Das Verfahren gegen Manners geht in die nächste Runde. Jetzt wurde erstmal die Anklage durch den Richter des Melbourner Gerichtes zugelassen.

04-063 Former Adelong capital director committed for trial
Wednesday 10 March 2004
Mr Craig William Manners, formerly a director of the listed company previously known as Adelong Capital Limited (Adelong), was today committed to stand trial in the County Court at Melbourne Court on charges laid by the Australian Securities and Investments Commission (ASIC).
Mr Manners, 37 of Heidelberg, Victoria, was committed for trial on 18 counts under the Corporations Act, including nine counts of making false or misleading statements and nine counts of breaching his duties as a director.
Mr Manners reserved his plea to all counts.
ASIC investigation followed a referral from the Australian Stock Exchange (ASX).
ASIC alleges that during an interview with a German journalist on 13 January 2000, Mr Manners, then a director of Adelong, made false and misleading statements regarding the future expectations and prospects of Adelong and its share price. The interview was subsequently published on the German internet site www.wallstreet-online.de, and caused a substantial increase in the demand for, and consequently the price of, Adelong shares on the ASX and the German stock exchanges.
ASIC also alleges that following the publication of the interview, Mr Manners, a client adviser with D&D Tolhurst Ltd at the time, sold shares and options in Adelong on his own behalf, and on behalf of companies associated with him, realising the sum of more than $3 million.
The Supreme Court of Victoria has previously made orders freezing approximately $1 million of assets connected to Mr Manners.
Mr Manners was bailed of his own undertaking and is scheduled to appear in the County Court at Melbourne on 11 May 2004.
The Commonwealth Director of Public Prosecutions is prosecuting the matter.

Mal sehen ob man da noch einmal zu einer Aussage geladen wird, würde gerne auch nach Australien fliegen.

Manners ist in drei Anklagepunkten schuldig gesprochen worden (Rest: Freispruch). Nachfolgende Info zum Ausgang des Verfahrens hab ich von der Staatsanwaltschaft bekommen, da ich in dem Verfahren (und im Vorverfahren) als Zeuge ausgesagt habe.
Welches Strafmaß verhängt wurde, weiß ich nicht.
I advise that on 9 June 2005 the jury returned verdicts of guilty on three counts of making a false or misleading statement likely to induce the purchase of securities contrary to s.999 and 1311(1) of the Corporations Act 2001. The statements that the jury found to be false or misleading were:
Count 10: that Adelong was currently finalising investments in 12
commercially focussed Internet start-up companies
Count 13: that Adelong were confident of shortly announcing a very
exciting partnership with a US Internet major
Count 14: that Adelong expected that a major US, Asian or European
internet portal or venture capital fund would take a majority
shareholding in Adelong shortly at a share price well above US$2.00 to
US$3.00 per share.
The jury acquitted Manners on the other charges. The plea hearing will take place on 4 - 5 July 2005. He will be sentenced some time after that date.
