derweil hat sich Elon Musk wieder einen neuen Freund gemacht:

Xpeng Motors is tired of Elon Musk's repeated accusations about intellectual property theft and broke its months-long silence on the issue. This came following a tweet Musk made last week after Xpeng announced it will be the first electric vehicle automaker to include lidar on its vehicles.

Earlier this year we posted a deep dive into the IP theft allegations, and thoroughly explained the entire situation.

This is all about an ex-Tesla employee, Guangzhi Cao, who left Tesla to work for Xpeng's US subsidiary, XMotors. Tesla later found out the Cao has downloaded a copy of Tesla's autonomous driving code while he was working for Tesla, which is not illegal but is understandably against company policy.

Tesla filed the lawsuit against Cao in March of 2019, alleging that the former autonomous driving technology engineer took Tesla's proprietary Autopilot source code. It's Tesla's belief that Cao downloaded the source code to give to his new employer.

Cao admits that he did download Tesla's Autopilot source code, but that he deleted it and never provided XMotors with any of it.

He discovered that those combined vulnerabilities could be exploited by any car thief who manages to read a car's vehicle identification number—usually visible on a car's dashboard through the windshield—and also come within roughly 15 feet of the victim's key fob. The hardware kit necessary to pull off the heist cost Wouters around $300, fits inside a backpack, and is controlled from the thief's phone. In just 90 seconds, the hardware can extract a radio code that unlocks the owner's Model X. ...

Die Lücke ist inzwischen geschlossen. Aber das ist nun bereits das dritte mal, dass die sehr jungen Forscher (wie die RobinHoodies nur die Variante mit Hirnfunktion) die Keyless Go Implementierung im Tesla gehackt haben. Bischen komisch für ein Unternehmen mit diesem grossen Technologievorsprung.

This is clearly a hardware issue, and the chip involved in the investigation, a NAND Nvidia Tegra, was used in a total of 159,000 Tesla vehicles bu NHTSA’s count, as noted in NHTSA’s ODI document ...

Analyzing the NHTSA documents also shows the presence of a NHTSA investigation into Tesla’s “white whale,” sudden unintended acceleration. This is not a conspiracy theory posited by cranks on Twitter,but is a live investigation, that in true NHTSA fashion was opened in January of this year. ...


1) Tesla is underreserved for any major recall. After booking a provision of $175 million for warranty expenses in the third quarter, Tesla's warranty reserve stood at $1.269 billion as of September 3oth. That’s a very small amount compared to Tesla's annual production rate, especially for a company that does not have a dealer network. With China’s State Administration for Market Regulation issuing a recall in October for Models S and X made from 2013 to 2017 due to Tesla's “whompy wheel” suspension issue, and the impact of yesterday's recall, I would expect Tesla to have to provision much more heavily for warranty in its 4Q2020 earnings report. Year-end figures are considered definitive by the SEC (and are audited,) so every public company reflects a degree of conservatism in them with regards to reserves rarely seen in quarterly figures.

2) Tesla’s awful performance in quality evaluation surveys—most recently Consumer Reports after a terrible performance in the most recent J.D Power survey—actually has a financial cost. Making bad cars is no way to make big profits. The Models S and X produced from 2012-2018 not only contributed to Tesla's cumulative, multibillion-dollar net loss in those 6 years, but they will live on Tesla's balance sheet as potential liabilities for years to come. ...
