Ja, bin leider nicht auf dem Hoch ausgestiegen.
Allerdings hab ich im letzten Frühjahr ein paar Stücke gegen einen schicken MX-5 getauscht. Dafür würde ich heute nur noch einen Bobby-Car bekommen.

Jan. 31--HICKMAN, Ky. -- A disputed Forbes magazine story saying Dallas-based Earth Biofuels was built on shell companies and insider transactions doesn't mar local confidence in the company's plans to build a 50-job, $11.1 million biodiesel plant here, Hickman-Fulton County Riverport Director Doug Goodman says.
"They tell me everything is a go, and that's the attitude I'm taking with it," he said Tuesday. "They've just completed a feasibility study, and our next move is land acquisition."
Goodman said the riverport authority checked out Earth, as it would any company, before striking the deal. The authority holds land options to negotiate with the company for a 30,000-square-foot factory to be built on 10 acres and make Willie Nelson-branded fuel. It would be financed by an $8 million bank loan and $3.1 million in equity, according to preliminary approvals for $1.12 million in state tax incentives.
Earth's application with the Kentucky Economic Development Finance Authority anticipated construction to start April 1 and be completed by Oct. 31. Goodman said that schedule may be slightly aggressive, but he expects work to start sometime in the spring.
Despite company claims of inaccuracies, Forbes stands by its Jan. 8 story saying Earth was built on shell companies and insider deals, Forbes spokeswoman Elizabeth Wasden said.
The Forbes story said Hollywood stars Morgan Freeman and Julia Roberts have joined country singer Nelson in helping promote Earth, which plans to build a national chain of filling stations selling an enviro-friendly diesel fuel called Bio Willie. Nelson, a director, gets a penny-per-gallon royalty.
Forbes wrote that Earth earned a "slim 4.2 percent gross margin" on $10.3 million in third-quarter 2006 sales, spending nearly half its revenue on administrative expenses. It missed a Dec. 4 deadline to come up with $80 million to restart a long-closed ethanol plant south of New Orleans, the company's largest investment at that time.
Under terms with lenders who provided $53 million in financing last summer, Earth must hit $30 million in earnings before interest, taxes and depreciation by the end of 2007 or come up with cash -- or face converting debt into stock that would dilute existing owners, Forbes reported.
Wasden said the magazine received a letter from Earth Chairman and Chief Executive Officer Dennis McLaughlin taking issue with the story, which hit newsstands in late December. The letter noted "numerous factual errors and misrepresentations," some related to McLaughlin's prior business dealings.
Earth Corporate Communications Director Shawn Horne said Tuesday that McLaughlin did not wish to respond further to the general tone of the story.
In response to the letter, Forbes did clarify that Earth had until the end of 2007 -- not 2006 -- to avoid having to convert debt into stock. Nothing else was corrected or clarified, Wasden said.
Other elements of the story, written by Daniel Fisher:
--Earth was formed out of a "clutter of shell companies" and a Meridian, Miss., biodiesel refinery bought from director Bruce Blackwell's brother for $7 million. "Aided by a flood of press releases, Earth's market value rose from next to nothing in 2005 to a recent $344 million."
--Eighteen pages of Earth financials "are insider transactions," such as $16,000 a month in rent for a truckstop and convenience store in Mississippi owned by director Blackwell. The deals also include a $160,000 investment in Blue Wireless, a penny stock venture McLaughlin controls, and a series of trades between Earth Biodiesel and Apollo Resources. Apollo was renamed from Powerball International, which McLaughlin took over as a dormant shell once in the hydrogen business. He was sued by New Mexico oilman Donnie Hill, who claimed Apollo's main assets had been stolen from him. Hill has since settled for an undisclosed amount.
"McLaughlin insists all transactions have been fair to Earth," Fisher wrote. "But they aren't necessarily helping it reach its goal of opening ethanol refineries in North Carolina, Louisiana, Texas and Illinois."
--McLaughlin called the Louisiana project "an ongoing business opportunity" that hasn't resulted in forfeiture of company funds, but Earth director William Luckett said the firm and its plant partners are in dispute over higher-than-expected construction costs.
The story also noted McLaughlin's other "colorful background" of key involvement with troubled companies:
--He founded Aurora Natural Gas in 1993 and later presided over its $100 million bankruptcy. Duke Energy Trading -- which bought gas from Aurora and resold it to third parties -- settled with McLaughlin and gave him a release after suing him for fraud, saying he used shell companies to double-bill Duke for $26 million, the story said.
McLaughlin's letter to Forbes said he was at all times a minority investor and didn't preside over the bankruptcy because he had already left the company.
--After a brief stay he left Ocean Resources, a "penny stock outfit in the undersea-salvage business," in January 2005 over allegations he had overcharged the company through his consultancy. "McLaughlin says the claims are unfounded and that Ocean owes him money," Fisher wrote.
McLaughlin's letter said he resigned "as part of a plan to move the company into an operational phase." Ocean later made allegations that a firm McLaughlin founded in 2002 and left in 2003 had been overpaid by Ocean for services rendered in 2005.
