      Der SAP Vorstand muß jetzt aber auch einmal handeln, sonst sehen wir die EURO 30,00 in den nächsten Tagen. Ist ein Schaden durch Untätigkeit einklagbar ?

      Oracle Suit May Prompt Criminal Action Against SAP

      Oracle Corp.'s lawsuit charging rival business software maker SAP AG with corporate theft could spur criminal as well as civil legal action against the company or rogue individuals acting on their own.

      SAN FRANCISCO - Oracle Corp.'s lawsuit charging rival business software maker SAP AG with corporate theft could spur criminal as well as civil legal action against the company or "rogue" individuals acting on their own.

      Analysts highlighted the details included in the 43-page complaint accusing an SAP business unit in Texas of illegally using customer log-ins to steal copyrighted materials and other materials from its password-protected Web site.

      "While Oracle's case against SAP looks compelling on the surface, it is important to remember that we have not yet heard SAP's side of the story," JMP Securities analyst Pat Walravens said in a research note.

      The lawsuit marks the latest battle between Oracle and SAP as they fight over the market for software that helps companies automate everything from human resources to accounting.

      SAP has said it would aggressively defend itself against the charges.



      "If I was back in the government this is something that would be of interest to me because it is high profile and it invoScott Christie, a former U.S. prosecutor in charge of computer crimes, said a key in the case -- should the charges prove true -- will be whether it was individuals acting alone or if SAP had any role in the alleged actions.

      He also noted that these kinds of high-profile cases tend to draw the attention of federal prosecutors and said it would come as no surprise if the government opens a criminal case.lves significant loss to the victim," he said.       The lawsuit filed in U.S. district court in San Francisco last week charges that SAP was able to copy thousands of Oracle software products and other confidential materials onto its own servers and compile an illegal library of copyrighted software code.

      Oracle said in the complaint a "storehouse of stolen Oracle intellectual property" allowed SAP to offer cut-rate support services to Oracle customers and lure them to SAP products.

      SAP's chief executive denied Monday that the company used customers' online access codes to steal copyrighted software.

      "We respect others' intellectual property," Henning Kagermann said on the sidelines of a conference in Munich.

      SAP is the business software market leader, but Oracle has spent $20 billion buying software rivals over the past three years to close the gap as its core database business matures.

      Executives at both companies regularly belittle each other's products and strategies in public. Oracle has called SAP's NetWeaver product deceiver" while SAP has referred to Oracle's "Project Fusion" has "confusion."


      LATEST SALVO

      Scot Braunzell, head of cyber security for a consulting group that does security management for big corporations, agreed the latest salvo could result in criminal charges and that Oracle appeared to have a credible case.

      But he suggested that "rogue" individuals could be involved and asked why a company would engage in corporate espionage without doing a better job of covering its tracks.

      "I would think that Oracle in its position right now would not file a complaint of this nature if they did not have credible forensic data," said Braunzell of Risk Control Strategies.

      "If this is going to be some type of corporate espionage, why would SAP come in using its own servers and its own network," he added. "That is a pretty pertinent question."

      Redwood Shores, California-based Oracle is seeking to stop SAP and prevent it from using illegally acquired materials, as well as damages and attorneys' fees, according to the lawsuit.

      Other analysts said it was too early to gauge the financial impact on SAP, but that it would generate unwanted attention in the news at a time when the German company is trying to reassure investors after it missed a key 2006 sales target.

      Since the beginning of the year, Oracle shares have risen a little more than 6 percent while SAP shares traded on the New York Stock exchange have fallen more than 14 percent. (Additional reporting by Christian Kraemer in Germany)

      Der Kurs dümpelt vor sich hin - kaum zu glauben.

      Die Sprachlosigkeit ist m. E. auch bezeichnend dafür, daß es kaum noch etwas zur SAP zu sagen gibt; ist das ein gutes oder ein schlechtes Zeichen?

      Wenn dem Thema SAP in diesem Forum bereits der Gesprächsstoff ausgeht, dann ist es zu hoffen, daß es an der Börse ebenso ist; das kann jedoch nur positiv für den Kursverlauf sein. Wir werden sehen!

      ....hoffen und harren macht manchen zur schnecke....
      dies gilt wohl auch für die trendwende bei der sap
      ich bin seit februar dabei habe im märz noch nachgekauft und ärgere mich immer mehr über meine dummheit und ungedult....

      im kurs tut sich ja so richtig nichts:cry: hoffentlich geht es bis zur jahreshauptversammlung im mai mal wieder ab!!! die richtung ist mir dann auch so langsam egal....hauptsache bewegung!!!
