Earth Biofuels Launches BioWillie(R) Marketing Program
Earth Biofuels, Inc. (OTCBB: EBOF), the exclusive distributor of Willie Nelson's brand of biodiesel - BioWillie(R) - today announced a marketing program to increase the availability of its biodiesel brand. Earth Biofuels will now offer the use of the brand to biodiesel retail fuel providers outside the Earth Biofuels fuel distribution network. As a result, fueling stations will be able to leverage the awareness, loyalty and quality built into the brand.

The branding agreements between Earth Biofuels and retail fuel providers will include stipulations that all biodiesel fuel sold under the BioWillie(R) brand name must meet the quality standards set for biodiesel by the American Society for Testing and Materials (ASTM) under specification number D-6751 as well as other rigorous compliance requirements for protecting the biodiesel fuel quality and brand name.

"The present demand for the BioWillie(R) brand biodiesel exceeds its current distribution network," said Earth Biofuels Vice President of Sales Jim Horton. "Truckers are asking for BioWillie because they believe the name means quality. This program will allow Earth Biofuels to establish retail BioWillie(R) brand biodiesel at pump locations anywhere in the country that biodiesel is sold."

Although biodiesel production has increased dramatically over the past several months, Earth Biofuels believes that the ability for retail biodiesel providers to effectively market their product domestically has not kept pace. By offering a recognizable name brand under tight quality controls, this unique program may help retail biodiesel providers increase demand at the retail level.

      About Earth Biofuels

Earth Biofuels produces and distributes biodiesel fuel through the company's network of wholesale and retail outlets. The fuel is sold under Willie Nelson's brand name, "BioWillie(R)." Earth Biofuels also produces and markets liquefied natural gas (LNG). The Company is focused on meeting the growing demand for alternative and renewable fuels in the domestic market. The Company's Web site is www.earthbiofuels.com.

      More Headlines

The troubled history behind the company that signed Willie Nelson.
Willie Nelson Sings The Blues is what they're calling the performer's New York City concert in mid-January. It's a pretty good title, too, for the outlaw country singer's latest do-good effort: lending his name, along with those of Hollywood stars Morgan Freeman and Julia Roberts, to a tiny Dallas outfit called Earth Biofuels, which intends to build a national chain of filling stations dispensing a brand of enviro-friendly diesel it calls "Bio Willie."

But there's a chance that Willie's 6.5 million shares, recently valued at $11 million, won't even be worth their weight in canola oil. Reason: Earth Biofuels missed a Dec. 4 deadline for coming up with $80 million in financing to restart a long-shuttered ethanol plant south of New Orleans, the company's largest investment to date. At the very least it stands to lose its $5 million deposit, to say nothing of an additional $22 million it has put into the project. With just $41,609 in cash on the books as of Sept. 30, that's a pretty big hit. Chief Executive Dennis G. McLaughlin III, 41, insists that the project "remains an ongoing business opportunity" and that "no funds have been forfeited." But Earth director William O. Luckett says the company and its partners in the plant are in dispute over higher-than-expected construction costs. So far none of this has appeared in press releases or SEC filings.

Nor has McLaughlin's colorful background. He presided over the $100 million bankruptcy of the company he formed in 1993, Aurora Natural Gas. Duke Energy Trading (nyse: DKE - news - people ) sued him for fraud, saying he used shell companies to double-bill Duke to the tune of $26 million. Duke ultimately settled and gave McLaughlin a release. McLaughlin blames the bankruptcy on one of his employees and on Duke itself, for inflating gas prices in late 2000; as for his not disclosing it in Earth's SEC filings, he says he has "never been employed by a company when it filed [for bankruptcy]." Right. According to Earth's most recent 10-K, he was Aurora's chief from 1993 to 2001, the year it filed for bankruptcy.

After that meltdown McLaughlin made a brief stop at Ocean Resources, a penny stock outfit in the undersea-salvage business, where he left in January 2005 over allegations he'd overcharged the company through his consultancy. (McLaughlin says the claims are unfounded and that Ocean owes him money.) Then he took over Powerball International, a dormant shell once in the hydrogen business, renamed it Apollo Resources and wound up back in court. He was sued by New Mexico oilman Donnie Hill, who claimed Apollo's main assets had been stolen from him. Hill, too, has since settled for an undisclosed amount.

Earth Biofuels formed out of a clutter of shell companies that started with a Meridian, Miss. biodiesel refinery bought from the brother of director R. Bruce Blackwell for $7 million. It took on Willie Nelson as a director when it licensed his name for "Bio Willie" (he gets a royalty of a penny a gallon). Aided by a flood of press releases, Earth's market value rose from next to nothing in 2005 to a recent $344 million.

If you care to find them, 18 pages into Earth's financials are insider transactions, including $16,000 a month in rent for a truckstop and convenience store in Mississippi owned by director Blackwell, a series of trades between Earth Biodiesel and Apollo and a $160,000 investment in Blue Wireless, a penny stock venture McLaughlin controls. McLaughlin insists all transactions have been fair to Earth. But they aren't necessarily helping it reach its goal of opening ethanol refineries in North Carolina, Louisiana, Texas and Illinois.

Earth earned a slim 4.2% gross margin on $10.3 million in sales in the third quarter of 2006, spending almost half its revenue on administrative expenses. Business must pick up fast: Under terms with lenders who provided $53 million in financing last summer, Earth has to hit $30 million in earnings before interest, taxes and depreciation by year-end or come up with cash--or face a conversion of debt into stock that would dilute existing owners.

Tune up your guitar, Willie. But will it be "Once More With Feeling"--or "The Party's Over"?

Earth Biofuels Subsidiary Awarded LNG Supply Agreement with Omnitrans
Earth LNG, Inc. today announced that its wholly owned subsidiary, Applied LNG Technologies USA L.L.C. ("ALT"), has been awarded a five year contract for the sale of liquefied natural gas (LNG) to Omnitrans, contingent upon Omnitrans' receipt of certain insurance certificates and endorsements from ALT.

Earth LNG is a wholly-owned subsidiary of Earth Biofuels, Inc. (OTCBB: EBOF).

Omnitrans is the public transit agency serving the San Bernardino Valley in Southern California. Founded in 1976 through a joint powers agreement, Omnitrans carries approximately 15 million passengers each year throughout its 480-square mile service area. ALT has sold LNG to Omnitrans since 2002.

Under terms of the new agreement, ALT will deliver transportation grade LNG each month to Omnitrans' East Valley facility. ALT delivers the fuel via cryogenic tanker truck from its LNG production facility in Topock, Arizona to specialized fueling stations from which the customer's fleet vehicles are fueled.

Transportation grade LNG helps companies meet strict emission standards in the state of California. Vehicles fueled by the transportation grade LNG produce approximately one-sixth of the nitrous oxides (NOx) and up to 15 percent less greenhouse gases than comparable petroleum diesel fueled vehicles.

Earth Biofuels and BioWillie® Featured in PBS Documentary
      18 January, 2007

Earth Biofuels, Inc. (OTCBB: EBOF) today announced that the company was featured in the weekly PBS program, “NOW”, hosted by David Brancaccio. The segment, “From Plow to Pump”, is a documentary which describes the biodiesel product life cycle beginning with the cottonseed farmer who supplies the oil for the production process to the tractor trailer that is fueled with BioWillie® biodiesel fuel.
The segment includes interviews with Willie Nelson and Earth Biofuels’ Chairman and CEO, Dennis McLaughlin. Additionally, it highlights Earth Biofuels’ and the renewable fuels industry’s continuing commitment to reduce America’s dependence on foreign sources of energy by providing domestically produced, clean-burning sources of energy.

“We are proud to be a part of the PBS program ‘From Plow to Pump’”, said Dennis McLaughlin, Chairman and CEO of Earth Biofuels. “Earth Biofuels is working to reduce our dependency on foreign energy by providing domestically produced, clean-burning renewable fuels for our nation. We believe strongly in this industry’s ability to have a significant impact on our national security, environment, and American farmers. We believe there is a great deal of educational value in this segment and appreciate PBS’s work to continue to educate on this important emerging technology.”

David Brancaccio, host of “NOW”, stated: “Lately there has been a lot of talk about the importance of alternative energy sources in reducing America's dependence on foreign oil. We wanted to address that issue. However, many alternative energy projects are still in the research stage. Since Earth Biofuels is actually marketing a retail product, that gave us the opportunity to look at a real-world example."

The program aired on Friday, January 12 on PBS and can be viewed at http://www.pbs.org/now/shows/302/index.html along with an extended interview with Willie Nelson at http://www.pbs.org/now/shows/302/willie-nelson.html. The program may be re-broadcast in local markets.

Earth Biofuels’ BioWillie® brand is on biodiesel pumps that are currently located in seven states, including California, Georgia, Louisiana, Mississippi, Oklahoma, Tennessee and Texas. BioWillie® is a blend of biodiesel and petroleum diesel. The biodiesel is made from oils such as cottonseed and soybean.

"I'm honored to be invited, but even more pleased that the Committee is considering this issue as seriously as it is," said Foltz. "Climate change and energy security are two of the most pressing issues of the 21st century, and we're happy to share our industry experience with the committee."

Foltz will be seated on the "Regional Infrastructure Integration" panel. Chairman Bingaman highlighted the issue in his response to President Bush's The State of the Union address on January 23, 2007, and has made infrastructure needs of the Biofuels industry one of the centerpieces of the conference
