A criminal investigation has been launched into Qwest Communications, making it the latest in a series of US telecommunications companies to come under scrutiny.
Meanwhile US regulators are investigating whether Bristol-Myers Squibb, one of the world`s largest pharmaceuticals companies, inflated its revenues by about $1bn (ý630m) last year.
The probe into Qwest, after criminal inquiries into Global Crossing and WorldCom, may add to the industry`s financial crisis as investors flee the riskiest companies, investors said.
Moody`s Investors Service said the investigation could undermine the company`s efforts to shore up its finances, and cut Qwest`s credit rating by three notches. The probe could hamper efforts to raise cash from asset sales and jeopardise a planned $300m asset securitisation program, Moody`s said. Qwest is trying to sell assets before the end of this year to meet debt repayments and avoid a default.
Rob Gensler, a fund manager at T Rowe Price, said the probe would make it more difficult for Qwest to avoid bankruptcy.
Qwest said it was told of the investigation on Tuesday by the US attorney`s office in Denver, although it had not been told the subject of the inquiry. The company`s extensive use of "swaps" of network capacity with other carriers was the subject of a separate investigation by the Securities and Exchange Commission. Like Global Crossing, whose swap deals have also come under scrutiny, Qwest relied heavily on such transactions to boost revenues from the fibre-optic network it built in the mid-1990s.
The investigations centre on whether these and other telecoms companies exchanged capacity with each other to inflate revenues, with no commercial purpose. Enron, which set up a business to trade telecoms capacity, is also a subject of the review.
Joseph Nacchio, Qwest`s chief executive officer, resigned last month under pressure from the board. Richard Notebaert, his successor, denied two weeks ago that Qwest would follow WorldCom in being hit by revelations of accounting fraud: "Qwest is a different company and I wouldn`t be here if I didn`t believe that."
Qwest`s shares, which had fallen from a high of more than $60 two years ago, plunged 32 per cent to $1.77.
In the Bristol-Myers Squibb investigation officials from the company have met the Securities and Exchange Commission to discuss the circumstances behind sales to drug wholesalers that inflated inventories beyond a sustainable level.
There is no suggestion at this stage that the company has acted improperly, or that bad management of inventories was a deliberate attempt to inflate sales.
