      Jim McGill, chairman of mobile application developer Macrosolve, waited eight years for his company's patent to be approved.


      But given the potential implications of patent number 7,822,816, he said it was worth the wait.

      "This is my first company I've started that could turn into a billion-dollar business," he said.

      According to the summary of the patent, Macrosolve now has the rights to the process by which a company or individual creates an app, sends it to be downloaded to mobile devices, collects information from users and sends it back to a central database.

      In other words, McGill said it covers every existing mobile app that sends data from the app user back to the makers or administrators of the app.

      That potentially covers hundreds of thousands of apps already installed on smart phones across the globe and perhaps millions more that have yet to be written, said Clint Parr, CEO of the company.

      "To be honest, we have no idea how many apps this will cover," he said.

      But Macrosolve does plan to reach out to as many as they can find and ask for a licensing fee, which could become a huge revenue source for the Tulsa company. Parr said the licensing process could greatly expand the company's employee count, currently at 17.

      McGill said the app was born out of a project for British Aerospace in the late '90s to create a portable pilot log application on Handspring PDA devices. Though half a million dollars was sunk into the project, the
      particular Handspring device was discontinued, making the code obsolete. British Aerospace canceled the project.

      The program's author and Macrosolve's founder, David Payne, decided to turn the idea behind the scuttled project into a program to gather information on mobile devices that could be easily adapted for use on a variety of platforms.

      "He envisioned apps when none of the companies had the idea," McGill said.

      Payne's program eventually became ReForm XT, Macrosolve's key data-gathering product. Payne left Macrosolve in August 2003.

      McGill said he filed the patent in 2002, though a flood of mobile device patents and a 2007 Supreme Court ruling making "obvious" patents harder to defend slowed the process.

      The patent was finally granted Tuesday. McGill said an advantage of the longer process is that the patent was even more thoroughly vetted.

      Though technology has taken great leaps in the eight years after the patent was originally filed, McGill said the patent was written broadly enough to cover current technology.

      "A properly drafted patent is an ageless thing," he said. "If you write a patent in the wording of that day's tech, you'll hang yourself."

      In part, the patent states: "In its broadest sense, the present invention is a method designed to accomplish the following: 1) Allow any computer(s) (desktops, laptops, handhelds, portables, etc.) to be used to capture information; 2) Transfer the information to a data center (via file transfer methods such as a network, to include, but not necessarily, Internet based) in a form that the data center can recognize; 3) Allow another computer(s) to access the information and download it from the data center in a format that can be readily used regardless of the format in which the original information was gathered."

      Parr said Macrosolve doesn't intend to sue companies using their patent or deprive people from using it. Instead, the goal is to license the patent to anyone who wants to use it.

      "We can approach very large companies and empower them with the technology and the patent to allow them to publish apps and reach a large audience," he said.

      Parr said Macrosolve is already in talks with companies such as Apple Inc., Google, Research in Motion Limited, makers of the BlackBerry smart phone, and Getjar, an independent smart phone app store, for licensing.

      Additionally, McGill said he wants individuals to be able to license the technology, since ReForm is built to allow people with little computer skill to create apps that allow people to gather data remotely and send them to a central location.

      "We could have people come to our site, use their credit card and license the capabilities to make their own apps," he said.

      ReForm XT is used by companies large and small for on-the-job data gathering, including the Golf Channel, which uses it to coordinate camera shots during golf tournaments, and a number of local restaurants and school systems.

      Macrosolve plans to use the anticipated revenue from licensing to beef up ReForm XT and make it more readily available for companies and individual computer users.

      schwer zu sagen, aber sie ist gestern schon recht stark gestiegen. die warscheinlichkeit das es runter geht ist höher als anders herum denke ich. denn am ende wurde das ask immer wieder nach gefüllt. ich halte sie mal auf dem radar. aber montag werden es sicher wieder eine menge neue otc news mit merger usw. geben, und hier ziehen die leute ihr geld raus die im gewinn sind. das interesse war nicht so riesig wie man am intraday sieht. ist halt schnell hoch gegangen wegen des geringen floats. hätte man gestern 16:30 uhr rein gemusst, dann könnte man den montag entspannter erleben. radar und wenn das ask fällt zu greifen aber wenn es so nachgefüllt wird wie freitag abend dann finger weg.

      da ist nach oben platz frei.

      Antwort auf Beitrag Nr.: 40.422.873 von WissenMacht am 31.10.10 10:33:17heißes eisen. aber sk war 0,13x0,15 und die letzten 2 stunden wurde das ask immer wieder aufgefüllt. wenn BB´s aufsprigen ok dann geht sie ab aber sonst eher sehr sehr hohes risiko das sie plötzlich down geht. ich bin mal auf morgen gespannt, aber wenn man hier kauft und sie steigt nicht weiter ist das geld in 10 min. weg. denn der fall wird hier genau so schnell gehen wie der ausbruch. zu geringes vol. werde sie mir die ersten 45 min. mal auf wachtliste setzen aber das ich hier rein gehe müsste schon größeres vol. kommen. so ist es ein ganz dünnes eis in dem man zu 90% einbrechen wird nach diesem großem anstieg

      Tulsa's First Christian Church builds its own iPhone application.

      Bixby retiree David Sailsbury doesn't get downtown much.

      So when he needed to find out how to get to his granddaughter's Christmas program at Tulsa's First Christian Church last week, he tapped the icon for the church's application on his iPhone and located a map.

      "The app got me to the church. It was wonderful," he said.

      First Christian (Disciples of Christ), one of Tulsa's oldest and most traditional churches, is also one of the first in Tulsa to have its own iPhone "app."

      Announced from the pulpit two weeks ago, the app provides the latest real-time information about the church and its day-care center, including phone numbers and e-mail addresses of staff, the church newsletter, calendar, service times, prayer requests, and weather cancellations. A hot button provides instant e-mail access to church staff members.

      It also has the weekly Bible verses from the common lectionary, a Bible program used by many preachers to systematically cover the entire Bible in three years.

      Associate Pastor Jeremy Skaggs is the man behind the church's app project.

      "I thought it would be really cool if First Christian had a cell-phone app," he said.

      "We wanted it as a way to keep in touch with our church members and also to market the church to the community.

      "If I was new in Tulsa, the first thing I'd do is check to see what apps are available here.

      "Technology is a way for us to get our name out there, for people to get to know what the church is, what we're about and what programs we have."

      Skaggs can update the app instantly from his iPhone or computer with the latest prayer request, weather cancellation or other news.

      "Mainline churches have been really slow to take on the new technologies," he said. "I think we were the last to use websites."

      He developed the app with his sister, April Sailsbury, with Tulsa-based Anyware Mobile Solutions, a division of MacroSolve Inc. Sailsbury said it took four to six weeks to develop the app and get it approved for the iPhone.

      If the app proves popular, Skaggs said, the church will see about putting it on other smart phones, such as Android and BlackBerry.

      As of Tuesday morning, 105 people had downloaded the app at the church of about 1,000 members.

      The app is available free to everyone.

      Jeff McMains, vice president of Anyware Mobile Solutions, said it cost about $2,000 to develop the app, which can be less costly than building a custom website.

      The app is based on the ReFormXT platform, developed by Anyware to help organizations stay in touch with their members. That platform is used by schools, including the University of Tulsa, Edison Preparatory School and Tulsa Community College, country clubs such as Southern Hills and Forest Ridge, health -care organizations, and businesses.

      Why not just access the church's website on a smart phone, instead of having an app for the church?

      McMains said the smart phone culture is not receptive to going to a website, which has to be typed in, can be difficult to navigate and is not formatted usefully for a phone.

      A search of the iPhone app store turned up apps for two other Tulsa area churches, First Baptist in Owasso and Church on the Move, and fewer than 200 churches nationwide.

      April Sailsbury said she expected mobile apps to sweep the church world just as websites did years ago.

      "We've had other churches interested in starting an app. I think as people start to understand their power, more churches are going to launch apps.

      "Mobile is here. That's how people stay in touch. ... And kids younger than us are 10 times more connected with their mobile devices. So having that information easily and readily available on a mobile device is a very smart marketing decision for companies, churches and other organizations."

      San Jose (dpa) - Ein iPhone-Nutzer der ersten Stunde begehrt gegen Apple auf: Der in Kalifornien lebende Jonathan Lalo hat den Elektronikkonzern wegen der Weitergabe von persönlichen Daten an Werbefirmen verklagt.

      Er verlangt Wiedergutmachung von Apple und strebt, um seiner Forderung Nachdruck zu verleihen, eine der berüchtigten Sammelklagen an. Geht diese vor Gericht durch, würde sich Apple Millionen Nutzern des iPhone-Handys und des Tablet- Computers iPad gegenübersehen.

      Lalo zeichnet in seiner am Mittwoch bekanntgewordenen Klage ein durch und durch düsteres Bild davon, wie Apple mit dem Datenschutz umgeht. Demnach können Werbefirmen bei jedem iPhone nachverfolgen, welche Zusatzprogramme - sogenannte Apps - der Nutzer herunterlädt, wie oft er sie verwendet und wie lange. Darüber hinaus, so die Klage, erhielten die Werbefirmen teils Zugriff auf persönliche Daten wie Alter des Nutzers, Geschlecht, den Standort oder das Einkommen.

      Möglich wird all dies laut der Klage durch eine individuelle Kennung jedes iPhone oder iPad (Unique Device Identifier, kurz UDID). Diese könne weder blockiert, noch verändert oder gelöscht werden, heißt es in der Klageschrift. Erfahren hat Jonathan Lalo von der Kennung aus der Zeitung: Das renommierte «Wall Street Journal» hatte eine Woche vor Weihnachten eine Enthüllungsgeschichte im Blatt. Lalo reichte seine Klage am 23. Dezember ein.

      Lalo belangt zusammen mit Apple auch mehrere Anbieter von Apps, die er nach eigenen Angaben über die Jahre heruntergeladen hatte und die, wie er jetzt erfahren musste, seine Daten weitergeben haben. Dazu gehören die Programme von «The Weather Channel» und «Dictionary.com». Was Lalo besonders erzürnt ist, dass Apple vorgebe, jede einzelne App zu prüfen, um den Datenschutz zu gewährleisten. Von Apple selbst war zunächst keine Stellungnahme zu erhalten.

      Can you explain the goal of your applications?

      Empower society (non-technical people) to build and manage their own apps for business or personal usage across the major smartphones and app stores.       Can you give us some sense of how big this market could be?

      $1 Trillion globally (all mobility) and $35 Billion (our target market) by 2014.

      Who is your target customer?

      We have two. We have a division called Anyware mobile solutions, where our main product is ReForm XT. A mobile application development platform designed for very low-tech people to build their own mobile app. They can see it being built in little windows and a grab a lot of functionality. To build it and manage it and distribute internally and externally.

      The market itself is going to spread exponentially and so will our customers. Third parties who will want to spread it to their companies and their clients.

      Why should a business employ a Macrosolve application?

      It's simple to use but with very robust features. You don't need us just go to the website and we'll help you a little bit. It's $100-$200 a month but they don't need to come to you to change the content in the app, they can do it themselves. They're running their own show


      You have several different applications, can you tell us about them?

      We have 3 core product lines (DineInsight, ClubInsight, School Insight), all built on the ReFormXT platform which is also sold under this brand. We see the most traction right now with restaurants, clubs and schools.

      What kind of businesses would be best served by your product?

      All types of businesses can use branding apps to promote their company. Their customers download the app for free off of appstores. It's aimed primarily at small and mid-sized businesses. The enterprise/productivity apps can be employed by all types of businesses looking to streamline internal operations and communications. The strength of ReFormXT is that it can do both.

      If you go to the golf channel they're using ReForm XT in a totally different way. They eliminated all the paperwork at the end of the day. A woman at the golf channel developed an app to automate how people can communicate to her allowing her to run her business more efficiently.


      Where do you see Macrosolutions in 5 years?

      We're looking at a large double digit growth market. We certainly see the company trading on a larger exchange. Right now we're operating on the question of how big can this get. Later we expect to be involved with licensing and licensing our patents to other companies. We're also going to continue to expand the division that builds really advanced custom apps. Those are about building the next product, the next reform. That's a billion dollar market.

      Another patent-owning company has targeted app developers on both Apple and Android platforms, intensifying concerns among developers that smartphones are the new hunting ground for so-called "patent trolls".

      MacroSolve, a US-based company traded "over the counter", has so far sued 10 app development companies, claiming that they infringe a patent 7,822,816, entitled "system and method for data management", which covers the collection and transmission of data for questionnaires and puts them online.

      The patent was filed in August 2003 and awarded in October 2010, and the discussion specifically relates to "handheld computers" – a category that has now come to include smartphones.

      Jim McGill, chairman of MacroSolve, has said that the patent covers "thousands of existing apps" that collect data and send it to a central server. The company has chosen to sue app developers in the "rocket docket" jurisdiction of Texas Eastern District in Tyler – where patent-owning companies frequently file cases in the expectation that the courts will process them quickly, and in their favour.

      The news will further discomfit app developers, who have already seen Lodsys – a company which bought a small portfolio of four patents from another patent licensing company, Intellectual Ventures – send demands for payment to a number of iPhone app developers.

      Software patents issued by the US Patent Office have the potential to strangle the burgeoning mobile app business, because they can tie up small developers in court cases that they cannot afford to defend – or where they may be unable, for geographical reasons, to organise a defence.

      Apple's legal department is understood to be investigating the claims by Lodsys, but it is not known whether it has been alerted to the claims being made by MacroSolve against the 10 developers.

      If the patent cases are upheld, the app developers could be liable for damages and for royalty payments on the use of the patent.

      Developers could aim to have the patent invalidated, but that would be a long and expensive legal process.

      The cases have highlighted a problem with the US Patent Office, which has already been criticised for awarding patents that are too broad, or even cover impossible inventions such as antigravity vehicles.

      The patents owned by MacroSolve might be challenged and nullified on the basis of being "obvious", given the time when they were filed, when the mobile web was already being used in a number of countries. But that would involved developers in long drawn-out legal battles which they are ill-equipped to fight.

      Lodsys and MacroSolve may, if successful, chase hundreds or even thousands of app developers in Apple's iTunes App Store and Google's Android Marketplace, as well as the rapidly-growing Windows Phone Market.

      Apple, Google and Microsoft have not commented on the latest claims and lawsuits.

      Since 18 April, MacroSolve is suing:

      • Canvas Solutions, which makes Smart Business Forms;

      • Kony Solutions, which generally writes mobile apps;

      • Widget Press provides a "FormEntry Touch Private Label" program to deliver custom forms to iOS users;

      • Pogo Corporation, which provides apps such as cinema information;

      • and SWD Interactive, which helps people build iPhone apps.

      These join four companies it began suing in March:

      • Blue Shoe Mobile Solutions, which helps people create mobile apps;

      • Brazos Technology, which provides ticketing system apps for public officers such as police;

      • On The Spot Systems, which offers survey apps for businesses to offer to customers;

      • and Formstack, which provides billing apps.

      Over-the-counter investors are being told that MacroSolve's stock – which has dropped from $2.50 in late 2009, when it was first listed, to around 25c now – represents a "phenomenal and solid investment".

      MacroSolve, founded in 1997, itself says it is "a pioneer in delivering mobile apps, technology, and solutions to businesses and government" through its two divisions, Anyware and Illume Mobile, and says it has "long-standing" relationships with companies including Apple, BlackBerry maker RIM, Microsoft and Motorola.

      It does produce its own apps through its mobile divisions, such as Elmer's BBQ "It Be Bad", which shows a menu of smoked meats from a food chain.

      However, according to details released by the company on 17 May, its sales in the first quarter of 2011 were just $116,000, down from $274,000 in the same period in 2010, with losses widening to $507,000 compared to $446,000.
