Bank Indonesia to Appeal Court`s Decision on Bank Bali
JAKARTA, April 3 Asia Pulse - Bank Indonesia Governor Syahril Sabirin has said the central bank would soon appeal the state administrative court`s ruling that the Indonesian Bank Restructuring Agency`s (IBRA) takeover of Bank Bali (JSX:BNBL) was illegal.
"The (court`s) decision was not correct. We must appeal it," Sabirin told newsmen over the weekend.
The court on Thursday decided that IBRA`s takeover of Bank Bali was illegal and that the bank should be returned to its former controlling owner, Rudy Ramli.
It also ruled that Bank Indonesia must revoke its decree placing Bank Bali under IBRA management and return the bank and its management to its former status.
IBRA took over Bank Bali in July last year after the bank failed to raise 20 percent of its recapitalization costs, as the agency required.
The government`s recapitalization program aims to bring a bank`s capital adequacy ratio (CAR), the ratio between assets and credits, to a minimum of four percent.
Countering the central bank`s move, Ramli filed a lawsuit against the government in October last year, accusing Bank Indonesia and IBRA of taking over Bank Bali illegally and without protecting the bank`s best interests.
Ramli argued in his lawsuit that the government had forced Bank Bali to accept Standard Chartered Bank as its strategic partner.
He said the bank was never consulted in the choice of Standard Chartered as its partner, accusing the government of conspiring with the foreign bank to help it acquire 20 percent of Bank Bali`s shares at a low price.

Bank Bali Shareholders Postpone Rights-Issue Plan
JAKARTA (Dow Jones)--PT Bank Bali (BNLI.JK) shareholders Friday postponed a decision on a rights-issue after Thursday`s court ruling in Jakarta that the Indonesia Bank Restructuring Agency`s takeover of the bank was illegal, a spokeswoman said.
"The decision on a rights issue has been postponed and we don`t know when it will be made," she said.

P.T. Bank Bali Outlook Lowered To Stable By Moody`s
New York (Dow Jones)--Moody`s said it lowered the ratings outlook for P.T. Bank Bali to stable from positive.
The move follows a ruling by the Jakarta State Administrative Court, that the Indonesian Bank Restructuring Agency was not justified in taking over the bank in July 1998.
Moody`s expects a lengthy appeals process to follow that risks delaying Bank Bali`s much-needed recapitalization. Bank Bali is burdened by a high level of problem loans which are largely responsible for the bank`s operating losses. As of end September 1999, the bank`s reported capital adequacy ratio was minus 49.6%. Moody`s believes that this is likely to have deteriorated since then. The ratings of P.T. Bank Bali are as follows:

balibank-urteil ist schon vor einigen wochen gefallen. ibra wird aber dagegen vorgehen. die übernahme war in der tat rechtens. der alte ralim hat überdies die ibra-gelder veruntreut und seinen freunden aus der alten golkar-partei überschrieben, zur finanzierung suhartos ziehsohn.
was tun? balibank wird n.m.mng. nicht zerschlagen, sondern weiterbestehen. allerdings wird das die aktionäre noch eine stange geld kosten. die k-e wird sicher kommen. je später desto teurer - wahrscheinlich. wer glaubt, daß indonesien ein rechtsstaat wird, sollte einen kleinen anteil balibank halten!

hilft zwar in dieser Situation nicht weiter, aber ich kann mich noch gut erinnern; als ich vor gut einem Jahr in Indobanken einstieg, dachte ich: nimm BNII für die langfristige Kohle, Bali für den schnellen Deal. Mittlerweile habe ich erkannt, das Bali ein Zankapfel verschiedener Kulturen, Interessengemeinschaften, Wirtschaftsbosse etc. ist. Für BNII bin ich zwar (wieder) positiv gestimmt, aber an Bali glaube ich einfach nicht mehr und wenn die irgendwann wieder anfangen sich vom Boden abzuheben, werde ich sofort verkaufen, sobald diese dann wieder zurückkommen.
ICH HABE DIE SCHNAUTZE VOLL VON BANK BALI - ALTER GURKENVEREIN !!!
Da spielt es sowieso keine Rolle mehr, was irgendwelche Analysten oder sonstwer über die Aktie erzählt. Das beste was hier passieren kann, ist das die ganze Scheiße auf 0,01 Euro fällt, wir uns nochmal richtig vollsaugen und dann bei 0,02 wieder rausgehen können um wenigstens unseren Loss wieder rauszuholen.
Es nervt mich ja nicht bei einem riskanten Geschäft Geld zu verlieren - das ist zwar schade, gehört aber zum Geschäft. Aber mich hier von irgendwelche Witzpillen die ganze Zeit an der Nase herumführen zu lassen, da habe ich keinen Bock mehr drauf.
Und jetzt kaufe ich Mexikowerte :-)

seit 1 Jahr warne ich FINGER WEG, sind alle rechnerisch Pleite und in vielen Faellen hoffnungslos (Ausnahme : Bank Panin, die ist aber nicht billig).
Ich kenne viele Bnker iin Indonesien persoenlich, und ich sage Euch, lasst es.
Der Glaube, dass allein der Kursverfall auf ein paar cents bedeutet, dass der Wert sich im Aufschwung vervielfacht, ist leider falsch. Grund: der wahre Wert der Eigenmittel ist stark negativ, die Banken erholen sich nur durch Kaptialerhoehungen im Verh 100 neue fuer 1 alte Aktie.
Das bedeutet oekonomisch, dass Altaktionaere ihren Anteil fast vollst. verwaessern oder de fact Regress fuer die Altlasten leisten.
GANZ ANDERS THAILAND: zumindest die besseren der Thai-Banken haben nun alle Altlasten gemeistert (TFB, NFS, SCB) und machen (TFB) wieder Gewinne.
Thailand hat einen Aufschwung, der fast alle Sektoren erfasst (ausser Immo / Bau), Indonesien ist noch voll in der Krise.
Thailand und sogar die Banken werden von Ratingagenturen upgegradet, Indonesien nicht, eher downgrading.
Thailand kann den IWF-Kredit aus eigener Kraft zurueckzahlen, Indon. wird die naechste Tranche gesperrt ( viel extremer gehen die Gegensaetze nicht mehr).
Aber der SET in Thailand ist bei nur knapp 400 (histor Hoch 94: 1700), der Indon. Index ist bei 550 (histor. Hoch ca. 750).
Was ist hier das um Dimensionen bessere Preis-Leistungs -Verhaeltnis ?
Thai Banken (zb. NFS) gibts UNTER DEM BUCHWERT !!!, Indon. Banken haben keinen Buchwert (oder einen negativen).

Indonesia Sets Minimum Bank Capital Adequacy Ratio
JAKARTA, April 14 Asia Pulse - Bank Indonesia said that all banks in Indonesia with the exception of state savings bank BTN and Bank Bali were required to have a capital adequacy ratio of not lower than 4% in June.
BTN was still in the process of auditing and needed recapitalizing and Bank Bali was facing a court battle over a dispute between the old owners and the central bank.
The deputy governor of Bank Indonesia (BI), Subardjo Joyosumarto, said the central bank would consider closing down those failing to meet the minimum CAR by June.
"If the cost of liquidation is lower, they would be closed down. But otherwise the government would inject additional capital," Subardjo said.
He said the CARs of 162 banks in the country averaged 7.15 in January.

Recapitalization of Indonesia`s Bank Bali Pending Court Decision
JAKARTA, April 13 Asia Pulse - The central Bank Indonesia (BI) has postponed the recapitalization of Bank Bali, still mired in litigation over its takeover by the government.
An Indonesian court ruled against the BI`s takeover of the beleagured Bank Balis, but the central bank has appealed to the Supreme Court.
Bank Indonesia took over Bank Bali last year after its owners failed to provide the necessary 20% portion of recapitalization funds for the bank, which was rocked by a high profile scandal.
BI Deputy Gubernur Subardjo Djojosumarto said the position of Bank Bali was now "waiting for the settlement of its problem.
"We don`t want legal problem surfaces again in the future," Subardjo said.
He said that Bank Indonesia was optimistic that it would win in its battle in the higher court as "BI has done the right thing according to the law."
He said if until the second week of this month a decision is not forthcoming from the Supreme Court an alternative way would be sought to settle the case.

BTW: ich hab mir einen email kontakt zu einem indonesischen broker aufgebaut, er arbeitet fuer PT DANPAC SECURITIES. nach seiner meinung wird Bank Bali NICHT pleite gehen, technisch gesehen war Bank Bali schon laengst einige male pleite, aber die regierung will Bank Bali rekapitalisieren.
Falls jemand interessante fragen bzgl. Bank Bali oder anderen indo-werten hat wuerde ich diese weiterleiten.
