WASHINGTON (Reuters) - A senior Democratic lawmaker said on Thursday he would push to pass legislation to repeal a three-year-old U.S. ban on Internet gambling that has hurt trade ties with European Union.
"I'm going to be pushing it," House of Representatives Financial Services Committee Chairman Barney Frank told reporters at a press conference to lay out his agenda for reforming U.S. financial regulation.
Work on drafting the legislation should be completed this month, a House aide said.
Congress attempted in 2006 to quash online gambling in the United States by barring businesses from knowingly accepting payments in connection with unlawful Internet gambling, including payments made through credit cards, electronic fund transfers and checks.
European online companies lost billions in market value after the Unlawful Internet Gambling Enforcement Act became law and they withdrew from the U.S. market.
Supporters of the ban, which was enacted when Republicans still controlled Congress and the White House, argued that offshore Internet gambling websites take billions of dollars out of the U.S. economy, damage families and serve as vehicles for money laundering.
Advocates of lifting the ban say it is impingement of personal liberty and estimate the United States could raise nearly $52 billion in revenue over the next decade by taxing and regulating Internet gambling instead.
Meanwhile, the London-based Remote Gambling Association has accused the U.S. Justice Department of singling out European online gambling companies like PartyGaming and 888.com for prosecution while allowing U.S. companies to operate freely.
The European Commission, acting on an industry petition, began a formal investigation into that issue last year and is expected to release a report soon saying it has grounds to take action at the World Trade Organization.

Reps. Barney Frank (D-Mass.) and Peter King (R-N.Y.) introduced legislation Wednesday that, if passed, would create regulatory framework for online gambling in the United States.
"Internet gambling in the United States should be controlled by a strict federal licensing and regulatory framework to protect underage and otherwise vulnerable individuals, to ensure the games are fair, to address the concerns of law enforcement, and to enforce any limitations on the activity established by the states and Indian tribes," the 48-page bill reads.
The bill, which calls on the Treasury Department to regulate the industry, is careful about making sure individual states and Native American tribes have the right to impose further restrictions on Internet gambling or outright ban it.
A licensing system must "adopt and implement systems to enforce any applicable federal, state, and Indian tribe limitations," reads one part of the bill.
Another section of the bill indicates that one of the minimum requirements for a licensed operator is "ensure that no customer who is located in a state or tribal land that opts out...can initiate or otherwise make a bet or wager prohibited by such opt-out."
In order for an operator to obtain a license in the U.S., they would have to they had demonstrate they had a plan to, among other things, "protect underage and problem gamblers, ensure games are being operated fairly and comply with and address the concerns of law enforcement."
All operators would have to pass a background check. And if granted the standard five-year license, they would have to make sure all players were of legal age and allowed to wager from their location, collect customer taxes, pay any of their own taxes, safeguard against financial crime, implement safeguards for problem gamblers, implement privacy safeguards and meet any other requirements the Treasury Department might ask for.
The legislation also clearly spells out that sports betting on the Internet is illegal.
"The bill was very impressive and thorough," said Buffalo State business law professor Joe Kelly. "I certainly think it establishes what an average Congressman is looking for (in terms potential operators) -- suitability, solvency and social responsibility."
Kelly also said the bill set very high standards for people seeking gaming licenses.
"The entity seeking the license has to show clear and convincing evidence (that they're suitable). That's a higher burden of proof than in many civil cases. It's also what New Jersey uses (to regulate their gaming industry), " he said.
Leaders within the online gambling industry joined Kelly in their praise of the bill.
"Online poker is a legal, thriving industry and poker players deserve the consumer protections and the freedom to play that are provided for in this legislation," said Poker Players Alliance Chairman and former Senator Alfonse D'Amato said. "We are grateful for Chairman Frank's leadership and will be activating our grassroots army made up of over one million members to help him drive legislation."
"As Americans continue to wager online more than $100 billion annually in a thriving underground marketplace, it is time for Congress to acknowledge that prohibition has been a failure and a new approach is needed," added Jeffrey Sandman, spokesperson for the Safe and Secure Internet Gambling Initiative.
"Banning Internet gambling has the same effect as the ban on alcohol had during Prohibition; it merely drives the activity underground, forgoes massive tax revenues and makes criminals out of otherwise law-abiding citizens," said Youbet.com CEO Michael Brodsky.
Rep. Jim McDermott (D-WA) introduced a companion bill to the King and Frank legislation Wednesday that calls for any operator licensed under the Frank bill to pay a 2% fee to the government on all deposits.
"We are losing billions of dollars in federal and state taxes every year because a prior Administration and its supporters drove legitimate U.S. online gambling off-shore by passing an ill-conceived late-night amendment in Congress that has done nothing except make Americans more vulnerable to scams when they wager online and cost us billions in lost revenue," Rep. McDermott said.

MAY 6, 2009, 3:42 P.M. ET
By COREY BOLES
WASHINGTON -- A senior House Democrat introduced bills Wednesday that would suspend rules banning Internet-based gambling and seek to regulate it instead.
A third bill introduced by a Democratic member of the Ways and Means Committee would ensure that online gaming companies would start paying taxes to the U.S.
According to a recent study from consultancy PricewaterhouseCoopers, the U.S. Treasury could stand to gain $48.6 billion annually by taxing online-gambling companies.
This is the second consecutive year that the bills have been brought forward, in an attempt to undue a move in the last days of the Republican-controlled Congress in 2006 to ban Internet gambling.
House Financial Services Chairman Barney Frank said Wednesday at a news conference introducing his bills that he hadn't spoken to either House or Senate leadership nor to the Obama administration about the bills. But he said he planned on pushing the legislation through his committee before Congress breaks in August.
Rep. Jim McDermott of Washington is the author of the bill that would tax regulated online-gambling companies.
The ban is set to go into place in December, after the Bush administration moved to put rules enacting the ban in place toward the end of 2006.
Mr. Frank's legislation would allow companies to apply for a license allowing them to provide gambling services to U.S. residents. Applicants would have to meet the same standards as individuals wanting to work in the Las Vegas gambling industry.
They would have to be willing to subject to a review of their financial condition, corporate structure and business experience.
Companies would have to put in place controls to ensure that neither minors nor residents in states with laws in place banning online gambling could access their sites.
The bill also would attempt to mollify concerns of professional sports leagues by continuing a prohibition on gambling on pro sports.
Under the rules that are set to go into place, it would be up to financial-services companies that process credit- and debit-card transactions to determine which are related to illegal gambling activities.
The industry strongly objected to the rules, arguing that they shouldn't be expected to be sheriffs determining what transactions are against the laws.
Mr. Frank said that Rep. Shelley Berkley (D., Nev.), who represents Las Vegas and is one of the co-sponsors of the bill, has supported a ban on online gambling in the past.
The American Gaming Association, which counts among its members many of the large casino operators, has decided to remain neutral over the issue. The group had been another strong opponent of online gambling in the past.

Weißt du was darüber?

Macht selbst ohne R/S 19 Mio/ 25 Mio Aktien = 0,76 USD
