On January 2, 2019, after the close of trading, Apple shocked the market when it disclosed the true state of its actual 1Q19 iPhone sales, particularly in China. For the first time during Cook's tenure as Chief Executive Officer ("CEO"), Apple would miss its public revenue projections and the miss was up to $9 billion. The Company would admit that in addition to macroeconomics in the Chinese market, the price cuts to battery replacements a year earlier to fix the Company's prior surreptitious conduct had hurt iPhone sales....

...Der Oberste Gerichtshof der USA hat am Montag mit mit fünf zu vier Stimmen für die Zulassung einer Kartellklage gestimmt. Die Klage stammt von iPhone-Nutzern, die Apple vorwerfen, dass die 30%ige Provision des iPhone-Herstellers beim Verkauf von Apps über den App Store an die Verbraucher weitergegeben werde. Das sei eine unlautere Nutzung von Monopolmacht, weil Apple dadurch den Verbrauchern höhere Preise abverlange.

Apple argumentierte, dass nur App-Entwickler und nicht Benutzer, in der Lage sein sollten, eine solche Klage einzureichen und stützt sich dabei auf ein vorangegangenes Urteil. Hauptargument ist, dass die Verbraucher keine direkten Kunden von Apple seien.

Das Gericht gelangt jedoch zu einer anderen Auffassung. „Wir sind anderer Meinung. Die Kläger kauften Apps direkt von Apple und sind somit direkte Käufer [..]. In diesem frühen Stadium des Rechtsstreits prüfen wir weder die Begründetheit der Kartellansprüche der Kläger gegen Apple [..]. Wir stellen lediglich fest, dass die [..] Direktkaufrichtlinie diese Kläger nicht daran hindert, Apple im Rahmen der Kartellgesetze zu verklagen.“...

..die lieber über 1000 gefälschte iPhones mit angeblich dem gleichen Defekt - vom selben User! - eintauscht, als der Sache mal vorher auf den Grund zu gehen:

Lass den verzweifelten faultcode ruhig BILD-Links posten. Dann ist er zumindest beschäftigt. Meine Qpple-Aktien steigen kontinuierlich.
