Hallo Leute,

Was macht Impath genau weißt Du das.

CORRECTED - IVAX seeks court contempt for American BioScience
In Sept. 8 Miami story headlined... ``IVAX seeks court contempt for American BioScience``... please read in 1st para... to de-list American BioScience`s patent... instead of... to de-list their patent (deleting reference to Bristol Myers-Squibb and making patent singular)
Replacing entire 5th para to indicate that judge did not rule Taxol should be removed from Orange Book.
In 10th para, pls read... Bryne ordered Bristol-Myers to list American BioScience`s patent.... The listing had supported... instead of Byrne ordered Bristol-Myers to register American BioScience`s patent.... The registration had supported (changing register and registration to list and listing)
A corrected version follows:
MIAMI, Sept 8 (Reuters) - Generic drug maker IVAX Corp (AMEX:IVX - news) will ask a federal court to hold American BioScience Inc in contempt for ignoring an order for it and Bristol Myers-Squibb Co (NYSE:BMY - news) to de-list American BioScience`s patent for the cancer drug, Taxol.
IVAX said on Friday American BioScience filed a patent infringement against IVAX and two of its subsidiaries, based partly on the same listing that was ordered to be removed from the Food and Drug Administration`s so-called ``Orange Book.``
American BioScience`s move came only a few hours after the court ordered the company to de-list the patent from next Wednesday.
On Thursday, Los Angeles U.S. District Court Judge William Bryne granted a limited stay, expiring at the close of business on Sept 13, allowing American BioScience and Bristol-Myers to appeal against the order.
On Wednesday, IVAX said Judge Bryne issued a ruling that could allow the Miami firm to soon start selling its copycat version of Taxol, Bristol-Myers Squibb`s top selling breast and ovarian cancer treatment.
The Orange Book lists patents relating to already marketed medicines and generic competition to listed drugs is not allowed for 30 months from the date of listing.
``We do not expect this new suit to have any effect on the timing of our efforts to turn our tentative approval for a generic competitor to Taxol into final FDA approval,`` Neil Flanzraich, IVAX`s vice-chairman and president, said in a statement.
``We intend to seek the strongest possible sanctions from Judge Bryne, including a finding of contempt,`` he added.
Taxol had annual global revenues of over $1.5 billion last year and is expected to generate $2 billion next year.
Last month, Bryne ordered Bristol-Myers to list American BioScience`s patent in the Orange Book but later changed his ruling. The listing had supported American BioScience patent infringement suits against IVAX or any other companies intending to sell generic Taxol or paclitaxel as it is otherwise known.

gesundheitmarkt dabei sein will.

IVAX Responds to Latest Legal Maneuvers by Bristol-Myers Squibb
MIAMI--(BUSINESS WIRE)--Sept. 12, 2000--IVAX Corporation (AMEX:IVX - news) responded to questions concerning a press release issued by Bristol-Myers Squibb late yesterday concerning a lawsuit that it filed in the Federal Court in New York. Neil Flanzraich, vice chairman and president of IVAX, said, ``Although we have not yet seen the complaint, judging from the press release, Bristol-Myers is obviously trying to relitigate in another court the case that it lost last week in Federal Court in Los Angeles and has also attempted to relist in the FDA`s Orange Book the patent that the Federal Court in Los Angeles ordered it to delist.``
Flanzraich continued, ``Both Bristol-Myers in this action and American BioScience, Inc. in the infringement action that it filed last Thursday are trying to make a mockery of the Federal judicial system in their efforts to preserve an eight year old monopoly on a critical anti-cancer drug developed by the federal government at taxpayer expense. We intend to vigorously oppose these legal and regulatory actions and continue to believe that the courts will protect the public interest by permitting IVAX to promptly bring a generic form of Taxol® to the thousands of American women suffering from breast and ovarian cancer.``
The ``FDA`` refers to the United States Food and Drug Administration, and the ``Orange Book`` is officially known as the FDA`s list of Approved Drug Products with Therapeutic Equivalence Evaluations.

IVAX Receives Final Approval for Generic Taxol
MIAMI--(BUSINESS WIRE)--Sept. 15, 2000--IVAX Corporation (AMEX:IVX - news) has received final approval from the United States Food and Drug Administration for its Abbreviated New Drug Application (ANDA) for paclitaxel 6 mg/mL injection (packaged in 30 mg/5 mL, 150 mg/25 mL, and 300 mg/50 mL multiple-dose vials). Indicated for the treatment of breast and ovarian cancer, IVAX` paclitaxel injection is the generic equivalent of Bristol-Myers Squibb Company`s Taxol®, estimated to have U.S. sales of $1.2 billion this year. IVAX` first to file position for this product entitles the company to 180 days of marketing exclusivity for generic paclitaxel. The product will be marketed through IVAX` wholly-owned subsidiary, Zenith Goldline Pharmaceuticals, Inc.
``Final marketing approval of our generic Taxol product represents another important milestone for our company, which has a tradition of overcoming special challenges to bring important pharmaceutical products through the regulatory process to their successful commercialization,`` said Phillip Frost, M.D., chairman and chief executive officer of IVAX Corporation. ``This accomplishment was made possible by the outstanding efforts of IVAX` dedicated and hard working employees.``
Neil Flanzraich, vice chairman and president of IVAX commented, ``Anyone who has followed IVAX` efforts to bring its generic version of Taxol to market in the United States knows IVAX has had to overcome a succession of disruptive and delaying tactics. We strongly believe the system must be changed to eliminate opportunities for abuse by those seeking to prevent or delay generic competition, and we will say more about that in the future. For the moment, we are pleased that this important victory will benefit the thousands of American women suffering from breast and ovarian cancer.``
IVAX Corporation, headquartered in Miami, Florida, is a holding company with subsidiaries engaged in the research, development, manufacturing and marketing of branded and generic pharmaceuticals and veterinary and diagnostic products in the U.S. and international markets.
