      Im Nortel-Pool liegen 6.000 Patente und Patentanmeldungen aus den Bereichen Mobilfunk, LTE, Datenübertragung, Glasfaser, Sprachübertragung, Internet, Internet Service Provider, Onlinesuche, mobile Videoübertragung und soziale Netzwerke. Abgedeckt werden die Softwareplattformen Blackberry OS, Apples iOS und Googles Android.

      denke das einige Patente nicht nur für die momenatn bekannten Bieter interessant wären. Auch Microsoft wäre eine klarer Kandidat.

      Nachdem ich mir den u.a. Artikel durchgelesen habe, stellt sich mir die Frage, wieviel ist den von Nortel überhaupt noch übrig und wieviel Schulden sind noch offen?!?!?
      Wenn ich lese, was 2009 schon alles verkauft wurde, was ist da noch übrig?

      Nortel, Kanadas größer Netzwerkanbieter, ging genau vor zwölf Monaten in Insolvenz. 30.000 Nortel Mitarbeiter wussten nicht, wie es für sie weitergehen würde. Ihre Hoffnung: Verkauf an ein stabiles Unternehmen, das nicht nur die Nortel-Marktanteile, sondern auch sie als Mitarbeiter brauchen würde.

      Dabei stand Nortel auf dem Markt gar nicht so schlecht da. Immerhin war Nortel bei VoIP Marktführer in Nordamerika und verkaufte dort mehr Softswitches für IP-Telefone als alle Konkurrenten zusammen. Darüber hinaus war Nortel im Mobilfunkmarkt der größte Carrier-Ausrüster der USA.


      Vor der Insolvenz verneinten die Nortel-Manager jegliches Interesse am Verkauf des Konzerns. Eine Zerschlagung des Konzerns stehe nicht zur Debatte. Die Finanzkrise und die sich dadurch deutlich verschlechternde Kreditsituation der Carrier- und TK-Ausrüster führte zusammen mit der Verschuldungshöhe des Unternehmens schließlich dazu, dass profitable Geschäftseinheiten verkauft werden mussten. Dann folgte der Insolvenzantrag nach Chapter 11 des amerikanischen Insolvenzrechtes.

      Mike Zafirovski, CEO von Nortel und vormals Chef von Motorola, hatte anfangs erklärt, die Insolvenz ermögliche Nortel einen Neuanfang, aber als sich Zafirovski mit rund zwölf Millionen Dollar Abfindung aus dem Staub machte, war klar, dass Nortel unwiederbringlich abgewickelt werden musste und sämtliche Millionen aus den Verkaufserlösen an die Gläubiger gehen würden.

      Zum Zeitpunkt der Insolvenz hatte Nortel mehr als zwei Milliarden Dollar Schulden angehäuft.

      Die Konkurrenz hat Nortel nun unter sich aufgeteilt:

      •Im Juli 2009 ging die Mobilfunksparte (CDMA und dessen Nachfolger LTE) für 1,13 Mio. Dollar an den schwedischen TK-Ausrüster Ericsson. 2.500 Mitarbeitern wechselten damit zu Ericsson. Ericsson verspricht sich davon den Einstieg und Durchbruch im lukrativen US-Geschäft im Carrier-Bereich.

      •Im September 2009 kaufte der VoIP-Spezialist Avaya für rund 900 Mio. US-Dollar das Enterprise-Telefoniegeschäft mit rund 6.000 Mitarbeitern.

      •Das restliche LTE-Geschäft ging für 10 Mio. Dollar an das japanische Unternehmen Hitachi.

      •Rund 282 Mio. US-Dollar bot der amerikanischen IP-Spezialist Genband für CVAS (Carrier VoIP and Application Solution) mit 2.200 Mitarbeitern. Die Auktion findet voraussichtlich im Februar statt.

      •Ericsson und Kapsch sicherten sich das GSM-Geschäft mit 630 Mitarbeitern für rund 103 Mio. Dollar.

      •Der amerikanische Carrier-Ausrüster Ciena erwarb Ende Dezember das MEN-Geschäft (Metro Ethernet Networks) und die optischen Netze für rund 769 Mio. Dollar.

      Nokia Siemens Networks (NSN) hatte mehrfach mitgeboten und ging leer aus. „… dass NSN im Fall MEN nicht einmal die Hilfe eines Finanzinvestors half, muss man als garantiert schlechte Pointe für das Joint Venture werten, zeigt es doch zumindest ungefähr an, wie wenig die Joint Venture-Partner Nokia und Siemens bereit sind, in ihr Unternehmen zu investieren“, schrieb das Internet Portal »ChannelPartner« am 16.Januar 2010.

      Nortel Provides Update on Allocation Protocol Motion

      TORONTO, ONTARIO, Jun 20, 2011 (MARKETWIRE via COMTEX) -- Nortel(1) Networks Corporation NRTLQ +7.55% announced today that the Ontario Superior Court of Justice (the Canadian Court) and the U.S. Bankruptcy Court for the District of Delaware (the U.S. Court) have directed Nortel, Nortel Networks Limited and its other Canadian subsidiaries that filed for creditor protection under the Companies' Creditors Arrangement Act (CCAA), the Nortel U.S. entities that filed for similar protection under Chapter 11 of the U.S. Bankruptcy Code, the Nortel entities under administration in the U.K. and certain other EMEA jurisdictions, as well as certain other parties, to participate in a joint mediation of the issues raised in the motions heard by the two courts on June 7, 2011. The Canadian Court and U.S. Court together will appoint a sole mediator by supplemental order. The directions also provide that the mediator shall determine the time, date, place and protocol of the mediation. If the parties agree, the mediator will have expanded authority to conduct an arbitration in respect of this matter.

      The directions were made pursuant to motions filed in the Canadian Court and U.S. Court that had sought orders establishing an allocation protocol regarding the allocation of sale proceeds from the sales of Nortel's businesses and patent portfolio. The motions were heard at a joint hearing of the Canadian Court and U.S. Court on June 7, 2011 and the decisions of both courts are currently under reserve. While the decisions are pending, the Canadian Court and U.S. Court concluded to direct the parties to mediation, as set out above, to attempt to progress these matters to ultimate resolution.

      "The Wall Street Journal said that Intel has joined the list of “technology giants” set to bid for the patent portfolio of failed telecoms equipment manufacturer Nortel Networks, which is due to be auctioned next week. The company will join Apple, Ericsson and Google, and RPX, which buys up patents on behalf of other parties to stop them being used against them. RPX has previously been linked with partners including Sony, Cisco, Nokia and Samsung."

      Nortel Networks Corp. Tuesday revived an aborted effort to cut off retiree health-care benefits and long-term disability pay for former U.S. workers, by opening talks with ex-workers.

      On track to raise more than $4 billion by selling off its businesses, the liquidating telecommunications-equipment maker won court approval to assemble an official committee of retirees to negotiate over the termination of health-care benefits, and another to negotiate over long-term disabled pay.

      At $2 million per month, the expense of retiree health care and pay for disabled workers is more than Nortel can bear, an attorney for the Toronto company said at a hearing in the U.S. Bankruptcy Court in Wilmington, Del.

      Click here to find out more!Judge Kevin Gross authorized federal bankruptcy watchdogs to name a panel of U.S. retirees to talk exclusively about ending health-care benefits. Gross also authorized a separate committee to negotiate with Nortel's approximately 240 U.S. long-term disabled workers over ending their pay.

      Last year, the company moved to cut off retiree health-care benefits. However, an appeals court in Philadelphia, ruling in another corporate bankruptcy case, said U.S. law requires companies in Chapter 11 to open formal talks with retiree committees before dropping their health care.

      Nortel ultimately will be able to walk away completely from its retirees and disabled workers once its bankruptcy ends. Congress, however, enacted safeguards that require negotiations with retirees before health-care benefits are cut off during a bankruptcy case, the Third U.S. Circuit Court of Appeals wrote last year.

      "All [the law] guarantees retirees is a voice, and some minimal amount of leverage, in a process that could otherwise be nothing short of devastating to them and to their families and communities," the appeals court said.

      "We emphasize that Congress enacted the [special safeguards] because it considered the termination of retiree benefits a true human tragedy," the court wrote in the ruling, which grew out of the bankruptcy of Visteon Corp.

      Unlike most companies, Nortel kept disabled workers on the payroll. The end of Nortel's corporate life means an end to their incomes.

      The excitement generated by next week's auction of 6,000 Nortel Networks patents is a validation of the tremendous value of the intellectual property that Nortel researchers developed over generations.

      It is also a black eye for Canadian governments that turned their back on future technology that had been financed by millions in tax credits, but protected old technology at Chrysler and General Motors, traditional resource industries like Potash Corp. and speculators in obscure commercial debt.

      If governments had responded when Nortel hit the wall, would Research in Motion be in as much trouble today?

      Just two years ago, RIM co-chief executive Mike Lazaridis got the cold shoulder on Parliament Hill when he urged the government to keep Nortel intact rather than pursue the subsequent piecemeal disintegration in bankruptcy at fire-sale prices.

      Lazaridis wanted the Nortel patents.

      Freed of incompetent Nortel executives, the Nortel technology could have blossomed at RIM and provided ammunition in the battle with the iPhone and Android handsets.

      Nortel, instead, appears headed for another year in bankruptcy protection because of a major impasse.

      The issue is how to divide $4 billion in asset sales (including Google's $900-million opening bid for the patents) among pensioners, bondholders, suppliers and employees. The estimated claims range from $11.1 billion, according to the latest official Nortel tally, to more than $24 billion if a host of European claims are recognized.

      All the claimants are going to get hurt, even if the patents sell for more than $2 billion.

      Last week courts in Canada and the U.S. ordered the creditors into a new round of mediation, despite no progress in earlier attempts. The judges pointedly refused a quick decision on contending North American and European proposals to distribute the cash.

      North American creditors want a full trial with arguments. Europeans are pushing for arbitration.

      "Creditors have been waiting nearly two-and-a-half years for a meaningful distribution," Ontario Superior Court judge Geoffrey Marowetz reminded the parties.

      He chided them for fighting over protocol while the big distribution issue goes unaddressed. The lecture failed.

      The two sides couldn't agree on an acceptable mediator, forcing the courts to make an appointment this week.

      The result of the logjam is that Nortel will likely "celebrate" a third anniversary in bankruptcy proceedings in January. Lawyers, accountants and mediation will continue to siphon millions from the Nortel estate every month.

      George Riedel, the top remaining Nortel executive, likely will get yet another extension of his duties. He didn't leave March 31 as originally planned. He could still be around past the latest deadline of Aug. 31. He was paid $2.71 million in 2010.

      Another twist in the Nortel bankruptcy. A vocal minority among the 350 Canadian long-term disability recipients fought to get separate representation of their claims before ultimately losing in the courts. But in the U.S., Nortel is now proposing to give retirees and LTD recipients separate independent committees to represent their interests in the case.

      Many in the U.S. group are unhappy because it is the first step to Nortel finally cutting off their benefits.

      That's right - while the Canadian pensioners and LTD recipients had their medical and life insurance benefits slashed in January, their U.S. counterparts still get benefits.

      Nortel said it is costing $2 million per month to pay benefits to 5,568 retirees and survivors and 245 LTD recipients. Nortel tried to cut off the U.S. group a year ago but was blocked by an unrelated court decision that found that companies have to negotiate before pulling the plug.

      The sale of Nortel's patent portfolio could face a hitch.

      Former researchers David Steer and Leo Strawczynski are pushing a complaint that Nortel failed to properly compensate them and other former employees by cutting some pensions, severance and other benefits.

      The two Ottawa experts have a long list of patents to their credit. They are probably on shaky ground claiming ownership of their patents.

      But their determination not to testify on behalf of the future patent owners in court cases might give some bidders second thoughts about the value of the portfolio.

      The two researchers want a trust set up from parts of the proceeds to benefit Nortel pensioners, their survivors and long-term disability recipients.

      Zarlink Semiconductor said it has a deal with Medtronics Inc., the U.S. medical technology giant with $16 billion in annual sales, to develop ultralow radio chips for medical products that are expected to start production this fall.

      Pacific Safety Products, the struggling Arnprior maker of bulletproof vests, said it now has access to $2.5 million in cash that was previously tied up in a big reorganization and sale of company assets to new owners.

      The company, which recently reported growing sales, said it will use the money for debt management and other corporate purposes.

      Enervate Inc., an Ottawa green technology company, has appointed Louis Szablya as vice-president of marketing and utility solutions. He has 30 years experience, most recently as director of smart grid integration with SAIC, the big U.S. computer services company.

      Optelian, an Ottawa optical networking company, will more than double research and manufacturing capacity as it moves to a new Brewer Hunt Way headquarters in Kanata. The nine-year-old private company plans more hiring.

      Arts REIT, a real estate investor, bought an industrial and office building, leased to St. Joseph Communications, at 1165 Kenaston St., near St. Laurent Boulevard, in its first buy in the Ottawa market. Primecorp Commercial Realty handled the deal. No specific terms were released.

      Integrated Device Technology, a California company that owns the former Tundra, is changing executive protection deals if the company is bought in the current wave of merger action. Chief executive Ted Tewksbury will be eligible for two years of salary, bonuses and benefits if he loses his job after a takeover.

      Microsoft ist offenbar am Kauf von Nortels Telekommunikationspatenten interessiert. Wie das SOA World Magazine berichtet, gehören zu den Bietern neben Google, Apple und Intel auch zwei nur für diesen Zweck gegründete Konsortien. Eines davon soll von Microsoft angeführt werden.

      Bisher hatte sich der Softwarekonzern aus Redmond stets gegen eine Veräußerung des rund 6000 Patente umfassenden Portfolios ausgesprochen. Er soll sogar vor Gericht Einspruch erhoben haben. Microsoft befürchtet, dass sich die Bedingungen für seine derzeit gebührenfreie Lizenz der Nortel-Patente ändern könnten. Es fordert daher, dass die vorhandenen Vereinbarungen auf einen etwaigen Käufer übertragen werden. Mit dem Kauf des Portfolios könnte es sich vor Forderungen Dritter schützen. Ein Sprecher des Unternehmens wollte sich auf Nachfrage von ZDNet nicht zu dem Bericht äußern.

      Laut Patentexperte Florian Müller glaubt Microsoft, von den Nortel-Patenten gehe keine Gefahr aus. Die Patente zusammen mit anderen Mitgliedern eines Konsortiums zu besitzen, biete aber zusätzliche Vorteile. "Microsoft könnte davon ausgehen, dass die Patente bis zu einem bestimmten Preis eine gute Investition für jemanden sind, der es versteht, mit Patenten Geld zu verdienen", so Müller.

      Die Patentsammlung des seit Januar 2009 insolventen kanadischen Netzwerkausrüsters deckt Mobilfunk-Geräte und -Infrastrukturen ab sowie optische und Datennetzwerke, Techniken für Internet, Internetwerbung, Sprachübertragung und PCs. 2007 hatten Nortel und Microsoft eine strategische Partnerschaft geschlossen und sich gegenseitige Lizenzrechte eingeräumt.

      Seit 27. Juni läuft die eigentliche Auktion der Patente. Den ursprünglich für 20. Juni geplanten Beginn hatte Nortel aufgrund des großen Interesses an der Patentsammlung verschoben. Eine Entscheidung soll weiterhin am 30. Juni fallen.

      Bisher ist lediglich ein Gebot von Google über 900 Millionen Dollar bekannt. Dem Kauf durch den Suchanbieter hat die US-Justiz schon zugestimmt. Als weitere Interessenten gelten Research In Motion und Ericsson.

      Man kann zum jetzigen Zeitpunkt nicht abschätzen ob die 2,6Mrd $ Schulden überstiegen werden.

      es wird zumindest drauf spekuliert sonst hätte der Kurs nicht um mehr als 100% zugelegt in der letzten zeit.

      Shares of NRTLQ traded as much as 40% higher yesterday as the bankrupt tech giant’s remaining assets went on the auction block. The Canadian company has delayed the auction for a week after it saw significant level of interest in its approximately 6,000 patents and patent applications.

      According to reports, this portfolio of patents could be expected to generate as much as $1.5 billion in the auction. Technology giants including iPhone maker Apple, chipmaker Intel, Chinese telecom ZTE, and Canada’s RIM are all expected to be in the list of would-be buyers. NRTLQ entered into a stalking-horse deal with Google in April, which put the opening bid value of the portfolio at $900 million.

      NRTLG filed for bankruptcy in early 2009 and eventually gave up on restructuring plans. The Company then opted to liquidate all its assets.

      Shars of NRTLG traded yesterday at an intraday high $0.07. Approximately 12.76 million shares have traded hands during the session, versus the 10-day average volume of 11.25 million. Over the last 52 weeks, NRTLG has seen a low of $0.01 and a high of $015. It is currently trading above its 50-day moving average of $0.04 and above its 200-day moving average of $0.03.

      Financial Summary

      NRTLQ reported revenues from continuing operations of $20 million in the first quarter of 2011, compared to $362 million for the first quarter of 2010, reflecting a reduction of 94.5% as a result of the business divestitures and the deconsolidation of its U.S. subsidiaries.

      The Company reported a net loss of $105 million in the first quarter of 2011 , compared to net earnings of $355 million in the first quarter of 2010. The net loss included interest expense of $79 million, other expense – net of $12 million, partially offset by other operating income of $25 million comprised primarily of billings under transition services agreements and reorganization items of $6 million.

      Nortel Obtains Further Extension of Stay Period Under CCAA

      TORONTO, ONTARIO - (Marketwire - June 30, 2011) - Nortel(i) Networks Corporation (OTCBB:NRTLQ) announced today that it, its principal operating subsidiary Nortel Networks Limited and its other Canadian subsidiaries that filed for creditor protection under the Companies' Creditors Arrangement Act (CCAA) have obtained an order from the Ontario Superior Court of Justice (Canadian Court) further extending, to December 14, 2011, the stay of proceedings that was previously granted by the Canadian Court. The purpose of the stay of proceedings is to provide stability to the Nortel companies to continue with their divestiture and other restructuring efforts and to continue to work toward the development of a plan of arrangement under CCAA.

      Nortel verkauft Patente für 4,5 Mrd USD an Technologiekonzerne

      TORONTO (Dow Jones)--Die 6.000 Patente des kanadischen Telekomausrüsters Nortel Networks bescheren den Gläubigern des insolventen Unternehmens einen Geldregen von 4,5 Mrd USD. Für diese Summe bekam am Freitag in der seit Monaten mit Spannung verfolgten Patent-Auktion ein Konsortium aus bekannten Technologiekonzerne den Zuschlag: Apple, EMC, Ericsson, Microsoft, Research In Motion und Sony dürfen sie künftig nutzen. Die Patente schützen Technologien im Bereich Computer, drahtloses Internet, Online-Suche und soziale Netzwerke.

      Der schwedische Telekomausrüster Ericsson erklärte separat, man habe sich mit 340 Mio USD am Kauf der Patente beteiligt. Das Nortel-Portfolio sei "das Erbe" von 100 Jahren Forschung in der Telekomindustrie, und der Erwerb werde sich für die Branche langfristig auszahlen. Der Blackberry-Hersteller RIM bezifferte die Beteiligung am Patent-Erwerb mit 770 Mio USD.
