Unsealing his ruling in favor of Tesla investors peeved by the co-founder’s social media habits, a federal judge was unequivocal about Elon Musk’s tweet declaring he would take the company private.
“No reasonable jury could find that Mr. Musk did not act recklessly,” U.S. District Judge Edward Chen wrote in an April 1 ruling unsealed on Tuesday, adding that Musk knew otherwise from discussions with Saudi investors a little more than a week earlier.
On Aug. 7, 2018, Musk told his then-22 million Twitter followers that he had been considering taking Tesla private at $420 per share, a price tag widely perceived to be an in-joke for cannabis culture.

Crucial to Judge Chen’s ruling was a July 31, 2017, meeting with a representative of Saudi Arabia’s public investment fund (PIF), which lasted between 30 minutes to an hour. Musk says they discussed the possibility of taking Tesla private.
“However, the total amount of funding needed to take Tesla private was not discussed. Nor was the price to be paid for Tesla stock if the company were to be taken private,” Judge Chen found. “In addition, there was no discussion about what percent ownership would be taken by the Saudi PIF if Tesla were to be taken private.”
Late last month, Musk’s attorney Alex Spiro insisted that his client’s tweet was true.
“Nothing will ever change the truth which is that Elon Musk was considering taking Tesla private and could have—all that’s left some half decade later is remnant litigation which will continue to make that truth clearer and clearer,” Spiro claimed in an email Law&Crime in late April.
Judge Chen categorically found the “Funding secured” assertion embedded in the claim misleading.
“Based on the evidence of record, the Court finds that no reasonable jury could find the statement ‘Funding secured’ accurate and not misleading,” the 33-page order states. “The evidence of record shows that there was nothing concrete about funding coming from the PIF; rather, discussions between Tesla and the PIF were clearly at the preliminary stage. There had been no discussion about what the purchase price would be for a share of stock. Nor had there been any discussion about what percentage of the company the PIF would own or the total amount of money the PIF would contribute.”

These sales increases were despite supply-chain issues principally for computer chips and battery cells and a shutdown of its factory in Shanghai for a few days due to a COVID-related government-imposed lockdown in the region.
The company overcame those issues due to its own battery cell manufacturing facility, its ability to redesign computer chip software, and its success with a more vertically integrated supply chain than competitors. Tesla’s share price increase boosted the Fund’s performance by 51 basis points in the quarter.
Tesla remains the Fund’s largest holding and at quarter end represented 27.7% of the Fund’s net assets. We believe Tesla sales could increase substantially as additional production capacity is added this year in Berlin, Germany and Austin, Texas. Demand for Tesla cars remains extremely strong.

Ansonsten: alle weiteren Top 10-Positionen nach $TSLA (vom November) sind auch jetzt noch ganz vorne dabei, aber mit anderen Gewichten => er hält also eisern an seinen Lieblingen fest oder wie er es ausdrückt:

So ein Quartalsbericht ist ja immer recht lang bei ihm & Sohn (10 Seiten!) und er denkt sich schon was bei allem mMn. Aber irgendwann, wenn er weiterhin so an $TSLA festhalten sollte, wird er mMn nicht umhinkommen, zu sehr auf alte Erfolge hinzuweisen (was er ja jedesmal macht und die ich auch gar nicht bestreiten will).
Aber auch für einen alten Portfolio-Manager gilt mMn: einmal ist immer das erste Mal mit so einer "Conviction Position" (die er aber $TSLA nicht so nennt; das Wort "conviction" kommt trotzdem dreimal drin vor)

The manufacturer explained that the current ESG reports do not measure the magnitude of the positive impact on the world, which is the biggest mistake. Instead, it focuses on measuring the dollar value of risk/return. The problem is that individual investors who trust their money to ESG funds of large investment institutions may not be aware that they can be used to buy shares in companies that worsen rather than improve climate change.
As an example, Tesla cites measuring the impact of the automotive industry. While the average investor might think that the more electric vehicles an automaker sells, as a percentage of total volumes, the better its ESG score—but the reality is different. As long as the company continues to slightly reduce emissions from its manufacturing operations while also releasing internal combustion engine vehicles, its ESG ratings are likely to rise.
But, vehicle use-phase emissions, which represent 80-90% of total automotive emissions (included in Scope 3 of ESG reporting), tend to be misreported due to the use of unrealistic assumptions or not reported at all. Thus, it turns out that some oil and gas companies rank higher than Tesla on “Environmental Impact,” which, as we understand, is completely untrue.
