was damaged in transport back, to Les Bijoux. As a result of his conversations with Mr. Osipov, Mr. Kravit knew that Mr. Altomare owed money to Les Bijoux for his purchase of the yellow diamond ring.

16. On or about September 24, 2007, Richard Altomare entered into a second transaction with The Estate Department, in which he sold twenty-one additional items including his collection of expensive watches for $481,000. The items included 1) a diamond necklace, 2) diamond bracelet, 3) pear-shaped diamond ring, 4) cultured pearl necklace and 5) pearl earrings, 6) A. Lange & Sohne watch, 7) Jaeger LeCoultre watch, 8) Franck Muller steel watch, 9) diamond eternity band ring 9 ct, 10) Breguet 18 K yellow gold watch, 11) Rolex 18k gold watch, 12) A. Lange & Sohne steel watch, 13) A. Lange & Sohne watch, 14) Corum 18k yellow gold watch, 153) F.P. Journe watch, 16) Audemars Piguet watch, 17) Rolex Cellini watch, 18) 18K yellow gold necklace, 19) Diamond Bracelet, 20) cultured pearl and diamond necklace, and 21) loose emerald cut diamond 11.02 ct. Mr. Altomare signed another Second Hand Dealers Property Form in which he acknowledged receipt of $411,000 in cash with the balance of $70,000 due on October 5, 2007. This Form was subsequently signed by Barbara Altomare when she received the additional $70,000 in cash.

17. The price that The Estate Department paid for the 11.02 ct emerald cut diamond (along the other twenty items) of $481,000 is substantially less than the purchase price of the diamond alone which was approximately $500,000, and the F.P. Journe platinum watch which was purchased for $20,000.

18. Mr. Altomare's conveyance of these items of jewelry, watches and precious metals were made without fair consideration at a time while he was a defendant in an action for money damages and a judgment had been docketed against him. He knew at the time of the transactions that he had not satisfied the Judgment entered against him on March 8, 2007.

19. Mr. Altomare conveyed these items of jewelry, watches, and precious metals with actual intent to hinder, delay or defraud the Securities and Exchange Commission, which is a present creditor. He and his wife requested payment for the items be made in cash rather than a check. Although Altomare clearly represented on the Second Hand Dealer's Property Form that the property was his to sell, he did not advise The Estate Department of the existing Judgment obtained by the Securities and Exchange Commission on March 8, 2007. Moreover, at the hearing on October 12, 2007, Mr. Altomare's attorney misrepresented to the Court that proceeds from the jewelry sales belonged to Barbara Altomare, when in fact Mr. Altomare had purchased part of the jewelry with money stolen from Universal Express, and he represented in the transactions with The Estate Department that these items were his property. He placed his thumb print on the report as the seller of the property. Upon information and belief, Mr. Altomare paid
part of the proceeds from these sales to his attorney for legal services in this case.

V. Multiple Claimants Claim an Interest in the Property

20. The SEC claims an interest in the Property to satisfy the Judgment.

21. The Receiver claims the Property belongs to the Company.

22. The Estate Department claims to have an interest in the Property.

23. The SEC has given notice of this Motion to The Estate Department, who is represented by counsel. The Estate Department's counsel has informed the SEC that The Estate Department will intervene to be heard on this Motion. The SEC will not object to The Estate Department's motion to intervene.

24. This matter is in the nature of an interpleader and pursuant to 28 U.S.C. § 2361, the SEC requests that the Court enter an Order restraining all claimants from instituting proceedings affecting the property until further order of the court.

WHEREFORE, SEC requests entry of an Order: 1) setting aside the fraudulent transfer of jewelry, watches and precious metals from Richard A. Altomare; 2) directing the United States Marshals Service for the Southern District of Florida to sell Mr. Altomare's fraudulently conveyed property seized from Kravit Estate Buyers d/b/a/ The Estate Department, Inc.; 3) directing the deposit of the proceeds from the sale into the registry of the court; 4) determining the proper application of the proceeds and 5) restraining all claimants from instituting proceedings affecting the property until further order of the court.

U.S. Marshal seizes jewelry sold by former Universal Express CEO

Federal authorities say former Universal Express CEO Richard Altomare
used company funds to add to his personal watch and jewelry
collection - including a $500,000 diamond - then sold everything for
hard cash.

On Oct. 10, U.S. marshals seized 24 pieces of jewelry and watches
from Kravit Estate Buyers/The Estate Department in Boca Raton. The
SEC filed a motion in New York federal court on Nov. 5 to sell those
items to satisfy its $21 million judgment against the shuttered Boca
Raton-based company.

A judge ruled that Universal Express and Altomare illegally sold
unregistered securities and issued false press releases. As the SEC
prevailed, the company raised an additional $9.5 million by selling
unregistered securities this year, while Altomare took a $1 million
salary from the money-losing luggage shipping company, according to a
report by Miami attorney Jane Moscowitz, who took over as receiver on
Sept. 7.

Altomare is under federal criminal investigation while he appeals
$3.1 million in damages.

In an Oct. 31 letter, Moscowitz asked Altomare to reimburse the
company for $558,900 in jewelry purchased from Les Bijoux in Boca
Raton, $30,000 in gambling markers at a Las Vegas casino and his
$200,000 bonus.

Altomare did not return a call to his personal residence. His Miami
attorney, Arthur Tifford, also did not return a call.

"Their choice was to take money from the company and not pay the
employees, which is ridiculous," said Fort Lauderdale attorney
Christopher Whitelock, who represents a former Universal Express
employee in a federal unpaid wages lawsuit against the company and
its former executives. "He's gambling with people's wages."

Whitelock believes nine or 10 employees weren't paid for several
weeks and were denied overtime payment. The receiver's report shows
that some employees charged $61,000 to their credit cards to cover
company expenses - and were not reimbursed.

Money wired for jewelry
According to the SEC's motion, Altomare used wire transfers from
Universal Express to Les Bijoux from January through May to purchase
an 11-carat, emerald-cut diamond for $500,000; a 7-carat, radiant cut
fancy yellow diamond ring for $85,000; a Jaeger LeCoultre Atmos Clock
for $40,000; and a FP Journe Chronometre souverain platinum watch for
$20,000. These purchases were not mentioned in the company's SEC
filings and weren't part of Altomare's disclosed compensation.

In September, Altomare sold Kravit Estate Buyers the yellow diamond
ring and four other items for a total of $90,000 and signed an
agreement that he had title to the property and was free of liens,
according to the SEC. However, when Mark Kravit of Kravit Estate
Buyers asked Greg Osipov of Les Bijoux for the ring's certificate,
the jewelry store's managing member said Altomare still owed him
$65,000 for its purchase.

Later that month, Altomare sold 21 items - including the emerald-cut
diamond and the FP Journe watch - to Kravit Estate Buyers for
$481,000 in hard cash, according to the SEC, which noted that these
items were purchased for much more.

"Altomare's attempt to sell the property and take the proceeds for
himself was theft," SEC attorney Leslie Hughes wrote in a court
memo. "Under these circumstances, the Estate [Buyers] acquired no
title to the property because the property was owned by the company
and wrongfully converted by Altomare. No one can confer a better
title than he has, and a thief cannot pass good title."

Carl Schoeppl, the Boca Raton attorney for the Estate Department,
said his client would file a motion in the New York federal case to
have the jewelry returned to it. The Estate Department was a bona
fide purchaser without knowledge of the liens against Altomare, he
said. It will contest that the items were stolen, but if it can't
recover them, it would take action against Altomare and his wife,
Schoeppl said. He said falsifying a purchase agreement is a criminal
offense.

Professor backs SEC stance
The SEC has a good case for assigning the jewelry to the company's
assets, Nova Southeastern University law professor Mark Dobson said.
Unfortunately, the shop that bought the items appears to be on the
hook, and its best hope is that Altomare still has the money it paid
him, he added.

As for Altomare, buying the jewelry with company assets and taking
them for himself could be considered criminal theft - similar to what
former Tyco International CEO Dennis Kozlowski was convicted of, said
Boca Raton securities attorney Jim Sallah, who used to work in SEC
enforcement.

"Companies get looted all the time, but this is pretty brazen,"
Sallah said. "The fact that Altomare did it right under the SEC's
nose and after the company was thrown into receivership is pretty
outrageous."

Alle Assets wurden verkauft - Mad Packers, Luggage Express, Virtual Bellhop etc. etc. - und zwar für wenige tausend Dollar!
USXP wird liquidiert und der Verkauf der Assets reicht nicht mal aus um die außenstehenden Schulden von Altomare zu bezahlen!

Die 700mio sind NICHT collectable! Warum? 3 Parteien wurden angeklagt, zwei davon können die besagte Summe nicht bezahlen.
Die dritte Partei hat schon etwas gezahlt, aber das reicht NIE und NIMMER aus um die Schulden von Altomare zu begleichen!
Des Weiteren wird angezweifelt ob der richterliche Beschluss überhaupt gültig ist, weil es KEINE Beweise für NSS gibt!!!

Fakt ist: USXP gibt es nicht mehr. Die Firma wird nach und nach liquidiert und wenn ich schon wieder lese dass dieses Jahr PRIVATE FLÜGE im Lear Jet aus Firmengeldern bezahlt wurden dann würde mir als Shareholder das kalte Kotzen kommen.
Der Typ wird in den Knast wandern, denn er hat nicht mal Geld um eine Kaution zu hinterlegen.

An Amazing Fraud
November 14, 2007, 10:47 pm

The story of Universal Express and the contempt in which its former chief executive, Richard Altomare, held the law and the interests of its shareholders, gets more and more outrageous.

I first chronicled the case in June, in a column in which I pointed out that Mr. Altomare had ignored a federal court order that he step down as the company's chief executive and stop illegally selling stock to the public. The judge had found Mr. Altomare was a "repeated and remorseless" violator of securities laws.

This is a company that financed itself through the illegal sale of stock, and that got employees to put company expenses on their personal credit cards. Eventually, a federal judge appointed a receiver to take control of the company, who found the cash was gone and there were millions of dollars in unpaid bills.

But Mr. Altomare was not suffering. Here are some tidbits from the latest report of the receiver, as filed in federal court:

From April 2006 to May 2007 -- the latter date after the judge had ordered him to stop running the company -- Mr. Altomare had the company spend $558,900 at a retail jewelry store in Boca Raton, Fla. In October, he pawned the jewelry for $500,000.

In July -- after my column, and after the Securities and Exchange Commission asked a judge to hold him in contempt for failing to obey the earlier order -- Universal Express paid $30,000 "to cover Altomare's marker at the Wynn Las Vegas," a casino.

It turns out that there was much less than met the eye to the two major assets Universal trumpeted in its news releases and S.E.C. filings. The company knew its judgments against supposed naked short sellers -- judgments obtained in uncontested trials -- were worth pennies on the dollar, at most, but did not tell its shareholders. And the Michael Jackson collectible items it auctioned brought in nothing but legal woes for the company. They sold for so little that the auction house got to keep all the proceeds, and Universal Express is fighting legal battles over whether it owned the stuff to begin with.

Finally, there is this tidbit on the Jackson memorabilia:

"The collection also consisted of some master tapes of various Jackson family recordings. Those items have not been located, and there is reason to believe Altomare has them in his possession and is seeking to sell them."

The unanswered question now is whether the Justice Department will file criminal charges.

Ich beobachte euch hier schon einige Monate und muß leider feststellen
das 99 % von dem was ihr erzählt und handelt total daneben ist.
Mit USXP macht ihr nichts anderes als ein Wettbewerb wer die meiste
Kohle vernichtet.
Ich dachte immer an der Börse will man Geld verdienen und nicht
Geld verschenken.
USXP ist ein super Investment!
Wieviel IQ muß man haben um daran zu glauben,oder wenn man schon
alleine daran glaubt damit Gewinne zu machen.
Wisst ihr was absolut dumm ist ?

Wenn man verarscht wird und man merkt es nicht !

Ich bin es nicht, weil ich keine "Ratschläge" aus der Ferne brauche.

Wenn ich mich in die "Scheisse" setze, bin ich selbst dran schuld
und kein anderer.

Viele Basher hier, das gefällt mir. Da weiss ich, dass hier noch
was Positives kommt.

Es gibt genug tote Aktien, da kümmern sich in den einschlägigen Threads weder Pusher noch Basher schon monate-/jahrelang nicht
mehr drum. Die sind dann wirklich tot.

Aber hier ist das nicht so, wie gesagt, die Basher sind in der Überzahl, und die kümmern sich auch noch tgl. um "ihren" Wert.

Und das ist gut so.

Richtig Cssi,die bez.Basher und die Möchtegernbasher diese eigentlich armen Teufel,die ja nur vorgegebenes ohne eigenen Hirneinsatz ab zu schreiben brauchten,haben ja schließlich auch den USXP Kurs mit unwahren Attacken dort hingebracht,wo der Kurs jetzt steht.--

Es wurde von den Bashern (Namen nenne ich keine,da sie sich ja selbst wiedererkennen-oder sonst bekannt sind),übelste Nachrede über die USXP und ihren CEO,den Führer unserer Company der USXP verbreitet.So hatten alysant und störtie dem angeblich einsitzenden RA schon die Hand gereicht-und die USXP sei so Wally und 7.Sinn schon ausgegliedert und und und.......Alles erst..kende und erlogende Sch..ße von Seitens der Basher,nur um Panik zu verbreiten.-Denn weder sitzt König Richard A.Altomare im Jail,noch
ist die USXP"F" zerschlagen.----
Ganz im Gegenteil der Richter entließ die USXP -und auch das
Berufungsgericht,hielt diese Entlassung hoch.
-------was bedeuten könntest,daß wir vielleicht bald den USD pro 1 USXP Shares sehen,so denn die Auftrageber der bez.Basher,diesen ihren Bashern den Auftrag erteilen,die USXP nicht mehr schlecht-sondern nun wenn auch Seitenverkehrt,wieder im positiven Sinne an zu preisen :kiss Ein Scheißspiel,für den der sich von der bisherigen Basherschaar hat einschüchtern lassen.
P.S.:Schrift oder Satzfehler schenke ich den Oberschlauen in diesem
Board,die gleich bestimmt wieder versuchen werden,in Heerscharren

Universal Express Overstated Courtroom Victories: Receiver

BOCA RATON, Fla. (HedgeWorld.com) —The actual value of what remains of Universal Express may be even less than what the court-appointed receiver thought it was in September. That is the inference readers will draw from the receiver's report to the U.S. District Court in Manhattan, filed on Wednesday [Nov. 14].
Universal Express Inc. is a logistics and transportation company that, according to the Securities and Exchange Commission, has made illegal unregistered distributions to the public of hundreds of millions of shares of stock. Its receiver, Jane Moscowitz, filed her second report on its assets this week, for the benefit of the judge presiding over the SEC's case against Universal Express, Gerald E. Lynch.

Mr. Lynch appointed Ms. Moscowitz in August Previous HedgeWorld Story, and in her first report, the following month, she noted that Universal Express claimed among its assets two court judgments against "various stock manipulators and ‘naked shorters,'" totaling, with interest, approximately $700 million. Both judgments were obtained in uncontested trials. In this second report, Ms. Moscowitz painted a still gloomier picture. She made note of rumors surrounding these judgments, rumors that seem to have sustained Universal's shareholders in the false hope of a big payday.

"One was that early on the Company had located and was about to collect $183 million of the judgments. That rumor is wholly without foundation," she wrote. "Shareholders have also written that they were told that $15 million had recently been offered by [one of the defendants, Ronald] Williams. No such offer was made."

In general, Universal Express' characterization of the judgments as substantially collectible doesn't appear to be correct, she concluded.

The company's assets also formerly included a collection of memorabilia of entertainers Michael and Janet Jackson. This asset, too, was overvalued. In a press release in May, the Universal Express estimated the value of the memorabilia at between $30 million and $200 million. An auction held soon after realized only a little less than $600,000.

"The morass of litigation and money owed surrounding the acquisition and auction of this collection makes it highly unlikely that any funds will be realized. . . ," Ms. Moscowitz wrote. "The Receiver is, instead, seeking to minimize liabilities."

There has also been a flurry of filings in recent days with regard to the SEC's case against co-defendants: individuals who served as go-between in the corporation's allegedly illegal issuances of stock.

These individuals are Mark S. Neuhaus, George J. Sandhu and Tarun Mendiratta. Their attorneys couldn't be reached for comment Friday afternoon [Nov. 16]. The SEC claims that they received stock from the company at a substantial discount to the public market price. They then re-sold the shares to the public for a quick risk-free profit and used the proceeds to finance subsequent stock purchases as the scheme rolled forward. The dilutive effect of the issuances lowered the stock's value, according to the SEC.

The recent flurry of filings has involved what are known as motions "in limine," i.e. motions by one party to ban another party from introducing certain specific items in evidence, or producing the testimony of specified witnesses.

The attorney for Mr. Sandhu, for example, has asked that the court preclude the testimony of three members of the SEC staff, on the ground that they don't have any personal knowledge of the facts at issue on the one hand, and they aren't qualified as expert witnesses on the other.

Consequently, "they are hearsay witnesses who can only offer speculation," Mr. Sandhu's attorney claimed in the motion.

Vergiss nicht:

Ich hab mit USXP damals 1.000% Gewinn gemacht.
Und habe sogar RECHTZEITIG zum Aussteigen gewarnt
nach mehreren dubiosen Press Releases von Altomare!!

Das konnte nicht mehr länger gutgehen. Was meinst Du
denn warum ich Altomare so hasse? Ich wäre damals sehr
sehr gern dabei geblieben. Aber was er da abgezogen hat
war unterste Schublade.

Ich habe draus gelernt!

Und ich bin bei einigen anderen OTC Werten genauso
auf die Schnauze gefallen. Man darf halt nicht vergessen:
OTC ist ein absoluter Klitschen und Betrüger Markt!

Um es mit Federn auszudrücken: Ich musste einen Haufen
meiner Federn lassen........die mir übergeschüttet wurden.....



Ich handle meist nur noch mit Zertifikaten auf
Indizes, Rohstoffe und einige andere Tech Werte
aus Dax und Tec Dax.

der Spruch ist gar nicht so blöd, aber es gibt noch einen anderen Spruch, den man entgegen setzen kann, und der lautet: "die Hoffnung stirbt zuletzt"...

und an dieser Stelle kann ich (ich spreche ausschliesslich für mich) nur sagen: die Hoffnung ist bereits seit längerem beerdigt worden, nur hat fast jeder diese Beerdigung (bis jetzt) verpasst...
