Es gibt einige neue Berichte auf der Seite von Globe http://www.globemm.com/. zu Aktivitäten, Geld und sonstigen Vermögenswerten. Nachdem sich lange nichts getan hat und auch wenig berichtet wurde, scheint sich nun langsam wieder etwas zu tun. Das kommt m. E. zum richtigen Zeitpunkt, da die Stimmung gegenüber Rohstoffen sich scheinbar gerade etwas aufhellt. Darauf haben wir lange warten müssen.....

Antwort auf Beitrag Nr.: 59.715.417 von ralli9999 am 25.01.19 23:35:54Über die im folgenden Artikel, im aktuellen "Mining Review Malawi" auf Facebook vom 24.01.2019, enthaltenen Punkte aus dem neuen Minengesetz, besteht offenbar, wie im letzten GBE-Announcement zu entnehmen/interpretieren ist, zwischen GBE und der Regierung, bis auf nicht weiter detaillierte Punkte, Einigkeit.
Von den bisher gemachten Erfahrungen, in Punkto Transparenz, sind sie wahrscheinlich schon mehrere Schritte weiter, als man offiziell einräumt und ein kurzfristiger Abschluß der Verhandlungen könnte durchaus bevorstehen.
Malawi Govt. to have 10% shares in large mining ventures

Government will take up 10% free equity in large-scale mining operations without obligating itself to give any concessions on any item in the fiscal regime, this is according to the New Mines and Minerals Act.The Act explains that government will have a limited-time option to exercise its right to a free equity ownership interest in a mining project commencing at the time that a large-scale mining licence application is submitted and terminating on the date that the mining licence application is granted or denied.It says: “At the time that the Mineral Resources Committee considers a large-scale mining licence application but before it decides the application it shall recommend in a notice to the Minister whether the Government should elect to require a ten percent free equity ownership interest in the associated mining project.”“The Minister shall, within twenty eight days of a notice decide, in consultation with the Minister responsible for finance, and notify the Mineral Resources Committee whether the Government shall exercise its right for up to a ten percent free equity ownership interest in the mining project, and if so, the percentage.”The Act also introduces a new licence called Retention Licence, which is granted to holders of valid exploration license to maintain the exclusive right to apply for a mining license, over an exploration area when exploration has been completed but prevailing conditions do not justify mine development at that particular time.The Law says that Retention Licence applicant shall be a holder of a valid exploration licence, whose exploration licence area includes the entire area to which the retention licence application relates. It says a Retention Licence holder shall be a company duly incorporated, or registered as an external company under the Companies Act, 2013 that has the technical competence and financial ability to fulfill the licence obligations.In addition, the New Law has introduced a small scale mining licence which is valid for two years replacing the one year mining claim in the previous 1981 Act for regulating small scale mining operations, such as lime production and gemstone mining.“Malawian citizens only are eligible for this licence and it is granted by the Commissioner,” says the Act. The Law also introduces a provision for mining companies to sign community development agreements stating that a holder of an exploration licence, retention licence, medium-scale mining licence or large-scale mining licence shall develop a community engagement plan in collaboration with local government authorities, traditional leaders, communities, organizations, women and minority groups in the area in proximity to the tenement.“Where more than one tenement is held by the same tenement holder in a localized area, the tenement holder may register a single community engagement plan that provides for community engagement in that area,” it says.Speaking when he tabled the Bill in Parliament, Minister of Natural Resources, Energy and Mining, Aggrey Masi, said it was important for the Members of Parliament to pass the long awaited bill to allow the government address challenges in the sector notably illegal mining by artisanal and small-scale miners.Opposition parliamentarians who spoke before the Bill was passed said though the Bill had some areas which needs improvement or rectification, it was important to pass it into Law to allow that things move in the sector, and make amendments later.The enactment of the new Law is a respite to a number of stakeholders in the minerals sector including the private sector and civil society organisations, who have been advocating for the new law saying the 1981 law was archaic and not in tandem with modern developments in the sector.

Mining Act
Malawi’s mining law - Mines and Minerals Act (Cap. 61:01) has been in place since 1981. This legislation
has been the foundation for Globe’s investment into the KNP.
On 14 December 2018, the National Parliament of Malawi passed a new bill – Mines and Minerals Bill
2018 (New Act) which legislation is intended to replace the current legislation. For the New Act to come
into force it must receive Presidential assent, but to date this has not yet occurred.
The Company believes the New Act will have an economic impact on the KNP pending assent, as such the
Company is not in a position to finalise its financial modelling of the KNP and as a result of this, it is not in
a position to complete the Feasibility Study.
Development Agreement
The Company has made significant progress in negotiating a Development Agreement for the KNP with
the Government of Malawi. The Company has accepted that the Government will be issued equity in the
entity which holds the KNP. Again, the New Act has certain requirements which would need to be
reflected in the Development Agreement and so the assent of the President to the New Act is relevant to
the outcome of these negotiations.
Finalisation of the Development Agreement also requires a shareholder’s agreement to be drafted prior
to the Development Agreement becoming operative, amongst other conditions.
Financial Model
The Company is not yet in a position to finalise and release the key outcomes of the financial model due
to:
(a) the current uncertainty associated with the status of the mining law in Malawi (see the
commentary on the Mining Act above); and
(b) the status of negotiations between the Company and the Government on the Development
Agreement,
each of which may cause material change to the financial model when they are resolved/finalised.
Timing
The Company cannot place a timeframe upon when the New Act will be assented to, or when the
Development Agreement will be settled, and therefore when the Company can finalise the Feasibility Study
for presentation.
Despite the fact that the assent of the new Mining Act and by extension the finalisation of the Development
Agreement are matters beyond the control of the Company, the Company assures its shareholders that it
has and continues to do everything within its capabilities to bring about finalisation of the Development
Agreement, in order to allow the Company to advance the project to funding and ultimately production.
Mutharika ist und dürfte klar sein, daß es ohne Zugeständnisse an Investoren aus dem In- und Ausland nicht geht, wie es ja auch weltweit üblich und Standard ist. Der Artikel in der Maravipost vom 23.10.2018 macht zumindest große Hoffnung das es nun tatsächlich dazu kommen könnte.

Vom letzten Mediation -Gerichtstermin am 15.11.2018, an dem die Kompensation der betroffenen Einheimischen Haushalte behandelt werden sollte, gibt es offiziell und auch im Internet noch keinerlei Informationen und Hinweise.
Ich habe aber seinerzeit folgenden Facebook-Eintrag mit Kommentaren gefunden:

Ich gehe daher davon aus, daß die Minenlizenz in Kürze erteilt werden könnte und GBE dann tatsächlich auch mit Kanyika an den Start gehen wird. Dazu werden wir von GBE hoffentlich demnächst endlich einmal mehr erfahren.
Mutharika wird jetzt alles dafür tun die maximale Publicity zu bekommen, um bei den in Mai 2019 anstehenden Wahlen als Präsident wiedergewählt zu werden. Den erste Schritt dahin hat er mit dem heutigen Tag bereits erfolgreich getan.
Es wird daher aus meiner Sicht kurzfristig Schlag auf Schlag gehen und Mutharika wird nicht mehr viel Zeit verstreichen
lassen die Wähler mit allen Mitteln auf seine Seite zu ziehen.

Gerade der nötige Strom sollte dann, bis zur Inbetriebnahme der Mine, vorhanden sein und die Mine damit versorgt werden können.
