Come on . You have to ask me. A little research on G reorganization, and from that he concludes commons are going to get wiped. LOL. Yet here we have billions of dollars of lawsuits filed by reputable law firms, based on federal statutes, and this little entry negates all the positives that exist for commons. Don't you think the professionals would be doing hundreds of hours of research on The g reorganization? Also read his posts from yesterday and go to his tax link. WHere does it state that in a g reorganization commons can't share in new commons. No where.

Mordy, we agree to disagree. I think Walrath has to get this dead right, it is a career defining moment. If she rules for WMI it is going to open a floodgate here.
The 'safe' route for her is to send it to trial. We'll see what she is made of soon enough.

she already stated it was a mature debt due and owing at 6/24. To combat the summary judgment, jpm and the fdic had to come up with a genuine dispute of a material fact. They did not. They merely speculated. SO she has to grant the summary judgment because the holding company is entitled to it under the law procedurally. JPM and the fdic failed to meet their burden. Moreover, she would have denied it by now. Nothing threatens her career more than being lax on making decisions.

Walrath isn't going to rule on the 4.4 Billion until she is forced to by the upcoming March 10 reorg deadline. She obviously is working on a monster ruling document here, and needs more time.
It took her 4 months to rule on the Noteholders issue, which was nothing compared to SJ, and that was 20 pages!!!!
SJ on the 4 Billion could be a freaking dissertation. I expect it in late Jan/Feb so that WMI has enough time to consider the money in the reorg plan.

10. I think she will do it before the 18th. Judges don't like to have the lawyers before them when they make decisions. Serve the opinion on them a few days beforehand so the loser cools off before the next hearing. Then kind of grin at the fdic when she says request for relief is moot. Time is on my side. She has had enough time.
