Der Kurs robbt sich nun doch langsam wieder nach oben.

Es gab nun schon zum wiederholten Mal ein interessantes Gerichtsurteil aus den USA, das besagt, dass US-Cloudunternehmen die Daten ihrer europäischen Kunden im Sinne des Patriot Acts auch dann an die US Behörden rausrücken müssen, wenn diese auf europäischen Servern gehostet werden.

Wenn diese Rechtssprechung wirklich Bestand haben sollte, dann dürfte dies dazu führen, dass die mächtigen US-Softwarekonzerne keine Chance haben, mit ihren Cloudlösungen in Europa erfolgreich zu sein. Umgekehrt wäre das eine Riesenchance für Fabasoft und andere europäische Cloud-Provider.
Kommt es auf Basis solcher Urteile wirklich zu einer geopolitischen Aufteilung des weltweiten Cloud-Marktes? Von der Beantwortung dieser Frage hängt viel ab, wenn man den zukünftigen Unternehmenswert von Fabasoft korrekt einschätzen will.

“Microsoft has lost the first round in its fight to prevent US authorities from seizing customer data stored in its overseas data centers.
Following a two-hour hearing before the US District Court for the Southern District of New York on Thursday, District Judge Loretta Preska ruled that a US warrant ordering Microsoft to hand over its customers' emails and other data was valid, even though the data in question was stored on servers in Dublin, Ireland.
Redmond had argued that because the data was managed by one of its foreign subsidiaries, local law and not US law should apply. Judge Preska disagreed.
"It is a question of control, not a question of the location of that information," she said.”
